WHEREFORE, THE UNINHABITED SIKU'--luRES AND REAL PROPERTY AT THE FOLLOWING LOCATIONS
WITHIN THE CITY OF JACKSONVILLE, OWNED BY THE VARIOUS PARTIES AS CITED BELOW, CONSTITUTE A
HEALTH AND SAFc.1 '( HAZARD TO THE GENERAL PUBLIC DUE TO THE LACK OF STRUCTURAL SOUNDNESS AND
DILAPIDATED CONDITIONS WHICH EXIST IN THE VARIOUS BUILDINGS AND IMPROVEMENTS THEREON. THE

NOW, THEREFORE, BE IT ORDAINED BY THE CnY COUNCIL OF THE CnY OF ~ACKSONVILLE,
ARKANSAS~ THAT:
SECTION ONE: IN ACCORDANCE WITH ACA s 14- 56 - 20 I t:.1.AL. AND ~ACKSONVILLE
MUNICIPAL CODE 8.26.0 10 t:.1. SEQ., THE FOLLOWING STRUCTURES AND REAL PROPERTIES LOCATED
AT 30 I SOUTH OAK, 8000 SOUTH Hwy. 161, LOT #6, (I 18 W. VALENTINE ROAD), 2 103 HAMILTON
STREET, #3, #5, #8, AND #9, 5 15 SOUTH ROAD, #7, 120 I SOUTH HWY. 161, LOT #20,
4004 SOUTH Hwy. 161, #28 AND #34, WOODHAVEN MOBILE HOME PARK, 132 CENTRAL AVENUE,

DECLARED TO EACH CONSTlTUIt:. A SEPARATE NUISANCE TO THE HEALTH AND SAFETY OF THE CITIZENS OF
JACKSONVILLE.
THE CITY COUNCIL HEREBY DIRECTS THE CODE ENFORCEMENT OFFICE TO PROVIDE NOTICE TO
THE PROPERTY OWNERS AND ALL OTHER INTERESTED PARTIES (AS CITED ABOVE) THAT, IF SAID
STRUCTURES AND REAL PROPERTY ARE NOT REPAIRED AND/OR THE HEALTH AND SAFETY HAZARDS
REMOVED FROM SAID STRUCTURES, BRINGING THEM BACK INTO COMPLIANCE WITH THE PROVISIONS OF
THE ~ACKSONVILLE MUNICIPAL CODE, WITHIN THIRTY (30) DAYS FROM THE DAIt:. OF PASSAGE OF THIS
ORDINANCE, THE STRUCTURES AND IMPROVEMENTS ON SAID REAL PROPERTY CITED ABOVE WILL BE
CLEARED AND RAZED. ALL STRUCTURES AND NUISANCES SHALL BE REMOVED SO AS TO ELIMINATE ANY
HEALTH OR SAFt:.I<( HAZARDS TO THE GENERAL PUBLIC AND THE COST FOR DOING SO SHALL BE ASSESSED
AGAINST THE OWNER(S) OF SAID PROPERTY.
SEcnON 7WO: IF THE CliY OF ~ACKSONVILLE IS REQUIRED TO UNDERTAKE AND/OR COMPLETE
REMOVAL OF HAZARDOUS CONDITIONS FROM THE REAL PROPEKIIES IN QUESTION, THE CITY WILL THEN FILE
A LIEN AGAINST THE RESPECTIVE REAL PROPERiY INVOLVED FOR COLLECTION OF ALL REASONABLE COSTS
INCURRED TO UNDERTAKE AND COMPLETE THE REMOVAL OF SAID HAZARDOUS CONDITIONS ON THAT
PROPERTY .
SECTION THREE SHOULD ANY PART(S) OF THIS ORDINANCE BE DECLARED INVALID FOR ANY
REASON, NO OTHER PART(S) OF THIS ORDINANCE SHALL BE AFFECTED THEREBY.
SECTION FOUR: ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE
HEREBY REPEALED TO THE EXTENT OF SAID CONFLICT.
SECTION FIVE: BECAUSE THE PASSAGE OF THIS ORDINANCE IS NECESSARY FOR PUBLIC
HEALTH, PEACE, AND SAFt:.I<( OF THE CITIZENS OF ~ACKSONVILLE, AN EMERGENCY IS HEREBY DECLARED.
THUS THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT IMMEDIATELY UPON PASSAGE.
