1139 000054 ORDINANCE NO. 1139 (#11 · 00) AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE 99 10.22.010 AND 10.22.020; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. ---------------------------------------------------------------------------- ---------------------------------------------------------------------------- WHEREAS, the Jacksonville City Council, having reviewed provisions of the current. Jacksonville Municipal Code regarding the operation and parking of large trucks, tractors, and trailers throughout the City, recommends that the Jacksonville Municipal Code regarding such be modified so as to better provide for the safety and well-being of the citizens. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: SECTION ONE: Jacksonville Municipal Code 9910.22.010 and 10.22.020 are hereby modified and amended to include the following additions, deletions, and modifications: A) JMC 9 10.22.010 (Unlawful Parking) shall be amended as follows: It shall be unlawful for any person, corporation, or association to park any commercial hauling truck over one (1) ton and/or commercial hauling trailer, commercial hauling equipment, or commercial hauling cargo, with or without the tractor or towing vehicle attached thereto on any street of the City for a period of time longer than one (1) hour unless: a) same is being loaded or unloaded; or, b) use of said vehicles and/or trailers in residential zones shall be limited to travel to and from locations to load/unload goods, merchandise, or equipment. Once said loading, unloading, and/or hauling is completed, said oversized vehicle/trailer/equipment shall be promptly removed from the residential zone. B) JMC 9 10.22.020 (Violation - Penalty) shall be amended as follows: Violation of any provision of this Ordinance shall result in a citation issued to the owner/operator/driver of said vehicle/trailer/equipment and/or the owner/occupant of said property. The minimum fine for such a violation shall be no less than Twenty-five Dollars ($25.00) and no more than One Hundred Dollars ($100.00). Each day the vehicle/tractor/equipment remains on the property shall constitute a separate offense. SECTION THREE: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: So as to best provide for the safety and well-being of the citizens of Jacksonville, an emergency is hereby declared to exist. As such, this Ordinance shall take immediate effect from and after its date of passage as provided by and subject to applicable law. APPROVED AND ADOPTED THIS 5 tk..
