1121 (\ (~Af..;'\1" 0 fJa [iI~~" ,) " ....,J ...~ '-'" -.ff ORDINANCE NO. 1121 (#7 - 99) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF PURCHASING A MAINT}!;NANCE CONTRACT FOR THE CITY OF JACKSONVILLE'S COMMUNICA TION SYSTEM; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSESo ------------------------------------------------------------------- -------------------------------------------~----------------------- WHEREAS, in an effort to protect the City of Jacksonville's communication system, the City must obtClln a maintenance contract for service and protection of the City's communication system that services all City departments; and, WHEREAS, the unusual nature and complexity of the system currently being used by the City of Jacksonville requires purchase and protection of our system, and Motorola is the only provider who can properly service and maintain the entire system. Because accurate and functional operation of the entire system is vital to the effective and efficient operation of the City's various departments, only one vendor can provide the specific contract services needed. NOW, THEREFORE, BE IT ORDAI~l!ID AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: SECTION ONE: Competitive bidding for the PUl pose of purchasing a maintenance contract for the City of Jacksonville's communication system would be costly and non-productive, making said competitive bidding unfeasible and impractical. SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA ~14-58-383, for the approval of a maintenance contract for the City of Jacksonville~s communication system. Authorization is hereby given to the Mayor to enter into a maintenance service agreement with Motorola Service Division of Kenner~ Louisiana, to provide comprehensive communication system maintenance/service at a cost of Four Thousand Eight Hundred Thirty-eight and 41/100 Dollars ($4,838.41) per month, covering the period of May 1, 1999 through December 31,2000. SECTION THREE: All Ordinances, parts of Ordinances, or previous actions taken by said Council in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: Immediate implementation of maintenance coverage for the City's communication system is necessary for the continued safety and welfare of the citizens of Jacksonville. Therefore, an emergency is hereby declared, and this Ordinance shall take effect immediately upon passage and publication, as provided by and subject to the requirements of applicable law.
