ORDINANCE NO. 1120 (#6 - 99)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE
OF PlJl<.CHASING ClJ.KBSIDE RECYCLING CONTAIl\JJ!iRS FOR USE IN THE
CITY OF JACKSONVILLE'S RECYCLING PROGRAM; AND, FOR OTHER
PURPOSES.

WHEREAS, in an effort to expand the City of Jacksonville's recycling
program, the City must purchase curbside recycling containers for use by
the citizens of JacksonVIlle; and,
WHEREAS, the unusual nature and format required of containers
currently being used by Jacksonville citizens, as well as til11e constraints,
require Immediate purchase and delivery of additional containers. After
some research, only one vendor can provide the specific containers at a
reasonable cost.
NOW, THEREFORE, BE IT ORDAIlVl!iD AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of
purchasing curbside recycling containers for use in the expansion of the
City of Jacksonville's recycling program would be costly and non-
productive, making said competItive bIdding unfeasible and impractical.
SECTION TWO: COlllpetitive bidding is hereby waived,
pursuant to ACA 914-58-383, to purchase additional curbside recycling
containers for use in the City of Jacksonville's recycling program.
Authorization is hereby given to the Mayor and City Clerk to enter into a
purchase contract with Otto Industries of Charlotte, North Carolina, to
purchase up to 3,000 curbside containers at a maximulll cost of Ten
Thousand Fifty Dollars ($10,050.00), at the rate of Three and Thirty-five
Dollars ($3.35) per unit cost, together with applicable tax and shipping
charges.
SECTION THREE: All Ordinances, ~)arts of Ordinances, or
previous actions taken by said Council in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION FOUR: This Ordinance shall take effect immediately
upon passage and publication, as provided by and subject to the
requirements of applicable law.
