1215 000128 ORDINANCE NO. 1215 (#23 - 03) AN ORDINANCE CREATING AN ANTI-BIASED BASED POLICING/RACIAL PROFILING POLICY FOR THE CITY OF JACKSONVILLE POLICE DEPARTMENT TO FOLLOW; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. ---------------------------------------------------------------- ---------------------------------------------------------------- WHEREAS, Act 1207 of 2003 requires that each law enforcement agency in Arkansas develop a Racial Profiling Policy by January 1, 2004, prohibiting racial profiling and requiring law enforcement officers have reasonable suspicion prior to a stop, arrest, or detention. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THA T: SECTION ONE: The City Council of the City of Jacksonville hereby authorizes the creation of the attached Anti-Biased Based/Racial Profiling Policy, attached hereto, identified as Attachment A, and incorporated herein, for use by members of the Jacksonville Police Department in performance of their duties as law enforcement officials of the City of Jacksonville. It shall be identified as Procedure 4.118 of the Jacksonville Police Department Policies and Procedures Manual, and the Jacksonville Police Department is hereby directed to implement and adhere to the provisions contained therein. SECTION TWO: The provisions of this Ordinance are severable. If any provision hereof shall be held to be invalid, such holding of invalidity shall not affect the validity of applicability of the remainder of the provisions thereof. SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION FOUR: An emergency is hereby declared to exist and this Ordinance being necessary for the immediate preservation of the public peace, welfare, health, and safety, and this Ordinance shall be in full force and effect from and after its passage and approval.
