ORDINANCE NO. 1212 (#20 - 03)
AN ORDINANCE CONDEMNING STRUCTURES AND REAL PROPER I " AT
VARIOUS UNINHABITED LOCA TIONS LISTED BELOW IN JACKSONVILLE,
ARKANSAS, FOR STRUCTURAL DEFECT.~ DEFICIENCIES, AND PUBLIC
HAZARD CONDITIONS; AND, FOR OTHEK PURPOSES.

WHEREAS, the uninhabited structures and real property at the following
street addresses, all located within the City limits of Jacksonville and owned by the
various parties as stated below, constitute a health and safety hazard to the general
Jublic due to the lack of structural soundness and dilaQidated conditions which exist
In and about the various improvements t'lereon. The properties and owners

WHEREAS, despite repeated notices and demand, said property owners have
failed to repair their respective properties, structures, and/or remove the
deteriorated e ements so as to e iminate pu)'ic lea tl and safety lazards and bring
the propertY and its improvements into compiance wit 1 the provisions of the
Jac<sonvi Ie Municipal Code.
NO".!, THEREFOR~ BE J I ORDAINED BY THE CI I J' COUNCIL OF THE
CI I " OF JACKSONVILLJ:, ARKANSAS:
SECTION ONE: In accordance with ACA 914-56-201 et. al. and
Jacksonville Municipal Code 98.28.010 et. seq., the above mentioned structures and
real properties listed above and located at the property addresses stated a 'Jove are
hereby declared to each constitute a separate nuisance to the health and safety of
the citizens of Jacksonville and are hereby condemned.
The City Council hereby directs the Code Enforcement Office to provide
notice to the pro,Jerty owners and all other interested parties (mortgagors ~if
app:ica')lel) that, If said structures and rea property are not repaired ana/or ttie
health and safety hazards removed from said JroJerty so as to bring the propertY
into compliance with the provisions of Jac<sonvl e Vlunlcipal Code witlin ninety (90)
days from the date of passage of this Ordinance, the structures and improvements
on said real property cited above will be cleared and razed. All structures and
nuisances shall be removed so as to eliminate any health or safety hazards to the
general public, and the cost for doing so shall be assessed against the owner(s) of
said property.

complete the necessarv removal of hazardous conditions from the real properties
in question, the City wil then file a lien against the respective real property involved
for collection of all reasonable costs incurred to undertake and complete the
removal of said hazardous conditions on that property and authorize Cit'l officials

SECTION THREE: Should any Jart(s) of this Ordinance be declared invalid
for any reason, no other partes) of the Ordinance shall be affected thereby.
SEC I ON FOUR: AI Ordinances or parts of Ordinances in confict lerewitl
are hereby repealed to the extent of such conflict.
SECTION FIVE: This Ordinance shall take effect immediately upon
passage and pub ication, as provided JY and subject to the requirements of
applicable law.
