AN ORDINANCE CONDEMNING STRUCTURES AND REAL PROPERI Y AT
VARIOUS UNINHABITED LOCA TIONS LISTED BELOW IN JACKSONVILLE,
ARKANSAS, FOR STRUCTURAL DEFECT~ DEFICIENCIE~ AND PUBLIC
HAZARD CONDITIONS; DECLARING AN t'MERGENCY; AI'iD, FOR OTHER
PURPOSES.

WHEREAS, the uninhabited structures and real property at the following
street addresses, a I located within the CiP.' limits of Jacksonvil e, owned by the
various parties as stated below, constitute a ~lealth and safety hazard to the general
public due to the lack of structural soundness and dilaQidated conditions which exist

CI I " OF JACKSONVILLt, ARKANSAS:

SECTION ONE: In accordance with ACA gl4-56-2Q1 eta al. and
Jacksonvi e .Mu~icipa Code 98.28.010 et. seq., tle above l11entioned structures and
real Jropertles listed a Jove and located at the property address stated above are
here JY declared to each constitute a separate nuisance to the healt 1 and safety of
the citizens of Jacksonville and are hereby condemned.
The City Council hereby directs the Code Enforcement Office to provide
notice to the property owners and all other interested parties (as stated above) that,
if said structures ana real property are not repaired and/or the health and safety
hazards removed from said structures, Jringing them back into compliance with the
provisions of Jacksonvie Municipal Code, within thirty (30) days from the date of
passage of the Ordinance, t"le structures and improvements on said real prope~
cited above will be cleared and razed. All structures and nuisances shall be
removed so as to eiminate any 'leath or safety hazards to the genera: pubic, and
the cost for doing so shall be assessed against the owner(s) of said property.
SEC I ON I tHO: If the City of Jacksonville is required to undertake and/or
com Jlete removal of hazardous conditions from the real properties in question, the
Ci~ will then file a lien against the respective real prope~ involved for collection
of all reasona J e costs incurred to undertake and complete the removal of said
hazardous conditions on t lat propertY and authorize City officials to request said
amounts be collected by the Pulaski County Tax Collector should the owners fail to
timely pay said fees ana amounts duem

SE~ lION THREE: S 10uld any Rart(s) of this Ordinance be declared invalid
for any reason, no other partes) of the Ordinance shall be affected thereby.
SECTION FOUR: All Ordinances or parts of Ordinances in conflict herewith
are hereby re Jealed to the extent of such conflict.
SECTION FIVE: Because the passage of this Ordinance is necessary for
Jubic health, peace, and safety of tle citizens of Jacksonville, an emergency is
hereby declared. Thus, this Ordinance shall be in full force and effect immediately
upon passage.
