AN ORDINANCE ACCEPTING AND CONFIRMING ANNEXA TION OF VARIOUS REAL
PROPERTY LOCA TED ON THE SOUTH SIDE OF JACKSONVILLE COMMONL Y KNO "IN
AS THE SOUTH ANNEXA TION; DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES.

WHEREAS, through Resolution No. 558 (#3-02), the Jacksonville City Council urged the
submission and a Jproval of a Petition for Annexation of various real property located on the South
side of Jacksonvil e commonly known as the South Annexation;
WHEREAS, said Petition for Annexation was filed, Public Notice was duly published, and a
Public Hearing was held on March 20, 2002. Subsequently, County Judge Floyd G. Villines III entered
an Order of Annexation for the following described property into the City of Jacksonville. Because of
statutory requirements, the City Council must now confirm and accept said Annexation action by
Judge Villines.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: The following described property is hereby annexed and accepted
into the City of Jacksonville, Arkansas:
Property on the South side of the City of Jacksonville, Arkansas, along the North and
West sides of the Union Pacific Railroad to the South side to One Quarter (1/4) mile South
of Wooten Road, more particularly described as follows:
Beginning at the SW corner of the NE 1/4 of the NE 1/4 of Section 2, Township 2
North, Range 11 West; thence East on the South line of the NE 1/4 of the NE 1/4 to
the East line of the W 1/2 of the NE 1/4 of the NE 1/4; thence North along the East
line of the W 1/2 of the NE 1/4 of the NE 1/4 to a point 300' South of the South and
East Right-of-Way line of the Union Pacific Railroad; thence Northeasterly parallel to
the South and East Right-of-Way line of the Union Pacific Railroad to the East line
of Section 2, Township 2 North, Range 11 West; thence South along the East line of
said Section to the Soutleast corner of the NE 1/4 of the NE 1/4 of Section 11,
Township 2 North, Range 11 West; thence West along the South line of the N 1/2 of
the NE 1/4 of Section 11, Township 2 North, Range 11 West to the West line of the
NE 1/4 of Section 11, Township 2 North, Range 11 West; thence North along the
West line of the NE 1/4 of Section 11, Township 2 North, Range 11 West to the
South line of Section 2, Township 2 North, Range 11 West; thence North along the
West line of SE 1/4 of Section 2, Township 2 North, Range 11 West to the Northerly
Right-of-Way line of State Highway 161; thence Westerly along the North Right-of-
Way line a distance of 85.56'; thence N 00 50' 51" W to the South line of the NE 1/4
of the SW 1/4 of Section 2, Township 2 North, Range 11 West; thence West along
the South line of the NE 1/4 of the SW 1/4 of Section 2, Township 2 North, Range 11
West to the North and West Right-of-Way line for Union Pacific Railroad; thence
Northeasterly along the Union Pacific Right-of-Way line to the Southwest corner of
the NE 1/4 of the NE 1/4 of Section 2, Township 2 North, Range 11 West and the
point of beginning.

attached hereto and made a part hereof.]

occurred, and the S. 161 Water Extension Pro'ect has a proposed completion date in 2004. Other City
services are to be extended as available utility services aHow.
SECTION THREE: All ordinances or parts of ordinances and resolutions in conflict
herewith are hereby repealed to the extent of said conflict.
SECTION FOUR: It is hereby ascertained and declared that this Ordinance is
necessary for immediate implementation 0': greater efficiency in governmental and emergency
services operations. Therefore, an emergency is hereby declared, and this Ordinance shall take effect
immediately upon passage and publication, as provided by and subject to requirements of applicable
law. ~
