1167 000020 ORDINANCE NO. 1167 (#21-01) AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE 9.12.; PROHIBITING THE UNQUALIFIED DISCHARGE OF WEAPONS WITHIN THE CORPORATE LIMITS OF THE CII" OF JACKSONVILLE; ASSESSMENT OF A PEM4L I Y FOR VIOLA TION OF THE TERMS OF THIS ORDINANCE; AND, FOR OTHER PURPOSES. WHEREAS, recent events have indicated there is a need to modify, update, and create stiffer penalties for inappropriate and unqualified discharge and use of firearms and weapons within the corporate limits of the City of Jacksonville. NOW, THEREFORE, BE IT ORDAINED BY THE CI I l' COUNCIL OF THE CI I Y OF JACKSONVILLE, ARKANSAS, THA T: SECTION ONE: Jacksonville Municipal Code 9 9.12.010 shall be amended and modified to read as follows: Jacksonville Municipal Code ~ 9.12.010 (Prohibitio~) No Jerson, other than an animal control officer, military officer, police officer, or security police officer while in the line of duty, shall discharge, fire, or set any arrow, cannon, firearm, fowl piece, trap, or weapon of any type within the corporate limits of the City of Jacksonville except in the following specific circumstances: (a) It will hereinafter )e unlawful for any person to discharge, fire, or allow a minor to discharge or fire any air rifle, arrow, BB gun, cannon, pellet gun, ~ellet rifle, C02 weapons, or com ,Jressed air weapons within the corporate limits of the City except in a qualified area/event; (b) A qualified area/event shall be a place of business, location, or facility specifically designed for the safe and protected discharge of weapon(s). Steps wi I Je taken to provide a safe and controlled environment with appropriate eve s of bac <ing materia s, firing range space, and discharge recovery sections to effectively eliminate the ,Jossibility of injury to fellow participants, by-standers, and/or the publiC when weapons specifically designed for use in the faci.ity(ies) are disc:larged. Further, no person shall discharge, fire, or allow to be discharged or fired by a minor any bombs, firecrackers, roman candles, squids, torpedoes, or other such items containing powder or com Justi J e/exp osive materia within the corporate imits of t le City of Jac <sonvi e. Exceptions are granted for t lose utilized JY sc 1001 personne during sc 1001 event(s) and those utilized by individuals during the course of their employment upon compliance with all applicable state and federal laws, regulations, and safety provisions. Any person pronounced guilty of any of the above provisions shall be deemed guilty of a violation and, upon conviction, shall be punished of a fine of not less than Twenty-five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each such offense. SECTION THREE: Should any section, cause, or provision of this Ordinance or the franchise agreement pursuant thereto Je declared invalid by a Court of competent jurisdiction, such a ruling shall not affect tle va idity of the Ordinance as a whole or any part thereof, other than the ,Jart so declared invalid.
