1241 000056 ORDINANCE NO. 1241 (#3 - 05) AN ORDINANCE MODIFYING JACKSONVILLE MUNICIPAL CODE ~13.16 REGARDING CERTAIN CHARGES AND FEES ~ ASSESSED; REPEALING JACKSONVILLE MUNICIPAL CODE ~~13.16.020 - 13.16.040; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, water user rate fees for customers of the Jacksonville Water Commission are set by the Jacksonville City Council in accordance with JMC 9 13.16.010 et. seq. However, the Jacksonville Water Commission is authorized under ACA 9 14-234-301 et. seq., to, assess certain charges and fees in the operation of the Jacksonville Water Department as deemed necessary to cover the costs and operational expenses necessary for meter connections, deposits, and other certain charges and fees as required for the Water Department to continue operations, together with the authority to promulgate and adopt appropriate policies and procedures to impose said charges and fees; and, WHEREAS, the Jacksonville Water Commission, having recently obtained an engineering study regarding user rates, charges, and fees, las determined t1at modifications are necessary to certain c larges and fees imposed by the Department for customers of the Jacksonville Water Commission. Because of the authority granted the Commission under state law, the Jacksonville City Council believes it appropriate to revise the Jacksonville Municipal Code accordingly. NOW, THEREFORE, BE IT ORDAINED BY THE CI I t' COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THA T: SECTION ONE: Jacksonville Municipal Code 99 13.16.020 (Water Meter Connection Fees - Within City Limits), 13.16.030 (Water Meter Connection Fees - Outside Corporate Limits), 13.16.040 (Water Meter Connection Fees), and 13.16.050 (Meter Deposits) are hereby repealed. SECTION I WO: All ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION THREE: Because implementation of the assessment of certain charges and fees are necessary for tle efficient and effective operation of the Jac<sonville Water Commission, the need for immediate impementation of this Ordinance is imperative.
