AN ORDINANCE ABANDONING A PUBLIC RIGHT OF WAY REAL PROPERTY
LOCATED IN THE HASKINS COMMERCIAL SUBDIVISION, JACKSONVILLE,
ARKANSAS (GENERAL LOCATION: REAL PROPERTY LOCATED AT JOHN
HARDEN DRIVE AND MARSHALL ROAD,JACKSONVILLE, ARKANSAS); AND, FOR
OTHER PURPOSES.
WHEREAS, older public right of way property more particularly described below,
which lies between previously platted lots, is no longer of use to the City. The existing
easement property is no longer needed and serves no beneficial purpose either now or
in the future for the City of Jacksonville, for additional, better located easements have
been granted by the affected property owner(s);
WHEREAS, the Jacksonville City Council held a public hearing regarding said
abandonment of easement on June 17, 2004, with notice of said meeting duly published.
Because additional easement(s) have previously been granted, no consent was necessary
from other parties; and,
WHEREAS, under State law, the City has determined that said real property reverts
to the real property owners of record, who have consented and approve of the
abandonment of the old City easement real property and whom in exchange have
granted new easements.
NOW, THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: The Public Right-of-Way Easements being abandoned are
more particularly described as follows:
EASEMENT DESCRIPTION A:
Part of the SE 1/4 of the SE 1/4 of Section 24, T-3-N, R-11-W, City of
Jacksonville, Pulaski County, Arkansas, more particularly described as
follows:
Commencing at the SE corner of said Section 24, thence N 00° 37' 41" W
a distance of 1043.40 feet to the intersection of the East line of said SE 1/4
of the SE 1/4 and the Westerly Right-of-Way line of U.S. Highway 67/167;
thence continuing N 00° 37' 41" W a distance of 166.52 feet to the point
of beginning and the centerline of a 12 feet easement; thence along the
centerline of said easement S 45° 15' 57" W a distance of 381.64 feet;
thence S 11° 02' 29"W, a distance of 142.18 feet; thence S 18° 47' 38" E,
a distance of 43.74 feet to the Northerly right-of-way line of John Harden
Drive and the termination of said easement
AND
EASEMENT DESCRIPTION B:
Part of the SE 1/4 of the SE 1/4 of Section 24, T-3-N, R-11-W, City of
Jacksonville, Pulaski County, Arkansas, more particularly described as
follows:
Commencing at the SW property corner; thence N 06° 17'48" E a distance
of 44.89 feet to the point of beginning and the centerline of a 10 feet
easement; thence along the centerline of said easement S 71° 41' 38" E a
distance of 318.90 feet to the termination of said easement.
(GENERAL LOCATION: Real property located in the Haskins Commercial
Subdivision at the corner of John Harden Drive and Marshall Road,
Jacksonville, Arkansas)

Said Right-of-Way Easements are hereby abandoned under the powers granted to Cities
of t le First C ass in t le State of Ar <ansas. The Mayor and City Cler < are hereby duly
authorized and directed to approve tle aprpropriate documents designating tle easements
as described a Jove closed and abandoned. T le rea propertY rights described herein shal
revert to the current property owner, identified as John HasKins, of the real property
affected in accordance with state law.
SECTION I \NO: A copy of this Ordinance, duly certified by the City Clerk, shall
be filed in the Office of the Recoraer of the Counw and recordec in the Deed Records of
the Coun~, hereb\/ amending the plat recorded on November 1, 1920, in the Pulaski
County Circuit C er < Recore s.
SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby
repealed to the extent of said conflict.
SEt-lION FOUR: This Ordinance shall take effect immediately upon passage and
publication, as provided by and subject to the requirements of applicable law.
