1228 000032 ORDINANCE NO. 1228 (#12 - 04) AN ORDINANCE ABANDONING PUBLIC RIGHT OF WAY REAL PROPER. f LOCATED ON WEST MAIN STREET, JACKSONVILLE, ARKANSAS (GENERAL LOCATION: REAL PROPER. f LOCATED ON WESt MAIN STREET ADJACENT TO THE NORTH SIDE OF OVERPASS, JACKSONVILLE, ARKANSAS); AND, FOR OTHER PURPOSES. WHEREAS, older public right of way property more particularly described below, which lies between previously Jlatted lots, is no longer of use to the City. After construction of the Main Street Overpass, the existing easement propertY is no longer needed and serves no beneficial Jurpose either now or in the future for the City of Jacksonville; WHEREAS, tle Jac<sonvi e City Counci le d a pu J ic learing regarding said abandonment of easement on May 20, 2004, witl notice of said meeting duTy pub Ished. Because additiona easement(s) are not needed, no consent was necessary from other parties; and, WHEREAS, under State law, the City has determined that said real property reverts to the adjoining real pro Jerty owners, who have consented and approve of the abandonment of City easement real property.
