0383 RESOLUTION NO. 3 8 3 ( - 87) A RESOLUTION DECLARING REAL PROPERTY LOCATED AT 1014 RAY ROAD, JACKSONVILLE, ARKANSAS, A NUISANCE; TO AUTHORIZE THE CONDEMNATION AND REMOVAL OF ANY AND ALL HAZARDOUS CONDITIONS EXISTING ON SAID PROPERTY; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Jacksonville, Arkansas, has been contacted by numerous citizens concerning the condition of the property located at 1014 Ray Road, Jacksonville, Arkansas, owned by Mr. C. V. Ford; and, WHEREAS, an inspection of the property revealed a health and safety hazard to the public because of the dilapidated con- dition of the structure including the following conditions: the rotted floor on the West end, the caved roof on the West side as well, and other conditions of that nature; and, WHEREAS, the City Council of the City of Jacksonville, Arkansas, is desirous of eliminating all public health and safety hazards within the City limits so as to provide a clean and safe environment for its citizens; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1: The real property and any fixtures thereof • located at 1014 Ray Road, Jacksonville, Arkansas, is hereby declared to be a nuisance, a health and safety hazard, and said property is to be condemned and the hazard removed. Section 2: The City Council of the City of Jacksonville, Arkansas, hereby authorizes notice and, if necessary, the removal and destruction of any and all hazardous conditions that exist on the real property located at 1014 Ray Road, Jacksonville, Arkansas, by whatever means necessary. Section 3: Because of the nature of the health and safety hazards which exist on the property involved, it is declared that a hazard to the life, health and welfare of the citizens of the City of Jacksonville exists. It is, therefore, declared that an emergency exists and this Ordinance, being necessary for the immediate needs of the public health and safety, shall take effect and be in force from and after its passage. Section 4: That all Ordinances, Resolutions, or parts thereof in conflict herewith are hereby repealed to the extent of such conflict. APPROVED AND ADOPTED THIS 7.th DAY OF MAY, 1987.
