ORDINANCE NO. 1222 (#6 - 04)
AN ORDINANCE PLACING THE ISSUE OF FOUR (4) YEAR TERMS FOR
ALDERMEN ON THE NOVEMBER Z 2004 GENERAL tLECTION BALLOT FOR
THE VOTERS OF THE CII " OF JACKSONVILLE, ARKANSAS; AND, FOR
OTHER PURPOSES.
WHEREAS, Aldermen for the City of Jacksonville, Arkansas, currently seek
and hold elected terms of Two (2) years. In doing so, it is often not efficient and
effective management of government assets and resources because of the
inordinate time required to address campaign issues so often; and,
WHEREAS, ACA 914-43-312(a)(2)(A) provides that a City of the First Class
may submit to its voters the question of Four (4) year terms for the eected position
of Aldermen. Such must be done so as to not implement the Four (4) year terms
at once, but so as to stagger the Four (4) year terms and make one Four (4) year
term in each ward elected every Two (2) years.
NOW, THEREFORE, BE IT ORDAINED BY THE CI I "COUNCIL OF THE
CI I " OF JACKSONVILLE, ARKANSAS, THA T:
SECTION ONE: There is hereby called a question to Je submitted to all
duly registered voters on Tuesday, November 2, 2004, at which election there shall
be submitted to duly qualified electors of the City of Jacksonville, Arkansas, the
issue of Four (4) Year terms for the elected position of Aldermen within the City of
Jacksonville, Arkansas.
SECTION TWO: Tle question of a owing Four (4) year terms for
Aldermen shall be placed on the ballot for the election in substantially the following
form:
Vote on the measure by placing an "x" in the square opposite the
measure Yes or No:
PURSUANT TO ACA ~14-43-312 (a)(2)(A), ARE YOU IN FAVOR
OF FOUR (4) YEAR TERMS FOR ALDERMEN ELECTED WITHIN
THE CII f OF JACKSONVILLE, ARKANSAS?

SECTION THREE: In approval of such, it is mandated by ACA 914-43-
312(a)(2)(A) that Aldermen representing Position One (1) from eaCl Ward be
elected to Four (4) Year terms in the General Election of 2006, and Aldermen in
Position Two (2) from each Ward be elected to a Two (2) year term in 2006. In the
General Election of 2008, those representing Position Two (2) from each ward will
be elected to Four (4) year terms, resulting in staggered terms for each Ward with
One (1) alderman being elected to a Four year term every Two (2) years from each

SECTION FOUR: The election shall be held and conducted, the vote
canvassed, and the results declared under the law and in the manner now provided
for municipal elections, and only qualified voters of the City shall have the right to
vote at the electiona
SECTION FIVE: Tle City C er< is authorized and directed to give notice
of the election by one .Jublication in a newspaper having general circulation within
the City. Publication shall be made not less than Ten (10) days prior to the election.
After said election, results of the election shall be proclaimed by the Mayor, and his
Proclamation shall be published one (1) time in a newspaper published in the City
and having a general circulation therein, which Proclamation shall advise that the
resu ts, as proclaimed, shall be conclusive uness attac'<ed in tOle courts within thirty
(30) days after the date of publicationB
SECTION SIX: A certified copy of this Ordinance shall be given to the
Pulaski County Board of Election Commissioners and the Secretary of State so that
the necessary election officials and supplies may be provided. A certified copy of
this Ordinance shall also be provided to other County and State officials for review
as necessary.
SECTION SEVEN: The Mayor and City Clerk, for and on behalf of the
City, are hereby authorized and directed to do any and all things necessary to call
and hold the election as provided herein and, if t le measure is approved by the
electors, to notify the Secretary of State and Pulaski County Clerk with the terms of
the election and to perform all acts of whatever nature necessary to carry out the
authority conferred by this Orc inance.
SECTION EIGHT: All Ordinances and parts thereof in conflict herewith are
hereby repealed to the extent of said conflict,
SECTION NINE: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applica Jle law.
