0369 25 RESOLUTION Nb. 3 6 9 ( #10 - 86) A RESOLUTION URGING ARKANSAS SENATORS, CONGRESSIONAL DELEGATION AND STATE LEGISLATORS TO AMEND CURRENT LEGISLATION TO ALLOW MUNICIPALITIES TO LEGISLATE IN THE AREA OF AIR AND WATER POLLUTION AND HAZARDOUS WASTE DISPOSAL AND FOR OTHER PURPOSES. WHEREAS, there is currently both federal and state legisla- tion which preempts the field of air and water pollution and hazardous waste disposal; and WHEREAS, the residents of the City of Jacksonville and all other municipalites, desire to have a direct imput into the decision- making process in regards to air and water pollution and hazardous waste disposal; and WHEREAS, the persons most directly affected by any hazar- dous waste disposal would be the residents of a particular muni- cipality in which the hazardous waste would be disposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF JACKSONVILLE, ARKANSAS, THAT: 1. We urge Senators Dale Bumpers and David Pryor, Congressman Tommy Robinson, and all the Arkansas House of Representatives and Senate to enact legislation which would per- mit municipalites to legislate in the area of air and water pollution and specifically in the area of hazardous waste dispo- sal within their municipalities. 2. We request that the Mayor of the City of Jacksonville distribute this Resolution to the above -named representatives as soon as possible. 3. We request a response back from each of these elected officials in regards to what action they can take on behalf of the residents of the City of Jacksonville to see that this legislation is enacted.
