RESOLUTION CLOSING THAT PORTION OF AN ALLEY WHICH COMMENCES
AT THE WEST RIGHT -OF -WAY LINE OF WARREN STREET AND RUNS WEST
BETWEEN LOT 41 AND LOTS 35 -40 OF WEST JACKSONVILLE SUBDIVISION
NO. 1 TO THE CITY OF JACKSONVILLE, PULASKI COUNTY, ARKANSAS:
DECLARED AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, the City Planning Commission of the City of
Jacksonville, Arkansas, has recommended closing that portion
of an alley which commences at the west right -of -way line of
Warren Street and runs west between Lot 41 and Lots 35 -40 of
West Jacksonville Subdivision No. 1 to the City of Jackson-
ville, Pulaski County, Arkansas;
WHEREAS, this matter was submitted to the City Council
of the City of Jacksonville, Arkansas, and a hearing date set
for June 21, 1984, and that public notice thereof was duly
published as required by law in the Jacksonville Daily News, a
bona fide newspaper having general circulation in the City of
Jacksonville, Arkansas;
WHEREAS, there was no hearing objection by any resident
or citizen of the City of Jacksonville to the closing of said
alley, which is dedicated but not used for highway purposes; and
WHEREAS, all adjoining property owners and utility com-
panies have in fact consented to the closing of said alley,
subject to the condition that easement rights to said alleyway
property be reserved by all utility companies;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Jacksonville, Arkansas, that:
SECTION 1. That portion of an alley which commences at
the west right -of -way line of Warren Street and runs west
between Lot 41 and Lots 35 -40 of West Jacksonville Subdivision
No. 1 to the City of Jacksonville, Pulaski County, Arkansas,
should be closed under the powers granted to cities of the
first class in the State of Arkansas, subject to a reservation

of easement rights for utility companies and the Mayor and
City Clerk are hereby authorized and directed to enter into
an agreement with the adjoining property owners to close and
abandon said alley.
SECTION 2. That this Resolution being necessary for the
immediate preservation of the public health, safety, welfare
and morale of the citizens of the City of Jacksonville, Arkansas,
an emergency is hereby declared to exist and this Resolution
shall have full force and effect immediately after its passage.
