A RESOLUTION AUTHORIZING AND APPOINTING THE MEMBERS OF THE
JACKSONVILLE MUNICIPAL MULTIPURPOSE PROPERTY OWNERS'
IMPROVEMENT DISTRICT, NO. FOUR (THE MEADOWS MUNICIPAL PROPERTY
OWNERS' IMPROVEMENT DISTRICT); AND, FOR OTHER PURPOSES.
WHEREAS, throu g h Ordinance No . 1302 (#I -07), this City Council created the Jacksonville
Municipal Multipurpose Property Owners ' Improvement District No . Four (The Meadows Municipal
Property Owners' Improvement District);
WHEREAS, Municipal Property Owners ' Improvement Districts are empowered by Ark. Code
Ann.§ 14-94-101 et seq. and , once formed , are separate and distinct public corporations. Nevertheless,
upon completion of all the improvements in the district, the governing body of the city shall select
successor commissioners in the event of a vacancy ;
WHEREAS, the Meadows Municipal Property Owners ' Improvement District has completed
all ofthe improvements in the District;
WHEREAS, the Meadows Municipal Property Owners ' Improvement District operates and
maintains grinder pumps and sewer lines that connect the homes of the Meadows Subdivision to the
sewer system operated by the Jacksonville Wastewater Utility;
WHEREAS, all the original commissioners of the Meadows Municipal Property Owners '
Improvement District were affiliated with the developers of the subdivision , and resigned effective
f --August 2025;
WHEREAS, the qualification to serve as a commissioner in the di strict is limited to property
owners and creditors of the district. In the event that a property owner or creditor is a corporation ,
partnership , trust, or other legal entity , an y officer, director, trustee, employ ee , or other designated
representative of the entity may be named and appointed as a commissioner;
WHEREAS, the Jacksonville Housing Authority holds an interest in approximately one-third
(1 /3) ofthe homes in the district;
WHEREAS, the Jacksonville Housing Authority has conferred with the Jacksonville
Wastewater Utility for the purpose of identifying individuals of integrity and good business ability ,
whether they are officers , employees or other designated representatives of the Housing Authority ,
having an ownership interest in property within the District, to be named to and recommended as
commissioners to thi s City Council ; and
WHEREAS, the Jacksonville Housing Authority, with the support of the Jacksonville
Wastewater Authority , has recommended to this City Council the following individuals: Tony
Landecker; Jay Whisker; and Paul Richards.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Appointment of the following individuals to the po s ition s of Commissioners
of the Board of the Jacksonville Municipal Multipurpose Property Owners' Improvement District No .

2. Jay Whisker

SECTION TWO: Any and all other Resolutions in conflict herewith are hereby repealed to the
extent of said conflict. This Resolution shall be in effect from and after its date of passage, and the Clerk
of the City shall deliver a copy of the same to the individuals named here shall take and file with the
clerk their oath of office within thirty (30) days of their appointment, as provided for in Ark. Code Ann.
§ 14-94-1 07(a)(1)(A).
