AN ORDINANCE ESTABLISHING THE CITY OF JACKSONVILLE MUNICIPAL
PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT DISTRICT NO. 6 (MEADOW
CREEK PROJECT); AND FOR OTHER PURPOSES.
WHEREAS , there has been filed with the City Clerk ofthe City of Jacksonville, Arkansas,
a Petition purporting to be signed by all the owners of record title of the real property within the
territory described on Exhibit "A," which is attached hereto and incorporated herein by this reference
(the "Property"), praying that a municipal property owners' multipurpose improvement district be
established for the purposes set forth hereinbelow; and
WHEREAS , after due notice as required by law, the City Council of Jacksonville , Arkansas,
has heard all parties desired to be heard.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: That a majority in value of the owners of record title of the Property signed the
Petition, and there is hereby established a municipal property owners' multipurpose improvement
district (the "District') within the Property, for the following purposes: (1) acquiring and purchasing
equipment and machinery incident to the operation and maintenance of improvements; (2) any and
all other acts which shall be deemed necessary in order to purchase , construct, accept as a gift ,
operate, and maintain any and all improvements; (3) doing all things now or hereafter permitted
under applicable law, including , without limitation, Ark. Code Ann.§ 14-94-101 , et seq., to be done
and performed by municipal property owners' improvement districts. The District shall have the right
to exercise the power of eminent domain in order to carry out its purposes.
The District shall dedicate the utilities and streets to the City of Jacksonville and /or the appropriate
agency or company that oversees a utility. After completion and dedication of the infrastructure ,
maintenance on the infrastructure will be performed by the City of Jacksonville or the agency or
company responsible for the utility.
SECTION TWO: Any ordinances or parts of ordinances that are in conflict herewith are hereby
repealed to the extent they conflict with this ordinance.
SECTION THREE: That the legal description of the real property to be encompassed within this
District is described as follows:

SECTION FOUR: The District shall be known as the Jacksonville Municipal Property Owners'
Multipurpose Improvement District No.6 (The Meadow Creek Project). Jonathan Thomas Kennon ,
Vincent Peter Contomo , III , and Lawrence Paul Wilson, whose name(s) appear in the petition, are
named Commissioners , who shall constitute the Board of Improvement of the District.
SECTION FIVE: In the event any portion of this ordinance is declared or adjudged to be invalid or
unconstitutional , such declaration or adjudication shall not affect the remaining portions of this
ordinance , which shall remain in full force and effect as if the portion so declared or adjudged invalid
or unconstitutional was not originally a part of this ordinance.

COUNCIL OF JACKSONVILLE, ARKANSAS
The undersigned a re the owners of record title of the real property situated within the
territory described in t he attached Exhibit "A" a nd incorporated herein.
The undersigned further states that all of the above-described territory is owned by
twenty-five ( 25 l or fewer persons , and that all of the above-described territory is located
within the City of Jacksonville , Arkansas.
The undersigned petition that the real property described in the attached Exhibit ·A"
be formed in to a municipal property owners' improvement distri ct to be known as City of
Jacksonville Municip al Property Owners' Multipurpose Improvement District No.

(Ark. Code Ann . ~ 14-94-101, et seq . l for the purpose of constructing, either within or without
the bo undaries of the D ist r ict. if the property within the D istrict will be benefited thereby,
(a ) constructing waterworks , sewers . and systems of gas pipelines, (b l grading, draining,
paving, curbing, and guttering streets and laying sidewalks, together with facilities related
to any of the fo regoing. and (c) the cost of construction of various improvements, and other
amenit ies i n the Dis t ri ct. and for all purposes authorized by Ark. Code Ann . Title 14. Chapter
94 and amendments t h e r eto , and to any and all other act;:; which shall be deemed n e ce ssary
in orde r to purchas e. cons tr u ct, ac ce p t as a gift, opera te , a n d m a intai n any and al l
improvements a uthorized therei n .
The p urpo s e s are to be accomplished in the manner and t,vith the materi a ls that the
commissio ners fo r the D is t ri ct deem to be in the bes t interest of the Dis t ri ct and a s s pec ified
by law. The cos t of t he Dis t rict shall be assessed upon the rea l property of t he District
according t o the bene fi ts r e ce ived.
The undersigne d petition t hat the District shall not cease t o exis t upo n the acquiring,
constructing, or co mp letion of the improvements or amenities but shall con tin ue t o ex is t, all
in accordance with Ark. Code Ann. § 14-94-128.
The undersigned further petition the City Council of Jacksonville, Arkansas, to
appoint as commissioners for the District three persons of integrity and good business ability,
and the undersigned nominates Jonathan Thomas Kennon. Vincent Peter Contorno, III, and
Lawrence Paul ·wilson to serve as said commissioners.
