The City Council of the City of Jacksonville, Arkansas met for a regular session on February 5, 2026 at their regular meeting place. Council Member Ray delivered the invocation and Vice
Mayor Twitty led a standing audience in the “Pledge of Allegiance.” Vice Mayor Twitty announced that Mayor Elmore had a family event to attend, which is the reason for his absence tonight.
ROLL CALL: City Council Members: Dietz, McCoy, Ray, LaBron, Moss, and Kinman answered ROLL CALL. Vice Mayor Twitty also answered ROLL CALL declaring a quorum. PRESENT SEVEN (7) ABSENT
THREE (3). Council Members Ruple, McCleary, and Mimms were absent.
Others present for the meeting were: Police Chief Brett Hibbs, Fire Chief Alan Laughy, Parks & Rec Director Kevin House, Assistant Finance Director Brandy O’Brien, Director of Economic
Development Robert Birch, Director of Engineering & Public Works Adam Whitlow, Deputy Director of Network Operations Shawn Sutterfield, Assistant City Clerk Emilia Vazquez, Kathy Perez,
Morgan Allen, Theresa Cook, and Jim Moore.
PRESENTATION OF MINUTES: Vice Mayor Twitty presented the minutes of the regular City Council meeting of January 8, 2026 for approval and/or correction at the next regularly scheduled
City Council meeting.
APPROVAL AND/OR CORRECTION OF MINUTES: Council Member McCoy moved, seconded by Council Member LaBron that the minutes of the regular City Council meeting of December 4, 2025 be APPROVED.
MOTION CARRIED.
CONSENT AGENDA: Council Member Ray moved, seconded by Council Member Kinman to approve the consent agenda as presented. MOTION CARRIED.

PLANNING COMMISSION: ORDINANCE 1808 (#03-2026)
AN ORDINANCE RECLASSIFYING PROPERTY IN THE CITY OF JACKSONVILLE, ARKANSAS (1315 LEE MAC DRIVE); AMENDING ORDINANCE NOS. 213 AND 238 AND THE LAND USE MAP OF THE CITY OF JACKSONVILLE,
ARKANSAS; AND, FOR OTHER PURPOSES.
Council Member McCoy moved, seconded by Council Member LaBron to place Ordinance 1808 on FIRST READING. ROLL CALL: Council Member Dietz, McCoy, Ray, LaBron, and Moss voted AYE. MOTION
FAILED with Council Member Kinman voting NAY.
City Clerk Davitt confirmed the majority of Council in its entirety was needed for motion to be carried.
Council Member Kinman stated she would like more time to understand it since it was just available to her tonight.
It was the consensus of the City Council to re-present the ordinance at the next meeting.

GENERAL: PUBLIC HEARING ORDINANCE 1809 (#04-2026)
AN ORDINANCE CONDEMNING STRUCTURES AND REAL PROPERTY AT THE LOCATION NOTED BELOW IN JACKSONVILLE, ARKANSAS, FOR STRUCTURAL DEFECTS, DEFICIENCIES, AND PUBLIC HAZARD CONDITIONS; DECLARING
AN EMERGENCY; AND, FOR OTHER PURPOSES.
Vice Mayor Twitty opened the public hearing at approximately 6:04 p.m.
Code Enforcement Supervisor Marissa Barger stated this is to condemn three public nuisance properties. She explained the first is 213-217 Marshall Road, which is a small shopping center
next to Zaxby’s. She confirmed Notices of Noncompliance were mailed for violations including vacant property and exterior/interior structure requirements with no response or improvement.
She related the next property is 2112 Chapel Hill Road, which is a mobile home. She recalled getting a response from the owner, but communication stopped the middle of last year after
only partial demolition. She noted it has caused severe public nuisance, health, and safety issues. She lastly stated 118 Burroughs Road is a house that burned last year and Code has
not heard from the property owner, nor had any improvement.
Jerry and Willie Trotter, heirs of 118 Burroughs Road, told how they planned to remodel the house, but have not had a chance to do so yet. When Vice Mayor Twitty inquired about a timeline,
they responded that they will clean the yard tomorrow.
Supervisor Barger explained that Code initially tagged it on August 6th, 2025 and have had no response from a property owner or representative. She provided Council with pictures and
documentation to review.
The Trotters told how the house is boarded up and the gate is closed and locked; they have to clean the front yard and start work on the house. When Council Member Ray asked if they
would work on the house within 90 days and if it was repairable, they concurred, reiterating they will start on the yard tomorrow and get a small dumpster to clean the house out since
it just burned the living room.
Supervisor Barger reiterated that Code has not had any response or action taken; no dumpsters delivered or cleaning of the property. She affirmed this has been ongoing since August.
City Attorney Friedman brought up that they would have 30 days after passage to make significant progress.
The Trotters related that the property is owned by their deceased mother and brother, but their mother had a Last Will and Testament. They explained they have tried to review the Will,
but the record holder will not show it to them, even though they provided death certificates and more. When Council Member Kinman asked the reason for no improvements in four months,
they replied that it was due to lack of funds, noting there was no insurance on the house; also, one of them was in the hospital for days due to smoke inhalation.
City Attorney Friedman mentioned if Council passes this ordinance in its entirety, they would still have 30 days to take corrective action or provide a detailed repair plan to Code.
Vice Mayor Twitty strongly advised the Trotters to stay in contact with Code.
City Clerk Davitt noted there are not enough council members present to suspend the rules to pass the ordinance tonight.
Council Member Dietz suggested the Trotters get an attorney to clear the title through probate so they own the property.
City Attorney Friedman related that she can meet with the Trotters after the meeting adjourns.
Council Member Moss cited a portion of Section One of the ordinance: “The City Council hereby directs Code Enforcement to provide notice to the respective property owner and any and
all interested parties that, if said structures and real property are not repaired and/or the health and safety hazards removed from said property so as to bring said property into
compliance with applicable provisions of the Jacksonville Municipal Code within Thirty (30) days from the date of passage of this Ordinance, the structures and improvements on said
real property cited above will be cleared and razed. All structures and nuisances shall be removed so as to eliminate any health or safety hazards to the general public, and the cost
for doing so shall be assessed against the owners of said real property.” He pointed out this passage gives them 30 days to make improvements and keep in contact with Code.
Supervisor Barger concurred.
City Attorney Friedman pointed out that they would have an additional two weeks since it cannot be passed until the next Council meeting.
Vice Mayor Twitty closed the public hearing at approximately 6:16 p.m.
Council Member Ray moved, seconded by Council Member Kinman to place Ordinance 1809 on FIRST READING. ROLL CALL: Council Member Dietz, Ray, LaBron, and Kinman voted AYE. MOTION FAILED
with Council Member McCoy and Moss voting NAY.
City Clerk Davitt confirmed this ordinance will be re-presented at the next meeting.
