26 JUL 13OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on July 13, 2026. Chairman Oakley opened the meeting at approximately 6:30 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Todd Underwood, Billy Hall, Jeff Twitty, and Allen Walker were present and answered ROLL CALL. Chairman Jim Oakley declared a quorum. PRESENT (5) with chair, ABSENT (3), VACANT (1). CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Twitty moved, seconded by Commissioner Walker to approve the minutes of June 8, 2026 as presented. MOTION CARRIED. PUBLIC HEARING(S): CONDITIONAL USE 209 North Bailey Street Mixed Commercial/Residential use under the Mixed Use Overlay District The public hearing opened at approximately 6:31 p.m. City Engineer Adam Whitlow stated the structure is currently being used as a residence after the closing of the business. He explained how the owner wants the option of mixed use in the future, the property was properly advertised and posted, Public Works received no phone calls in support or objection, and Staff has no objections to the approval. He recalled the property being an appliance store previously. Petitioner Amanda Dalton related that the property has been a business and residence since 2020. Engineer Whitlow confirmed the property is in the Mixed Use Overlay District, so this is an allowable use under a conditional use permit. Commissioner Hall reiterated that it is allowed by the zoning already and has business and residential zones on all sides. The public hearing closed at approximately 6:33 p.m. Commissioner Walker moved, seconded by Commissioner Hall to approve the conditional use for mixed commercial/residential use under the Mixed Use Overlay District at 209 North Bailey Street. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): FINAL PLAT Knotting Hill Subdivision PH II Engineer Whitlow noted the two remaining comments are to provide Water acceptance and designate on table which lots to install handicap ramps/truncated domes. Representative Aaron Robinson with Bond Engineering confirmed they have Wastewater approval, but are still waiting on Water’s. Engineer Whitlow affirmed there are no issues and they are ready to start selling lots. Commissioner Hall moved, seconded by Commissioner Underwood to approve the final plat of Knotting Hill Subdivision PH II contingent on Water Department approval. MOTION CARRIED. BUILDING PERMIT(S): a. SITE PLAN Budget Mini Storage Engineer Whitlow stated this is an existing mini storage facility where they are constructing two alike buildings near the frontage of School Drive. He believes the only thing lacking is the Storm Water Pollution Prevention Plan (SWPPP) as required by the Arkansas Department of Environmental Quality (ADEQ). He confirmed that Staff has no issues with it, it is correctly zoned, and the density is still good. Representative Aaron Robinson with Bond Engineering believes there is more room, recalling the owner enclosing some of the storm drainage, putting some on one side of the fence, and this is another inside. Commissioner Underwood moved, seconded by Commissioner Twitty to approve the site plan for Budget Mini Storage as presented. MOTION CARRIED. b. SITE PLAN Lot 26 & 27 Madden Subdivision Engineer Whitlow pointed out that this is the plan previously tabled due to Health Department issues. He explained that the owner has reduced the site by removing the other two food trucks. He mentioned that takes away a lot of Health Department regulations that caused the delay. He brought up that this site does not have to come before the Commission, but because it was tabled last month, he wanted to give an update. He confirmed Staff has no issues with it as now proposed. When Commissioner Hall inquired, he replied that ARDoT has change ordered the sidewalk into the ongoing project, so they will install them. He related that the owner is doing asphalt millings that meets the dust-free requirement. He told how the owner has a business license, and it is only when there is more than one food truck or has onsite dining that triggers the Health Department regulations for food truck courts. Commissioner Underwood moved, seconded by Commissioner Twitty to approve the site plan for Lot 26 & 27 Madden Subdivision. MOTION CARRIED. c. SITE PLAN Marion Towing & Recovery Engineer Whitlow recalled this property being used for rebar manufacturing and had a conex box there. He detailed how a company has bought it and this would be a good use. He listed the SWPPP is required prior to construction, driveway permits are required by ARDoT, and they must provide exterior elevations when applying for the building permit to confirm compliance with the Commercial Design Standards. He added that they must coordinate with Water and Wastewater, although sewer is not available and will be provided by septic. He affirmed Staff has no issues with approval of this site. It was confirmed that the Fire Marshal does not have any concerns. Representative Aaron Robinson with Bond Engineering mentioned the petitioner wanting to put up a temporary building while they get theirs ordered so they can put a sign up. He related he does not have the architectural drawings yet for the permanent building and they are working through the length of time allowed for the temporary building with Engineer Whitlow. He reiterated that they are trying to identify how long it will be there, noting it may be a year before their permanent building is delivered to the site. Engineer Whitlow reiterated that the site had a conex box on it previously, so they are amenable to it, but there needs to be conditions and they have not provided that. He related a contingency that our code requires is a permanent building with exterior elevations that meet the Commercial Design Standards. He added that they will be required to comply with opaque fencing, have landscaping along the front, and paved parking lot for visitors, which shows on their site plan. He surmised the property is zoned C-4, which is the most intensive use in commercial zones and this plan fits in. Commissioner Twitty moved, seconded by Commissioner Walker to approve the site plan for Marion Towing & Recovery contingent on providing Storm Water Pollution Prevention Plan (required by ADEQ), driveway permits (required by ARDoT), and Exterior Building Elevations to ensure compliance with the Commercial Design Standards, and also the approval of Water, Wastewater, and the Arkansas Department of Health.
