26 APR 13OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on April 13, 2026. Chairman Oakley opened the meeting at approximately 6:30 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Billy Hall, Terry Sansing, Nick Priest, Vivian Brittenum, Jeff Twitty, and Allen Walker were present and answered ROLL CALL. Chairman Jim Oakley declared a quorum. PRESENT (7) with chair, ABSENT (1), VACANT (1). CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Brittenum moved, seconded by Commissioner Twitty to approve the minutes of March 9, 2026 as presented. MOTION CARRIED. PUBLIC HEARING(S): a. REZONING parcel located between John Harden Drive & Old Highway 67 (Toneyville Road) approximately 1000' north of West Coffelt Road from C-3 to R-8 The public hearing opened at approximately 6:31 p.m. Representative Aaron Robinson with Bond Engineering stated this property extends from the access road to Toneyville Road. He explained that the front of the property will be left commercial zoning, while the back will be an RV resort area. He mentioned the developers planning to have a playground area, washers, dryers, sitting areas, and green space. He brought up that the City Engineer commented that the density was too high, but this is just a sketch to give the Commission a rough representation of what may go there. When Chairman Oakley inquired, he replied that since they plan having over thirty spots, the Fire Marshal could require more than one way in and out. Chairman Oakley pointed out that the Commission approved an RV park adjacent to this property that is now under construction. When Commissioner Walker inquired, Mr. Robinson confirmed there will be asphalt, curb, gutter, concrete pads, and hookups for water, sewer, and electric. He related that they will have to put in detention ponds. Engineering Tech Mylissa Griggs brought up that the City has not received any phone calls regarding the request. Chairman Oakley recommended that the City change the color of the required signs for posting properties, noting the orange color is hard to see. Engineering Tech Griggs confirmed Staff had no issues with the request since they have addressed questions on the density, but this is strictly a rezoning request. The public hearing closed at approximately 6:36 p.m. Commissioner Brittenum moved, seconded by Commissioner Hall to approve the rezoning of the parcel located between John Harden Drive & Old Highway 67 (Toneyville Road) approximately 1000' north of West Coffelt Road from C-3 to R-8. MOTION CARRIED. b. REZONING 10022 South Highway 161 from R-0 to R-4 The public hearing opened at approximately 6:37 p.m. Representative Nick Tucker with Tucker Land Surveying noted there was a replat and site plan to accompany this rezone, but they have to do a sewer extension, so the replat was pulled from the agenda. He explained the owners are going to divide the property into three lots to build three single-family rental homes. Engineering Tech Griggs related that all houses are planned to face West Valentine Road. She confirmed the only difference in the zoning is the lot size since R-4 can go down to 20’, where they could be connected, but the smallest planned is 41’, not connected. Mr. Tucker reiterated they will not be connected; they will have side setbacks with the house footprints being 27’ wide, leaving roughly 7’ on either side of each house. Engineering Tech Griggs affirmed they will still have to adhere to Fire Code separation. When Commissioner Walker inquired, Mr. Tucker confirmed they will not be duplexes, but will be single-family residential. Citizens Sheila Gray and Lori Meyers, of 112 West Valentine Road related that they just bought the property next door. They shared concerns with parking, sight distance, and flooding. Mr. Tucker stated they will have standard, concrete driveways, the property is not in the floodplain, and they have not done a drainage study since this is just a rezone. He mentioned the houses will have 16’ between them, be single story, and R-0 zoning surrounds the property. Engineering Tech Griggs confirmed the minimum lot size for R-0 is 70’ x 120’. City Clerk Davitt brought up that her office does not have a letter giving Mr. Tucker permission to represent this item. Engineer Tech Griggs clarified that she has the signed request form. Mr. Tucker told how it is Ryan and Jeff Aclin who own Mid Ark Houses and Arkansas Homes and Rentals. City Clerk Davitt inquired if they also own RLA, Viva La Vegas, JTJ Construction, VIP Homes LLC, Rock City Houses LLC, Puckett Investments, Shady Investments, and Wilson DW Properties and Investments. She then asked how many businesses do they have at that address, noting this is why the Commission needs Mr. Aclin present to answer questions. She related that the one address is the only one for all of those businesses. She requested Mr. Tucker ask Mr. Aclin to visit her office. Ms. Gray and Ms. Meyers pointed out that there are more people who could not make the meeting tonight. Engineering Tech Griggs shared that Public Works has received several calls, but everyone she spoke with had concerns with it being rezoned to commercial; no objections were received for residential. Ms. Gray and Ms. Meyers mentioned a possible petition, but City Clerk Davitt confirmed the Commission has no reason to deny action tonight. The public hearing closed at approximately 6:46 p.m. Commissioner Sansing moved, seconded by Commissioner Brittenum to approve the rezoning of 10022 South Highway 161 from R-0 to R-4. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): a. FINAL PLAT Drew Addition Representative Aaron Robinson with Bond Engineering stated they are planning two lots for two single-family residential houses on Southeastern Avenue. When Commissioner Brittenum inquired, it was confirmed that the houses will not be rentals. Engineering Tech Griggs told how all of Staff’s concerns have been addressed, but there are two contingencies; provide an Engineer’s estimate for ½ street improvements for the requested payment in lieu of fee and provide drainage calculations to support minimum driveway culverts. When Chairman Oakley brought up the Bill of Assurance, she told how it is very basic. Commissioner Hall moved, seconded by Commissioner Twitty to approve the final plat of Drew Addition contingent on providing an Engineer’s estimate for ½ street improvements for the requested payment in lieu of fee and drainage calculations to support minimum driveway culverts. MOTION CARRIED. b. FINAL PLAT Smith Kitchen Addition Representative Aaron Robinson with Bond Engineering mentioned a site plan for review, but it got pulled. He shared that the petitioner has another engineering firm doing the site plan, so he is not privy to a lot of that information. Engineering Tech Griggs confirmed it is all standard setbacks, noting this step was required when ready for permanent construction and he wants to pull a building permit. She explained he is not quite ready for that and is sticking with his food truck and picnic tables. She shared his main concern was to get the security of the fencing since people were coming onto the property at night and sleeping on his tables. Commissioner Walker moved, seconded by Commissioner Priest to approve the final plat of Smith Kitchen Addition. MOTION CARRIED. c. FINAL PLAT Lot 1, Roy Commercial Subdivision Representative Aaron Robinson with Bond Engineering related that the Commission will see the site plan next. He explained it is an existing house being converted into a car dealership, so they are platting the property to conform and pursue his site plan approval. Engineering Tech Griggs confirmed that all comments have been addressed on the final plat and they have no issues. She mentioned this is standard procedure to be able to receive a permit for the site development; he is not doing any construction, other than putting in a new parking lot. She added that the address is 1900 South Highway 161, which is zoned C-3, but has been a nonconforming use as residential for years. When Commissioner Walker inquired, Mr. Robinson replied that a Bill of Assurance in a one lot subdivision is pointless since it is to ensure everyone in the subdivision is conforming to the same standards. He confirmed one is attached, since the City requires it. Engineering Tech Griggs clarified that it is further formal dedication of the easements and rights-of-way, if applicable. Commissioner Sansing moved, seconded by Commissioner Priest to approve the final plat of Lot 1, Roy Commercial Subdivision. MOTION CARRIED. BUILDING PERMIT(S): a. SITE PLAN Lot 1, Roy Commercial Subdivision Representative Aaron Robinson with Bond Engineering detailed that this is a parking lot extension to have employee and customer parking, along with vehicles displayed. He explained parking and landscaping is shown; the only things outstanding are drainage calculations and a cost estimate. Engineering Tech Griggs confirmed the only contingency is to provide drainage calculations indicating that stormwater flow will not be adversely affected and cost estimate for any further ½ street improvements. Mr. Robinson told how he will submit the sidewalk plans to the Highway Department, since it is on their right-of-way, and they could deny the request, which they have done on Military Road in the past. He surmises that they will not let him put one there. Commissioner Sansing moved, seconded by Commissioner Brittenum to approve the site plan for Lot 1, Roy Commercial Subdivision contingent on providing drainage calculations indicating that stormwater flow will not be adversely affected and a cost estimate for any further ½ street improvements needed. MOTION CARRIED. b. SITE PLAN Lot 6, Block 0 Metropolitan Commercial Estates Representative Aaron Robinson with Bond Engineering recalled a site plan for a building and parking being presented a few years ago to the Commission. He explained the petitioner now wants to tear down what he built, add on to the parking, and build a new building. He acknowledged there are a few outstanding issues; the elevations of the building and drainage calculations. Engineering Tech Griggs shared that the City’s main concern is making sure everything is notated so we know what the plan is. She related that they had issues previously regarding inventory displayed on grass and not on a hard surface. She told how they had Bond Engineering add on the site plan that all parking is to be on a paved surface. She noted when the petitioner first moved onto this lot, the City did not have commercial design standards in place, but we do now. Commissioner Walker moved, seconded by Commissioner Priest to approve the site plan for Lot 6, Block 0 Metropolitan Commercial Estates contingent on providing plans/elevations for proposed building to ensure compliance with Commercial Design Standards and drainage calculations indicating that stormwater flow will not be adversely affected. MOTION CARRIED. GENERAL: Request for removal of right-of-way dedication and Loop Road connection from Master Street Plan by Daniel Gray Daniel Gray with RE/MAX Homefinders Realty stated the 80 acre property is listed for sale and under contract, contingent upon the Master Street Plan being revised to remove the cut through for J.P. Wright Loop Road that was going to connect to Southeastern Avenue. He told how he spoke to the City who confirmed there are no plans for that connection to ever happen now. He related that the owners would like to market the front 3 acres as commercial, after the right-of-way is abandoned. He explained when this all happened, the property was outside the city limits, but within their planning jurisdiction. He confirmed recent legislation has changed, and since it is within County, they will request it with them for the right-of-way to be officially abandoned. He mentioned still needing the City’s Master Street Plan updated to remove the cut through. Engineering Tech Griggs told how the Master Street Plan has been needing to be updated. She explained that the original plan was to develop a very large subdivision on the property, but that is no more. She told how this right-of-way dedication was for that development, and at that time, the City had a one-mile planning jurisdiction outside of the city limits. She affirmed the City has no say in anything beyond our city limits now and the City cannot grant the abandonment of the right-of-way, but can only show support by removing it from the Master Street Plan. Mr. Gray requested the Master Street Plan be updated to remove that J.P. Wright Loop Road “spur” out of it. When City Attorney Friedman inquired, he confirmed he prefers it be done prior to pursuing the County request, to show City support. When Chairman Oakley inquired, City Clerk Davitt clarified that it would be a recommendation from this body to the City Council. Engineering Griggs concurred. City Clerk Davitt noted it requires an ordinance to update the Master Street Plan. Engineering Griggs related that there are other proposed streets that need to be removed as well. City Clerk Davitt detailed that this body will recommend, per Engineering’s recommendation, that all streets now located in the County need to be removed from the City’s Master Street Plan. Commissioner Twitty moved, seconded by Commissioner Sansing to recommend to City Council that all streets now located in the County need to be removed from the City’s Master Street Plan. MOTION CARRIED. ANNOUNCEMENT(S): Commissioner Resignation Commissioner Sansing announced his resignation from the Commission. He explained that it is due to possible conflicts of scheduling when he is out of town.
