25 OCT 13OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on October 13, 2025. Acting Chairman Oakley opened the meeting at approximately
6:30 p.m. expressing appreciation to those in attendance.
ROLL CALL: Commissioners Mike Dietz, William Montgomery, Terry Sansing, Nick Priest, Zeke Brown, and Acting Chairman Jim Oakley were present and answered ROLL CALL. Acting Chairman Oakley
declared a quorum. PRESENT (6) with chair, ABSENT (3).
CORRECTION AND/OR APPROVAL OF MINUTES: Council Member Dietz moved, seconded by Commissioner Sansing to approve the minutes of September 8, 2025 as presented. MOTION CARRIED.
PUBLIC HEARING(S):
REQUEST TO APPROVE PLAT(S): a. FINAL PLAT Aubethany Estates Phase I
City Engineer Whitlow stated the infrastructure is in, they have posted a letter of credit for remaining improvements, which is asphalt, and have met the threshold to submit for final
plat. He explained there are contingencies he would like on record.
Representative Aaron Robinson with Bond Engineering confirmed the zoning is R-3, there will be duplexes, but can have triplexes. He noted originally, this was a one lot subdivision where
the developer was going to own all of the duplexes and triplexes, but after financing, they brought it back with public streets and lots fitting in the R-3 zoning. He mentioned widening
the entrance to address the recommended two ways in and out. He pointed out this is Phase 1 and Phase 2 will be behind it, all consisting of about 46 lots total. He brought up the only
real issue is with the Arkansas Department of Transportation saying they cannot have sidewalks on the right-of-way, which he questions since the City did a sidewalk project near. He
related that they said he had to take the sidewalk off of the plan, but Public Works wants them back on. He affirmed he did not want to add them on private property.
Engineer Whitlow affirmed the District 6 permit officer said no sidewalks on their right-of-way, but there needs to be sidewalks, unless there is a waiver granted. He surmised he could
convince them to allow the sidewalks since it was done in the past, but for now, he would support an in lieu of fee.
Mr. Robinson concurred, saying the developer does not want to build them on his property, or build on the right-of-way and be told to tear them out.
Engineer Whitlow brought up another contingency, explaining once above 30 lots, Fire Code requires a second entrance. He recalled the Chief being amenable to a wider entrance to accommodate,
but does not have anything from the Chief confirming.
Mr. Robinson noted this first phase does not trigger a second entrance since it is not yet over 30 lots. He mentioned other similar cases in Cabot and Little Rock. He offered for himself
or the Engineering Department to reach out to the Fire Marshal to get something in writing, because as soon as this gets done, the developer wants to start the second phase.
Engineer Whitlow read the list of contingencies: add note indicating sidewalk construction along Military Road right-of-way, Tract A needs to be designated as a Detention Pond Easement,
provide correct Bill of Assurance (copy provided references H & S Subdivision throughout, items 1 & 2 appear to need corrections, item 6 needs to clearly state maintenance responsibility
since it is ambiguous as to who maintains if the City does not accept ownership), change name from Adelaide Road to Adelaide Lane, provide status of street light installation, contractor
to provide warranty letter once pavement is complete, provide proof of acceptance from Water and Sewer, provide Stormwater as-builts, verify with USPS if cluster box units are required,
and provide concurrence from Fire Marshal to allow single access for future expansion of phases. He briefly voiced frustration regarding the USPS cluster boxes and the lack of guidance
received.
Commissioner Sansing moved, seconded by Commissioner Priest to approve the final plat of Aubethany Estates Phase I with contingencies of: adding note indicating sidewalk construction
along Military Road right-of-way, Tract A needs to be designated as a Detention Pond Easement, provide correct Bill of Assurance (copy provided references H & S Subdivision throughout,
items 1 & 2 appear to need corrections, item 6 needs to clearly state maintenance responsibility since it is ambiguous as to who maintains if the City does not accept ownership), change
name from Adelaide Road to Adelaide Lane, provide status of street light installation, contractor to provide warranty letter once pavement is complete, provide proof of acceptance from

b. FINAL PLAT Graham Woods PH 4B
Engineer Whitlow stated this phase is almost complete, but has received a $177,000 financial assurance for the remaining improvements. He read the list of contingencies: add dimension
along east property line of Lot 33, change General Note #7 to reflect Tract C as Drainage Easement (to remain consistent with Tracts A & B in Phase 4), provide bond for incomplete infrastructure
(as outlined in § 17.12.125 of JMC), contractor shall provide warranty letter once pavement is complete, provide proof of acceptance from Water & Sewer, provide Stormwater as-builts,
verify with USPS if cluster box units are required, and provide temporary turn around at end of Redbud Court (per Fire Marshal).
Commissioner Sansing moved, seconded by Commissioner Montgomery to approve the final plat of Graham Wood Phase 4B with contingencies of: add dimension along east property line of Lot
33, change General Note #7 to reflect Tract C as Drainage Easement (to remain consistent with Tracts A & B in Phase 4), provide bond for incomplete infrastructure (as outlined in §
17.12.125 of JMC), contractor shall provide warranty letter once pavement is complete, provide proof of acceptance from Water & Sewer, provide Stormwater as-builts, verify with USPS
if cluster box units are required, and provide temporary turn around at end of Redbud Court (per Fire Marshal). MOTION CARRIED.
BUILDING PERMIT(S): SITE PLAN Prices Rite Subdivision Lot 1
Representative Tommy Bond with Bond Engineering recalled this building being torn down by a tornado and this is to replace it.
A brief discussion ensued regarding parking.
Engineer Whitlow explained since it was existing and is going back like it was, they felt it was a grandfathered use. He surmised it is zoned C-2.
Council Member Dietz moved, seconded by Commissioner Sansing to approve the site plan for Prices Rite Subdivision Lot 1. MOTION CARRIED.
