MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: June 8, 2026 6:00 p.m. – 6:06 p.m.
ATTENDANCE: Commissioners: Priest, Moore, and Chairman Brittenum were present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brittenum declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Priest moved, seconded by Commissioner Moore to approve the regular meeting minutes of April 13, 2026. MOTION CARRIED with Chair voting
AYE.
VARIANCE(S): Rear & Front Yard Setback Variance 122 Joiner Avenue
The public hearing opened at approximately 6:01 p.m.
Representative Nick Tucker with Tucker Land Surveying recalled this property being approved for a rear yard setback variance in October, but a sewer line was discovered on the north
side of the lot, which caused them to shift the house to the south and encroach on the front yard setback. When Commissioner Moore inquired if this pertains to the manhole in the front
yard, he concurred, noting it is shown on the survey. He confirmed that the concrete walk that leads from the house to the main sidewalk has not changed and the driveway location is
the same, allowing two full size vehicle parking.
City Engineer Adam Whitlow related that Staff has no objections. He reiterated the previous rear yard setback approval and pointed out that the lot is in a curve, so it is a small encroachment
in the corner. He affirmed that these are small, non-conforming lots in the Sunnyside Subdivision and Staff feels the hardship is justified.
The public hearing closed at approximately 6:06 p.m.
Commissioner Priest moved, seconded by Commissioner Moore to approve a rear yard setback of 5’ and a front yard setback of 20’ at 122 Joiner Avenue. MOTION CARRIED with Chair voting
AYE.
ADJOURNMENT: Without objection, Chairman Brittenum adjourned the meeting at approximately 6:06 p.m. MOTION CARRIED.
