Front Yard Setback Variance 1501 Justice Street Petitioner: Charles Anderson Homes LLC Representative: Bond Engineering 8-10 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: September 8, 2025 6:00 p.m. – 6:14 p.m. ATTENDANCE: Commissioners: Hall, Brittenum, Sansing, Twitty, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Davitt recorded those listed above in attendance and Chairman Oakley declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brittenum moved, seconded by Commissioner Sansing to approve the regular meeting minutes of August 11, 2025. MOTION CARRIED. VARIANCE(S): a. Front Yard Setback Variance 1433 Justice Street The public hearing opened at approximately 6:02 p.m. City Engineer Adam Whitlow recalled a similar previous request on Lee Mac Drive, adding that the builder measured from the wrong place. Petitioner Charles Anderson with Charles Anderson Homes told how his usual excavator was hospitalized at the time when they measured off of the street instead of the actual line, which was four or five feet off the curb. He stated the pad was built prior to starting. Engineer Whitlow confirmed that is a common misconception, but the curb is not related, necessarily, to the property line. He affirmed the only true way to know, is to measure off of the front property pins, noting his department requires a certified plot plan. Mr. Anderson related these are the last three houses on Justice Street. When Commissioner Brittenum mentioned inspections, Engineer Whitlow stated the City cannot delineate property lines; only a licensed surveyor can. He brought up that a 20’ setback is still adequate per Fire Code. The public hearing closed at approximately 6:13 p.m. Commissioner Hall moved, seconded by Commissioner Twitty to approve front yard setbacks of 20.5’, 20.8’, and 20.7’, respectively, at 1433, 1437, and 1501 Justice Street. MOTION CARRIED. b. Front Yard Setback Variance 1437 Justice Street This item of business was combined with item a. above. c. Front Yard Setback Variance 1501 Justice Street This item of business was combined with item a. above.
