MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: October 13, 2025 6:00 p.m. – 6:09 p.m.
ATTENDANCE: Commissioners: Hall, Sansing, Twitty, and Chairman Oakley were present.

Assistant City Clerk Emilia Vazquez recorded those listed above in attendance and Chairman Oakley declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Sansing moved, seconded by Commissioner Twitty to approve the regular meeting minutes of September 8, 2025. MOTION CARRIED.
VARIANCE(S): a. Rear Yard Setback Variance 122 Joiner Avenue
The public hearing opened at approximately 6:01 p.m.
City Engineer Adam Whitlow stated this request is to go from 25’ to 5’. He explained the lot is smaller than current code and in order to build the proposed 1400 square foot house, it
requires a variance. He confirmed the property was properly advertised and posted and Public Works received one objection from the neighbor to the north, but they are on the side of
the lot where the house is compliant; not the rear. He related there are like properties with substantially less than code requirements and this is an old platted area with no building
lines. He noted Staff supports granting the variance due to the above mentioned and is similar in nature to others approved in the area.
Commissioner Sansing recalled when Council voted to sell city-owned lots in the area, they were aware there would have to be variances issued for building on them because they are smaller
sized lots from a different era.
The public hearing closed at approximately 6:04 p.m.
Commissioner Sansing moved, seconded by Commissioner Twitty to approve a 5’ rear yard setback at 122 Joiner Avenue. MOTION CARRIED.
b. Rear Yard Setback Variance Lot 485F of Northlake Subdivision PH XIIB (located at the southwest corner of Fawnwood Street and Black Bass Court)
The public hearing opened at approximately 6:05 p.m.
Engineer Whitlow stated the request is to go from 25’ to 12.1’, it was properly advertised and posted, and Public Works received no phone calls in support or objection. He confirmed
Staff has no objections in granting the variance. He explained that this is a corner lot with an interpretation issue. He related that he would consider the front of the house facing
Black Bass Court, so the rear would be what would be the side setback if you drive down Fawnwood Street, which is the variance request, but if you consider the rear setback opposite
of the driveway, they are compliant. He mentioned there being different interpretations for double frontage lots, so that is something he will clarify in the future with code updates.
The public hearing closed at approximately 6:09 p.m.

Commissioner Sansing moved, seconded by Commissioner Hall to approve a 12.1’ rear yard setback for Lot 485F of Northlake Subdivision PH XIIB. MOTION CARRIED.
ADJOURNMENT: Without objection, Chairman Oakley adjourned the meeting at approximately 6:09 p.m. MOTION CARRIED.
