MINUTES OF THE JACKSONVILLE PLANNING COMMISSION, FEBRUARY 5, 1974
The Planning Commission held its regular meeting at 7:30PM at City
Hall on February 5, 1974, with the following members in attendance:
T. P. White Chairman, Cleo Cavender, Hugene Wooley, Doug Wilkinson,
Johnny Wright, Jim Peacock, Albert Sidwell, Lewis Ederington, and
Daisy Olson. Other persons attending were Tommy Bond, Billy Rector Jr,
Nancy Burnette and Charles Randall as representative from Metroplan.
A letter received from Catherine Anderson Waggoner, Velma Boroughs
and James Carter was read by the Chairman. He stated that since the
Planning Commission could not consider one lot for rezoning to a mobile
home park and since it was without the province of the Planning Com-
mission to issue a permit in violation of the ordinance, that he felt
that any action taken would have to come from the Council. It was
thereupon moved by Doug Wilkinson, with second by Johnny Wright, that the
Secretary forward the letter on to the Council without recommendation.
All members voted in favor of the same.

The Planning Commission held its regular meeting at 7:30PM at City Hall
on March 5, 1974, with the following members in attendance: T . P. White,
Chairman, Cleo Cavender, Hugene Wooley, Lewis Ederington, Johnny Wright,
Jim Peacock, Albert Sidwell and Daisy Olson. Other persons attending were
Tommy Bond, Larry Wilson and Nancy Burnette.
Minutes of the February meeting were approved as circulated.
First item of business was consideration of the approval of Final Plat
of Lots 16 through 18, Block 7 and Lots 1 through 4, Block 8 of Section 4,
Northwood Acres, Jacksonville. After study by the members present, it
was moved by Cleo Cavender, with second by Albert Sidwell, that the same
be approved, subject to the subdivider meeting the Council's requirements
as to all public utilities and public improvements. All members voted ~-

Second item of business was a request from Tommy Bond for rezoning from ~
~-1 to R-3 the following described :eal property:. A tract of land located h

City of Jacksonville, Pulaski County, Arkansas, more particularly described~('
as follows: Commencing at the Northwest corner of the Southeast Quarter ,
(SEJ:i) of the Southwest Quarter (SWJ:i) of Section 18, T-3-N, R-10-W; thence
S 0° 04' E, 605.0 feet to the point of beginning; thence N 890 34' E,
150.0 feet; thence S 0° 04' E, 608.5 feet; thence S 89° 55' W, 511.03 feet;
thence N 04' 45' W, 607.3 feet; thence N 89° 34' E, 410.8 feet to the point
of beginning: Containing 7.47 acres, more or less.
Whereupon, it was moved by Johnny Wright, with second by Hugene Wooley
that public hearing be set thereon at 8PM on the first Tuesday in April.
All members voted in favor of the motion.
Final Plat of Oakwood Subdivision, together with Bill of Assurance was ·
presented by Tommy Bond, which contained four lots on Gregory Street.
Tommy stated that sewer would be provided for Lots 3 and 4 and that a
minimum of eight foot easement would be added to the back of the lots for
sewer lintes. Mr. White suggested that Oakwood Drive be built and
connected with the apartment complex at the back of the property. Mr.
White further suggested that an opening be made for a street to come out
on McArthur Drive. It was moved by Jim Peacock, with second by Johnny
Wright, that final approval be given, subject to the addition of the
easement being made. All members present voted in favor of the motion.
A discussion ensued regarding the name of North First Street and the con-
fusion to people because of the Freeway splitting the two segments of
the street. It was the decision of the Planning Commission members that
the street name remain North First and that the Council take immediate
action to erect adequate signs directing people to T. P. White Drive,
Vandenberg Drive and North First Street.
A letter from Reed Williamson was read by the Chairman regarding
Schneider Grocery. It was the consensus of opinion of the members
present that the property in question has been rezoned by the overall
City zoning in 1968 and that, if in fact, the property had been
continuously used for business, that it is a non-conforming use which
would not be enjoined by the City, but if the facts proved that the ·
business classification had been abandoned or changed by the usage that
it would be up to the City Attorney to resolve the question by liti-
gation; that it was not the responsibility of the Planning Commission
to interpret the facts or the law.

The Planning Commission held its regular meeting at 7:30PM at City
Hall on April 2, 1974, with the following members in attendance:

Minutes of the March meeting were approved.
A revised preliminary plat of Oakwood Subdivision with plans of
sanitary sewer were submitted by Tommy Bond. There was a general
discussion regarding the drainage of the Subdivision. Tommy Bond
stated that his father had made the engineering study and determined
t h e size needed for culvert to tie to the City drainage at Gregory
Street. Tommy further stated it would be their request that sidewalks
b e required on only one side -the side opposit e the cul de sac. It
was moved by Doug Wilkinson, with second by Dr. Albert Sidwell that
the same be approved, subject to the Council being satisfied on the
drainage.
Tommy Bond withdrew a previous request for rezoning of Oakwood
Subdivision.
Final Plat of Westwood Subdivision was submitted b y Bill Carpenter,
with the statement it would be completed before the Ci t y would be
expected to accept it and that he would finish the sidewalks after
driveways were completed. It was moved by Doug Wilkinson, with second
by Hugene Wooley that the same be accepted. All ~vere in favor of the
motion .
A request from Jim Peacock for rezoning 34.7 acres from Class R-1 to
Class R-3 was submitted. Said area being mor e particularly described

The Planning Commission held its regular meeting at BPM at City Hall
on May 7, 1974, with the following members in attendance: T. P. White,
Chairman, Cleo Cavender, Hugene Wooley, Doug Wilkinson, Jim Peacock,
Albert Sidwell, Lewis Ederington and Daisy Olson. Other persons attending
were George Ed McCain, Rubert Polk, Leon Massey, Charles Randall and
Tommy Bond.
Minutes of the April meeting were approved.
First item of business was a request from Leon Massey to build a pre-fab
metal warehouse for light commercial use on Lot l, Block l , Galloway's
Addition to the Town of Jacksonville, covering 30% of the lot instead
of 25%. A waiver was requested to allow 31% density on his lot rather
than the ordinance provision of 25%; and further asking a deviation in
the front setback line to be changed from 25 ft. to 24 ft. Mr. Massey
stated that he planned to place a metal building with a brick office
area on concrete slab on the property in question and black top the
whole are a . It was the consensus of opinion of the members p r esent
that there should be controlled access in and out of the p roperty and
that the b uilding should be set on the rear prope r t y line which would
eliminate the need for deviating the front setback line . Wi t hthese
stip u l ation s, i t was moved b y Doug Wilkinson, with second by Jim Peacoc k
t hat approval be g iven on the request . Th e motion carried.
Mr. White reported to the Commiss i on members on a meeting h e had h ad
wi t h the utility companies and stated that he felt that all p reliminary
p lats should s h ow approval from the utility companies before the Plan-
n ing Commission gives approv al in t h e future.
Public hearing on the rezoning of Schneider Groce r y p roperty was tab led
indefinitely to allow eetermination as to property rights b y t h e courts .
George Ed McCain appeared i n opposition to the r e quest.
Publ i c h earin g was convened on requests from Jim Peacock for r ezoning
of Bruce Hardcastle property. No persons appeared in opposition to
the requests. It was moved by Cleo Cavender, with second by Hugene
Wooley that both parce l s be approved as requested. All members voted
in favor of t h e same.
Doug Wilkinson discussed the development of prop erty on the corner
of Jeff Dav i s, Hill Street and John Harden Drive and mov e d t h at the
Plann i ng Commission go on record as to b eing opposed to the entrances
as now shown on the plat for h ighway access. Lew i s Ederington second ed
t h e motion and all persons voted in favor of the same.
Ch arles Randall was present and stated that Metroplan was working on
u p dating the Master Street Plan and was showing land usages in the
zoning map and that upon completion , copies would be a v ailable for
the Commission members.

The Planning Commission held its regular meeting on Tuesday, August 6,
1974, with the following persons in attendance: T. P. White, Chairman,
Cleo Cavender, Doug Wilkinson, Albert Sidwell, Daisy Olson, Rubert Polk,
Dovie Polk, Clifford Schneider, Duane Reel and Nancy Burnette.
The meeting was called to order by the Chairman.
Minutes of the June meeting were approved. There had been no meeting
held in July.
A r equest for final approval of Lots 1-4 and 14-29 of Oakwood Subdivision
was submitted by Duane Reel on behalf of the owner. A check in the amount
of $19.50 accompanied the request, which was to cover fee of such plat.
Duane stated that the west side of the property had no drainage problems
(that West of Oakwood Drive) and was the only portion considered in the
Final Plat request. After consideration by the members present, it was
moved by Dr. Albert Sidwell, with second by Cleo Cavender, that the
request be granted, subject to the subdivider or engineer furnishing
proper plat of the Final Portion to the secretary and to City Hall. Mr.
Reel stated that this would be done. Whereupon, the motion carried
unanimously.
It was determined by the members present that the legal title had been
resolved on the Schneider Grocery, and that the matter would be taken up
on the following Tuesday evening after notice to all interested persons
was run in the local newspaper.
A request from Bill Carpenter had been forwarded to the Chairman; which was
read to the members present and filed with the Secretary. It was not
clear to the members, exactly what area was covered by the request. It
was thereupon decided that a representative of t h e petitioner should be
present at the special meeting set for the following Tuesday so that the
matter could be considered at that time. The Secretary was advised to so
instruct the petitioner.
There was a request for the final approval of Phase II Stonewall Sub-
division submitted by Duane Reel. After consideration by the members
presents , it was recommende d that the same be approved.

MINUTES OF SPECIAL MEE'riNG, JACKSONVILLE PLANNING COMMI SSION, AUG. 13, 1974
The Planning Commission held a special meeting on August 13, 1974, with
the following persons in attendance: T. P. Wh ite, Chairman, Hugene Wooley,
Albert Sidwell, Lewis Ederington, Daisy Olson, Bill Carpenter, Ivlrs. H. J.
Howard, George Ed McCain, Rubert Polk, Dovie Polk, Clifford Schneider and
Ruth Blazer.
The Chairman declared the public hearing on the Schneider Grocery
property open at 8 PM. Persons speaking in opposition thereto included
George Ed McCain, Ruth Blazer (on behalf of her sister, Mrs. Mabel McCain),
Mrs. H. J. Howard and T. P. White.
The prirnary objections were that a reopening of a business at the location
would create additional traffic hazards; that the adjacent owners had the
rlght to rely on the previous zoning which had upgraded all the property
there to residential; that a garage would depreciate surrounding
property values; that the desired use by the petitioners would be an
overdevelopment of the property, in that required parking space was
not available on the plot in question for the vehicles that would be
there for repair and for other customers; and that such a request
involved spot zoning, which constituted poor planning.
Those speakers in favor of the request included Rubert Polk, Davie
Polk and Clifford Schneider. Mr. Schneider stated that he had purchased
the property as a business over twenty years ago; that he had financed
it with a Small Business loan; that there were gas pumps in the ground;
that a business of one kind or another had been operated continuously
on the property until less than a year ago; that ne needed the income
he could der i ve from selling the property as a business.
The Polks s tated that they had held up relocating to another location
since February and needed to get this matter resolved at this time one
way or the other so that a definite step could be taken by them toward
planning their future. He further stated that the location was ideal
for him to have a small business where he could work as much as health
would allow, he could live on the site and be with his small child
when she was not in school; that he had no desire to expand to a size
large enough to require other employees, that he would be the only one
doing work there, and would only handle two or three cars at a time
at most, and that the required parking space for such an operation was
amply met at the site in question; he further stated that he f elt he
had improved the proper·ty considerably since he first became interested
in it, by painting and cleaning.
Upon motion by Dr. Albert Sidwell, and second by Hugene Wooley, it
was recommended that rezoning be denied. The vote was three for the
motion, one against, and one abstention.
A l et ter of resignation from James Peacock to Ma i or John Harden was
read by T. P. White. Upon motion duly made and seconded, the secretary
was instructed to s end a letter of appreciation to Mr. Peacock.
The matter of requests for rezoning by Mr. Carpenter was presented
by the Chairman. Dr. Sidwell stated that he would oppose any change
of property from an industrial classification to any other, but
that he would agree to a public hearing thereon. Upon motion duly
made and seconded, public hearings were set to begin at 8:30PM on
Tuesday, September 3, 1 9 74 on thl t:W<;\o}y~owing described parcels

Minutes of the August 6th and August 13th meetings were approved as
mailed.
The Chairman requested that all members encourage the May or to act with
haste in filling the vacancies occasioned by Jim Peacock's resignation
and Johnny Wright's deatl1 . He stated that it was his feeling that the
Ordinance setting up the Planning Commission required a full commission
of nine members at all times, even though only five are required to
constitute a quorum .
There was some discussion regarding flood prone areas within the City.
Tommy Bond stated that he had heard t hat a map had been adopted setting
forth such areas, but no one present had seen copies of such a map. It
was the general feeling of the members present that Planning Commission
files should contain such studies and ordinances from the City and that
if such a map had been adopted, a copy should be sent to the Planning
Commission Secretary.
Public he aring was convened on the joining areas requested by Bill
Carpenter in the South Half of Section 24. Since the request was to
c hange approximately 25 acres from Industrial use to Co~nercial and
Re sidential use, t here was some concern on the part of the membe rs in
that they felt there would be a continuing need for more and ~ore
Indu strial property in the future and that the Industrial Park should
be contained for that exclusive purpose. Dr. Sidwell stated that even
though he was prejudiced because of his association with Transvaal and
that the greater encroachment of residential use, the greater the number
of complaints Transvaal had to constrantly deal with; that he personally waul
have to concede that the property in question wouid not render itself well
to Industrial use and the property o wner s h ould not b e denied _the right
and the opportunity to develop it for residential and commercial use.
Doug Wilkinson felt that one tier of lots reserved for Industrial use
would detract from the residential community and not be beneficial to
the Industrial part. It was his feeling therefore, that all that property
west of the desired R-3 classification should also be rezoned to R-3.
John Harrington stated t hat it was his opinion that de letion of the 25
acres in question from the Industrial Park would not material ly affect
industrial growth in Jacksonville, in that there wa s an ample number of
acres remaining for industrial development.
Daisy Olson stated that in the event the deve toper has def inite -
arran gements for the tier of lots to be used as industrial that the
Planning Commission should not change that area to residential and there by
deny the developer that ppportunity to use his property. Whereupon, she
moved that the request ~ as submitted b~recommended for approval. The
motion was seconded by Lewis Ederington. The vote thereon was four in
favor, two against .
Final Plat of Charles Repl at of the South 279.8 feet of Lot SA, To wn
of Jacksonvi±le, together with Bill of Assurance an d check in the amount
of $10.50 was submitted by Duane Ree l and Charles Van Nostrand. The
deve lopers assure d the members that all streets, sewer and water were

The Jacksonville Planning Commission held its regular meeting at
7:30PM on Tuesday, December 3, 1974, with the following members
in attendance: Cleo Cavender, Hugene Wooley, Doug Wilkinson,
Albert Sidwell and Daisy Olson. Other persons attending were
John Harrington and Charles Randall from Metroplan, Tommy Bond
and Athel Kennedy.
Minutes of the November meeting were approved as mailed.
A petition for rezoning Lots 35, 36 and 37 of Dupree's
East Jacksonville Addition (Known as Kennedy's Grocery) from
R-1 to C-2 was submitted. It was moved by Doug Wilkinson,
with second by Cleo Cavender, that the same be set for public
hearing on January 7, 1975 at 8PM. The motion carried.
A petition for rezoning 2.5 acres in Oakwood Subdivision (for
the purpose of enlarging the existing Oakwood Apartment Complex)
from R-1 to R-3 was submitted by Tommy Bond.-It was moved by
Hugene \'Jooley, with second by Doug Wilkinson, that the same be
set for public hearing on January 7, 1975 at 8PM. The motion
carried.
Mr. Randall from Metroplan stated that he had been working with
the Highway Departmentand is being apprised of their work on
the Master Street Plan.
Mr. Sidwell reminded the Commission members of the need for
further study of the Administrative Guide.

The Jacksonville Planning Commission held its regular meeting at
7:30PM on Tuesday, January 7, 1975, with the following members in
attendance: T. P. White, Chairman, Lewis Ederington, Cleo Cavender,
Hugene Wooley, Doug Wilkinson, Albert Sidwell, Daisy Olson, Don
Boshers, Gary Fletcher. Other persons attending were John
Harrington from Metroplan, Mayor James Reid, Morris Justice, Charles
VanNostrand, Tommy, Bond, Athel Kennedy, and Freddy Dodd.
Mr. White introduced the two new members, Gary Fletcher who replaced
Jim Peacock, whose term expires January 1, 1976 and Don Boshers who
replaced Johnny Wright, whose term would have expired January 1,
1977. Mr . White explained the rotation of offices and general
procedures of the Planning Commission and stated that materials
such as the subdivision regulations and the zoning code would be
made available to the new members.
