Since the Vice-Chairman was absent, Commissioner Betts addressed the membership and asked if there were no objections he would preside over the meeting that evening. There were no objections. He then called the meeting to order. Those members present on ROLL CALL were: Acting Chairman Betts, Comm: Howard, V!ilkenson, Morgan, Gray, ~1cAlister and Ray. PRESENT ON ROLL CALL: 7. Absent: 1. Quorum was declared. Others in attendance: T.R. Bond, Bond Consulting Engineers; Bill Owens, City Engineer; John New, City Inspector and City Attorney Paul Groce. RECOGNITATION OF NEW MEMBERS: Chairman Betts recognised the commissions two new members, Mr. Mack McAlister and Mr. Bart Gray, Jr. and welcomed them to the commission. The commission was in agreement to have the new City Clerk continue as secretary. · APPROVAL AND/OR CORRECTION OF MINUTES: Comm. Ray moved, seconded by Comm. ~1organ to approve minutes of December 8, 1980 as published. Approved by unanimous voice vote. ~10TION CARRIED. NOMINATIONS FOR CHAiru~N AND VICE-CHAirurnN/PLANNING COMMISSION: Comm. Howard moved, seconded by Comm. ~1organ to nominate Comm. Hugene Wooley for chairman of commission. Approved by unanimous voice vote. MOTION CARRIED. Comm. Wilkenson moved, seconded by Comm. Howard, to nominate Comm. Frank Betts as Vice-Chairman. Approved by unanimous voice vote. ~10TION CARRIED. DISCUSSION: PINE VALLEY ESTATES SUBDIVISION: City Engineer, Bill Owens addressed membership about Pine Valley Subdivision They stiul do not have streets and developer, now deceased, sold lots promising to put in streets and post a bond. He did neither. City Eng. Owens will bring a report back to commission at next meetinq. One resident, ~k. Paul Woodard ~>'lith his attorney, ~k. Ken Sugg, was present at meeting and stressed that residents need streets badly. DISCUSSION: REZONING FEES/POLICY CHANGE RECot1MENDED: Comm. \'lagnon moved, seconded by Comm. Morgan that on joint request we only charge the one filing fee and not charge each request a filing fee. The following voted aye, Comm: Gray, Wagnon, Wilkinson, Morgan, Howard and ~1cAlister. Comm. Ray voted nay. Motion received 6 affirmative votes, 1 negative vote. MOTION CARRIED. With consent of membership, Chairman Betts deveated in agenda to set up times for Public Hearings. AREA: FROM C-1 TO C-3: The public hearing was called to order by Chairman Betts at 8:00 P.t1. The following comments were heard from those in attendance: (1) Mr. C. E. Middleton, 3001 T.P. White Dr., opposed, felt it would lower property value. (2) Dr. James Durham, 2900 T.P. t~hite Dr., opposed, felt gradually h.wy. construction would run into residential property. (3) Col. Lou Riggle, 3412 T.P. White Dr., opposed, felt it would lower property value. (4) Mrs. Alice Riggle, 3412 T.P. White Dr., opposed any more low zoning on T.P. White Dr. felt it should be left residential. A petition with 63 signatures was presented to the commission opposing the rezoning. After much discussion, Comm. ~1organ moved, seconded by Comm. Howard to deny rezoning property. The following voted aye, Comm: Gray, ~·Jagnon, ~Jilkinson, Morgan, Ray and Howard. MOTION CARRIED. Rezoning was denied. PUBLIC HEARING: REZONING SO. HWY. 161 & SHANNON DR. AREA/1.19 ACRES: FROM C-3 TO R-2: The following comments were heard from those in attendance: (1) ~1r. Fred Boyd, 8017 So. Hwy, opposed because it was spot zoning. (2) ~1r. Bill Hubanks, 10,000 So. Hwy., opposed, felt it should be left C-3. Ron t1ayton, owner of said property, addressed membership and stated he did not want to offend any one by rezoning property, but would like ,< . ~-~"") •' ij/ ~~ it rezoned to place duplexes on it. He stated he felt it would not lower other residents property value because they were going to be nice houses. Comm. ~!ilkinson moved, seconded by Comm. r1cAlister to approve rezoning of So. Hwy. & Shannon Dr. Area from C-3 to C-2. The follo~,;Jing voted aye, Comm: Gray, Wagnon, Wilkinson, Howard and McAlister. Comm: Morgan voted nay. Comm. HOt-lARD, JR.: Commission instructed City Attorney Groce to look into new ordinance Little Rock has concerning removal of portable signs and report back to commission at next meeting. He would bring it to commission for final plat at next meeting. DISCUSSION: NON-RESIDENTIAL SUBDIVISION REGULATION DRAFT: CITY ENG. OWENS: Non-residential subdivision regulation draft was handed out to each member for their review . Mr. Charles Randall, of Metroplan, addressed the commission concerning a Planning Seminar for Planning Commission members, City Courcil members and any city officials that would like to attend. f1r. ~!illiam Bonner v-1ill be conducting meeting on Zoning and Setback Requirements. The meeting will be held January 28, 1981, at ~1etroplan in Little Rock. Time will be from 9:00 l.\.M., until 4:30 P.t1. ~1s. Barbara Coggins had received a preliminary sketch of North Lvood Acres. She requested she be informed of when Commission would discuss this area. City Eng. Owens stated he would inform Ms. Coggins since he lived in same area. DISCUSSION: PINE VALLEY ESTATES: (BILL OWENS) City Engineer Bill Owens addressed Commission about Pine Valley Estates Subdivision. He referred to the letter addressed to Commission concerning same. Developer has not asked for final on phase I of subdivision, and has not obtained bond for phase II. Now developer has died and the development has gone to his partners and heirs. They are now trying to get together to sign a partner~ ship. Mr. Ken Suggs, Attorney for one of the property owners, addressed the Commission and asked that they have the developer pave their street. The Commission replied they have no authority to do so. DISCUSSION: CONDOMINIUM DEVELOPMENT/STONEWALL SUBDIVISlON; T.R. Bond of Bond Engineers stated to membership that only change in agreement was that they would take over maintenance and up keep of outside building and grounds. Parking of owner had been restricted to rear parking with a one (l) way street going around condonimium at rear of buildings. Four driveways were going onto Martin Street, two entrances and two exits. Comm. Betts opposed four driveways onto Martin Street because he felt it would be a traffic hazard. Howard moved to deny request for rezoning because of traffic congestion. Motion died for lack of second. Mr. Earl Smith; Earl Smith Realty; 1204 John Harden Drive, stated he wanted to place a real estate office on property. There was no one else from audience that commented on request for rezoning. Comm. Ray moved, seconded by Comm. Gray to grant request to rezone property from R-0 to C-1. ROLL CALL and the following voted aye, Commissioners: Wagnon, Betts, Mor.gan, Gray, McAlister and Ray. Commissioner Howard voted nay. Motion received 7 affirmative votes, l negative vote. MOTION CARRIED. PUBLIC HEARING: NORTHEASTERN AVE/OFF GRAHAM ROAD 30.55 ACRES MORE OR LESS: BELLEVUE SUBDIVISION: FROM R-lA to R-3: Chairman Wooley introduced a letter he had received from T.R. Bond stating that in the submittal they had inadvertently referred to the fact the property had been considered for Housing Authority complex. The letter was to correct the record, the property is nob being considered by the Housing Authority and the request is based on the owner's preference to construct multi-family housing. Comm. Wagnon moved, seconded by Comm. Morgan to grant rezoning. Approved by unanimous voice vote. MOTION CARRIED. PUBLIC HEARING: JOINT REQUEST: ALL REQUEST TO BE REZONED FROM R-1 TO C-2 CLASSIFICATION: Mr. Ben Rice addressed membership to discuss rezoning. He stated all lots, but four, surrounding property is already zoned C-2. At sometime in the future, Hwy. 161 is planned to be a four lane . . (~'d) Mr.H ~rl~~ Jackson; 204 Brewer Street; opposed rezoning property. He felt it should be left as it is, residential. He presented the Commission with a petition with approximately 40 signatures. The signatures were taken about one (l) year ago when owner tried to have property rezoned. After commission voted on rezoning, Mr. Jackson took petition back. Comm. Ray moved, seconded by Comm. Wagnon to grant rezoning from R-1 to C-2. ROLL CALL and the following voted aye, Commissioner: Morgan, Gray, McAlister, Ray and Wagnon. Commissioner: Howard and Betts voted nay. Motion rec~ived 5 affirmative votes, 2 negative votes. MOTION CARRIED. DISCUSSION: UPDATE ON REGULATIONS FOR REMOVAL OF PORTABLE SIGNS: City Atty. Groce addressed membership on removal of portable signs. He checked with Little Rock on their portable sign ordinance, and they were having a difficult time with removal of same. He stated it would be very difficult to get rid of them altogether. Comm. Howard opposed portable signs and said he would like for us to do away with them completely if possible. City Atty. Groce stated we could, however, treat them as permnant signs and use present ordinance for regulating signs. NON-AGENDA ITEM: NORTH WOOD HEIGHTS: City Atty. Groce asked to address the Commission on a matter of North Wood Heights, which is in our five (5) mile jursidiction. He stated he had just found out that the developer was selling illegial lots. We are lacking in our enforcement of our jursidiction because we are under staffed and have a rough time of policing our area. He pleaded that we should try to watch as closly as we can, our five mile jursidiction, because one day we will have these subdivisions and if they are not completed correctly now, we will have to take on the financial burden of correcting them when we do take them into the city. APPROVAL AND/OR CORRECTION OF MINUTES: The minutes are to reflect at the February 9, 1981, regular meeting, Bond Engineers are going to come back to membership for further discussion on Condominum Development in Stonewall Subdivision, with two driveways instead of four. The minutes of February 9, 1981, regular meeting, reflect discussion of portable signs as unresolved. Comm. Betts will get together with Comm. Howard and come back to membership at the ne x t regula r meeting concerning the use of e x isting sign ordinance to cover portable signs. Comm. Betts moved, seconded by Comm. Morgan that the minutes of February 9, 1981, be approved as published and corrected. Approved by unanimous voice vote. MOTION CARRIED. DISCUSSION: NON-RESIDENTIAL ORDINANCES: (City Eng. Owens) City Eng. Bill Owens acidressed commission, and asked if anyone had any questions concerning the regulations for non-residential subdivisions. The regulations do require a buffer strip and a fence between residential and non-residential property. Chairman Wooley raised a question concerning buildin g lines and lot coverage, listed under Industrial, there are si x (6) blanks that were not filled in, and he was concerned about compliance with the ordinance. (See attachment) Mr. Owens stated they complied with the ordinance already. He would fill the blanks in when the final draft was completed. Mr. Owens stated he saw no problems with the regulations but would like to bring them back to the next regular meeting for discussion when, hopefully , all members of the commission would be present. Bill Owens addressed membership concerninq anne xation into the city. There is an annexation plan in the works, to take in appro x imately 2 1/2 miles of the Dick Jeter, Wooten Road, Valentine Road area, and his concern was that the Planning Commission would not have anything to say about the matter. (County Judge shall have a public hearing on the petition. Time for the hearing will be 30 days after petition is filed and published in a newspaper. If the court grants the anne x ation, the County Clerk will record all paperwork. After 30 days have passed and nothing has been filed against anne x ation, it shall go to the City Council in ordinance or resolution form accepting the anne x ated territory). 0AL~)UNVlLLt ~LANNlN~ LUMMl))lUN MARCH 9, 1981 PAGE TWO He went on to say, the streets are not dedicated and are in bad shape, there is a problem with beavers, there is a drainage problem and they are in the flood plain. Also, there is no sewer in the area. If the city takes the area in, it will cost approx. $60,000 to pave the existing streets and approx. $40,000 for the drainage and we still have not dedicated the streets. We will also need instructions on how to issue building permits in the area, and how to police building in the area. They cannot build to city standards. If a subdivision is not recorded, or streets are not dedicated, unplatted lots or lots in the flood plain are not issued building permits. City Eng. Owens has slides of the area in his office if any of the members of the commission would like to come by and look at them. A question was raised of how fast it would possibly be annexated and if a special meeting should be called concerning the area. It was learned it would take appro x . 60 days to annex the property. No special meeting would need to be called for said property. Membership decided to postpone further discussion until next regular meeting so each member could drive out to the area in question to see it for themselves. City Eng. Owens stated the streets were in bad condition because water had stood on them for about two years and we would have to do something to make them hold up. Mr. Paul Woodard, resident of Pine Valley and his Attorney, Mr. Ken Suggs, were present and stated there still had not been anything done about the streets. Steps had been taken in court with Cooper Cooperation, developers, to hasten improvements but none have been made , Mr. Suggs said he found where Pine Valley Estates had been filed with the Circuit Court Clerk in the plat book. It designates dedi·cated streets but he did not ftnd that they were accepted just filed. A bond for the streets in Phase II sti'll has not been posted. It was decided that Ctty Eng . Owens and Secretary Waltman would contact Cooper Cooperation and request someone from their cooperation appear at the next regular meeting to give the commtsston some idea of what they plan to do . Owens comments, we ask the representative of Northlake property owners to give their point of view, then the floor will be open to anyone that would like to offer comments or ask any questions. City Eng . Owens stated he attended a meeting of the property owners Saturday afternoon at 1:00 P.M. Something was said at that meeting that needs to be clarified. Some thought if this property is rezoned R-5 that Rp4, R-3 or R-2 zoning uses could go into this property . That is not true . R~5 zoning, in my interpertation, ts single family zero lot line housing. This property was rezoned from RPO to C~2 in 1~77 with no opposition, and 1s up to go from C-2 to R-5. I didn•t think it would be a problem to go from commercial to residential. This will give the property owners about three (3) weeks to decided if they want the rezoning or not. There has been a request for apartments or multi-family buildings and they can be built while it is zoned C-2 as long as they comply with building codes. Chrm. Wooley read the permitted uses of R-5 zoning from the Code Book. Permitted uses in R-5 district are: attached singly family units and any use permitted in R-0 and R-1 districts. Mr. Richard Scharf, 121 Ricky Raccoon Drive; was spokesman for the property owners. He stated the home owners wanted to know what the builder intended to build. There were a lot of rumors circulating. The rezoning had caught everyone by surprise. The way they found out it was being rezoned was by the signs posted on the property. He asked that Mr. Jack Wilson, builder, present his side of the case and tell the people exactly what he intends to do with the property. Other comments from the audience: Mr. Woody Bohannan, 211 Turkey Trot Court, asked Chrm . Wooley to go over permitted uses in C-1 and C-2 zoning because he was not familar with building codes. Chrm. Wooley read from the code book the permitted uses in C-1 and C-2 zoning. Then he read the R-5 permitted uses again. Ms. Adrian Brietzke, 6697 Northlake Drive, asked if the area now zoned C-2 would allow for apartments over apartments and if R-5 zoning would allow apartments over apartments. City Eng. Owens said no, R-5 w~s zoning for townhouses. The zoning now, C-2, would allow for ·condominiums and townhouses. Mr. Jack Wilson, builder, addressed commission and said he would be glad to answer any questions anyone had. He proceeded to tell the property owners what he planned to do with the property. He planned to have 26 units with 2 to 2 ~ baths each with approximately 1280 sq. ft., built on an old world concept . They would be a seperate sub- division from Northlake Subdivision. The name of this subdivision would be Timber Ridge. They would be townhouses. Several residents started discussion about a privacy fence between the townhouses and the back of their lots. Mr. Wilson stated he would put a privacy fence up. Unidentified resident; asked about parking for the owners of the town- houses. Mr. Wilson said there would be off street slabs for parking in front of each unit. All traffic would be internal. Mr. Scharf asked Chrm. He could put the fence in before the units were marketed. Mr. Duel requested the fence be not 1 ess than 6' high and in some places 8' high. DISCUSSION: ANNEXATION OF VALENTINE, DICK JETER, WOOTEN ROAD AREA: Comm. Betts thanked City Eng. Owens for the preliminary draft report on above referenced annexation. It gave him all the information he needed. City Eng. Owens stated at the time of annexation there needs to be down in an ordinance that when the city annexas property with problem~ that may or may not be insurmountable, they are their problems. I am concerned with the streets and roads being in bad shape, the asphalt is in bad shape and the drainage problems. The farmers stop up Ink Bayou in the spring to care for crops so it is not all beaver problems. In 1971, the Corps of Engineers said all the area is in the 100 year flood plane. Our ~odes states building permits cannot be issued if the property is in the flood plane . I feel this should be placed under long consideration. -Comm. Ray stated the property owners side of the annexation . He said thi·s nei-ghborhood was settled i'n 1880, it is 91 years old. It established an improvement district eleven (11) years ago for water and gas service. The people that live in this area are all on fixed income, but live c1ose to Jacksonville and want to collie into the city. We do not want to annex the farm land just the residential property down Valentine Road . He said he knew the problems the people had but supports the annexation .of the property. He said we could apply for federal funds to help these people fix up their houses. Sunnyside Hills has a grant for three (3) years to help with their problems and with federal funds we can do the same for these people. Six out of the seven y<ears Mayor Reid has been in office we have applied for federal funds and received them. He also said there is legislation up now to allow improvement districts that set aside money for improvements to be paid back. Chrm. Wooley asked City Attorney, Paul Groce if there were any utilities the city would have to furnish immediately if they were annexaed. City Attorney Groce stated Police and Fire protection would be the only thing to furnish immediately. He would need to look more detail at the other utilities. Comm. Ray moved, seconded by Comm. Wagnon to recommend to the City Council to annex the Valentine Road area after they have gone through the proper procedures. Mr. Ken Suggs, attorney for one of the property owners in Pine Valley Estates, asked the commission to question the developers on a time table for completion of phase I and phase II. White: 1600 Johnson Street: stood as spokesman for the neighborhood, He stated he hoped the commissioners had read the letter attached to the petition. The people in the neighborhood had nice homes and had the bulk of their finance tied up in them . They are asking the zoning to remain residential . The total amount of property Mr. Johnson, developer, asked to be left for commercial was granted when the subdivision was first developed. We ask that the commission deny request for rezoning. Comm. Wagnon asked what the property owner proposed to do with the property. T.R. Bond, Bond Consulting Engineers representing owner, stated the owner planned to use this as additional parking area for cars that come in for the auto auction. He is intending to clean, fence and gravel the area. Comm . Betts commented he did not think this was just a one night a week event. People are bringing cars in on Monday and taking them out on Thursdays. There are cars there all the time. James Morton: 1501 Dogwood: asked what kind of fence the owner intended to put up and how high . Mr. Johnson, owner, sat<!! he was thinking about a chain link fence for the entire area. Parking would be along the fence. The entrance or exit would not be changed, it would remain on John Harden Drive. Comm. Betts asked the City Engineer if James Street, John Harden and T.P. White intersection was a high accident intersection. City Eng. Owens said there was a lot of traffic in that area, and the more volume traffic you have the more accidents you have. That intersection is in the top five (5) high accident intersections each year . Then Comm. Betts asked for the City Engineer 1 s opinion of the rezoning. The City Engineer replied during the past years, the commission had allowed commercial zoning to go one lot deep all along John Harden Drive. If this is rezoned commercial, it will cause a big jag in the residential area because commercial is already one lot deep now . Jesse Gullett: 1521 Dogwood: asked what would happen to the property when the auto auction is passed from the scene? He agreed the auction is not just a one night a week event. The area is very congested now, and he request we deny the rrezonir.Jg. Muriel Liles: 1305 N. James: her lot joins this property and she ts opposed because of additional traffic and parking . T.P . White: felt -there wo uld be no way to keep the people from using Johnson Street as an exit even though the entrance or exit would not be changed. He went on to say, when Mr. Johnson developed the subdivision it was promoted as better than average residential and is requesting it stay that way. Guy Johnson, owner, assured the people the flow of traffic would not be on Johnson Street, that the entrance and exit would remain the same. Comm. Howard stated there was a lot of traffic on James Street now. It is hard to go up or down the street with parking on both sides of the street. There is 38' right-of- way, full width pavenent, the lots are 45 '· wide and 115 'deep and they have canplete city utilities. The park has 165 spaces and covers approximately 20 acres. City Engineer, Bill OWens said he would like to address that matter. He had been asked how he felt about the drainage. City Engineer OWens and Street Superintendent Bob Martin went to Country Estates after the large rains we have had to check on the drainage. We would require 1 1/2" hot mix over the existing streets and sane extra work on the third and fifth street. My analysis on the drainage is there is no signi,ficant drainage problem, sane minor problEm but nothing major. Mr. Fielder said the original plans of the park, stated there is a 15 1 set back, but all of the lots do not have the 15 1 set back. Chnn. Wooley said he would like to see the consistent 15 1 set back and asked the owner if he could rrove the mobile hanes that are not in conformance with the set back into conformance. Mr. <:gden said he would, if he could bring the park in in phases. The commission agreed to work with him on this. Carrm. Betts asked if they planned sanething that would be attractive, an:::l how were they going to control parking. Mr. Cgden said they felt the people that own their own lot tend to take pride in it and larrlscape and care for it. The people that rent tend not to do anything to make the lot better or fix it up. All spaces have paved parking, also this will be in the bill of assurance if this is approved as a subdivision. City Eng. Bill OWens said we did not have mobil horne residential developnent type regulations, this is an experiment. Chnn. Wooley said to request mobil hane lots in a subdivision, the mobil horne park would cease to exist and would require the zoning be changed to take it fran a park to a subdivision. He continued, since this park already exist, and they are wanting to change it fran rental to owner I request the carmission give them time and work with them on this and it in turn will help us to work up the requirements we need in this area. He feels this will be desirable and will upgrade the park. Consensus of the ccmnission is to wor~ with the owners in getting this park into a subdivision. IDN-AGENDA: Cornm. Ray stated he attended the Planning Conference June 4 -6, at the carnolet Inn and enjoyed it. The conference was geared more to professional planners. After talking with others in attendance, he felt Jacksonville is doing a fine job. Texarkana, Arkansas, was the only city that was ahead of other cities in planning. The conference brought out how Municipalities, Planning Commissions, City Engineers and Developers set dc:wn and work together to map out plans. REQUEST APPROVAL OF FINAL PIAT/FAS'IVIEW ADDITION/PHASE VI-A: Mr. Duane Reel representing owner, Mr. Torrmy Dupree, stated owner is requesting the camnission approve the final plat of Eastview and accept a bond in lieu of the street canpletion until the residential construction is f lli rilished. Mr. Dupree will post a bond in the amount of $13,500. to guarantee the streets will be finished. City Engineer, Bill ONens stated he would like to see the bond in a larger amount of $15,00. or $16,000. to cover the cost of the streets. Corrm. Betts brought out the camnission had worked with Mr. Dupree and Bond Engineers on Northlake Subdivision on a similar situation. Northlake is suffering several deficiencies and they have not been fixed. Bill Owens stated there were deficiencies in the sewer and v..ater lines, stonn drainage and the streets. The company assured him the deficiencies would be fixed in 90 days and it has been some 240 days and they are still not fixed. Ccmn. Betts then said perhaps the engineering finn did rot know of the deficiencies. This is getting out of control and was getting ·''' embarrassing. City Engineer ONens has written a letter to City Insp. New ii'1structj_ng him not to issue any building pennits in Northlake, Phase III until the work is canpleted to the city•s satisfaction. MEmbership then discussed the possibility of Mr. Dupree post;ing a large enough. .. =~)JQnd to cover the deficiencies in Northlake and the streets in Eastview~ Chrm. Wcoley said he did not think we could tie the Northlake subdivision in with Eastview. We should consider this (EastviEW} subdivision. The commission was also concerned with what happens when the warranty on the streets is up arrl the deficiencies are not fixed. City Eng. ONens said if a letter is written before the warranty is up concerning the deficiencies and kept on file, then this letter would extend the warranty and the developer would be bound to fix the deficiencies. Discussion then ensued on : .the zoning of the property. Ccrnm. Gray was not sure the property was zoned properly for the duplexes that were planned to be placed on property. Mr. Dupree had planned to build 13 duplexes on 13 lots. To comply with the ·!Zoning of the property _ (R~5) he would need 26 lots. Camn. Gray suggested he either change the zrning or divide the lots before the final plat approval. After more discussion concerning the zoning, Mr. Dupree withdrew his request for the final approval of Eastview. The set- back is now 35', but the owner is requesting a waiver of 25' setback so he can build a house on the lot. The property is zoned camnercial in that area, and City Eng. ONens said he does not see any problan if the mEmbership grants the waiver. PINE VAlLEY ESTATES SUBDIVISION: Mr. Joe Jones of Cooper Corporation, stated that no one in the corporation had been able to bond. He is now requesting to put the lots back on the market, and set up an escrow account and place $1, 000. per lot into the account in order to fix the streets. Mr. Paul Woodard, resident of Pine Valley Estates, stated he was against this i'1ew proposal. He would like the corporation held to the original agreanent of posting a bond then starting the streets. He has not discussed this new proposal with his attorney because he has been unable to reach him. Mr. Marlin Howell, resident of Pine Valley Estates, thought a bond issue might guarantee the money for the streets. He felt the escrow account was not a guarantee because if there was a depression in the money market you could not sell the lots. City Eng. ONens stated Mr. Jones had done what was asked of him except post a bond but he has tried to do this but has been unable to. He felt assured Mr. Jones was trying .to do what had been asked of him . Mr. Woodard asked that this item be held in abeyance until he could discuss this proposal with his attorney. We have agreed to put more asphalt on the road so the county will accept it. City Engineer Owens continued, I have talked with Mr. Wallace Wyeth of Pulaski County Planning Board and we are in agreement in phase I. The county will accept the road in phase I and will accept the subdivision if City of Jackson- ville will accept the subdivison. We ask that the commission agree to the same proposal for phase III, should he build in phase II, that was agreed to for phase I. That is to hold in an escrow account $1,000. per lot for the construction of streets. At the present time, because of the economy situation, the money will not completely build the streets, but the money will be used for streets. Pulaski County feels responsibility toward the people that liVJe in the sub- division because they turned it over to Jacksonville Planning Commission during a transition period. Wallace Wyeth of County Planning, County Judge William 11 Bill 11 Beaumont, County Engineer and Jacksonville City Engineer Bill Owens are going to meet next week to work together on getting the streets for Pine Valley Estates. The mEmbers of the conmission that have been on the board for some time are familiar with the plan, but the newer rrembers are not as familiar with it. As a result of this Corrrnissioner Gray initiatErl that Mr. Randal speak to us. This is a good time also to look at the future developnent of the South Jacksonville area. In the last year we have had several meetings concernErl with a rezoning request of a parcel of property in that area. The commission as a whole needs to look at this area and see if we want this corrmercial development, Mr. Randal is with Metroplan and has been a big help in the developnent plan and transportation plan for Jacksonville. We have worked closely with Metroplan for the past 6 - 8 years, and Mr. Ramal has been our prime connection. He then turned the meeting over to Mr. Randal. Mr. Randal stated he had gathered a few remarks together basErl on the imp::lrtance of having a Comprehensive Development Plan. I have worked with the commission extensively with the developnent you have in Jacksonville, and the plan you have is a good one. The con:rrnission needs vision on how to have the city look in the future. This you try to do with a plan. It is important to have a plan to set out policys arrl set maps. The Planning Corrmission arrl City Council has to rrake decisision on land usage and it is better if you have a plan to go by, to refer to arrl use once it has been adopted by the city. A plan should be defined enough so you can use it as a basis for decision making. You have to have a plan before you implement procedures. If you have a zoning ordinance, you have to have a plan. Think where your service areas are and will be in the future, the private sectors, builders, investors, etc. so it will cane into a unified city in the future. Having streets laid out in the function of major arterial and minor streets is important in marketing analysis for business. In the 1920's the State Enabling Act gave cities of the first and second class the authority to plan and regulate land use with three classes of zoning -residential, manufacturing and business. Permitted use generally allowed you to put schools and parks in any zone. But in the 1970's the National Environmental Act began to change minds as to what a plan should shew. Location and character of the property arrl timing came into thought. They wc:uld need to establish sewer and water lines, a Police Department and Fire Department in outlying areas. A number of states began to recognise cities need a plan to develope by based on needs. An important principal often over looked is the importance of the Planning Cornmiss,... ion itself. They are advisary to the City Council. The City Council passes the ordinances, but the PlanniiB Commission has the public hearings, and hears what the people have to say before it goes to the council. PAGE 'IWO Mr. Randal then explained there are three (3) parts to the Comprehensive Developnent Plan. They are the land Use Plan, Camu..mity Facilities Plan and the Master Street Plan. The land Use Plan is intended as a guide for Jacksonville ,-'----- in the future, how arrl where to arrange land use and roadways. Canmuni ty Facilities is a need and buildings should be placed in and around the city. (public buildings, library, utili ties, etc.) The Master Street Plan is to be used as a guide to develope a roadway system to accommodate the growth of the city. This Comprehensive Development Plan is developed to grow with the city until the year 1995. A question and answer period followed with much more discussion. Chrrn. ORDINA.N:E NO. 32-81: AI.J.DWTI:--TG DAY CARE FAMILY HCMES IN R-0, R-1 AND R-2 DISTRICTS WITHIN THE CITY LIMITS OF JACKSCNVILLE: City Engineer ONens stated he had been approached by Ms. Retha TUrpin of the IB.y Care Family Homes and asked if the city allowed these homes inside the city limits of Jacksonville. When he told her no, she asked him to look into allowing them as there were several request in their office to have these homes in Jacksonville. The state cannot license these hanes until they have a business license fran the city. The problem is to have saneone to regulate this to some extent. The city has only one inspector arrl cannot check all the hanes in town. Havever, the state could regulate these hanes to make sure the children are taken care of properly arrl are not being abused. That is why the requirement that the city have a copy of the current license fran the state on an annual basis. During discussion, it was brought out that Day Care Family Homes will allow up to ten (10) children in a residential area. If there are more than ten (10) children it would be classified as a Day Care Center. Mrs. Virginia Reid, of Day Care Family Homes, stated her office would require ~a maximum of ten (10) children, a mtside play area, two (2) adults to supervise the children and depending on the location of streets, a fenced yard. They look at the safety of the children care- fully. She further said that people that keep under six (6) children \vould not require a license. The corrmission then discussed the rights of the adjacent proper<by owners. City Eng. <:Wens stated that was the reason he added . the petitio!}; to be filed with the Code Enforcement Officer of all adjacent residences stating they have no objections to this Day Care Family Horne being next door,~ to the Ordinance. These petitions wmld be filed with this office annually. The comnission then asked if one adjacent prop- erty avner objected, what would be done. City Eng. CWens replied, the city license would not be issued. Camn. Gray felt a disclaimer statement should be added to protect the property owners rights. City Attorney Paul Groce told the carmission this was just one solution, but was not a cure-all. Cann. Betts moved, seconded by Canm.
