OPENING REMARKS: ATTENDANCE:
Mayor Reid opened the meeting and administered the Oath of Office to the
members of the Planning Commission and stated that they should sign said
oaths at adjournment.
ROLL CALL: Commissioners: Howard, Hugh~s, Snethern, White, Gray, McAlister,
Friedman and Davis answered ROLL CALL . Commissioner Gwatney was not present
for the meeting. Mayor Reid declared a quorum.
SELECTION OF PLANNING COMMISSION CHAIRMAN -VICE CHAIRMAN
Commissioner Friedman nominated Bart Gray Jr., as Chairman.

Hughes that nominations cease and Bart Gray Jr., be elected
A unanimous voice vote was taken, MOTION CARRIED.

Chairman Gray received the appointment asking for the support of the
Commissioners .
Commissioner White nominated Lloyd Friedman as Vice-Chairman of the Planning
Commission . There were no other nominations. Commissioner Snethern moved,
seconded by Commissioner Davis that Lloyd Friedman be elected by acclamation
as Vice Chairman of the Planning Commission. A unanimous voice vote was
taken, MOTION CARRIED.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Friedman moved, seconded by Commissioner ~kAlister that the
minutes of the December 13, 1982 meeting .be approved upon the correction
of a typographical error on page two regarding Ordinance 61 8 . A unanimous
voice vote was taken, MOTION CARRIED.
UPDATE-DRIVEWAYS ON DUPREE PROPERTY
City Engineer Bill Owens updated the Commission with regard to driveways on
Dupree property behind the old Dodge place on Highway 161. He said that
a permit was issued in 1978 for the l:lriveways . He noted that the pipes had
been in place for the driveways for three or four years adding that there
were two driveways.
ANNEXATION -LOOP ROAD ACRES
Chairman Gray recognized Jim Peacock who stated that he preferred that
Loop Rd., Acres be brought into the city in two phases; Phase 1 consisting
of lots one (1) thru twelve (12) and Phase 11 consisting of lots thi r teen
(13) thru nineteen (19).
He stated that the Final Plat had not been recorded and that the subdivision
had not been accepted as such by the county.
Mr. Peacock stated that his request was for anne xation into the City of
Jacksonville with approval on the plat as stated in two phases.
City Engineer Owens updated the Commission concerning the subdivision
stating that it met all city requirements and added that the reason
for holding t me item in abeyance since the December meeting was due to

questions regarding zoning when annexed into the city as R-4 or R-0.
He suggested that the subdivision be annexed in as R-0 and then a public ~
hearing be set up for rezoning.
It was noted that there had been previous approval of a Final Plat of
Loop Rd., Acres by the Commission on November 8, 1982.
Commissioner White moved, seconded by Commissioner Snethern to recommend
to the City Council that Loop Rd., Acres be annexed into the City of
Jacksonville zoned R-0 and that the former action concerning acceptance of
the Final Plat be ammended accepting the Subdivision as presented in two
phases, namely Phase 1 consisting of lots one (1) thru twelve (12) and
Phase 11 consisting of lots thirteen (13) thru nineteen (19). A unanimous
voice vote was taken. MOTION CARRIED.
REQUEST APPROVAL OF FINAL PLAT -NORTH RIDGE SUBDIVISION
City Engineer Owens stated that the subdivision is outside the city but in
the j8~tsdiction of the city. He said that it had been developed according
to county specificationS.i;-:He ~uggested r that the Final Plat be accepted
subject to County approval and acceptance of road maintainance. He said
that the subdivision had been in the making for approximately two years and
is located in the area of Hatcher Rd.
Commissioner White moved, seconded by Commissioner Friedman to approve the
Final Plat subject to the acceptance of the County to maintain the roads.
A unanimous voice vote was taken. MOTION CARRIED.
It was noted that no City Council action was required with regard to the
i tern.
REQUEST REVIEW AND APPROVAL OF FINAL PLAT -WOODLAND HILLS SUBDIVISION
City Engineer Owens stated that several years earlier preliminary plans for
the whole subdivision had been presented to the Commission and that they
were approved and that Phase 1 had been completed. He said that the
request at hand is to continue with Phase 11 as submitted.
Commissioner Snethern moved, seconded by Commissioner Hughes to re-approve
the Preliminary Plat containing twenty-five (25) lots of Woodland Hills
Subdivision as submitted in 1978 with no changes. By a unanimous voice
vote, the MOTION CARRIED.
NON-AGENDA ITEM -PLAQUE FOR COMMISSIONER WILKINSON
Commissioner White moved, seconded by Commissioner Howard to prepare a
plaque for Commissioner Wilkinson whose term expired 1/1/83. By a unanimous
voi t e vote, the MOTION CARRIED.
NON-AGENDA ITEM -APPOINTMENT OF CHAIRMAN TO THE BOARD OF ADJUSTMENT
Commissioner McAlister nominated Commissioner Lloyd Friedman as chairman of
the Board of Adjustment. Commissioner Hughes moved, seconded by Commissioner
Davis that Commissioner Friedman be appointed by acclamation as Chairman of
the Board of Adjustment. By a unanimous voice vote, the MOTION CARRIED.

City Council Agenda Item: 6-17-82 Alderman Smith ,moved, seconded by
Alderman Fletcher to pay Mr. & Mrs. Francis Brown $1,500.00 to cover
the expenses incurred in setting up the mobile home at 214 Military
Road. By a unanimous voice vote, the MOTION CARRIED.
City Council Agenda Item: 7-15-82 Alderman Williamson moved, seconded
by Alderman Brooks to ask the Francis Browns' to move the mobile
home within two weeks from this date or forfeit the $1,500.00 offer by
the City for expenses incurred. ROLL CALL: Aldermen: Smith, Brooks,
Durham, Fletcher, Abdin and Williamson voted AYE. Aldermen: Knight,
Francis and Wilson voted NAY. MOTION CARRIED.
There was a general consensus that if the parties involved in the law-
suit could come to an agreement that could meet the approval of the
City -Engineer and the City Attorney that a building permit should be
issued.
Alderman Knight moved, seconded by Alderman Durham to deny the build-
ing permit until all agreements are put in writing and delivered to
the City Engineer and Mayor Reid.
Planning Commission Agenda Item: 10-12-82 City Engineer Bill Owens
stated that the City Council had given permission to issue a building
permit to Mr. & Mrs. Francis Brown if the two parties in the lawsuit
could reach an agreement concerning modification of the mobile home.
Commissioner Gray posed the question of assurance that the agreements
by the parties involved in the lawsuit would be carried out.
City Engineer Owens said that the building permit itself would state
the things agreed upon by the parties. He noted the certificate of
occupancy mentioned in the Municipal Code used in the process and also
stated that the last control the city has concerns the hook-up from
Arkansas Power & Light Company which is called in from the City Hall
after the final inspection.

Chairman Gray o~ened the meeting and recognized the City Clerk for ROLL CALL:
Commissioners : Gwatney , Rughes, White, Gray, Friedman and Davis were
present . Commissioners: Howard, Snethern, McAlister were absent. Total
present six (6} total absent three (3).
Chairman Gray declared a quorum. Others in attendance were City Attorney
Keith Vaughan, City Engineer Bill Owens, Alderman Emma Knight, Alderman
Gary Fletcher, Code Enforcement Officer John New, Tommy Bond of Bond
Engineering, Tommy Dupree, other interested citizens and members of the
press.
APPROVAL AND/OR CORRECTION OF MINUTES:

minutes of the January 10, 1983 Regular Planning Commission Meeting. By
a unanimous voice vote, the MOTION CARRIED.
ANNUAL REPORT:
Commisstoner Hughes moved, seconded by Commissioner Friedman to approve
the annual report as presented . By a unanimous voice vote, the MOTION
CARRIED.
INFORMATION REQUESTED/1982 EXPENDITURES-1983 BUDGET
Chairman Gray presented the information as prepared by the secretary to
the Commission.
REQUEST TO SET UP A PUBLIC HEARING FOR THE REZONING OF LOOP RD., ACRES
(from R-0 to R-5} Petitioner: Jim Peacock
It was pointed out by Chairman Gray that upon annexation to the city
recently, the zoning request was tentatively thought to be R-4.( I ~hibit A)
Mr . Jim Peacock stated that tile change was doe to the fact that he had
decided to build houses rather than put mobile homes on it.
The City Engineer said there would be no need for waivers with regard to
the zero lot line noosing which would probably be better.
Commissioner White moved, seconded by Commissioner Gwatney to set up a
Public Hearing for the rezoning of Loop Road Acres from R-0 to R-5 at
the next regular session of the Planning Commission. By a unanimous
voice vote, the MOTION CARRIED.
DISCUSSION/FOXWOOD encroachment on floodway {_City Engineer Bill Owens)
City Engineer Owens made reference to Ordinance 447 passed in 1977 which
gives the city jorisdiction over the floodway area. He explained that
when there is a difference between himself as representative of the city
and a citizen that the Planning Commission is set up as an arbitrator
between the two parties .
He stated that he had written a 1 etter dated October 26, 1982 to Foxwood
Country Club witli regard to the floodway problem . He said that a 24"
drainage pipe has been used in a drainage ditch which according to his
evaluations needs to be a larger pipe since three (3) fourty-eight (48)11
pipes are going into it. He added that he got no response to the letter
from the Country Club.

The City Engineer said he had thought he would write a registered
letter asking for removal of the 24" pipe and the installation of a larger one.
Commissioner Wh i te stated that the correct address at present is the
Jacksonville Country Club, 701 Foxwood Dr., Jacksonville Arkansas 72076.
Chairman Gray asked that the Engineer continue as above stated. The
Commission gave no negative response to the action proposed by the Engineer .
DISCUSSION/STONEWALL -R-5 zoning (Possible request for Public Hearing)
(Opinion/City Attorney Keith Vaughan)
Chairman Gray stated that he had received a letter from Savers stating that
they have decided not to seek any rezoning action on the Stonewall Property
at this time.
The item was removed from considerations at this point.
SELECTION OF TWO (2) COMMISSIONERS to work With the Council in the study of
properties adjoining the city with regard to possible anne xation.
SELECTION OF COMMITTEE to study present zoning Ordinance (Chairman Gray)
Chairman Gray combined the two items nih~ (9) and twelve (12). He asked
that T.P. White, Bill Howard and Russell Gwatney serve on the committee
as representatives from the Planning Commission. He encouraged the other
members of the Commission to attend the committee meetings if possible.
Mr . Charles Randall of Metroplan requested that he be notified of the committee
meetings.
DISCUSSION -Time element involved in setting up a public hearing (Chairman
Gray
Chairman Gray stated that the City Attorney had researched the posting and pub-
lication with regard to public hearings and that the requirement for both
is fifteen (15) days.
REPORT/MOBILE-MODULAR HOME COMMITTEE (Minutes/meeting of Jan. 31, 1983)
Chairman Gray gave to the Commissioners a proposed Ordinance with
re gard to the Mobile and Modular Home issue.
Alderman Knight gave an update concerning work of the committee and its
efforts with regard to the Ordinance as drawn up in relation to the changing
of the Ordinance in the area of definitions mainly. She mentioned that one of
the problems lay in the interpretation of a single family dwelling. It was
pointed out that a site built home is also defined in the proposed Ordinance.
Chairman Gray asked that the City Attorney rework the Ordinance and that clatffica-
tion be made by using information in the minutes of Jan. 31, 19 83 , committee
meeting. (Exhibit B of these minutes)
There was discussion concerning what the words "site built" mean ..
Chairman Gray stated that the meaning was that a modular/manufactured home
could not be brought to the site and put together in answer to a question
from Commissioner Gwatney .

Chairman Gray stated that the intent of the Ordinance is to set up
definitions to make such clarification that there will be no misinterpre-
tation. He said there would be further study with regard to zoning.
Alderman Knight said that it was the unanimous decision of the committee that
they did notwant manufactured housing at this time in already established
residential areas.
Mr. Drummond said he felt that component parts had not been addressed in
the Ord ina nee.
DaVtd Barrett, a homeowner in the Woodbriar Subdivision, stated that a
manufactured home placed in their area by Dan Shumate of Shelter Homes
was not desired by the property owners. He said he felt that a permi.t
for the home had been issued in error by the City Engineer. He mentioned
that local real estate people had indicated that property values would de-
preciate due to the home being in the subdivision .
City Code Enforcement Officer John New noted building inspectors oBligations
with regard to issuing permits as per Jacksonville Municipal Code.
He said by zoning the house was legal and that tbe SBC code had been met.
Commissioner White commended the committee for their work and said that
he felt this was a start in the right direction. He stated that the
Ordinance can be amended as necessary. He said that Jacksonville was
one of the first cities around that allowed mobile homes and that his
intent is to protect the rights of all home owners. He said tnat he felt
the particular home on Woodbriar Cove could be made adaptable to the area
adding that lines have to be drawn somewhere.
Mr. Clark questioned the permit being granted while a study was gain~ on .
It was noted by Comm. Gwatney said that with the Ordinance that is in force
now as permanent record in the city there was no choice for tbe City Engineer
but to issue the building permit for the modular borne in that all city codes
were met and certifications of electrical and plumBing work were i.n order.
City Engineer Owens stated that the minutes of October 7th record that City
Attorney Paul Groce said that his instructions at that present time were that
no building permits be issued for a mobile home in a residential zoned area
until the Ordinance is revised. He said at that time there was no restriction
with regard to a modular home. He stated that he did not go against tne instructions
of the City Council in issuing the permit for the modular home.
A discussion followed conc~rning component parts and t 'o what extent they ·might
be allowed with regard to a 11 site built 11 home. It was pointed out that trusses
and some sectional parts are ased at present i'n on site built homes by builders.
Chairman Gray stated tnat he felt the 11 Si.te built 11 home and the manufactured home
had been defined in tne Ordinance as proposed.
Alderman Knight pointed out that in defining 11 Site built 11 homes, inspections
are possible with regard to electrical, plumBing etc., during construction.
It was pointed out by City Code Enforcement Officer John New that the SBC
has been adopted by the city for all definitions for building as a whole but
added that a set of plans does not have to be submitted when a building permit
is asked for. He said the first thing he determines is proper zoning for what
is to be built thenthe object is checked in accord with plat approval of the

Planning Commission. He said the next step was to check set backs, easements
etc. He said any change can be made as long as the outside structure is not
altered. He stated that a set of plans has not been required during his seven (7)
and one-half years with the city.
It was pointed out that a plot plan for a residential dwelling and building plans
for a commercial building are required by the city at this time prior to the
issuing of a permit.
The Code Enforcement noted that ninety (90) percent of the homes are sectional
built in the Woodbriar Subdivision and the Briarfield Subdiviston.
Chairman Gray noted that the proposed Ordinance defines a modular home as one
being brought to the site in sections as a semi finished product with siding,
roof etc.' in tact.
Mr ~ New stated that he required certifications regarding the home 6n Woodbriar
Cove and that they were .in order with any other certified plumber and electrician
in the state.
Mr. Barrett questioned inspections by the city regarding damage to homes moved
intoanarea.
Mr. New stated that he was at the site on the fourteenth of February and that
sheet rock was being repaired and that an outside border with regard to the founda-
tion was being completed adding that the plumbing and electrical work is certified
relievimg the city of any obligation. He said if a certificate of occupancy is re-
quested that he will make the proper inspections and comply with the request.
Tom Meshawn said that he felt the issue is basically an economical one.
It was pointed out that there are modular homes in the Smithwick and Country Club
Subdivisions in the city.
Mr. Jimmy Evans stated that he felt the Ordinance may need to go back to the
committee for further clarification before being presented for approval by the
C i t y Co u n c i 1 .
Alderman Fletcher said he could see the need for the modular housing but that be
did not feel they should be used to in fill residential areas as was done in the
Woodbriar instance. He said that he felt proper zoning would provide places for
them. He added that the committee would have more work to do regarding the
issue. He said !that some of tile determinations tnat baye to B.e made :s eem to B:e
descriminatory and some regulatory.
Commissioner Friedman voiced concern that oto.er 5omes; woold B.e moved in i.f tne
Ordinance is further delayed.
Alderman Knight stated that she felt comfortable with the definitions as pro-
posed in the Ordinance =before the Commission.
It was pointed out by Comm;ssioner White that modifications using the classifications
included in the minutes of Jan. 31, 1983 seemed to be what the proposed Ordinance
needed. He added that there might need to be another zone added to the zoning of
the city. He ~ade comment concerning how the zo~ing had come together up to the
present time.

Mobile HOmes: The mob.ile home is a trasportabl>e dwelling unit built prior
to June 15, 1976 (H.U.D. CODE), which is greater than 320 square feet, and
designed to~be used as a year~around residential dwelling. It 1 s roofing or
siding are not of materials customarily used for site constructed homes and
is, traditionally, the most common type seen. (It is rectangular, flat~roofed
and metal ~tded.)
NEW SECTION:
Manufactured Homes; A dwelling unit built in a factory after 1976 and bearing
a seal of compliance to the H.U.D. construction code. --
Manufactured homes are further divided into three (3) catagories. They are:
Single Section Manufactured Home ~This home looks for all practical
purposes like the pre~1976 mobile home in it 1 s shape and configuration.
The difference is that it is built to the H.U.D. code assuring a better
quality construction. Th~ single sectioned manufactured house is
assembled on its own steel structural frame which can become its permanent
foundation and is pulled to the site as one unit.
Multi~Section Manufactured Home~ A home built, usually, in two sections
that looks for all aesthetic purposes like a site built house. It 1 s
pitched roof and siding are of materials customarily used for site~
0onstructed homes. The multi section manufactured home is assembled on
its own steel structural frame which can become its permanent foundation
and is pulled to its site in two, three or more sections.
Modular Home (Manufactured) ~ The modular house is not only built to
meet the standards of the H.U.D. code but also adheres to local building
codes. The modular home is built without any foundation and is hauled
on a trailer to the site where it is placed on a site built foundation.

Gwatney, Hughes, Howard, Gray, Davis, McAlister and snethern were
present for ROLL CALL. Commissioner Friedman came in at 7:40P.M.

APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Gwatney requested corrections regarding his statement
on page six be made as foll0ws: Commissioner Gwatney voted NAY
stating that he did not feel there should be descriminations made
regarding how a house is constructed whether sectional, stick
built, modular or moved in on a platform.
Commissioner Hughes moved, seconded by Commissioner Davis to ap~
prove the minutes with the above corrections made. By a unanimous
voice vote, the MOTION CARRIED.
REQUEST -TO SET UP A PUBLIC HEARING FOR THE REZONING OF A PARCEL
OF LAND AT THE CORNER OF THE SE.CORNER OF SO. REDMOND ROAD AND
HIGHWAY 67 FROM R-3 TO R-5 (Petltioner Shelby Capps)
City Engineer Owens noted that the parcel of land had been brought
before the Planning Commission on two previous occasions; once as
Pine Cove and once as Parkview Addition and that Preliminary and
Final -Plat approval had been given regarding it with stipulations
on the Final Plat. He added that the $41,000.00 bond was not
posted (the stipulation) and that the former developers· have de-
serted the project.
Commissioner Gwatney moved, seconded by Commissioner Davis to ~et
up a public hearing for the parcel of land legally described as
Exhibit "A'r of these minutes to be rezoned from R-3 to R-5. By
a unanimous voice vote, the MOTION CARRIED.
PETITION TO AMEND --THE BILL OF ASSURANCE/WOODBRIAR SUBDIVISION ·
Chairman Gray acknowledged the Amended Bill of Assurance as
brought before the Commission. He stated that the changes made
do not affect the third (3rd) phase of the subdivision. He said
it was not necessary for the Commission to approve the amended
Bill but that record is made that it has been brought before the
body ~
Vince Winegardner, a homeowner of Woodbriar Subdivision mentioned
petitions containing seventy-five percent (75%) of Phase I and
seventy-four percent (74%) of Phase II are on record with regard
to the amended Bill of Assurance.
Commissioner Gwatney stated that he felt the property owners are
within their rights to change the Bill of Assurance.
NON-AGENDA ITEM:
Chairman Gray discussed the time element involved in placing an
item on the Agenda and added that he felt each item snould be con-
~id-e-red for placement on the-Agenda by the Planning Commission at any Regular
·Meeting. ·

to suspend the rules and place on the Agenda the Eastwood sub-
division for the purpose of setting up a ~ublic hearing to rezone
the property from R-0 to R-4. By a unanimous voice vote, the
MOTION CARRIED.
It was pointed out by Commissioner Gwatney that Mr. Dan Shumate
(Petitioner) had recently brought the property before the Com-
mission and that it had be~n annexed into the City of Jacksonville.
Fee of $50.00 paid for advertising the public hearing.
Commissioner Friedman moved, seconded by Commissioner Gwatney to
set up a public hearing at the Regular meeting of the Planning
Commission on April 11, 1983 for the purpose of rezoning Eastwood
subdivision from R~ to R-4. By a unanimous voice vote, the
MOTION CARRIED.
NON-AGENDA ITEM:
Clty Englneer Owens presented a plot plan of an unplatted parcel
of land with a metes and bounds description, Exhibit "B" of these
minutes, and requested that the item be placed on the Agenda so
that a building permit can be issued .
. -Commissioner Friedman moved, seconded by Commissioner Gwatney to
suspend the rules and place item of an unplatted parcel of land
with a metes and bounds description facing Southeastern Avenue,
South of Graham Road on the Agenda. By a unanimous voice vote,
the MOTION CARRIED.
City Engineer Owens stated that the only stipulation that he
would request is that compliance with water and sewer require-
ments be met adding that he sees no problem with the request.
Commissioner Friedman moved, seconded by Commissioner Howard to
approve the issuing of a building permit with regard to the plot
plan submitted by the City Engineer as Exhibit "B" of these minutes
providing water and sewer requirements are met. ROLL CALL: Com-

Chairman Gray opened the meeting and recognized tne City Clerk, Secretary to
th~ Pl~nning Commission for ROLL CALL: Commissioners: Howard, Gwatney,
Snethern, Gray, Friedman and Davis answered PRESENT. Commissioner White came
in at 7:38 P.M. Commissioners: Hughes and McAlister were absent. Others
present were Mayor REid, City Engineer Owens, City Attorney Keith Vaughan,
City Code Enforcement Officer John New, interested citizens and members of the
press.
A quorum was declared by Chairman Gray.
APPROVA~ AND/OR CORRECTION OF MINUTES:
Commissioner Gwatney moved, seconded by Commissioner Howard that the minutes
of the r~arch 14, 1983 meeting be approved with correction as follows: "Cnair~
man Gray discussed the time element involved in placing an item on the Agenda
and added that he felt each Hem should be considered for placement on the
Agenda by the Planning Commission at any Regular Meeting."
By a unanimous voice vote, the MOTION CARRIED.
Mr. White came in at 7:38 P.M.
Chairman Gray apologized to Commissioner Snethern for not allowing him to
discuss a motion at the last Regular Meeting. He said tnat he had made an
error in closing the time for discussion.
He said that he preferred that all commissioners approve additions to the
Agenda in tne event the item nad not met the deadline requirement for Agenda
items. He encouraged the commissioners to feel free to table said items if
they fe .el that more information should be available before they are asked to
make a decision regarding the item.
REQUEST FOR FINAL PLAT APPROVAL/WOODLAND HILLS SUBDIVISION

City Engineer Owens stated that Sewer and Water are in and approved ; that
curb and gutter is in and tnat there is gravel on Da .wn Court. He said that
the developer requests approval without the paving of the streets being completed
at tnis time. He stated that the developer had posted a performance bond
of $10,000.00 regarding the paving of Dawn Court and that tne developer had agreed
to put up an amount equivalent for placement of sidewalks. He said he saw no
problems with the subdivision as presented and recommended approval of the Final
Plat.
There was general di.scussion regarding putting up the equivalent amount of money
for sidewalks. Mr. Bond stated that the amount of the check i.s $1,29J.50. Mr.

He said tnat the approximate cost involved in building sidewalks is $1.00 per

Samuels would not be functional and tnat it is impossible to put sidewalks

Commissioner White moved, seconded by Commissioner Gwatney to approve the Final
Plat as recommended by the City Engineer to accept the $10,000.00 bond regarding
the paving of Dawn Court and $1,291.50 in lieu of sidewalks in the Woodland Hills
Subdivision. By a unanimous voice vote, the MOTION CARRIED.

The commission requested that no houses be finalized until Da~wn Court is paved.
REQUEST FOR PRELIMINARY PLAT APPROVAL AND FINAL PLAT APPROVAL/STONEWALL
APARTMENT SUBDIVISION/SAVERS
It was pointed out by the City Engineer that the same builders had made a
request regarding an apartment complex in the Stonewall Subdivision in an R-5
zoned area which had not materialized.
He said the lot was too small to convey by metes and bounds thus making a plat
necessary. He noted that the comple x is for one lot and si xty units are the
proposed number of apartments. He noted present zoning as R-3. He sa ~d that
utility plans have been approved by Water and Sewer Departments. He mentioned
that there are basically no street improvements and that there is one driveway
north and one driveway south of the complex; ending the number of driveways allow-
ed ~on Martin and Stonewal l Drive. City Engineer Owens pointed out that there
is one driveway onto Highway 161 adding that there is 400.38 ft. between the
driveway and Martin St.
There was discussion with regard to ten additional feet for a right-of-way
on Hwy., 161 due to possible widening of the highway in the ne x t ten to fifteen
years . Mr. Bob Lowe who r epresented the Hodges Firm and Mr. Ralph Bozeman
representing the developer both stated that there would be a hardship with
regard to the developer but that something could probably be worked out with
~egard to the ten (10) additional feet.
It was noted that the driveway is in accord with the Highway Department standard
of twenty-five (25) feet.
It was pointed out that the required front set back is thirty-five feet from the
highway.
General consensus of the commissioners was that the widening of Hiqhway 161 to
a fourty-four (44) to fourty-eight (48) ft. street would require an additional
ten (10) ft. of right-of-way.
Commissioner White questioned whether or not action taken upon this request
would prove to be as the previous request mentioned by the City Engineer with
regard to Savers approval of the request.
Commissioner Snethern moved, seconded by Commissioner Gwatney to approve the
Preliminary and Final Plats as presented by the Hodges Firm regarding a si xty
(60) unit apartment comple x in the Stonewall Subdivision with the following
stipulations ; an additional ten (10) ft. of r i ght-of-way on Hwy 161 and a
letter from Savers approving the request by the Hodges Firm. By a unanimous
voice vote, the MOTION CARRIED.

Commissioner Gray stated the rezoning request as presented to the Commission.
Mr. Tommy Bond explained to the Commission the location as being between an "exist-
ing apartment complex on South Redmond Road and the freeway and stated that Mr.
Capps and Mr. Boyce Penn plan to build twenty-five (25) or thirty (30) town-
houses to be sold as single family homes on the property which he added is four
(4) hundred ft. wide and stated that there waul d be one driveway for the apart-
ments in the middle of the property.
Commissioner White moved, seconded by Commissioner Gwatney to approve there-
zoning request by Shelby Capps for said parcel of land from R-3 to R-5 . ROLL

problems with regard to the subdivision and noted corrections made regarding
said problems adding that they do not effect any of the lots in the replat.
Commissioner Gwatney moved, seconded by Commissioner White to approve the Replat
of lots 145, 146, 151 thru 156, 162 and 207 thru 215 of the NORTHLAKE SUBDIVISION
PHASE 111 A. By a unanimous voice vote, the MOTION CARRIED.
At this time Mr. Bond apologized to the Commission for the manner in which he
addressed an issue with regard to the Stonewall Subdivision request by the Hodges
Firm.
Mr. White briefly noted several instances of involvement by the Planninq Commission
r egarding the Stonewall properties adding that he felt the policy;of the Planning
Commission has been to make sure that the property owner or their representative
make rezoning requests. He added that he felt that Bond Consulting is a reputable
business firm and commended t~r. Bonds integrity.
UPDATE: Annexation and Zoning Review Committee

Commissioner Gray made reference to the minutes t6 the meetinq and stated that
a tentative date, the fourth (4th) Monday of each month at 2:00P.M. at City
Hall as a meeting time for the committee. He encou~aged all the commissioners
to attend the meeting.
He noted that the Mt:J~bile/Modular/Manufactured Home Committee did not have a
quorum at the last meeting and therefore no action was taken noting that a date
for the committee to meet has not been rescheduled at this time.
REQUEST FOR REZONING OF BELLVUE SUBDIVISION FROM R-3 to R-4 for Modular
Apartments (Bill Owens, City Engineer)
Mr. Owens stated that a request had come to his office regarding the said
subdivision but there was not a representative at the meeting therefore the
item was not discussed.
He noted that zoning at present is R-3 and not R-IA.
-ADDITION TO AGENDA
Chairman Gray stated a request for a pu~ic hearing by Alton Johnson for a
tract of land at the end -of North Bailey St., as described as Exhibit 'W' of
these minutes to be rezoned from R ~2 to R-4.
There was discussion concerning zoning in the general area of Thompson's Trailer
Park.
Commissioner Friedman moved, seconded by Commissioner Gwatney to set up a
public hearing for the rezoning of a tract of land at the end ; of North Bailey
as aforementioned. By a unanimous voice vote, the MOTION CARRIED.
ADDITION TO AGENDA
Chairman Gray stated that due to the rejection ny the City Council concerning a
request for fhe rezoning of Loop Rd., Acres, the item should be discussed by the
Commission as requested by the Counci'l.

City Engineer Owens was recognized by Chairman Gray to address the item with
regard to rejection by the Council. He stated that the entrance road into
the said property is the responsibility of the city but that from there on
the street is considered private. He said originally, usage was proposed as
a mobile home park but noted that the proposed usage was changed when there-
zoning request was made by Mr. Peacock.
He st~ted that the problem as seen by the Council was that not all prospective
property owners would endeavor to keep a private drive in a proper state of re-
pair.
The City Engineer pointed out that current zoning of the property is R-0.
Mayor Reid stated that the Council requests that the street be dedicated to
the city for maintenance.
The City Engineer pointed out that there is no curb and gutter on the street add-
ing that the asphalt work is in good shape and that the gravel was compacted
properly. He said he sees no problem maintaining the street for several years.
It was noted that curb and gutter was discu~sed when the property was considered
for a mobile home park under R-4 zoning, but no requirement was made concerning
said work, and that the property was outside the city.
City Engineer Owens said that the advantages of curb and gutter are that the
shoulders are kept from deterioratin g and there is a neat appea:.rance plus
a channel for drainage.
Mr. White questioned whether or not the Commission has the .right to waive the
curb and gutter requirement.
It was noted by Mr. Peacock that the intent with the Mobile Home Park was to
sell individual 1 ots.
Commissioner Gwatney pointed out that the Commission had granted waivers previously
regarding the property and added that ae feltthe R-5 zoning upgrades said property .
He stated that he did not desire to set a precidence with regard to the rezoning
request by not requiring curb and gutter.
Mayor Reid noted that lots were sold on Penton Lane and Leonard for mobile homes
and that it has curb and gutter.
It was pointed out that Loop Rd., Acres was outside the city when the Commission
granted the waivers.
There was discussion concerning a concrete strip in lieu of curb and gutter for
the property.
C~airman Gray stated that he felt the City Council wanted the Commission to see
that the streets are in compliance with City requirements before they are accept-
ed for ma i ntena nc e.
Mayor Reid stated that the Council would approve the property for R-~ zoning
as it is but that acceptance for city maintenance is desired for the R-5 ~oning.
City Engineer OvJens stated that the street does have 6" of gravel and 2" of
asphalt and at the time the property was dealt with it was outside the city;

that said street work was completed before annexation into the city.

It was stated by Chairman Gray that there is technically no difference in R-4
and R-5 zoning with regard to curb and gutter.
Mr. White stated that he felt a street being dedicated made the difference.
Commissioner Snethern moved, that the request for rezoning be submitted to the
City Council at the ne xt Regular Meeting as requested with requirements of curb
and gutter being met by the developer and that the street be dedicated for city
maintenance. There was no second to the motion and it was withdrawn later .
Mr. Peacock suggested that he put curb and gutter on the side of the street facing
the housing but not on the Loop Rd., side.
Commissioner Snethern and Gwatney voiced that the Commission could have erred in
their acceptance of .the subdivision -without curb and gutter thus placing the de-
veloper in an awkward position. Commissioner Gwatney stated that he felt the
Commission should be flexible in some respect in this instance.
General consensus was that no curb and gutter should be required on the Loop Rd.,
side considering the widening of Loop Rd ., in the future.
Commissioner Gwatney moved, seconded by Commissioner White to send the request for
the rezoning of Loop Rd., Acres back to the City Council based on the fact the Mr.
Peacock will pu t a rolled curb on the property owners side of .the said subdivision
and that the street be dedicated to the city to be accepted for maintenance. By
a unanimous voice vote, the MDTION CARRIED.

REQUEST FOR REZONING OF BELLEVUE SUBDIVISION FROM R-3 to R-5.
A general discussion concerning zoning at the present of the Bellevue Subdivision
was discussed as well as the intent of Mr. Doug Wilkinson to split some of the
lots in the developemnt of the subdivision when and if it is rezoned.
Mr. Bond stated that a portion of the acreage is already platted ; approximately
eight (8) or ten (10) lots.
He also stated that he would present a new legal description reducing the request
for the amount of acreage to be rezoned from approximately six (6) to five (5)
acres before publication of the pu~ic hearing concerning the rezoning.
Oomrilissiorier Howard moved, seconded by Commissioner Friedman to set up a public
hearing for the rezoning of Bellevue from R-3 to R-5 for the June Planning

REQUEST FOR SKETCH PLAT APPROVAL/PINE TREE VILLAGE
Chairman Gray recognized Tommy Bond who made explanation concerning alleys as
sketched on the plat before the Commission. Mr. Bond stated that the proposed
width of the alleys is twenty (20) ft. He said that they would be buil to city
standards structurally but not with curb and gutter. He mentioned that they
would be like construction of a rolled curb on Marshall Rd.
He stated that each of the units would be privately owned ; no common ownership of
any land.
Parking spaces which the City Engineer stated meets city codes were discussed.
Mr. Bond stated that the city would be requested to maintain the alleys.
Mr. Owens stated that there are no specifications regarding alleys in the city
code. He noted that city standards regarding streets are six (6) inches of gravel
and two (2) inches of asphalt and that an Ordinance recently passed states that the
work is at the discretion of the City Engineer.
He added that a regular street section is twenty-seven (27) ft. and asked that
the Commission make a decision regarding the alley as asked; twenty (20) ft. of
pavement. He pointed out that back access to the property is desira~e.
The City Engineer noted a problem with the three hundred (300)ft. arterial street
requirement regarding driveways and stated that he favored one entrance to the
development.

Mr. Bond stated that there are twenty-eight (28) units .in the development.
At this point City Engineer Owens stated that he felt that the plat should have
been referred to as a sketch plat in that the request is mainly that the alley
concept O.:e accepted by the comm1 ss ion.
It was pointed out by Mr. Bond that the streets are not such that would invite
use as a city street but mainly for the home owners noting again the twenty (20)
ft. width of the alleys . He also stated that ten (10) units would have garages
and eighteen (18) would not.
Commissioner Howard moved, seconded by Commissioner Friedman to approve the
sketch plat of Pine Tree Village with the alley concept.
After more discussion with regard to the alleys the above stated motion
and second was withdrawn.
At this point the PUBLIC HEARING was called to order by Chairman Gray at 8:02 P.M .
Request for the rezoning of a tract of land at the end of North Bailey St., from
R-2 to R-4 owned by Alton Johnson.
Chairman Gray recognized Judge Robert Batton who stated that he legally represented
Mr. Alton Johnson whose intent in the rezoning of the property is to place a mobile
home for use by relatives; that a mobile home park is not intended as such.
Commissioner Howard moved, seconded by Commissioner Hughes to approve the request
for the rezoning of the tract of land as described in the minutes of April 11, '>
1983 as exhibit "A". MOTION CARRIED with the unanimous approval of the
Commission.
PUBLIC HEARING CO~CLUDED
PROPOSAL FOR PLACEMENT OF PORTABLE BLDG. FOR CHURCH OF CHRIST "PRAYER MISSION"
Chairman Gray recognized City Cod~ Enforcement Officer John New who explained
the intent of certain property owners to place a portable building to be used
as a 11 Prayer Mission" on a 1 ot that is not zoned for said structure . He said
that he wanted the Commission to be aware that the request would be presented
to the Board of Adjustment in the near future. A sketch of the lot and place-
ment of the building was presented to the Commission. He said that in 1981 the
petitioners were granted permission to build a church on the property. Due to
the nature of the structure the item has been brought back to the Engineering
Dept., and that of the Code Enforcement Officer.
The item was for information only to the Commission.
Interested citizens at the m~eting were instructed to attend the hearing at the
time of the Board of Adjustment meeting for input pro or con concerning the item
of business and it was noted that the public would be notified of the heariftg.

City Engineer Owens pointed out that the development would be brought before
the Commission in p~ases and that the Commission could make judgement s concerning
the alley s with regard to each phase as presented.
It was pointed out by Mr. Bond that the section with garages would be presented
to the Commission as Phase 1 by preliminary plat.
Access to the rear of the buildings was discussed with regard to the alley concept.
Commissioner Gwatney moved, seconded by Commissioner Howard to approve the sketch
plat requesting that each phase be brought back first in preliminary plat form
for the consideration of the Commission with regard to the alley concept. By
a voice vote, the MOTION CARRIED.
ANNOUNCEMENTS
LJlrmn. Gray announced that Mr. McAlister had resigned his position as a
Planning Commissioner per a letter to himself and Mayor Reid due to his position
on the Pulaski County Special School District Board.
It was pointed out that a plaque would be in order for Mr. McAlister for his
2 1/2 yr. tenure of office on the Commission.
Chairman Gray announced that the name plates for the Commissioners were
a donation of First Jacksonville Bank.

ATTENDANCE:
Chairman Gray opened the meeting and recognized the City Clerk,
Secretary of the Planning Commission for ROLL CALL: Commissioners:
Howard, Hughes, Gray, White, Davis, Snethern and Dillard answered
ROLL CALL: Commissioner Gwatney came in momentarily and Commis-
sioner Friedman carne in at 7:45 P.M. Present nine (9). Absent (0).
Chairman Gray declared a quorum. Others attending the meeting
were City Engineer William C. Owens, Code Enforcement Officer John
New, Alderrnen :Rick Gray, Emma Knight and Kevin Francis, Mayor Reid,
Judge Robert Batton and approximately thirty-five (35) residents
who live in the area of the Oakwood Apartment Complex. Members of
the press were also present as well as other interested citizens.
Chairman Gray welcomed Mr. John Dillard to the Board and extended
appreciation to Mr. Mike Wilkinson for service rendered during
his te·nure on the Planning Commission . A plaque was presented
to Mr. Wilkinson by Mr. Gray.
APPROVAL AND/OR CORRECTION OF MINUTES:
commissioner Hughes moved, seconded by commissioner Howard to
approve the minutes as presented. By a unanimous voice vote, the
MOTION CARRIED.
Commissioner Hughes mentioned that in a conversation with Chief
Frank Neely he had spoken favorably of the alleys as proposed
for Pine Tree Village Subdivision and that he felt Fire Chief
Smart would favor them as well.
REQUEST FOR REZONING/MCARTHUR DRIVE METHODIST CHURCH FROM R-1
TO C-2
Chairman Gray recogn1zed J. c. James who represented the McArthur
Drive Methodist Church . He explained adjoining areas to the
Chrirch and stated that a Day Care Center is proposed for the faci ~
lity adding that it would be beneficial to the given area.
Commissioner Snethern moved, seconded by Commissioner Gwatney to
set up a Public Hearing on July 11, 1983 at 8:00P.M. to discuss
the rezoning of McArthur Drive Methodist Church from R-1 to C-2.
By a unanimous voice vote, the MOTION CARRIED.
REQUEST FOR FINAL PLAT APPROVAL/LIBERTY SUBDIVISION PHASE II
Chairman Gray recognized Steve Beadle of Bond Consulting Engineers,
who informed the Planning Commission that Water and Sewer require-
ments had been met and that there were seven (7) lots included in
the FINAL PLAT. The City Engineer verified the infor mation given
by Mr. Beadle.
Commission White moved, seconded by Commissioner Gwatney to accept
the FINAL PLAT of LIBERTY SUBDIVISION, PHASE II as presented to the
Commission, with all utilities meeting Jacksonville Municipal Code
requirements. By a unanimous voice vote, the MOTION CARRIED.

REQUEST PRELIMINARY PLAT APPROVAL/PINE TREE VILLAGE
Chairman Gray stated that the FINAL PLAT for the subdivision
is to be brought before the Planning Commission in phases, but
that the Preliminary Plat is the same as the SKETCH PLAT that
was presented to the Commission previously.
Mr. Tommy Bond stated that the first Phase of the subdivision
would hot have alleys reflecting on considerations of the Com-
mission a month previously. He said that Phase I is next to the
highway.
Commissioner Gwatney moved, seconded by commissioner Hughes to
approve the PRELIMINARY PLAT as presented of the PINE TREE
VILLAGE SUBDIVISION.
City Engineer Owens stated that the Water Commission had requested
that an eight (8) inch line instead of a six (6) inch line be
installed with regard to the subdivision.
It was noted that letters of approval are in order from the Water
and Sewer Dept., with the one exception.
Commissioner Gwatney moved, seconded by Commissioner Hughes to =
amend the motion as follows: to approve the PRELIMINARY PLAT as
is with the recommendation of the Water Commission to install an
eight (8) inch water main instead of a six (6) inch main for the
distance of approximately 450 ft. By a unanimous voice vote,
the MOTION CARRIED.
Commissioner Gray then took a vote on the original motion. By
a unanimous voice vote, the MOTION CARRIED.
The Preliminary Plat was approved with the amendment.
REQUEST SKETCH PLAT APPROVAL/FERRELL GRAY ZERO LOT LINE SUBDIVISION
BRIARFIELD
Chairmari Gray stated that the area of the proposed zero ldt lin~
subdivision is zoned R-5 making the zoning correct for the request.
Mr. Tommy Bond pointed out that the required lot size is twenty
(20) by eighty (80) feet and that these lots are thirty (30) by
seventy-seven (77) feet and that the petitioner is requesting a
fourty (40) ft. street right-of-way instead of fifty (50) feet
street right-of-way as per regulations.
City Engineer Owens explained that similar allowances were made
on Charolette Drive in the same area.
Mr. Bond explained that plans of the developer is to place two
units with a common wall on each lot noting that the resident
owner will be able to get to the back yard without going thru his
home.
City Engineer stated that he had no problem with the plat as pre-
sented.

with regard to sewer improvements.
Commissioner White moved, seconded by John Dillard to approve the
plot plan as presented and issue a building permit to petitioner
sonny Taylor with the stipulation that city and Health Dept.,
standards be met with regard to water and sewer. By a unanimous
voice vote, the MOTION CARRIED.
PUBLIC HEARING 8:00 P.M.
BELLEVUE SUBDIVISION REZONING from R-3 to R-5
Mr. Bond explained that there was some misunderstanding as to :
which lots are being request~ed to be . rezoned from R-3 to R-5.
He said that Mr. Doug Wilkinson proposed to build duplexes on
said lots.
City Engineer Owens stated that the aEea would be upgraded by the
proposed use.
Chairman Gray stated that Mr. Wilkinson specifically requested
that lots 23, 24, 25, 45, and 46 be rezoned.
Mr. Bond pointed .out by map the BELLEVUE SUBDIVISION explaining
which part is to actually be rezoned. He ~xplained the type of
housing in the area.
All utilities and streets are . in order Mr. Bond stated.
Commissioner Gwatney moved, seconded by Commissioner Friedman to
recommend to the City Council to approve the following lots num-
bered 23, 24, 25, 45, and 46 of the BELLEVUE SUBDIVISION be
rezoned from R-3 to R-5. By a unanimous voice vote, the MOTION
CARRIED.
HALTING OF CONSTRUCTION IN OAKWOOD SUBDIVISION/PETITION CONTAIN-
ING 34 SIGNATURES
Mr. Gary Stroud was recognlzed by Chairman Gray to speak in opposi-
tion to the construction of the Oakwood Apartments.

Mr. stroud stated that he had three major points of opposition.
They are as follows: (1) Drainage problems the construction
will add to, (2) Increased traffic flow in the residential
area, and (3) major devaluation of residential property in the
area of the apartment complex.
City Engineer Owens presented aerial photographs of the area and
explained proposed drainage projections for said area underway
by the city.
It was pointed out that the area was rezoned by Ordinance in 1975
for multifamily dwellings.
Mr. Morris Justice, one of the developers of the complex said
that he c felt part of the drainage problem is caused due to the
fact that residents have filled up a ditch which he said is a
ten (10) feet easement.
City Engineer Owens stated that there are plans to place a pipe
in said ditch referred to by Mr. Justice.
Mrs. Vasquez of #22 Red oak voiced her opposition to the complex
stating that she was not sure the rezoning of the property had been
done properly with regard to the signs that are required to be post-
ed on properties up for rezoning. She also stated that she felt
the drainage problems in the area would be increased by the complex.
Commissioner Snethern suggested that the city attorney research
the problem and advise the Commission as to what action, if any,
it can take with regard to it.
A resident from #20 White Oak Cove voiced that he was opposed to
single family and multi-family units adjoining with regard to
zoning.
Commissioner Gwatney stated that the land use was decided in 1975.
He said that the property is zoned residential; (R-3).
Commissioner Snethern stated that he felt there was nothing that
the Planning Commission could do at this point regarding the issue.
He said that he felt the residents should approach the matter from
a different angle adding that in his opinion the previous action of
the Planning commission was in order.
City Engineer Owens explained proposed plans to solve the drainage
problem east of Red Oak and White Oak Coves with the use of drain-
age boxes.
Mr. Pat Odell of 1313 Gregory noted that flash flooding is very bad
in the property adjoining his adding that traffic flow on Gregory
is affected at such times adversly.
Mayor Reid stated that the city is planning to correct the drainage
on Gregory St., with a brief explanation of the plan noting prior-
ities all over the city.
Commissioner White made reference to a problem that was solved at

Main and James that he at one time t hought was impossible corn-
mending the Engineering Department in the solving of said problem.
He said that he was a member of the Commission in 1975 and that
he could verify that signs were posted properly. He said at that
time the intent of the developers was to build apartments in the
area. He added that he is sympathetic concerning the drainage
problems and feels that there is a solution but that he did not
feel the Planning Commission could do anything at this point.
An unidentified resident expressed concern for the children of the
area with the added traffic with relation to the apartment complex.
Penny Lewis stated that she felt there was a contradiction regard-
ing the drainage as proposed.
Mr. White made explanation regarding the development of property
on higher ~round and the penalty of the area below it. He said
that requirements concerning developers also has its limitations
but that he felt the Commission had thus far done the best it
could.
General Consensus was that no action could be taken by the Corn-
mission with regard to halting construction of the apartment
complex.
It was pointed out that a building permit did not come before the
Planning Cornmission;that no action by the Commission has been
taken since the rezoning in 1975.
Chairman Gray stated his appreciation to the residents for ex-
pressing their concern.
ANNEXATION OF ISLANDS WITHIN THE CITY
Commissioner Gray noted the meetings of the committee regarding
annexation and Ordinance review and asked that the Commission
accept a recommendation by that committee to persue annexation
of islands within the city.
The City Engineer pointed out on an area map the location of the
several islands and made explanation regarding the placement of a
mobile horne on one of the areas that was legitimate. He said
that information from Metro Plan per state Statue permits annexa-
tion of said islands by Ordinance through proper public hearings,
etc~-
It was pointed out that there would not be an additional burden ·
placed on the Police or Fire Department by the annexation of the
islands.
Chairman Gray noted that Council action is required to bring
the areas into the city.
Commissioner White moved, seconded by Commissioner Gwatney that
the City Engineer proceed in obtaining legal descriptions of
said islands, that the City Attorney draw up proper Ordinance(s)
and that request for said annexations be presented to the City
Council. By a unanimous voice vote, the MOTION CARRIED.

NON-AGENDA ITEM: DEEREWOOD SUBDIVISION/FINAL PLAT
Cha1rman Gray presented a request from the developers of
Deerewood Subdivision for acceptance of a F.INAL PLAT to the
Commission.
Commissioner Friedman moved, seconded ·py Commissioner Gwatney to
place the item on the Agenda. By a unanimous voice vote, the
MOTION CARRIED.
The City Engineer stated that the subdivision was outside the
city noting that the County has no specifications for concrete
streets but that the city does. His recomme ndation was for
County maintenance of the streets a dding that a 2 yr. maintenance
bond is required by same.He said that water and sewer are in
and that ninety (90) pereent of the streets are in. He added
that ~ .couple of drainage boxes and a couple of turn-arounds
are incomplete at this point. He said there are no changes
from the plat presented to the Commission approximately four
(4) years ago.
Commissioner Gwatney moved, seconded by Commissioner White to
approve the FINAL PLAT of the DEEREWOOD SUBDIVISION with the
stipulation that a two year maintenance bond be posted with
regard to work not completed at this point in the subdivision.
By a unanimous voice vote, the MOTION CARRIED.
NON-AGENDA ITEM: BOARD OF ADJUSTMENT SELECTION:
Chairman Gray asked that Mr. T. P. White and Mr. w. H. Howard,
Jr., serve on the Board of Adjustment as representatives from
the Planning Commission per action previously taken by the City
Council. He stated that said appointments are from the present
date until December 31, 1983.
NON-AGENDA ITEM: TELEPHONE POLLING
Chairman Gray asked for an opi -~lon of the Planning Commission
regarding polling per phone.
It was pointed out by the media that such action is prohibited
per State Statue.
The consensus of the Commission was to continue with any given
issue as has been the custom of the Planning Commission at
Regular or Called Public Meetings,

Steve Beadle of Bond Consulting Engineers was recognized by Chairman Gray and
stated that the plat with the exception of the addition of Harbour St., which

Commission in the form of a sketch plat. He stated that there are now sixty-six
(66) lots. He explained the right of way of Ruth Ann St. as 40' and that of
Harbour St., as 50'.
City Engineer Owens stated that the Water and Sewer Departme nts have approved
the plans with regard to their requirements.
Mr. John New, Code Enforcement Officer stated that any set back would be
addressed when building permits are issued with regard to each lot.
Commissioner Snethern moved, seconded by Commissioner White to approve the

STONEWALL COMMERCIAL/TRACT 11 A11 FINAL PLAT
City Engineer Owens stated that the developers of the Stonewall project have
done everything that has been asked of them with regard to requests to comply
with city requirements.

Steve Beadle explained Northlake Phase III A with regard to lots in the
flood plain.
City Engineer (Wens stated that they could be built on if flood plain
requirements are followed. He mentioned that some things are still in-
complete with regard to Phase III A. They are as follows: some drainage
work, sewer lines, some concrete swells and excavation work on some of the
1 ots. He said the developer had said that he did not want to put the con-
crete swells in until the fill is brought in and that neither has been done
at this time. He said also that the Sewer Department has not granted approval
to ·the developer with regard to requirements of said department for the sub-
division. He said that he would not approve the storm drainage for Phase III B
until some boxes are redesigned. He pointed out that the Water Departments
approval of the Phase is incomplete a; well.
Commissioner Snethern moved, seconded by Commissioner Hughes that the
Pnanning Commission deny the request for FINAL PLAT approval of NORTHLAKE
PHASE III B. By a unanimous voice vote, the MOTION CARRIED.
REQUEST FOR REZONING 409 & 413 GRAHAM RD.,
Commissioner Howard moved, seconded by Commissioner Gwatney to set up on Aug. 8,
1983 a Public Hearing for the purpose of rezoning the property of Mr. C. L. Hudson
located at 409 & 413 Graham Rd., as follows: Lot 2 from R-1 to R-4, Lot 3 from
R-1 to R-4, Lot 4 from C-2 to R-4, the West ~of Lot s· from C-2 to R-4, Lot 7
from R-1 to C-2, Lot 8 from R-1 to C-2, Lot 9 from R-1 to C-2. By a unanimous
voice vote, the MOTION CARRIED.
PUBLIC HEARING:
REZONING REQUEST/MCARTHUR DRIVE METHODIST CHURCH from R-1 to C-2
Mr. J. C. James was recognized by Chairman Gray and explained that since the
. previous request for rezoning and public notice has been given the petitioners
have decided to request that the classification of rezoning be · changed from
R-1 to R-3. He explained that the reason for the change is due to the u.se of
the property to a better advantage in the given area. He said that he had not
contacted any commissioner with regard to the change in the request.
Chairman Gray presented as a matter of record the signatures of thirty (30)
property owners in the area of the McArthur Drive Courch who are in opposition
to the C-2 rezoning.
After a short discussion with regard to the first request for rezoning, Commissioner
Hughes moved, seconded by Commissioner Howard to set up a Public Hearing for
McArthur Drive Methodist Church at the August 8, 1983 meeting for the purpose
of rezoning from R-1 to R-3. By a unanimous voice vote, the MOTION CARRIED.
NON-AGENDA ITEM:
Commissioner Friedman moved, seconded by Commissioner Gwatney to place on the
Agenda fer discussion the construction of a Western Auto Store at 700 John Harden
Drive . the MOTION CARRIED.
City Engineer Owens stated that he has asked that a portion of Hill St., be
dedicated and that more parking be provided with regard to the building.
He said that he had given approval at the risk of the building permit being
denied to the builder for excavation work on the site.

Mr. Friedman explained that the building would be metal with a brick veneer .
The building site has a metes and bounds legal description the City Engineer
stated.
In that it was stated that all requirements of city code are met, Commissioner
Snethern moved, seconded by Commissioner Gwatney to approve the issuing of a
building permit for the proposed building at 2227 Hest Main . By a voice vote,
the MOTION CARRIED. Commissioner Friedman abstained.

OPENING REMARKS: ATTENDANCE:
In the absence of Chairman Bart Gray Jr., Commissioner Lloyd Friedman, Chairman
of the Board of Adjustment and an acting Commissioner of the Planning Commission
opened the meeting and recognized the City Clerk, Secretary to the Planning Com-
mission for ROLL CALL: Commissioners: Gwatney, Hughes, Snethern, White, Friedman
and Davis were present. Commissioners Howard, Gray, and Dillard were absent.
PRESENT 6 I ABSENT 3. Commissioner . Friedman declared a quorum.
Others present were City Engineer William C. Owens, City Attorney Keith Vaughan,
interested citizens and members of the press.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Gwatney moved, seconded by Commissioner Hughes to approve the minutes
of the October 10, 1983 Regular Planning Commission Meeting. By a unanimous voice
vote, the MOTION CARRIED.
REQUESTS TO SET UP PUBLIC HEARINGS:
There were no requests presented at this time.
WOODLAND HILLS PHASE Ill/PERMISSION TO START CONSTRUCTION:
City Engineer Owens updated the Commission concerning Woodland Hills Subdivision.
He stated that the Preliminary Plat was approved several years ago and that the
request at present is tbat the Planning Commission grant approval for construction
to begin in Phase 111 of said subdivision with no changes being made from the ·
Preliminary Plat as approved. He said that there is a clause in the code governing
construction in subdivisions that if construction is not begun within a six month
period that the matter has to be brought back to the Planning Commission for their
consideration.
He pointed out Phase 111 by map stating that water, sewer and street approval are
in ordeJ~. He stated that the1~e should be no problem in building sidewalks in this
phase.
Commissioner G\'i1atney moved, seconded by Commissioner White to give permission to
start construction of Phase 111, Woodland Hills Subdivision giving re-approval of
the Preliminary Plat. By a unanimous voice vote, the ~10TION CARRIED.
RE: ISLAND ANNEXATIONS/LETTER FROM ATTY. MIKE WILSON
There was discussion regarding a letter from ~·1ike Wilson, t\tty. for ~·1r. Roy T.
Reynolds and Dr. John Watkins regarding one of the parcels of land ·up for annexation.
Attorney Keith Vaughan advised the Commission to proceed with the annexation of
the nine various properties. He said that he felt the Commission in their decision
is within the law with regard to the particularly mentioned property owned by Dr.
\:Jatki ns.
Commissioner Gwatney moved, seconded by Commissioner Davis to reaffirm the previous
action of the Planning Commission to recommend to the City Council the annexation
of nine various properties,/called islands, within the city limits.

(#30-83). At the advice of City Attorney Keith Vaughan the Commission took the
following action.
Commissioner Hughes moved, seconded by Commissioner Snethern to recommend that
ORDINANCE 7 1 9 (#30-83) paragraph 18.24.020 to read Single family, site-built
dwellings instead of Single family dwellings . By a voice vote, the MOTION CARRIED.
Commissioner Gwatney abstained. MOTION CARRIED
Commissioner White noted that there could be possible problems with allowance
for businesses in residential areas adding that conformity in the specifically
zoned districts should be guarded.
Commissioner Gwatney said that he felt that business requests may need to go to
the Board of Adjustment for approval .
NON AGENDA ITEMS:
Commissioner Friedman stated that the following request was presented by City
Engineer William C. Owens:
1. Building permit request on Northgate Drive which has been reviewed by the
Board of Adjustment .
2. Preliminary layout for the relocation of Loop Road
(North First Street and Loop Road).
3. Request for building permit on Redmond Road and MoPac.
Commissioner Hughes moved, seconded by Commissioner Davis to suspend the rules
and place the three items so listed on the agenda. MOTION CARRIED.
There were comments made concerning requests of non agenda items being placed on
the agenda in that the cut-Off date is being overstepped.
City Engineer Owens stated that he felt that the requests, being made immediately
after the deadline, and that there was no problem with the requests except that
the property is unplatted thus requiring Planning Commission approval.
BUILDING PERMIT REQUEST ON NORTHGATE DRIVE

REQUEST FOR BUILDING PERMIT ON REDMOND ROAD AND MOPAC:
City Engineer Owens stated that the request for the building permit is before the
Commission due to the property being unplatted . He said that the request complies

Mr. Owens stated that the property is located where the new portion of Redmond

Commissioner White moved, seconded by Commissioner Davis to approve the building

3. PRELIMINARY LAYOUT FOR THE RELOCATION OF LOOP ROAD (NORTH FIRST ST., AND LOOP RD.)
City Engineer Owens stated that the relocation of Loop Rd., is requested by Flake
and Company.
He said approximately six years ago public notice was given and relocation of
Loop Rd., was before the Commission. Since that time there has been no further
action wtih regard to the item of business. He said the interested developer
would like to swap the old right of way for a new one as illustrated on Street
Relocation Study map filed L: Loop Rd., Relocation. He explained how the Vandenburg
intersection would be affected by the relocation. He said the relocation would
be between an A frame building and the Heritage shopping center.
After a discussion regarding location of Loop Rd., and the effect on the general
area the following action was taken:
Commissioner Gwatney moved, seconded by Commissioner Hughes to suspend the pre-
liminary layout decision until the next regular meeting of the Commission. By
a unanimous voice vote, the MOTION CARRIED.
Mr. White asked for a 100 1 right of way.
PRESENTATION OF PLAQUE:
Commissioner Friedman presented Mac McAlister with a plaque for his efforts during
his stay on the Planning Commission from 1980-1983.
ANNOUNCEMENTS:
Commissioner Friedman announced a joint meeting of the Planning Commission, the
Board of Adjustment, the City Council and Metroplan on Nov. 28, 1983 at Ramada Inn.

boundary is adjusted, a new map will need to be made,
adopted by Planning Commission, and filed for record with
City Clerk and County Circuit ClerkRecorder. Hetroplan
will assist in preparing the new map.
2. Planning Commission review of the Comprehensive Development
Plan.
a. What effect will the completion of the Trickey Lane
connection have on the development potential of land
south of Military Road and East of Loop Road?
b. If development is eminent in fringe areas such as
the two mentioned above (and oth e r fringe areas)
should the city pursue a vi g o r o u s a n nex a tion policy?
c. Review existing utility service areas and potential
utility service areas for information on how utility
service will effect the frin g e areas.
d. Study the impact that growth and expansion will have
on the Master Street Plan.

at our meeting Monday night. I'm sure there must be other things
you would also like to address. Metroplan will be pleased to have
you call on us if you feel we could be of assistance to the
