Chairman Leslie Belden called the meeting to order and asked for

Commissioner Stroud moved, seconded b y Commissioner Gentry that
the minutes of the January ~ 1989 Regular Meeting of the
Jacksonville Planning Commission Meeting be APPROVED. MOTION

APPROVAL AND/OR CORRECTION OF THE ANNUAL REPORT:
Commissioner Elliott moved. seconded by Commissioner Goodsell

DISCUSSION:
a. STREETS IN COMMERCIAL SUBDIVISIONS
City Engineer Reel pointed out that in the latter part of 1988
there was action by the Planning Commission with ~egard to
Sandalwood Subdivision pointing out that the street is a 27"
street. He made reference to the Jacksonville Municipal Code
which allows the 27' street in a minor subdivision with a
cul-de-sac not to be less than 300' unless granted by waiver. He
said the subdivision fits that category.

installation of street signs after which the city takes them over
and maintains them. He added that it is difficult to collect
said cost and suggested that Final Plat Fees be revised to
include the cost of those signs which are required in a
particular subdivision and that payment of the same be required
before approval of Final Plats by the Planning Commission and the
Ci t.\l Counc i 1.
He recommended that the suooestion be passed from the Planning
Commission to the City Council for approval.
He explained the nature of collecting fees for Preliminary and
Final Plats and the manner in which determinations would be made
by the Engineering Department with regard to the cost of signs;
look at the Final Plat noting the number of intersections and the
kind of signs needed.
Commissioner Elliott moved, seconded by Commissioner Gray that
a recommendation be made to the City Council that there be a
revision made to the FINAL PLAT FEE SCHEDULE which will include
payment to the CitY.. of Jacksonville fqr_ the cost and installation
of street sion~ within §l particular subdivision before FINAL PLAT
approval is granted. MOTION CARRIED.
c. MASTER STREET PLAN
City Engineer Reel presented a map to the Planning Commission
which showed the layout of the Master Street Plan for the City of
Jacksonville as updated by Metroplan.
He said there are ordinances governing primary arterial streets,
secondary arterial streets, collector streets etc. and that he
desired to make the commission aware of the same as he expla1ned
the 1 a\;/DUt.
He pointed out flood plain changes since the map was produced by
lvletrop 1 an.
He pointed out that when a subdivision development is being
planned the map is used to decide what type of street should be
built as far as width and construction and what is expected by the
City of Jacksonville as far as access and the amount of traffic
which the street will be expected to handle.
City Engineer Reel said that he would get a copy of the map for
each commissioner from Metroplan as well as an updated zoning
inap.

City Engineer Reel said that a Preliminary Plat is in the process
of being drawn up and will probably be presented at the March
Planning Commission Meeting addi ng that there was a quick
response to the letter sent to Mr. Cropper by the Planning
Commission which indicated that he had no intent of bypassing the
Planning Commission and that he was not aware of the five-acre
transfer requirement per Jacksonville Municipal Code.
e .. NON-AGENDA ITEM: PROBLEM; MIDDLETON SUBDIVISION
City Engineer Reel pointed out that in Middleton Subdivision,
an emergency arose due to there being a fire on Brookhaven which
necessitated the closing of Braden Street causing 120 families
not to be able to go or come for several hours.
A discussion ensued regarding how the problem could be corrected .
An extension of West Lane to come out east of Fuller Hardware
would cost approximately $45,000.00 with an added seven or eight
thousand dollars for drainage work.
Engineer Reel said that flood plain contro ls h indered the
developer from completing Braden Street.
He said that an emergency route might be possible at the north
side of the Episcopal Church and Willow Bend Apartments possibly
graveling a street with the permission of property owners for
approximately five to six thousand dollars.
Alderman Fletcher questioned whether or not there were other
subdivisions within the city with the one street access problem.
He pointed out the bus stop along a major thoroughfare also. He
asked that the Planning Commission give consideration to plan
another access into the area.
Code Enforcement Officer John New pointed out the inadequacy of
the West Plant not being able to handle added construction with
regard to the subdivision.
The plans of the subdivider initially in development of the
street was questioned with the general consensus being that more
information should be presented.
Commissioner Gray suggested that if an emergency route could be
developed for the approximate five to six thousand dollars, he

felt that would be the best course to tak e at this time.
Commissioner Elliott voiced that he felt that consideration
should be given to the problem with corrections made when funds
are available and that future plans eliminate such problems.

City Engineer Reel expressed that the possibility of Martin
Street being extended to Loop Road are minimal in that much of
the p ro perty is within the flood plain and flood way associated.
He pointed out the location of Trickey Lane, Highway 161
Military Ro ad on a map being viewed by the Commission. He
that the project connecting Trickey Lane and Highway 161
Military Road will be under way before the end of 1989.

intersection to the Gravel Ridge side of Bayou Meto is scheduled
to start construction before the end of 1989 as well.
Construction of a new bridge is included in the first phase of
the project. He said there would be two phases to the project
due to condemnation of some property affected in the project. He
said the first phase would take approximately three years. He
noted that the approximate distance for the improvements is one
mile which will be a two-la ne facility but constructed such that
it can be widened to four lanes if the traffic demands ever meet
that, noting that the bridge will be a four-lane bridge. He
pointed out that the old bridge will be operational and
functional for use especially to persons in the Northlake area.
He voiced a third priority as the connection of Industrial
Drive from Main St. to Redmond Road. He noted that EPA and
Federal funding is being sought to help in the project which will
relieve some traffic congestion in the area where the new city
hall is proposed to be constructed.
Other streets were viewed and noted by City Engineer Reel as
hopeful projects with four-lane capabilities in the i ndu strial

He pointed out signalization o f North First Street at Martin
Street and Loop Road and making North First a four-lane
thoroughfare from Main Street to Loop Road. He said the city
desires to four-lane Loop Rd. t o Linda Lane. He added that long
range plans are to four-lane Loop Road to Military Road noting
that there is adequate right-of-way to do so.

intersection at Main and Bailey Streets noting the stress
poles and major electrical circuits connected with
intersection, stating a cost of approximatel y $25,000.00.

connection with Blair St., Pine and Memorial Drive.
He said t here are combined efforts between the city and the
Pulaski County School District with regard to the ingress and
egress of cars for school children twice daily. He voiced t hat
making Memorial Drive one-way going North from the school to Pine
Street for a designated time period from 2:00 p.m. to 3:00 p.m.
is being considered. Mr. Delaney, who lives in the area, voiced
his concern and help if needed to correct the problem which he
said is critical.
A c ommittee was formed of Mr. Kenny Elliott, Mr. Jon Gentry, Mr.
Mark Goodsell, City Engineer Reel, and principal of t he Pinewood
Elementary School to work on solving the traffic problem.
It was noted that there h a s been no progress in modifying the
problem which exists on Braden Street with regard to inqress and
egress in relation to the subdivi s ion west of Marshall Road
better known as Carpenter Subdivision. A recent fire in the area
causing residents not to be able to go and come during the time
the t1re was being brought under control has made the improvement
a matter of concern.
In connection with the setting up of public hearings,
Commissioner Gray moved, seconded by Commissioner Elliott that
all public hearings be scheduled for 7:30 p.m. instead of 8:00
p.m. amending an earlier motion. MOTION CARRIED.

APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Gentry moved, seconded by Commissioner Elliott that
the minutes of the March 13, 1989 Regular Planning Commission
Meeting be APPROVED. MOTION CARRIED, including a correction: the
substitution of Mr. Throgmorton's name for that of Mr. DeLaney in
paragraph four, page four of the March 13, 1989 minutes.

Chairman Belden declared the Public Hearing open at 7:30 p.m.
She stated that the rezoning request is that the status be
changed from R-2 to R-3 giving the location as just off Memorial
Drive just off Madden Rd. across the street from Chapel Hill

Commissioner Gray updated the Commissioners on the activity of
the Board of Adjustment with regard to the request. (Ref. Board
of Adjustment meeting of 2/22/89).
He said that it was the recommendation of the Board that she
bring the request to the Planning Commission stating that she had
been under the impression that the zoning was such that the four-
plex could be constructed. He said that the variances that are
requested were included in the recommendation under consideration
by the Commission adding that the Board of Adjustment did not
address any of the request of Mrs. Phillips.

The five foot variance was oointed out as being requested for the
back of the fourplex which is a side yard and that there would
be less than nine feet from the edge of the fourplex to the rear
property line. Engineer Reel said that power lines run along the
easement and across the prooerty also adding that there will be
eighteen feet between buildings and that if any work would
need to be done it would be directly under the power lines.

Mr. Reel noted that normally sidewalks are required on high
density areas and that the lot size in this subdivision does not
relate to such as arterial and collector streets.
City Engineer Reel said that the City of JACKSONVILLE and Pulaski
County nave agreed that the County pay for paving the part of
General Samuels beyond Harris Road and that the City take care ot
that portion of streets in the Jackson Heights Subdivision.

to consider an item of business regarding the Replat of Lots 7 &
Blk. 8, Braden Addition to the City of Jacksonville,
County, Arkansas.
City Engineer Reel referred to a plot which showed the layout of
the existing house on the property as he related that the house
was built in 1958 and that the Braden Addition was set uo at that
time with a 30 ft. building line on the lots which faced Bailey

Mr. Milton Riddle was not included in the agenda but that previ-
ous action of the Planning Commission permits dealing with the

Commissioner Gray withdrew from the commission to represent the
petitioners in the transfer request.
He said that his company is representing an owner of a house on
approximately two (2) acres of land. He said that there is a
purchaser for approximately 1.9 acres of the parcel adding that
the new owner~ if the request is approved for the transfer, will
probably submit in the very near future a subdivision plan which
will possibly make one or two lots off the additional p~operty.
He said that there would be no problem with subdividing the
property with regard to wate~ and sewer availability.

City Engineer Reel said that approximately tw o years ago, a
request was made for a development plan of the area but that this
plat is the first to be submitted other t han a building permit

He said that the primary concern in issuing the building permit
to Wal -Mart was parking and drainage.
He stated that ac r eaqe of the subdivision as 8.723 acres. He
pointed out that major drainage problems will have to be ad-
dressed in the development explaining the plans being viewed by
the comm i ssion. He said that letters from the Water and Sewer
Dept . are on file st atin g the availability of the sa me to the
tract of ground at t h is time.
Mr. Reel said that a total of $200.00 was paid covering Prelimi -
nary and Final Plat fees.
It was pointed out by Mr. Reel that appro va l of the plat would
also be approval for construction of the commercial subdivision
ad ding that lots 2 , 3 and 4 have a 50 ft. front setback .
E ng ineer Reel said that a total development scheme of the 65,000
sq. f t. commercial subdivision wou l d be brought back to the Plan-

He pointed out the one driveway on North First St . and said that
he suggested to the developer that it might be permitted as a
right turn in and a right turn out.
A discussion followed regard1ng traffic patterns at the Vanden-
berg intersection.
City Engineer Reel pointed out the Municipal Code requirement of
300 ft. betwee n drives in relation to t he layout being viewed and

He also affirmed that there will not at this time or in the

Commissioner Gray noted that approximately a year ago the Prelim-
inary Plat was approved with the stipulation that rezoninq of
lots in the subdivision be complete bef or e final plat approval.

Mr. Wilson explained that he was informed by Bond Engineering
that rezoning of a portion of the subdivision had been requested
for rezoning. He said he was not clear as to just who was sup-
posed to initiate the request. He explained the mechanics of
what has been done up to this point.
He pointed out that the rezoning is at the request of th£7! city
and questioned who would be responsible for said expense and
asked if the developer should be penalized at this point.
There were other comments regarding the time element from the
of the last phase of Steeple Chase and the request
before the Commission.
Commissioner Gray said that he would not favor holding up the
development but noted procedural errors which the Commission
might need to address. He said that he did not feel there would
be any oroblem with approval of the rezoning from the Planning
Commission or the City Council.
City Engineer Reel voiced that he was under the impression that
legal descriptions of the oroperty requested for rezoning by the
~ity was available with the exception of an area along a drainage
ditch. He said that some of the material needed was not avail-
able and related that the city is waiving the $50.00 advertisinq
+ee required in the rezoning process.
He said that he did not have a oroblem with go1ng ahead and
issuing building permits at this ooint.
Code requirements regarding what can be built on a particularly
zoned parcel was stated and it was oointed out that there would
be no violation in that respect with issuing building permits for
this subdivision as submitted in the final plat.
City Eng1neer Heel explained that the rezoning is for the protec-
tion of present property owners as well as future owners.
Commissioner Elliott moved, seconded by Commissioner Goodsell
that the Final Plat of Foxwood Subdivision Phase VIII be APPROVED
with the stipulation that the punch list for sanitary sewer and
storm drainage be completed to the satisfaction of the City Engi-
neer prior to the signing of the plat.
City Engineer Reel voiced that there was a hole in a storm
which would have to be repaired befor~ signing of the final

Commissioner bray voiced that the signalization would be minimal
when the overall development is taken into consideration and that
it needs to be included in this particular development plan.
Mr. Cropper said there 1s difficulty in determining who should
pay for the signalization in that there are many businesses and
residential units which will benefit notinq that Wal-Mart will
probably be the qenerator of most of the traffic. He said that
he felt the requirement is being brought down on this develop-
ment. He said that compliance with parking requirements from
Wal-Mart are having to be met in the development.
It was not determined whether or not Wal-Mart would share in the
cost of the signalization requested by the Planning Commission.
Commissioner Gray said that if developing the area could start
over, 1t would no doubt be done different but that it is not
possible and that the commission is endeavoring to make the best
of the situation at this time. He said that he felt the request

platting and the actual buildino of a subdivision.
City Engineer Reel made reference to the subdividing of five or
more acres of property stating the code require ment that such
developments have to be brought before the Planning Commission.
He made note that the city was alerted when a sign appeared on
the corner of Loop Rd. and North First St. which prompted the
request by the city for development plans. He said that once the
improvements are in for the whole development, buildings can be

shows the improvements they have not actually been completed as
she explained the importance of selling off portions without the
whole being connected together and the responsibility uT the

Commissioner Gray pointed that his greatest concern is the exte-
rior of the development having to do with traffic patterns on
Loop Rd. and North First St.
Commissioner Elliott pointed out that there are things which are
not shown on the final olat such as storm drainage,
sewer but which are on the punch list for developments noting
the stipulations for the subdivision and the need for them to be
completed before final plat aporoval.
Mr. Cropper questioned the transfer of ownersn1o with McDonald's
due to the parcel under purchase contract being under five acres.
Commissioner Gray pointed out why it could not relating that the
control of the development by the Planning Commission would be
lost in the transfer and emphasizing the responsibility of the
commission to the citizens of Jacksonville. He added that it 1s
his desire for the subdivision to be the best that it can be.
City Engineer Reel said that the traffic signalization is on the
FAU funding list in a two to five year time frame. He said that
he did not feel that the Highway Department would participate in
a reimbursement situation adding that historically they have not

for planning, engineering, right-of-way purchase and construc-
tion. He explained that 90% federal funding with a 10% match by
the city might be possible for traffic signals at Loop Rd. 1s
approximately a half million dollar project. He said that the
traffic signal is warranted at the intersection adding that it
will continue to become loaded to the north.
The need of improvements at the intersection were reiterated by
Commissioner Gray as he voiced the need for it to be done now.
A discussion ensued regarding the possible purchase by McDonald's
one of the tracts under a metes and bounds legal
wit0 reg3rd to improvement reouirements. The necessity of coming
back to the Planning Commission was emphasized whether for a
building permit or preliminary plat aporoval.
Commissioner Gray pointed out that the plan as presented express-
es the desires of the commission for the area with the exception
of a signal at the corner.

Chairman Leslie Belden opened the meeting and requested that
the secretary call the ROLL.
ROLL CALL:
Commissioners: GoodselL Gentry, Gray, ~;troud. Dillard
King and Herbold were present. Commissioner Elliott was
absent. Chairman Belden also answered ROLL CALL and declared a
quorum. Present eight ( 8) . Absent one (1) .
Others present for the meeting were City Engineer Duane Reel.
Assistant City Attorney Robert E. Bamburg, Code Enforcement
Officer John New, petitioners, interested citizens and members of
the press.
APPROVAL AND/OR CORRECTION OF MINUTES:

the minutes of the November 13, 1989

There were no requests submitted to set up a public hearing or
for building permits.
PUBLIC HEARING: 7:33 P.M.
Chairman Belden opened the public hearing regarding a request by
Bill Carpenter to rezone a parcel on South Road located between
Raney Place and Marion Street from R-1 to R-3.
A resident whose property adjoins the parcel. Mr. Harry Matthews,
recommended the rezoning.
It was noted that the property had been posted and newspaper
advertisement had been done.
The public hearing was closed at approximately 7:40 p.m.
Commissioner Gray moved, seconded by Commissioner Gentry that the
rezoning of a parcel located on South Road between Raney Place
and Marion Street be rezoned from R-1 to R-3. MOTION CARRIED.
Chairman Belden then opened a public hearing regarding the
rezoning of a parcel located on James Street, Tract "A" at the
corner of Eastview Drive, School Drive and Stone Street.

location had been made but did not make a definite co1nmitment
regarding the request for rezoning.
It was suggested by Comm issi oner Gray that the granting of a
variance might meet the need of the petitioner. He expressed
concern regarding the zoning classification change.
After a short discussion. the public hearing was closed with no
comments from the general public regarding the rezoning .
Advertising and posting of the property was in order .
The public hearing was closed at approximately 7:50 p.m.
Commissioner Dillard moved, seconded by commissioner Herbold that
the rezoning of a parcel owned by Tommy Dupree located on James
Street, Tract "A" at the corner of Eastview Drive. School Drive
and Stone Street from C-2 to C-3 be rezoned. ROLL CALL:
Commissioner Goodsell, Gentry, King, Stroud, dillard and Herbold
voted AYE. Commissioner Gray voted NAY. MOTION CARRIED.
DISCUSSION:
MASTER STREET PLAN
The consensus of the Planning Comrni ss ion after discus::: i ng the
Master Street P l an is as follows:
(1) Delete t he west end o f General Samuels going 1nto Paradise
Park a t t he offset.
(2) Retain the e x tension of Gregory Street from Marshall Rd. to
Redmond Road as a principal arterial street.
(3) Delete the extension of Martin St. to L oop Rd.
(4 ) Add Industrial Drive as a collector Street.
(5) Add Northlake drive from North belt Freeway to West Main St. as
a collector street.
(6) Delete Section of Valentine from Cloverdale Rd to Hwy 67-167.
Metroplan representatives encouraged the Planning Comm ission to
submit a request for the Master Street Plan to be analyzed and
recommended that it be done in phases noting additional fees for
the the revision by Metroplan.

There was general discussion regarding the land use within the
city and the planning jurisdiction outside the city, the widening
of Hwy 161 and other related improvements, one being an exit ramp
off Hwy 67-167 at Madden Rd. and Northeastern Avenue.
Chairman Belden suggested that she. Commissioner Gray,
Engineer Reel and Richard McGee work on the Master Street
revision endeavor.
