OPENING REMARKS:Mayor Swaim opened the meeting and welcomed the newly elected members Mr. Lester Piggee and Mr. James Davis. He also welcomed Mr. Kenny Elliott who was re-appointed. Terms of the three commissioners are to expire 1/1/93. Mayor Swaim administered the "Oath of Office" for the new members. ROLL CALL: Commissioners: Goodsell. Elliott. Gray. Gentry. Belden. Piggee. Davis and Herbold were present. Commissioner Carlton King was absent. Mayor Swaim declared a quorum. Present eight (8). Absent one (1). Others present for the meeting were City Engineer Duane City Attorney Keith Vaughan . Code Enforcement Officer John petitioners. interested citizens and members of the press. Reel. New. At this time Mayor Swaim accepted nominations for Chairman of the Planning Commission. Commissioner Belden moved. seconded by Commissioner Gray that Mr. Kenny Elliott be elected as Chairman of the Planning Commission. MOTION CARRIED. Chairman Elliott presided over the remainder of the meeting after expressing appreciation for the position of Planning Commission Chairman . Commissioner Gray nominated. seconded by Commissioner Gentry. that Commissioner Leslie Belden be elected as Vice Chairman of the Planning Commission and Chairman of the Board of Adjustment. Commissioner Davis moved. seconded by Commissioner Goodsell that nominations cease. MOTIONS CARRIED with Commissioner Belden being elected to the two positions. Commissioners members to Commission. James Davis and Mark Goodsell volunteered as serve on the Board of Adjustment from the Planning Commissioner Gray moved. seconded by Commissioner Belden. that Commissioners Davis and Goodsell fill the two positions on the Board of Adjustment to be filled from the Planning Commission. MOTION CARRIED. NON-AGENDA ITEM: Mr. Ben Rice presented a request to rezone Fractional Lots 4, 5 & 6. Block 24. Original Town of Jacksonville. Pulaski County. Arkansas, lying West of U.S. Highway 161 from C-2 to C-4. Mr. Rice explained that the property is located by the Jacksonville Daily News along HwY 161. Block 24, Original JACKSONVILLE, Pulaski County. Arkansas. lying West Highway 161 be set for a public hearing February 12, 7:30 p.m. during the Regular Planning Commission Meeting. CARRIED. of State 1990 at MOTION No building permit requests were submitted. NON-AGENDA ITEM: City Engineer Reel updated the Commission on the Commercial Subdivision at Vandenb u rg Intersection and Store location at Hwy 161 and Loop Rd. He noted Commission had requested a bond guaranteeing improvements. He said that the bond is in hand. Rogers Wct l-l''l.ctrt that the off-site He added that at the time of closing with McDonald's, they requested that the one lot be recorded as a subdivision. He said that it is desired that a FINAL PLAT OF TRACT 3 ROGERS COMMERCIAL SUBDIVISION be drawn up adding that there are no improvements other than those which have been requested, which would be covered by the bond (in hand), f o r that particular lot. There was a short discussion regarding what improvements are covered by the bond. Mr. Reel said that the developer will take care of the driveway that is asked to be placed just east of McDonald's property, the deceleration lane for North First Street north to the main drive, the widening of the main drive to four lanes at the access, acceleration and deceleration lanes north of the main entrance that would lead into the next exit and the right turn lane on Loop Rd. He said a commitment has been received from Wal-Mart and McDonald's which says that they will participate with the construction of intersection traffic signalization on Lo o p Rd. He noted commitments are as follow regarding traffic signalization as requested by the Planning commission upon approval of the Preliminary Plat of Rogers Commercial Subdivision: Wal-Mart 20%, McDonald's 20% and the developer 60%. He added that said signalization is included 1n the bond, which has a termination date of December 31, 1990. He said that the bond could be invoked if improvements have not been completed as set forth therein at that time. The amount of the bond was said to be $112,000.00. CITY OF JACKSONVILLE REGULAR PLANNING COMMISSION MEETING JANUARY 8, 19.5g qc 7:30 P.M. -7:55 P.M. He related that indications from the developer are that shops will be open for business before Christmas 1990. He said that the on-site drainage is not included in the bond but that it is a part of the Final Plat and must be completed on acceptance of said plat. Commissioner Gray pointed out that the Planning Commission has previously approved a building permit for McDonald's to construct a business on the metes and bounds legally described property. City Engineer Reel said that Tract 3 would meet all requirements as discussed in previous meetings of the Planning Commission with regard to the Preliminary Plat of the Rogers Commercial Subdivision on file in the office of the City Clerk. He said that a special meeting could be called if so desired by the Planning Commission before the FINAL PLAT OF TRACT 3, ROGERS COMMERCIAL SUBDIVISION is signed and recorded. The plat was pointed out on a map being viewed by the Planning Commission. Chairman Gray posed a question regarding a format for Commercial Subdivisions with regard to a Bill of Assurance. City Engineer Reel said that there is not at this time but that he feels this might be a good time to formulate stipulations which are desired by the Planning Commission for commercial subdivisions. Commissioner Gray moved, seconded by Commissioner Davis to recommend to the City Council that they approve a FINAL PLAT of of a one lot subdivision; namely. TRACT 3, ROGERS COMMERCIAL SUBDIVISION. with the stipulations as set forth in the LAST PRELIMINARY PLAT submitted to the Planning Commission. MOTION CARRIED. Chairman Elliott expressed that the new members are welcomed to the Planning Commission. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of January 11, 1990 Reel, New, Commissioner Belden moved, seconded by Commissioner Gentry that the minutes of the January 11. 1989 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. At this point, Chairman Elliott opened the first of three public hearings scheduled to begin at 7:30 p.m. (1) REZONING: Tract D and E , Plot 7, located between Hwy 161 and T.P. White Dr. from C-3 to C-4 (Petitioner Tommy Dupree) City Engineer Reel said that Hwy 161 requested rezoning and that there is viewpoint of the city with the C-4 zoning. lends itself to no problem from the the Mr. Dupree said that one of the proposed buildings would front off Hwy 161 and the other off Hwy 67-167. He pointed out that setback requirements made the rezoning request necessary. He related that there is approximately 1.23 acres in Tract "D" and 1.81 acres in Tract "E" and that there is approximately 200 ft. of frontage on each tract adding that the parcels go from road to road and includes all property from Heritage Shopping Center to the Dodge dealership. There was discussion regarding proposed businesses for the lots and it was noted by City Engineer Reel that there does not seem to be a problem with alignment of existing businesses. It was pointed out that land use in the commercial zoning requested does not differ greatly from the present zoning, but that setbacks are different. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 12, 1990 7:30 P.M. -7:55 P.M. Commissioner Piggee moved, seconded by Commissioner Davis that Tract D and E. Plot 7, be rezoned from C-3 to C-4. ROLL CALL: Commissioners: Gentry, King, Piggee, Davis and Gray voted AYE. Commissioners Belden and Herbold voted NAY. MOTION CARRIED. Recommendation to approve the request to be sent to the City Council. (2) REZONING: PART OF PLOT 5, AIR FORCE MAIN GATE DEV. AREA South of Nixon and North of Parrish Street from R-3 to C-3 (Petitioner Doug Wilkinson) There was general discussion regarding the use of the property. Mr. Wilkinson pointed out that there would be a buffer which has 120 ft. wide street frontage on which duplexes would be constructed. He said the requested rezoning is prompted by a desire to construct low rise warehouse distribution offices. He said that the developer desires to open up Hapsburg, which at this time is undeveloped but which is a dedicated street, between Days Inn and Jim's Automotive for access to the freeway instead of coming in through the residential area to the warehouse distribution offices. Mr. Jim residents rezoning signatures Hughes of 508 Hapsburg spoke for approximately 25 of the area with regard to requesting denial of the request and presented a petition containing 87 of area residents opposing the request. Secretary Lula M. Leonard read the letter (on file at City Hall) requesting the rezoning as submitted by Mr. Doug Wilkinson. Mr. Hughes pointed out the following as reasons for denial of the rezoning: (1) decrease in property values of single family residences if the commercial zoning is approved (2) increased traffic flow through a school zone (3) a C-3 area 120 ft. away from a residential area (4) possible sewer and drainage problems. The sign advertising·the public hearing was discussed with regard to size and placement. Commissioner Belden read from the Jacksonville Municipal Code the permitted uses listed under different zoning classifications . There was a lengthy discussion regarding zoning in the area comments being made that the streets are dedicated and eventually be opened up as the land is developed regardless the zoning. with will of CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 12, 1990 7:30 P.M. -7:55 P.M. Commissioner Gray expressed that he was thankful for the group attendance noting media advertisement and the posting of the property. He pointed out previous action of the Planning Commmission with the area along Bailey Street and noted that the particular tract under discussion has some commercial zoning and is adjacent to a vacant field which is zoned commerial along North Bailey. He added that the zoning would lend itself to the development of Parrish St. when completed and that it would lend itself also to the commercial traffic. He noted that his greatest concern would be the development of the commercial area behind Jim's Automotive without an access to the freeway versus being opened up to North Bailey without being opened up to the freeway. He said he felt the development was a good compromise for the piece of property. It was pointed out that the streets which are incomplete at this time are dedicated streets and that zoning classification does not affect them. It was also noted that street development is not the responsibility of the city but is the responsibility of the developer. Mr. Ed Palmer, a resident of Parrish St., voiced that there are Industrial Parks for such commercial endeavors as he expressed concern for area residents and devaluation of their property with the commercial development in the residential area. City Engineer Reel voiced that the Planning review the development before permits for issued by the City of Jacksonville. Commission would construction are Maximum height per Jacksonville Municipal Code was stated to be three stories for R-3 zoning and thirty-five ft. for commercial construction. Sketches of the proposed development were viewed by the Commission and street construction was discussed. City Engineer Reel explained that sewer improvements would have to be submitted to the Wastewater Department for approval before any construction is begun. He said that drainage would be addressed by the Engineering Department before construction also. It was requested by the residents that the Commission deny the request due to permitted use in C-3 zoned areas. Commissioner Bart Gray Jr. moved, seconded by Commissioner Belden to recommend to the City Council the approval of that the request to rezone from R-3 to C-3 Part of Plot 5, Little Rock Air Force Base Main Gate Development Area. Jon Gentry commented that he felt the development was the beneficial compromise for the neighborhood. Commissioner Belden moved, seconded by Commissioner King that a recommendation be sent to the City Council to approve the request to rezone Fractional Lots 4, 5 & 6, Block 24, Original Town of Jacksonville from C-2 to C-4. REQUEST TO APPROVE PLAT:SKETCH PLAT: Keathley Commercial Subdivision located south and East of U.S. HwY 1 6 1 and Missouri Pacific Railroad City Engineer Duane Reel pointed out that the subdivision is designed as a C-1 light commercial area. He said that the square footage of the lots meets the minimum required by Jacksonville Municipal Code noting that the lots in the cul-de-sac show frontages actually on the right of way line as 31 to 35 ft. in that particular area. He pointed out parking requirements for C- 1 zoning e x pressing concern that purchasers of the lots be made aware of the limited parking possibilities. City Engineer Reel said that the access to the rear of the lot and the parking were of concern to him. He pointed out that there 1s a problem with lots 3, 4, 6 and 7; lot 5 meeting criteria. He said the lots will not support C-3 zoning as the zoning map was viewed. It was pointed out that the development would lend itself to C-1 zoning. Commissioner Belden moved, seconded by Commissioner Piggee that the SKETCH PLAT FOR KEATHLEY SUBDIVISION be tabled until the City Engineer is notified that the plat is ready to be brought before the Planning Commission for action. MOTION CARRIED. Commissioner Gray pointed out that a rezoning request might be the solution needed for the subdivision. After discussion, Mr. Brooks expressed the desire to rezone the property to C-2. REQUEST TO RENAME STREET: From "North Front Street" to "Dr. Hudson Avenue" (Petitioners: Ruby Hudson and Fred Bowen) After a short discussion, the fact that there were no houses which front off North Front Street and that that it would not be in the best interest of the city to bring the street up to city standard which would cost between twenty-five and thirty thousand dollars. City Engineer Reel expressed that there was no problem with the name change but did not rec ommend street improvement which was also requested. Commissioner Gray moved. seconded by Commissioner Belden that the Planning Commission recomend to the City Council that North Front Street be renamed Dr. Hudson Avenue with the exclusion of street restoration. MOTION CARRIED. 9t1 CITY OF JACKSONVILLE. ARKANSAS REGULAR PLANNING COMMISSION MEETING MARCH 12. 1990 7:30P.M. -8:13P.M. City Engineer Reel pointed out that the parcel is basically land locked. He said that development of the front portion was probably done without consideration of development of the rear portion. He related that concessions through his office to the developer was for a 40 ft. right of way with a 5 ft. easement on each side for street construction and that the request as presented is for a 30 ft. easement and that the 30 ft . easement comes within 6 ft. of the existing 16 unit complex. He pointed out that the property remains under private ownership with a street to serve lots which are proposed to be sold with individual ownership and that his office has a problem with a public thoroughfare across private property even though it is an easement. There was a lengthy discussion regarding the "land-locl<" situation, lot reduction, land ownership, other access to the property off Hwy 161 (which is hindered by underground fuel storage tanks), setback requirements (which are not met in the proposed subdivision as presented to the Planning Commission), and the Jacksonville Municipal Code requirement with regard to the sale of parcels under five acres with regard to properties previously owned by Mr. Keathley which did not come before the Planning Commission at the time of sale. Rhone, 10019 E. Shannon drive City Engineer Reel noted that a petition from the residents of Shannon Drive was submitted to the city regarding making it a one-way street. He pointed out that a similar request was submitted three or four years ago. He said that the best proposal would be to make the street one- way from south to north and suggested that information regarding improving the conditions which exist on Shannon Drive be provided residents of the area as well as the date of a public hearing which will be held with regard to the requested change to a one- way street. He suggested that a committee be formed to study the situation and that a recommendation from that committee be made at the next regular meeting of the Planning Commission. Asst. Engineer Reel stated that Mr. McKay desires to construct buildings on the property to accommodate Mart y 's Muffler Shop and other tenants pointing out that the property is zoned C-4 for heavy industrial, heavy manufacturjng area. He related that he suggested the C-4 zoning whi c h accommo d a tes general c o mmercial. He added that the M-1 and M-2 zoning, which requires a 2 5' front yard and a 75' rear yard , would not support the construction desired by Mr. McKay. As zoning of the area was discussed, it was noted that several businesses are operating by conditional use. Commissioner Gray suggested that waivers regarding the setbacks might be the proper way to address the needs of the proposed construction. It was suggested that the lot be made a "pan handle" one with the street having a 30 ft. right-of-way and that clearance be provided for fire and garbage service. ITEM (1) Carport construction I 1604 Keaton It was pointed out by Mr. John New that the Bill of Assurance has been violated and also that the Jacksonville Municipal Code 1s violated with regard to setback lines in the carport construc~ion at 1604 Keaton . He noted that letters have been sent advising fi v e property owners 1n the Keaton Addition of similar violations. It was pointed out that Mrs. Nutt was not aware of the violation until contacted by the Code Enforcement Office and that since that time she contacted Bobby Bamburg, acting in the capacity of Asst. City Attorney, and has acquired the signature of more than fifty percent of the property owners in the subdivision who have no problem with the construction of the carport on her property. There was lengthy discussion regarding the route that should be taken to clarify the situation regarding the construction of carports, attached and detached, violation of the building setback line and whether or not the matter s hould come before the Board of Adjustment. The consensus of the Commission was to obtain from City Attorney Keith Vaughan a legal opinion regarding the construction of the carport at 1604 Keaton. (2) Building Line Variance #5 Club Ct. (Lot #320 Foxwood Subdivision. Phase VIII) Petitioner: Jack Wilson City Engineer Reel presented the information used by the city In issu1ng a building permit for construction of a home at #5 Club Ct., Foxwood Subdivision. He also presented a rep l at submit.ted by Mr. Jack Wilson for the same address in which a twenty-five foot building line setback is requested instead of the thirty- five foot setback required by ordinance in Jacksonville Municipal Code. There was a lengthy discussion regarding action of the Planning Comm ission in other similar circumstances . Mr. Reel said that the bank along the drainage ditch will need to be stabalized in the construction for city maintenance along with comments regarding allowing five feet for storm drainage. He also pointed out that funding has been requested for expanding North First from a two-lane to a four-lane thoroughfare. He requested that the firm dedicate a ten foot easement along North First which was agreed to by Mr. ~ulmer and Mr. Rome. Block 2. N.E. and Harry Harpole Addition from R-2 to C-1. MOTION CARRIED. City Engineer Reel stated that changes proposed by the Planning Commission are now in the hands of Metroplan for adjustments. He said that he is expecting Metroplan to propose that all land along North First Street be eligible for commercial zoning. He said that if it does, all property owners should be contacted regarding the information. Commissioner Gray voiced that he is of the op1n1on that others along the street will follow suit if the request by Mr. Walker is granted. He said that those with whom he has talked concerning the request have stated as much.
