OPENING REMARKS: Mayor Swaim opened the meeting and expressed appreciation for those in attendance. ROLL CALL: Commissioners: Elliott, Goodsell, Payne, Dornblaser, Gray and Davis were present. Commissioner Piggee came in at approximately 7:32 p.m. Commissioners Belden and Herbold were absent. PRESENT seven (7). ABSENT two (2). Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Code Enforcement Officer John New. petitioners and interested citizens. The press was not present for the meeting. OATH OF OFFICE CEREMONY: At this time, Mayor Swaim administered the Oath of Office to Mr. Paul Payne. Mr. Jim Dornblaser and Mr. Bart Gray Jr. They were seated and participated in the remainder of the Planning Commission Meeting for their first session as comrnls- sioners in the year 1991. Commissioner Elliott nominated Commissioner Bart Gray Jr. as Chairman of the Planning Commission for the year 1991. Commissioner Goodsell moved, seconded by Commissioner Davis that the nominations cease. MOTION CARRIED. Commissioner Davis moved, seconded by Commissioner Piggee that Mr. Bart Gray Jr. be elected as Chairman of the Planning Commis- sion for the year 1990 by acclamation. MOTION CARRIED. Mayor Swaim then yielded Chairmanship of the meeting to Mr. Gray. Mr. Gray expressed appreciation for the nomination and ope ned the meeting for nominations for a Vice-Chairman of the Planning Corrunission who will also serve as Chairman of the Board of Ad- justment. Commissioner Goodsell nominated Commissioner Jim Davis as Vice- Chairman of the Planning Commission and Chairman of the Board of Adjustment. Chairman Gray gave opportunity for volunteers to serve on the Board of Adjustment. Commissioner Belden requested through Commissioner Kenny Elliott that she be retained as a member of the Board of Adjustment. She said that sketches of the complex by Mr. Bill Canino, archi- tect for the project, are available for viewing. She added that the construction will enhance the neighborhood. Commissioner Elliott pointed out that the request, presented as rezoning from R-0 to R-3. is in actuality zoned R-1 and that zoning immediately to the east is R-4. Mr. Donald Carter who resides on Leonard Drive questioned what can be built in R-3 zoned areas. It was pointed out that R-1 is site built sing l e family dwellings and that R-3 allows multi-family units and that three hundred feet along Loop Rd . is desired to be rezoned . Sandra James, an employee of Pathfinder. 2309 Graham stated the housing will be built two and one-half miles from residence. He pointed out that there will be five one bedroom apartments, having complete living quarters, a unit for an apartment manager and parking for fifteen cars. He said that the building will meet all the standard building codes required in the Municipal Code for R-3 zoning. Mr. Arlo Irmer, 1300 Ferrell expressed concern for the safety of residents in relation to the vehicle activity along Loop Road. 000009 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 14, 19911,.. 7:30 P.M. -9:30 P.M. Mr. Glen Rhone who resides at 1005 Barbara Street questioned the drainage in the area with r8gard to the mobile home park. City Engineer Reel said that in the development scheme drainage is proposed to take the water from this particular development directly south into a main ditch that comes from Stonewall. He said that a small ditch can be improved in relation to Pinon Lane and that the improvement would be part of the Pathfinder Project and will help the water to move away from the area. Mr. Rhone addressed the safety factor also. He asked if there would be sidewalks required from Stonewall Drive to North First Street due to pedestrian traffic. Ms. Black said that most of the twenty individuals would be driving their cars. She said that Pathfinder will not assume to build the sidewalk although some of the persons will be walking to area stores as well as to work. She pointed out that the apartments are HUD funded and which will make it easier for the residents to pay their rent. She went on to explain that the City of Jacksonville will have to approve any construction and that HUD architects would consider the drainage factor in the development of the complex. Mr. Rhone questioned whether or not the zoning is "spot zoning" and why the already R-3 zoned areas in the City of Jacksonville were not chosen for the construction of the complex. Joan Zumwalt. Board Member of Pathfinder for nineteen years, voiced that there are a number of facilities in the city. She said that the site suits the need and is the second that has been requested to be rezoned in a nineteen year time frame. She said that as the city grows. the need for area rezoning arises point- ing out that neighborhoods in which the other facilities have been located range from downtown on Poplar Street, Hospital Drive, South Road and Military Road. She said the site is very ideal and that a better could not be found. Robin Rider 1626 Pinon Lane read a prepared statement which pointed out the following as reasons to deny the rezoning as requested: property not suited for this purpose due to the area being a single family neighborhood, decrease in property values, property tax loss, and security issues. It was stated by Ms. Black that taxes are paid by Pathfinder on their equities in the building only. Commissioner Elliott noted that the area to the east adjoining the parcel requested to be rezoned to R-3 is zoned R-4 which is conducive to multi-family. Ray Smith of 1707 Pinon Lane expressed concerns regarding drain- age with development of the proposed complex. He noted concerns with the safety of his children. City Engineer Reel said that at this time an would be sodded and seeded in conjunction with the complex. earthen channel constructi o n of It was pointed out that the complex is to be built with money attained through a forty-year government loan, such as G -I Loans, but that it is paid back by Pathfinder. She also informed the audience of the American Disabilities Act which sets forth that facilities be provided at diverse places rather than congregations or institutions or settings. She said that these persons have been given rights just as other citizens adding that the Federal Government will no longer allow congrega- tion of more than the number of units proposed in the complex. She said that property already owned by Pathfinder could not be used for the construction site. Mary McFadden, 1724 Pinon Lane, voiced concern for the persons who will be living at the complex and pointed out positive attributes of the physically disabled. Fred Row, 1702 Pinon Lane, voiced concerns for school children and noted the single family dwellings in the area. Ruth Thompson, 1624 Pinon Lane, voiced concerns for safety and parking noting that most of the persons in the mobile home park are retired and elderly persons. Mr. Bob Lowe posed questions regarding normal existence of persons who are not disabled in comparison with the good days and bad days of the persons who will occupy the Pathfinder complex. He questioned construction of the fence proposed by Pathfinder. CITY OF JACKSONVILLE. ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 14, 1991 7:30 P.M. -9:30 P.M. Chairman Gray noted that all the property from the entrance of Stonewall to Pinon Lane is zoned R-1 and that the parcel 1s surrounded by commercial zoning on the east and the west. Jo Davis, 1012 Loop Road, expressed concerns with the safety factor involved with added traffic on Loop Road. Don Carter, 1712 Leonard, voiced concerns regarding the traffic on Loop Road also and pointed out that property values will decrease with the construction of a complex such as the one proposed by Pathfinder and that he did not feel the speed limit 1s enforced properly. He asked for the name of the property owner. Jamie Causey, 703 Charlotte Circle, voiced that she has a with downs syndrome and voiced that she appreciates a home the handicapped. She noted that there needs to be places persons with disabilities in Jacksonville. child for for Mr. Jeffrey Hicks, 1700 Pinon Lane, noted improvements by individual property owners on the street and that there is concern by the manufactured home owners regarding their investment and property value depreciation. Mr. Kenneth Geyer, 1704 Leonard, expressed that he has no problem with the persons who will live at the Pathfinder complex, but that his main concern is drainage and flooding for the area which already needs improvements. Ms. Colleen Black assured the property owners that flooding and drainage will be handled properly by the architect for Pathfinder, the City Engineer and HUD officials overseeing the construction of the project. Mr. Fred Hyatt, 1703 Leonard voiced that the ditch is full of junk and feels that is the cause of flooding in the area. II I ~ CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 14, 1991 7:30 P.M. -9:30 P.M. At approximately 8:35 p.m., Chairman Gray closed the public hearing. He pointed out that the particular tract of ground is subject to development in single family, site-built, R-1 type housing. He pointed out that further development of approximately seventy to one hundred acres is going to create opportunities and problems at the same time. He pointed out that the Planning Commission, the engineering staff and others will have to consider each phase as it is developed and will have to g1ve great consideration to the problems that already exist. Commissioner Elliott voiced that good things were brought to light during the public hearing noting that the work of the Planning Commission is to view each request and work out the best possible development plan for all parties concerned. Commissioner Piggee asked whether or not there are plans to widen Loop Road at this time. City Engineer Reel said that Loop Road is on a priority list with the Highway Department in that the City of Jacksonville are participants in Federal Urban Funding and that at some point in time, when funds become avai lab le, Loop Road will become a four lane facility. Commissioner Gray explained that a site plan, construction .. drainage, privacy fence, ingress and egress, parking, etc. will be lo o J<ed at by the Planning Comm issi on and the City Engineer at the time a building permit is requested. Mr. Frank Sipes, 1720 Leonard. questioned putting an apartment complex at the specific location on Loop Road. Chairman Gray pointed out that the congregation of the units 1n a central area was addressed earlier in the meeting. Pointing out the quality of units established in the City of Jacksonville previously, Commissioner Davis moved, seconded by Commissioner Elliott that approval of the rezoning of the parcel as requested by Pathfinder be recommended to the City Council. ROLL CALL: Commissioner: Goodsell. Payne. Dornblaser. Piggee, Davis and Elliott voted AYE. NAY 0. MOTION CARRIED UNANIMOUSLY. Chairman Gray pointed out that the rezoning request would be on the agenda for the next City Council Meeting. Chairman Gray adjourned the meeting momentarily as persons who attended the public hearing were dismissed. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 14, 1991 7:30 P.M. -9:30 P.M. Commissioner Davis moved, seconded by Commissioner Elliott that the 1990 ANNUAL REPORT of the Planning Commission be APPROVED. MOTION CARRIED. DISCUSSION: STONEWALL SUBDIVISION DEVELOPMENT City Engineer Reel made reference to a drawing of the last phases of Stonewall Subdivision. as prepared by Pulaski Financial Services, presented to the Planning Commission by Mr. James Gre e n . He said that at the time the last phase in the subdivi- SI On was approved by the city, it was decided by the Planning Commission that no development of additional lots would be al- l owed unless Stonewall Drive was developed on through to connect to Nor th First Street at the location of Da v is Academy . He said that Mr. Green's request is that he be allowed to develop the few lots which would complete the streets which are already stc~.r t e d . He voiced that negotiations with the Highway Department reg a r a 1ng traffic signal installation at North First and Martin Stre e t have been discussed with Mr. Green. He said that indications by the Highway Department are that it will be eight to nine months .before completion of the project. He p o inted out reasons from Mr. Green, which are valid from a deve lop ers standpoint. regarding the restriction of Stonewall Drive completion wn1cn has been put on the development by the city. Noting that his compromise, as City Engineer, would be that if Mr. Green is allowed to develop the lots which would complete the two culdesac areas, no certificates of acceptance would be issued by the city so that lots could be sold until the traffic lights are in operation at Martin Street and North First. Commissioner Elliot expressed concern regarding the development of the area and its impact on the traffic congestion at Martin Street and Highway 1 61 without the traffic signalization. Mr. Green said that development of the phase as proposed would work out time-wise about the time the light would be installed. He said that the first lot would probably be ready for sale in June or July as he asked for consideration for lot sales at the time the contract is let for the traffic light installation. It was the opinion of the body that the suggestion of the City Engineer, as stated in the beginning of the discussion regarding the development of Stonewall Subdivision, be followed with com- ments by Commissioners Jim Davis and Jim Dornblaser that any further development would be preceded by the completion of Stone- wall Drive to HwY 161. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 14, 1991 7:30 P.M. -9:30 P.M. Chairman Gray suggested that Mr. Green begin a phase of development at Hwy 161 and go east getting the biggest stretch of the subdivision. Mr. Green said t11at the most logical approach from a developers standpoint is to go with the existing street, completing the culdesacs as suggested in the beginning of the discussion. He said that he is committed to put in the last eight hundred feet of Stonewall Subdi v ision within the next three years. He said that after this phase. as proposed in the layout before the commission, he has no choice but to complete the remainder of Stonewall Drive. He said that he has an obligation to a church to complete Stonewall Drive to the end of their property. Chairman Gray suggested that completion of the street would mean the development of eleven more lots, opening up the multi-family lots by completing Stonewall Drive. Commissioner Dornblaser expressed that he did not favor the development of St onewa ll Drive in segments. Mr. Green said that he felt the Planning Commission is asking him for an exception instead of his request being an exception. Mr. Canino explained the sketch of the proposed building complex and stated that the buildings will be pulled away from the ease- ments and that no waivers will be requested. He pointed out that the parking will be concrete. City Engineer Reel said that parking is adequate. REQUEST TO ACCEPT PLAT: STONEWALL SUBDIVISION PHASE IV E City Engineer Reel made reference to Savers having submitted the o verall preliminary plat of the subdivision. He said that the eighteen lots in Phase IV E is the c o mpletion of a cu ldesac and that the same geometric design in the preliminary plat is be ing followed in this phase. Mr. Tim Lemons said that plans have been submitted to the Wate r and Sewer Departments and that submission to the Health Depart - ment would depend on the decision of the Planning Commission regarding preliminary plat approval or rejection. Mr. Reel said that information from the Highway Departmen t is that the traffic signals at Martin and North First will be com- pleted sometime in September. He said that he felt the traffic signals will control the additional traffic which will be created by the eighteen lots in Phase IV E. He made reference to discus - sion at the last meeting and his recommendation that no more lots be developed until Stonewall Drive is completed. Mr. Reel pointed out that the original layout of the subdivision, approved by HUD and designed by Bond Consulting Engineers, has not been changed in proposed Phase IV E. There was discussion regarding a problem caused for residents the Braden Addition when emergency services blocked the access to the subdivision and a like situation with access Phase IV E with regard to emergency services. 1n one into Mr. Green presented data showing other areas within the City of Jacksonville which, in his opinion, have less access for emergen- cy services than Phase IV E as pr opos ed. More discussion followed regarding the development of the remain- der of Stonewall Subdivision, both commercial and residential, which includes multi-family, and the completion of Stonewall Drive with a suggestion by Chairman Gray that some funds be placed in escrow, per lo t, to assure completion of Stonewall Drive. Mr. Green said that it was not feasible to do the same. Questions arose as to whether such could be done legally with Chairman Gray pointing out that City Attorney Bamburg had said that it could. Mr. Green pointed out that, in his opinion, the controlled access out of Stonewall Subdi v ision seems to lessen the importance of completing Stonewall Dri ve at this time. He said that the number of houses which will be exiting the one area is a very common situation as he made reference to other subdivisions. Mr. Gray contended that if Savers could have completed the por- tion of Stonewall Drive under discussion. that they would have. Chairman Gray asked Mr. Green if he would be willing to place some funds in escrow on the lots proposed for development. Mr. Green replied t hat, as an insurance agent, he could see problems with that and pointed out that he is co~nitted to com- pleting Stonewall Drive all the way through within the next three years. He said that his sale of a porti o n of the cornmercial area to First Baptist Church bears a guarantee that he will complete the street seven hundred feet from North First, in an easterly direction up to the edge of their property. He said that approx- imately fourteen hundred feet of Stonewall Drive would remain to be completed. He said that if the remaining lots could sell under normal circumstances, Stonewall Drive completion is only a time and interest obstacle. He said that the eighteen lot devel- opment in Phase IV E will give him and his banker some indica- tion of what will take place and hopefully enhance the develop- ment of Jacksonville. Mr. Green further urged that the Planning Comrnission allow the sale of lots when the bid letting takes place. Engineer Reel pointed out that he felt that prospective buyers of lots proposed for development should know that they have an investment which cannot be built on until traffic light installa- tion is complete at Martin and North First adding that there has to be some control by the City of Jacksonville regara1ng the issue of building permits. He said that he has n o problem with the stipulations set forth in the motion. It was pointed out that once the contract is awarded, it is a surety that the traffic signals will be completed. Engineer Reel said that the proposed time for completion of the signals is September or October. There was further discussion regarding the timing involved in contracts, actual installation of the traffic signals, the ap- proximate time involved in construction of a new home and the approval of the Final Plat. The following contingency was placed on the motion: that permis- sion to issue building permits be granted when a contract is set in place for the installation of the traffic signals at Martin and North First Street and that Stipulation (1) be removed from the motion. Chairman Gray opened the Public Hearing naming the f ollowi ng parcels which are requested 1118 No. First St., 1200 & 1 2 04 No . First St., and 1300 North First Street which are requested to b e rezoned from R-1 to C-1. Mr. Bob Walker represented the property owners and voi ced t hat the r e quest is made in that the owners feel that the change woul d be pro per for the property to be zoned for its highest and bes t use in the city. Mr. Gene Wilson , owner of the property at 1300 No. First Stre et agree d with Mr. Walkers comments. There were no negative comments from the general public with regard to the rezoning requests. City Engineer Reel related that the request will do aw a y with spot zoning along the highway and that the collective req u est is certainly in order. He relat e d that a rough draft of the land use plan with s ug g e sted zoning along streets and thoroughfares is available for the commission to view when all other matters on the agenda hav e been addressed . He voiced that the recommendation of the Planning Commission will be passed on to the Council as the item was discussed. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING October 14. 1991 7:30 P.M. -8:02 P.M. Commissioner Goodsell moved, seconded by Commissioner Davis to relate to the City Council that the Planning Commission has no problem with the closing of the alley as long as proper easements are maintained for present utilities located thereon. MOTION CARRIED. NON-AGENDA ITEM: Stone Street (one block long located between No. Oak and No. Elm St.) Chairman Gray commented that an item regarding a street closing was submitted after the closing of the agenda. He said that the action of the Planning Commission regarding this item would be similar to the action just taken with regard to the closing of the alley aforementioned and that a public hearing would be the responsibility of the City Council. He SlOn that this said that he felt the time of action by the Planning Commis- would be at the next Regular Planning Commission Meeting; appropriate action should be taken at that time. He said would give the commissioners time to review the matter. A preliminary plot plan was submitted for a residence to be built at 901 Stanphil Rd. for Mr. Danny Shillcutt. It was determined that the parcel is a portion of land whose previous owner was Mrs. Ann Wood. Engineer Reel said that this is the second lot which has been before the Commission from the parcel owned by Mrs. Wood with a building proposal. He said that at some point in time, a pre- liminary plat would have to be requested from the property owner. It was stated by the contractor, Don Meek, that Mr. Shillcutt purchased the land from Mrs. Woods brother and that Mrs. Woods owns the surrounding land. It was stated that the house would set forty feet back from the property line. City Engineer Reel said that all utilities are available. He related that if approval 1s given for this construction, it should be stipulated that no others will be approved unless a plat is submitted regarding the remaining parcel of ground owned by Mrs. Woods. City Engineer Reel related that the plot was a portion of a lot owned by Mrs. Woods daughter and that she has deeded it to her son Mr. Shillcutt. Commissioner Davis moved, seconded by Commissioner Herbold that the building permit be granted with the stipulation that a SUBDI- VISION PLAN be submitted in December at the Regular Planning Commission Meeting with occupancy delayed until a FINAL PLAT is approved. Representative Mike Wilson spoke for the petitioner of the rezon- ing as listed above. He explained the locati on of the property and pointed out that access to the property is through Dupree Park on a public street. He noted that the present zoning is R- 1, that it does not fit residential use of any kind and that the owners propose to request that the property be rezoned for rea- sonable commercial or light industrial use such that would not cause heavy trucks or excessive amounts of traffic on the park road. He said that there has been a proposal to the Parks Department to swap out some of the proposed access because the drive to Dupree Lake crosses the property owned by the petitioners requesting the rezoning. He pointed out that there is limited use of the property due to the elevation of it; that the property is low-lying and will have to be filled in at considerable expense and that there is approx- imately 13 acres requested to be rezoned. He voiced that some reasonable use of the property should be permitted 1n that R-1 is not conducive to the use of the parcel. Chairman of the Park & Rec Commission Robert Stroud voiced that the Commission is opposed to the rezoning. He noted that the Commission is concerned about the intent of the developer in that CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING December 9, 1991 7:30 P.M. -8:30 P.M. there is a safety factor for park participants noting that van- dalism is a problem now in the park area and could increase if particular commercial or industrial development occurs. He said that the Commission is in the process of redesigning the entrance to the park and that a gate at the entrance is being given con- sideration. He voiced that the Park & Rec Commission would not be opposed to buying the property at a reasonable amount. He said as representative of the citizens of Jacksonville, he feels that Dupree Park is the major park in the city and anything that might take away from that will be a detriment to the citi- zens of the city. He pointed out that it is not feasible that access through the park to the property requested to be rezoned be granted at this time. City Engineer Reel said that at present the road under discussion which goes through Dupree Park is owned and maintained by the Parks Department and that it is not built to any specific stan- dards for carrying residential or industrial traffic. Mr. McKimmey related to the Commission that he was told the road had been in existence for years when the property was purchased from Mr. Schmidt. Mr. Wilson reminded the Commission that in the past rezonings have been approved allowing fencing and screening construction as a buffer and suggested that such might be given consideration 1n this request. He pointed out that the request is for light industrial and he was not aware of definite plans by the developer at point. that this Park & Rec Director Annabelle Davis related that there was activ- ity regarding the property between the owners and the Parks Department in 1988 but that no agreement was reached at that time with regard to a land purchase or swap. It was pointed out by Chairman Gray that no residential construc- tion is allowed in M-1 zoned areas. The effect of corr~ercial or industrial traffic with regard to housing in the area was discussed. Mr. Stroud voiced that the Park Comnission would give considera- tion to buying the parcel at a reasonable price. Concerns were expressed by Cornmissioner Elliott regarding to the parcel through the park and the possibility of a with regard to residential housing in the area as well as for park participants. access buffer safety Mr. Wilson voiced that Highway Commercial was the most appro- priate zoning for the parcel under discussion. The legality of construction of a gate was posed. City Engineer Reel pointed out that the width of the street in the adjoining subdivision, where twenty-four residences exist on a culdesac, is twenty-seven feet as a discussion ensued with regard to traffic for a comnercial or industrial area. Chairman Gray m~de the Commission aware that in the event the request was denied, it could not be brought before the body for requested rezoning for one year. Regulations for vehicles allowed 1n the park was pointed out. The discussion continued until approximately 8:10 p.m. at which time Chairman Gray closed the public hearing. The Commissioners discussed the options before them; to approve the rezoning with no clarification of access into the property, to allow access off a residential area which was determined not to be in the best interest of the city, to disapprove the rezon- ing and to table or postpone the rezoning indefinitely. Chairman Gray pointed out that the request for rezoning could be postponed until access to the parcel happens or that it could be turned down. Commissioner Elliott, Payne, Dornblaser, Davis and Piggee voiced concerns with regard to rezoning the parcel with no access, access through the park facility, safety of park participants if the proposed use of the land generates high density traffic and high density traffic in a residential area if access is allowed through the adjoining subdivision. The concerns were discussed at length. Chairman Gray called for a motion to be made and encouraged the Commission to come to some decision regarding a recommendation to the City Council regarding the request to rezone the parcel to highway commercial use. Chairman Gray requested that there not be undue delay and representatives of the request keep the Commission informed regard to resolving the access to the parcel. REQUESTS TO SET UP PUBLIC HEARINGS: A request was submitted at the meeting from Standard Auto Parts, Inc. with regard to rezoning a parcel legally described as Part of Lots 41, 42, and 43 of the West Jacksonville Subdivision* 1, City of Jacksonville, Pulaski County, Arkansas. A plat showing the location of the parcel was presented with the request and after viewing the same, Commissioner Elliott moved, seconded by Commissioner Piggee to set up a public hearing as requested, to be conducted at 7:15p.m. during the Regular Plan- ning Commission meeting, to rezone the above legally described parcel from R-3 to C-2. MOTION CARRIED. Chairman Gray recommended that the regularly scheduled time of the Planning Commission Meeting be changed from 7:30 p.m. to 7:00 p.m. There were no objections from the Commission to said recom- mendation. It was requested that notification be sent to the media and that the Commissioners be called before the next regu- lar meeting. NON-AGENDA-LAND USE MAP Chairman Gray requested that the map as drawn up by Metroplan through the efforts of the Planning Commission be presented to the City Council for consideration at the first City Council Meeting in January. He pointed out that the Council would set the date and time of a public hearing with regard to approval of the map of the City of Jacksonville.
