OPENING REMARKS: Mayor Swaim presided over the meeting and
requested ROLL CALL.
ROLL CALL:
Commissioners: Kenny Elliott, Paul Payne, Jim Dornblaser, Bart
Gray Jr. and Lester Piggee answered ROLL CALL. Commissioners Tad
Green and James Davis were absent. Mr. Art Brannen and Mr. Frank
Dowd answered ROLL CALL after Mayor Swaim administered the Oath
of Office. PRESENT seven (7). ABSENT (2). Mayor Swaim declared a
quorum.
Others in attendance for the meeting were City Engineer Duane
Reel, Receptionist/Computer Technician of the Engineering Depart-
ment Mylissa Founds, Code Enforcement Officer Wayne Cox. peti-
tioners and interested citizens.
Mayor Swaim encouraged the new members as they entered the work
of planning commissioner.
He then presented Mark Goodsell a plaque and expressed apprecia-
tion for his work on the Planning Commission.
ELECTION OF CHAIRMAN OF THE PLANNING COMMISSION:
Commissioner Bart Gray Jr. placed the name of Commissioner
Elliott as Chairman. There being no other nominations,

Commissioner Gray moved,· seconded by Commissioner Piggee that
Commissioner Kenny Elliott be elected to the position of Planning
Commission Chairman by acclamation. MOTION CARRIED.
Chairman Elliott then expressed appreciation for the position of
Chairman of the Planning Commission and proceeded to chair the
remainder of the meeting.

Chairman of the Planning Commission and Chairman of the Board of

The following Planning Commissioners. Mr. Paul Payne and Mr. Art
Brannen. volunteered to serve with Mr. Davis. Chairman of the
Board of Adjustment, as members of said Board.

Commissioner Gray moved, seconded by Commissioner Piggee to set a
public hearing for 7:10p.m .. February 10. 1992 at City Hall
during the Regular Planning Commission Meeting scheduled for that
date. MOTION CARRIED.
DEVIATION IN AGENDA:
PUBLIC HEARING: 7:15 P.M. Ref: Rezoning from R-3 to C-2. Part
of Lots 41. 41 and 43. West Jacksonville Subdivision
There were no comments of a negative nature with regard to the
rezoning request and it was noted that the property was posted.
It was pointed out by City Engineer Reel that the owner is aware
of a sewer line easement on which there can be no construction.
Chairman Elliott closed the public hearing at approximately 7:18
p.m.
After a short discussion regarding location and zoning in the
area. Commissioner Gray moved, seconded Qy Commissioner Payne
that the rezoning reguested for Part of Lots 41. 42 and 43, West
Jacksonville Subdivision from R-3 to C-2 be RECOMMENDED FOR
APPROVAL to the City Council. MOTION CARRIED.

Chairman Elliott recognized Code Enforcement Officer Wayne Cox
who addressed the Planning Commission regarding the r e quest. He
voiced that setback requirements are met and the ci ty has no
problem with the request.
Commissioner Payne moved, seconded by Commissioner Dornblaser to
approve the building permit requested by Jacksonville manufactur-
ing Company for expansion of the present facility. MOTION CAR-
RIED.

City Engineer Reel pointed out that the plat is presented as the
result of a request by the commission for a plat of the parcel
owned by Mrs. Wood. He said that all things required by the city
in prtparat1 on of a final plat are met in the drawing .
Commissioner Gray moved, seconded by Commissioner Piggee that the
"FINAL PLAT of WOODCUT SUBDIVISION" be APPROVED as presented.
MOTION CARRIED.
Chairman Elliott noted that the plat would be presented to the
City Council for action at their next regular meeting.

City Engineer Reel addressed the Planning Commission. He ques-
tioned the access to the lots with frontage on North First Street
and recommended that a common drive be constructed to serve the
lots.
It was determined that present zoning in the area is C-2 and that
a shopping center is permitted in said zoning classification.
Chairman Gray pointed out that the minimum requirement for lots
in C-2 zoning is 15,000 sq. ft.
Mr. Green voiced that he has no knowledge of what will

With regard to access to the lots, he said the proposal is two
main entrances off North First Street into the interior of the
shopping area, one which now exists and one to be constructed.
He explained that lots one, two, three and four would be served
of f the existing drive, five and six off the common driveway and
lots seven and eight accessed off First Place Drive which would
be a dedicated drive. He said that the plat is in line with a
pencil drawing he presented to the Planning Commission in 1991.
A general discussion ensued.
City Engineer Reel voiced that his recommendation to the Planning
Commission is that there be a common drive parallel to North
First Street with two entrances off North First into the subdivi-
sion.
There was a lengthy discussion regarding the size of the lots as
platted, street locations and access off North First Street into
the subdivision.
City Engineer Re~l voiced that the Preliminary Plat should convey
the full development scheme with regard to lots, easements,
streets as well as each phase of the development.
It was pointed out by Chairman Elliott that the lot sizes are
about half the Municipal Code requirement in the commercial zoned
area.
Mr. Green voiced that in early 1992, Stonewall Drive would be
completed.
City Engineer Reel requested that a revised plat showing the
access off North First Street, lot size modification and the
plans for the development of the entire commercial area, includ-
ing each phase of the development, be submitted to the Planning
Commission.
Commissioner Gray moved, seconded by Commissioner Brannen that
Mr. Green confer with City Engineer Reel to put the plat in line
with C-2 zoning and present the plat to the Planning Commission
at a later date. MOTION CARRIED.
Mayor Swaim presented a plaque as a token of appreciation to Mr.
John Herbold for his efforts as Planning Commissioner.
The Planning Commission did not take a motion off the table
regarding a request by Mr. Byron McKimmey to rezone a parcel
adjoining Dupree Park. The matter was not discussed by the
Commission upon the advise of City Attorney Robert Bamburg.

Parks & Recreation Commission should be made
of the Planning Commission.
Mayor Swaim complimented the work of the Planning Commission and
expressed a desire that property along the West Main · extension
past Bayou Meto be considered for annexation into the City of
Jacksonville. He said that the property owners have expressed a
desire to become a part of the city.
City Engineer Reel voiced that he recommends an orientation for
the new members of the Commission.
He pointed out that the City Council will be taking action on a
revised Land Use Map of the City of Jacksonville at the Regular
City Council Meeting scheduled for February 20, 1992 at 7:15 p.m.

Chairman Elliott pointed out that the access easements were
questioned as they appear on the plat at the last meeting. He
related that the Planning Commission suggested at that lots two
and three be combined to bring them into compliance with code
regulations and that it was requested that the access easement be
on the front of the lots.
Engineer Reel stated that the access as shown on the plat is not
quite opposite Poplar Street and that the excess shown to be 176
ft. from the right of way line of Center Street lines up with
Willow Street. He said it seemed more appropriate geometrically
to have the streets in line with existing streets than to have an
offset at that point. He said that location of the drive prob-
ably would not cause a back up of traffic at the intersection.
Commissioner Brannen questioned the possibility of eliminating
one access into th~ subdivision.
City Engineer Reel explained that Lot 5 wou ld access off the
easement opposite Willow St.~ Lot 4 off the access opposite
Poplar adding that no access would be granted off North First
Street onto Lots 4; 5, 6 and 7. He related that the only access-
es designated on the plat onto North Fir st Street cuts Lot 3 in
half and the other is between Lots 5 and 6. He pointed out that
Lot 1 is served by an access easement sh6wn on Lot 2 and 3, Lot 4
is served by the access easement shown on Lot 3, Lots 5 and 6 are
served by the access shown to be in line with Willow Street and
Lots 7, 8 and 9 served by the access off Center Street.
Commissioner Gray noted that easements are shown on the Prelimi-
nary Plat versus construction of streets.
Mr. Green voiced that the access easements are really private
drive easements, they are not dedicated streets. He said they
are proposed to give legal access to lots which they affect.
Commissioner Dornblaser voiced that he would like to see Lots
and 6 modified.
Mr. Green said that reasons regarding ownership have determined
the layout of those particular lots.
Chairman Gray said that he would like to see the entrance across
from Willow Street be put back to the fifty foot building l1ne
and the street built off Center Street completed to Lot 9.
Mr. Green voiced that the plat is his concept of what he would
like to see done, not wh at may actually be done. He said that he
has a problem pre-determining for the commercial occupants.

Commissioner Gray suggested that the plat be considered a Sketch
Plat versus a Preliminary Plat relating that single lots could be
presented as Preliminary Plats as necessary.
City Engineer Reel explained the purpose of a sketch plat serves
the purpose of following a particular concept with the privilege
to bringing one or more lots with proposed changes as long as the
access shown on the sketch plat remains the same.
It was pointed out by Chairman Elliott that streets as proposed
in the plat would not be ones that would be dedicated to the City
of Jacksonville for maintenance.
Cit y Engineer Reel contended that the owner of Lot 9 has to have
a guarantee that he does have a viable access into that lot and
that he sees where the drive up to the end of Lot 9 could be
required to be ~city street, built to city specifications;
commenting that the Commission may need to consider requiring the
same of the developer.
There was more discussion with regard to lot access according to
the plat and the responsibility of street maintenance.
Mr. Green said that the oriqinal proposal for the street off
Center Street was that it be a dedicated one but that it is not
shown on this plat as such.
City Engineer Reel mentioned that there is a situation in the
city at this time in an industrial complex where streets were
taken over and they were not dedicated to the c1~y for maln -
tenance and now they are requested for maintenance and they are
not built to city specifications which is causing conflict.
Chairman Elliott voiced that he felt the plat should be called a
Sketch Plat and accepted as such.
City Engineer Reel voiced that access onto North First St. will
not change and that access for Lots 6 & 7 will remain as shown on
the plat.
Commissioner Payne moved, seconded by Commissioner Gray to ad-
dress the plat presented by Mr. Green as a Sketch Plat of First
Place Commercial Addition, Phase I, Stonewall Subdivision, and
approve it as is. MOTION CARRIED.
It was pointed out to Mr. Green that he can bring back, as a
Preliminary and/or a Final Plat, a lot or lots without improve-
ments.

the City of Jacksonville be rezoned from R-3 to C-3. MOTION
CARRIED.
Chairman Elliott voiced that the request for rezoning will be
recommended to the City Council at their meeting of February 20,
1992.
Chairman Elliott declared the public hearing officially closed at
approximately 7:38 p.m.

He addressed the item and stated that he did attend the Park and

determined that 133 trees would be lost which make up almost the
entire buffer between Dupree Park and the freeway. He said the
vote was almost unanimous that it wou ld not be in t he best ben e-
fit of the community to rezone the property . He said that he had
sympathy for the position Mr. McKimmey is i n re lati ng that per-
sons in the cu ldes ac which would be affected were very unfavor-
ab l e to the request.
Chairman Elliott pointed out the location of the parcel for the
sake of the new members.
Commissioner Gray voiced that access to the property creates
extreme problems for the property which he sa1d is nice property
fronting the freeway.
Commissioner Gray moved, seconded by Commissioner Dornblaser that
the request to rezone that Part of the NW1/4, SE1/4~ Sec. 25~ T-
3-N, R-10-W, adjacent to Dupree Park, as requested by Mr. Byron
McKimmey, be DENIED. MOTION CARRIED.
An orientation for the member s of the Planning Commission was set
for Monday night, 7:00p.m., Februa r y 24, 1992 at City Hall .

The Preliminary plat was viewed by the Planning Commissioners.
Engineer Reel voiced that a similar plat was submitted by Savers
several years ago.
Commissioner Gray asked if the plats were the final
development in the Stonewall Subdivision.

Mr. Green stated that he has approximately twelve additional
acres which are zoned multi-family. He pointed out that if the
need is greater for single family dwellings, the parcel may be
converted into a single family.

There was discussion regarding the complet1on of Stonewall Drive
and the development of the culdesacs as indicated in the Prelimi-
nary Plat before the Commission.
Mr. Green requested that he be allowed to complete Stonewall half
way.
It was pointed out by City Engineer Reel that he had related to
Mr. Green that any Final Plat presented to the Commission would
need to include the completion of Stonewall Drive to Hwy 161.
There was discussion regarding a portion of the Preliminary Plat
being presented in Final Plat form. It was the consensus of the
Commission that Mr. Green could in fact bring back in Final Plat
form a portion of the plat before the Commission.
Engineer Reel related that plat approval is only good for twelve
months.
He pointed out that Mr. Green has paid half the fee required for
all lots indicated on the plat and that if all of Stonewall Drive
is completed and half the lots in the subdivision on two of the
culdesacs are presented in a Final Plat, he would only pay the
remainder of the fee required for said number of lots indicated
in the Final Plat.
A discussion ensued relating to the completion of
Drive.

Commissioner Gray moved, seconded by Alderman Piggee that all of
Stonewall Drive will be completed in conjunction with whatever
plat approval is given by the Planning Commission. MOTION CAR-

After a lengthy discussion regarding the development of the
proposed Phase V before the Planning Commission, Mr. Green
related that he would probably develop Regency and New Castle
cul desa.cs first.
Commissioner Gray moved, seconded by Commissioner Dornblaser
that twenty-six lots . on Regency and New Castle culdesacs be
approved as a Preliminary Plat of Phase V, Stonewall Subdivision
with the stipulation that Stonewall Drive be completed to Hwy
161. MOTION CARRIED.

Mr. Brannen mentioned a Bill of Assurance. which is valid until
the year 2,000 at which time it is to be reconsidered, as he
eluded to the lots immediately behind the building originally
constructed by Edgewood Realty. He related that in the Bill of
Assurance removal of a building is required if the development of
the subdivision materializes.
Commissioner Payne stated that the first five lots are not in-
cluded in the request before the Commission.

Mr. Gray pointed out that all lots requested to be rezoned are
posted, noting that at the corner of Vine St. and HwY 161 a sign
is posted in error, that Lo t 1, Block 4, Harry Harpole Addition,
is not included in the rezoning request.
Mr. Harley Jackson, 204 Brewer, that he had spoken with the resi-
dent located on Lot 1, Block 4 concerning the rezoning. He
further related that the owner was unaware of the circumstances
surrounding a rezoning sign placed o n her property , relating that
she would be 1n favor of the rezoning if the aforementi o ned
property were also rezoned.
Chairman Elliott pointed out that she could not at this time be
added to the current rezoning request, that a formal request
would have to be placed before the Planning Commission before
they could review the matter.
Mr. Elihu Bevill expressed opposition to the rezoning request.
Mr. Joe Smith of 105 Braden addressed the Committee expressing
concerns for the type of businesses permissible under the new
rezoning.
Chairman Elliott asked City Attorney Robert Bamburg to clarify
what type of business is allowed in C-1 zoned areas.
City Attorney Bamburg read a varied list of businesses that could
be operated under a C-1 zoning from the Jacksonville Municipal
Code Book.
Mr. Gray spoke briefly on the intended use of Lots 11a & b a~
quiet businesses under the rezoning classification and that Mr.
Jay Hudson's business would relate to art.
Mr. Harley Jackson briefed the Commission on activity over the
years with regard to the lots up for rezoning. He related that
there is a lot of opposition to the rezoning and that he felt the
length of time advertising the requests had not been sufficient
for the community to be prepared to give proper input at th~
public hearing.
He also made negative comments regarding the work of the Commis-
sion with Metroplan and the negative impact the approval of the
rezoning will have on the community.

~ommissioner Dornblaser explained the position of the Commission-
ers relating to the fact that they do not receive a salary and
that their greatest concern as commissioners is to do the best
for the community as a whole.
City Engineer Reel related that it had been approximately ten
years since the land use map had been addressed and that the
study and work of the Planning Commission and the Council covered
approximately six months. He pointed out that the growth of the
city is in the northeast section in the area up for rezoning. He
noted that land use studies are recommended by Metroplan every
ten years and brought to the attention of all present that High-
way 161 will eventually become a four-lane thoroughfare.
Chairman Elliott closed the public hearing at 7:50 p .m.
Commissioner Dornblaser moved, seconded by Commissioner Payne
that the rezoning requests as listed below be approved and recom-
mended to the City Council for rezoning as indicated.

A site plan was submitted which indicated a seven foot side yard
building line. City Engineer Reel related that he had no problem
with the request in that the firewall as proposed will make the
request in compliance. He also voiced that the proposed layout
has the same setback as Kentucky Fried Chicken and is to be
located between that business and Southside Body Shop. Parking
spaces as displayed on the site plan were deemed adequate to meet
code requirements.
Commissioner Davis moved, seconded by Commissioner Brannen that
the building permit request of Payless Shoes be APPROVED as
presented. MOTION CARRIED.

A site plan was submitted which indicated the expansion intent.
City Engineer Reel related that total expansion will encompas s
approximately 95,000 square feet. He pointed out that drainage in
the area will not be affected by the expansion when Commissioner
Patton posed a question about the same.

Commissioner Gray moved, seconded by Commissioner Davis to
APPROVE the rezoning of the parcel of land addressed as 10016 So.
Hwy 161 as requested by Mr. & Mrs. Norwood from R-1 to C-1 with
the stipulation that the three tracts of land be plated as a one
lot subdivision, named Norwood Subdivision.
