REGULAR PLANNING COMMISSION MEETING
JANUARY 10, 1994
7:00 P.M. -7:45 P.M.
Mayor Swaim acting as Chairman called the meeting to order and
asked for Roll Call.
ROLL CALL:
Commissioners: Rudy Reid, Art Brannen, Tad Green, Jim Dornblaser,
Lester Piggee and Mr. Kenny Elliott answered ROLL CALL. It was
noted that a quorum was present. PRESENT (6) SIX, ABSENT (2).
Others in attendance for the meeting were City Attorney Robert E.
Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings,
Computer Technician Mylissa Founds, Mr. Tommy Bond, Mr. Bart Gray,
petitioners and other interested persons.
DEVIATION IN AGENDA: OATH OF OFFICE ADMINISTERED
Mayor Swaim administered the oath of office to reinstate
Commissioner Dornblaser and to instate Mr. Kenny Elliott.
Mayor Swaim expressed appreciation to former Chairman Gray and
Commissioner Payne for their service on the Planning Commission.
Their terms of office expired January 1, 1994.
Mayor Swaim entertained a motion for nomination of Chairman of the
Planning Commission.
Commissioner Brannen moved, seconded by Commissioner Green to
nominate Mr. Kenny Elliott for Chairman of the Planning Commission
for the term of one year to expire January 1, 1995. MOTION
CARRIED.
Mayor Swaim relinquished the gavel to Chairman Elliott.
Chairman Elliott asked for nominations for Vice Chairman of the
Planning Commission and Chairman of the Board of Adjustment.
Commissioner Dornblaser moved, seconded by Commissioner Reid to
nominate Commissioner Brannen for Vice ChaiDman of the Planning
Commission and Chairman of the Board of Adjustment. MOTION
CARRIED.
Chairman Elliott asked for volunteers for the Board of Adjustment.
Commissioner Green and Commissioner Reid volunteered for service
with the Board of Adjustment.

RESUME AGEIDA: APPROVAL AND/OR CORRECTION OF MINUTES
Commissioner Piggee moved, seconded by Commissioner Dornblaser that
the minutes of the December 13, 1993 Regular Planning Commission
Meeting be APPROVED as presented.
Commissioner Piggee expressed appreciation to former Chairman Gray
for expressing his views as related in conversation to Chairman
Gray prior to the previously regular scheduled Planning Commission
Meeting in December. Commissioner Piggee related that he was
unable to attend that meeting but wanted to offer his views to the
Commission.
MOTION CARRIED at this time.
Chairman Elliott asked for comments concerning the 1993 Annual
Planning Commission Report.
Secretary Lu Leonard related that she would like to include changes
of two pages for the Annual Report.
Commissioner Brannen moved, seconded by Commissioner Piggee to
APPROVE the 1993 Annual Planning Commission Report with the
changes noted. MOTION CARRIED.
REQUESTS TO SET PUBLIC HEARINGS:
REQUEST TO BUILDING PERMITS: Twin City Bank
Chairman Elliott related that the first item of business is a
building permit for Twin City Bank.
City Engineer Reel related that all setbacks and parking
requirements meet code standards for C-3 zoning.
It was discussed that the Preliminary and Final Plats petitioned by
Mr. E. L. Misak is the development area supporting the request for
a building permit by Twin City Bank.
DEVIATION IN AGENDA
REQUEST TO APPROVE PLATS: Misak Commercial Subdivision
Chairman Elliott related that he would like to address the item of
the Preliminary and Final Plats prior to addressing the proposed
building permit with regard to plat approval.
City Engineer Reel related that the property is located between
Northgate Drive and Bayou Meto Cemetery boarded on the East Side of
First Street. He related Mr. Misak' s desire to subdivide the
property with intent to sell a portion of the property to Twin City

Bank for construction of a branch office. He further related that
with water and sewer available, Mr. Misak was encouraged to submit

Commissioner Brannen moved, seconded by Commissioner Green to
APPROVE the Preliminary and Final Plats of the Misak Commercial
Subdivision. MOTION CARRIED.
RESUME AGENDA
REQUEST TO APPROVE BUILDING PERMITS: a. Twin City Bank
Chairman Elliott re-introduced the item of business.
City Engineer Reel related that the question of spacing of the
driveways had arisen. He related that according to code the drive
can be located as close as 50 ft. on Northgate Drive which does not
present a violation with ingress and egress. It was noted that
building setbacks and parking requirements have been met.
Commissioner Green moved, seconded by Commissioner Dornblaser to
APPROVE the building permit as submitted by Twin City Bank. MOTION
CARRIED.
b. Preliminary Plot Plan/Boyd Property Northeastern Avenue
Petitioner: Tommy Bond
City Engineer Reel related that the property is un-platted and
located on the West side of Northeastern close to Red Fox Lane. He
related that the owner is aware that the street will have to be
extended in order to achieve access to the property. He further
related that the property is zoned properly for the intent of the
owner.
Commissioner Dornblaser moved, seconded by Commissioner Reid to
APPROVE the building permit as submitted. MOTION CARRIED.
REQUEST TO APPROVE PLATS: a. Sketch Plat/Growing Pines
Subdivision Petitioner: Bart Gray
City Engineer Reel related that the property is located South of
Ray Road, East of Stanphill, West of Southeastern and North of the
Akridge Mobile Home Park with residence on both sides facing the
surrounding streets. He related that the zoning will support
single family residential construction which is the intent of the
petitioner.
Commissioner Dornblaser inquired as to the intent of road
development with regard to adjoining property owners.

Mr. Bart Gray related that the sketch plat by Mr. Penn was designed
originally with a culdesac and that he and Mr. Penn are in
agreement with regard to the development of a street through Mr.
Penn's proposed culdesac . He further related that the property
owned by Mr. Leroy Akridge adjoins the proposed Growing Pines
Subdivision from the opposite side and that there is the potential
of a possible street development with Mr. Akridge who was also in
agreement.
Commissioner Dornblaser pointed out that with a subdivision of this
size it is the practice of the Planning Commission to request two
points of access. He suggested sketch plat approval with the
stipulation that further development approval be contingent upon
adequate access.
Mr. Gray suggested a recommendation of phase approval with Planning
Commission consideration in regard to agreement resulting in street
development as the stipulation. He related that he would work
toward agreements of access with the adjacent property owners.
Chairman Elliott invited participation from the public.
Mrs. Norma Hollingshead of 1509 Stanphill expressed concerns with
regard to traffic flow. She explained that the street leading to
Military Road was a short street expressing concerns with regard to
the increase of traffic and future development.
Mr. Gray related that the intent is to develop the first phase
along Southeastern adding that the second phase would be contingent
on the sale of the first phase with an overall estimated
development time span of five years.
Mrs. Anna Bernard of 1512 Stanphill, and Lori and Mike Tapp of 1417
Stanphill Road expressed their support for Mrs. Hollingshead's
statement.
Commissioner Dornblaser clarified that the Sketch Plat is only Mr.
Gray's indication of his intentions for the property and that
approval of the Sketch Plat does not indicate approval of the
entire subdivision by the Planning Commission. He related that the
property is zoned for the intended use proposed by Mr. Gray.
Chairman Elliott related that the area is zoned for multi-family
development while Mr. Gray's intent is for single family
residential development, reviewing public concerns over density and
increased traffic flow for different kinds of development.

Mrs. Hollingshead further expressed traffic concerns for the area.
In response to a question posed by Commissioner Piggee in regard to
future plans for the area, City Engineer Reel related that the Hwy
Department has no intent to change the situation at Stanphill Road
that he is aware of.
Chairman Elliott related that the proposed development for most of
the lots in phase one of the subdivision would be accessed from
Southeastern with only a few lots using Stanphill Road as an
access.
Conunissioner Brannen moved, seconded by Conunissioner Green to
ACCEPT the Sketch Plat of Growing Pines Subdivision with the
stipulation for an additional entrance to the subdivision. MOTION
CARRIED.
Commissioner Reid asked if the situation could be monitored with
regard to a solution to the traffic problems of the area.
City Engineer Reel related that a tabulated list of accidents
involving Hwy 294 and Stanphill Road could be submitted to the Hwy
Department for consideration with regard to safety improvements.
b. Sketch Plat-Replat/Foxwood Country Club Petitioner Ted Belden
City Engineer Reel related that the Foxwood Country Club desires to
split the lot adjacent to the Country Club property for development
and sale. He further related that the owner of the adjacent corner
lot also desires a lot split. He then related that he was unaware
of how utilities would be provided to the lots adding that street
cuts have not been allowed in the last year due to re-paving of
Foxwood Drive. He further related that the Bill of Assurance may
not support a lot split.
Mr. Tommy Bond related that the Bill of Assurance for Foxwood Phase
Three requires signatures of two-thirds of the residents to approve
a split of lot 168 before it can be brought before the Planning
Commission.
He related that the Country Club desires to split a lot that is a
part of the original golf course which is not subject to the
Foxwood Bill of Assurance adding that sewer and water is available
from Foxwood Cove with regard to the utilities access.

Assurance requested signature approval from a Property Owners
Association which to his understanding, does not exist.
Mr. Bond read from the Bill of Assurance.
Mr. Crosby the owner of lot 168 stated that the lot subdivided
would retain 150 foot frontage and 100 foot frontage on an
additional lot which he noted to be more than the lots currently
being developed in the Foxwood Subdivision.
Commissioner Dornblaser moved, seconded by Commissioner Piggee to
APPROVE the Sketch Plat-Replat with the stipulation that it is in
compliance with the Bill of Assurance as deter.mined by the City
Attorney. MOTION CARRIED.
Discussion ensued as to the future development plans for the down
town Main Street area. Consensus of the Planning Commission was to
include further discussion of this matter at the regularly
scheduled Planning Commission Meeting, February 14, 1994.

Chairman Gray presented a plaque to Mr. Paul Payne expressing
appreciation for his excellent work on the Planning Commission and
the Board of Adjustment from 1991 to 1994. Mr. Gray was not
present to receive his plaque.
APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission
Meeting/January 10, 1994
Commissioner Dornblaser moved, seconded by Commissioner Piggee that
the minutes of January 4, 1994 be APPROVED. MOTION CARRIED.
It was pointed out by Mr. Dornblaser that an item mentioned in the
minutes regarding the future development along Main Street was not
on the agenda and requested that it be discussed at the appropriate
time during the meeting.
It was requested that the item be placed on the next agenda (March)
along with a request to City Engineer Reel to contact Metroplan and
have a representative present to discuss Main Street building
restrictions and development and advise the Commission.

Chairman Elliott read the letter from Mr. McKimmey regarding two
variances included in the Preliminary Plat Approval request; Lot

exceeds the five hundred foot maximum distance permitted i n the
Jacksonville Municipal Code.
City Engineer Reel explained that he desires that the lot requested
for a 15 ft. front setback meet the 25 ft. front setback
requirement and that the long culdesac be allowed. He pointed out
that the County will see the plat after the Jacksonville Planning
Commission deals with it. He related that the County will look
after the streets, that the water is served by the City of North
Little Rock and sewer by the sewer approval district in Gravel
Ridge. He said that basically, the Commission is looking at street
design and geometry of the culdesac as it relates to the
subdivision.
There was discussion regarding emergency vehicles in relation to
the length of the culdesac.
City Engineer Reel pointed out that proper radius of the culdesac
would take care of a situation with normal emergency equipment. He
said that the rules and regulations used in the subdivision
development were set in the early sixties by the University of
Arkansas for small cities establishing Planning Commissions.
It was the consensus of the group that the culdesac is actually
about 800 feet making a variance of 300 feet requ~sted according to
the Jacksonville Municipal Code.
Mr. McKimmey related that the plat is the last development of Green
Valley Development.
Engineer Reel said that the par cel is the last usable property in
the area and that the design of the culdesac is proposed due to the
terrain.
It was pointed out by Commissioner Dornblaser that it has been the
practice to mark lots falling within the flood plain with an F and
suggested that lots 24, 25 and 26 be designated in the same way.
The following motion was made expressing concerns of the comm i ssion
regarding culdesac length.
Commissioner Dornblaser moved, seconded by Commissioner Foster that
the PRELIMINARY PLAT of DEER CREEK SUBDIVISION be APPROVED with the
following stipulations: (1) that the culdesac length be approved
as requested and (2) that the fifteen (15) ft. front setback for

Commissioner Patton expressed concerns regarding the subdivision
not having but one ingress and egress.
MOTION CARRIED. There were no votes opposing the plat.
DISCUSSION: Annexation of Property between Jacksonville and
Sherwood
City Engineer Reel voiced that efforts by the Chairman of the
Planning Commission of Sherwood, the Mayor and property owners, who
requested to be annexed to the City of Sherwood in the area along
Highway 67/167, seem to have made it a moot issue with regard to
Jacksonville's requesting the annexation of certain properties into
the city. He said that Mr. Dupree, who owns some property off Lucy
Lane, does not want to be a part of Sherwood and that the City of
Sherwood has agreed to revise the legal description granting
freedom to the City of Jacksonville to annex the property. He said
that two other parcels indicated on a map before the commission
should be considered for annexation into the city and that a parcel
along Loop Road should be included in the effort.
There was general discussion regarding the annexation process and
areas that might be annexed into the City of Jacksonville.
It was the consensus of the Planning Commission that City Engineer
Reel compile the data needed to present the parcels to the City
Council for annexation into the city.
DISCUSSION: MAIN STREET DEVELOPMENT AND BUILDING RESTRICTIONS
Commissioner Dornblaser voiced his concerns regarding Main Street
and the possibility of imposing building restrictions with regard
to its development.
City Attorney Bamburg pointed out that some restrictions can be
placed, that some things would have to be "Grandfathered" in under
present restrictions and related that the task will not be an easy
one.
After a general discussion the consensus of the Planning Commission
was that City Engineer Reel contact Metroplan and Main Street
Arkansas requesting that a representative meet with the Planning
Commission with regard to guidelines for improving the area .

APPROVAL AND/OR CORRECTION OF MINUTES
Chairman Elliott noted an error on page one (1), paragraph four
under PRESENTATION OF PLAQUES, of the Feb. 14, 1994 minutes. The
correction reads; Chairman Elliott presented a plaque to Mr. Paul
Payne expressing appreciat:i.on for his excellent work on the
Planning Commission and the Board of Adjustment from 1991 to 1994.
Commissioner Brannen moved, seconded by Commissioner Piggee, that
the minutes of the February 14, 1994 Regular Planning Commission

REQUEST TO BUILDING PERMITS:
Commissioner Brannen moved, seconded by Commissioner Green to place
a request for a building permit with a metes and bounds legal
description on the agenda. MOTION CARRIED.
City Engineer Reel presented a plat with regard to a request to
place a double-wide mobile home on a parcel on Cloverdale Road
approximately 300 feet west of Highway 161 on the north side of the
road and adjoining the Wastewater Treatment Plant on the east
property line.
He pointed out that a couple of years ago, the parcel was rezoned
from residential to mobile home classification (R-4) and that the
Dupree's now want to set a double-wide mobile home on the far east
end of the property.
He related that a deal was made many years ago between the Dupree's
and the Wastewater Utility that the department would get the lots

platted for a subdivision adding that before the swap was
completed, Mr. Dick Morris expired. He noted that he related to
Mr. Dupree that plat work will have to be submitted to the Planning
Commission.
He said that the request at this time is to place a double-wide
mobile home on the two far east lots legally described by metes and
bounds.
City Engineer Reel related that Mr. Dupree would submit a layout
for the next regularly scheduled Planning Commission Meeting adding
that documentation of the arrangements between the Sewer
Commission, Dick Morris and Mr. Dupree needs to be located for the
present supervisor, Dick VanPelt, of Wastewater Utility.
Discussion ensued as to the intent of an Ordinance passed by the
City Council regarding placement of mobile homes.
It was noted that the property has been properly zoned for
manufactured housing.
Chairman Elliott related that the question before the Commission is
to approve a building permit without subdividing the land.
City Engineer Reel related the desire by the petitioner to sell
lots for mobile home use.
Commissioner Brannen moved, seconded by Commissioner Foster to
table the item of business until the next regularly scheduled
Planning Commission Meeting at which time Mr. Dupree should submit
a plat of the land.
Discussion ensued as to the type of hardship this would present to
Mr. Dupree.
City Engineer Reel related that the hardship would be due to the
fact that Mr. Dupree has already ordered placement of the structure
on the property.
ROLL CALL: Commissioners: Foster, Brannen, Green, Dornblaser, and
Patton voted AYE. Commissioner Piggee voted NAY. Motion received
five (5) affirmative votes and one (1) NAY. MOTION CARRIED.

REQUEST TO APPROVE PLATS: a. PRELIMINARY PLAT/GROWING PINES
SUBDIVISION Petitioner: Bart Gray and Thad Gray
City Engineer Reel related that the preliminary plat meets all the
criteria with regard to zoning for single family residences adding
there is a request for a 30 ft. building line instead of the
standard 35 ft. building line. He noted that, in his opinion, only
three lots could justify the request.
Mr. Tim Lemons, from Bond Engineering, representing the item of
business, voiced that other area cities have a standard 30 ft.
front setback for R-1 zoning.
Commissioner Art Brannen voiced concern regarding ingress and
egress for the subdivision.
Mr. Lemons expressed that between lots 28 and 29 allowance has been
made for a street to tie into the Penn Subdivision now being
developed on Southeastern Avenue.
Mr. Lemons explained that lots 19, 20, 21 and lot 31 would be
significantly impacted if the 30 ft. building line is not granted.
It was pointed out that several lots would exceed the 35 ft.
setback due to the shape of the lots in the culdesac.
There was a discussion regarding the development of the two
subdivisions and the reason for a 30 ft. setback with comments from
Mr. Bart Gray Jr. He related conversation between himself and Mr.
Penn with regard to the streets meeting as developments are
completed. He pointed out other developments in which stems have
been included in plats which will connect as adjoining parcels are
developed. He said that the Planning Commission requested a stem
in the Growing Pines Subdivision which is included in the
Preliminary Plat and that Mr. Penn agreed to undo a culdesac in his
development and plat a stem to match the one in the plat before the
Commission. He said that he is not aware of the time frame for
development of the Penn Subdivision adding that with development of
the Growing Pines Subdivision, it could make the Penn Subdivision
more valuable and that it might be developed sooner.
City Engineer Reel said that lots 19, 20 and 21 would be adversely
affected with imposing the 35 ft. building line setback and
culdesac lots 9 thru 14 and 3 thru 8 would need to be accepted with
a 25 ft. setback.
Other discussion included placement of houses on different lots in
relation to setbacks.

City Engineer Reel briefed the Conunission with regard to the
development of properties and added that proper arrangements have
been made by Mr. Penn and Mr. Gray with regard to their subdivision
plats. He said that accesses will be completed when the
development scheme is complete.
He pointed out the land locked situation on Braden St. due to the
Vertac issue adding that seldom does such things happen. He also
related the development of Northwood Acres Subdivision.
Mr. Gray voiced that the first development would encompass 35 lots
which would not create a bottle neck condition with regard to the
ingress and egress. He related that the main objective of a 35 ft.
setback as related to him by Mr. T. P. White is for the purpose of
parking two cars end to end adding that his plans are to have
double drive ways with double garages as part of the Bill of
Assurance.
Commissioner Dornblaser moved, seconded by Commissioner Brannen to
APPROVE the Preliminary Plat of the Growing Pines Subdivision as
submitted with the stipulation that lots 19, 20 and 21 have a 30
ft. setback while lots 9-14 and 3-8 in the culdesacs have a 25 ft.
setback with all other lots having a 35 ft. setback. MOTION
CARRIED.
b. Re-Plat of Lot 66 of the Tara Mount Subdivision
City Engineer Reel related that when Tara Mount Subdivision was
developed a large tract of land was included in lot 66 which was
owned by the developer Albert Johnson. He related the desire to
now split the lot for the purpose of building a home on the
proposed lot 66b adding that all the utilities are ready to serve
the new lot. He related that the dimension of the lot will support
a sizable structure.
Chairman Elliott related that it meets all requirements with a 50
ft. building line setback.
Commissioner Green moved, seconded by Commissioner Piggee to ACCEPT
the Re-Plat of Lot 66 of the Tara Mount Subdivision as submitted.

DISCUSSION: MAIN STREET ARKANSAS/Downtown Revitalization
City Engineer Reel related that after speaking with Metroplan he
contacted Main Street Arkansas who stated that from their point of
view an upgrade of this type would take a concerted effort from the
Chamber of Commerce, Planning Commission, and the Property owners
along Main Street. He related that he has received information
with several suggestions, one being Main Street Arkansas, who would
be willing to suggest ways to organize the revitalization efforts.
He said that the process wouldn't be easy, that it would be long
and that property owners would need to be involved. He related
that he didn't think the city has the authority to make
requirements like when and how much of a driveway to pour. He said
that a public hearing would be in order to get business
establishments along Main Street involved.
City Attorney Bamburg voiced that when the desires of the Planning
Commission are clear, an ordinance could be drawn up and presented
for passage. He explained that classifications of zoning could be
categorized and that future, not present, developments would be
affected.
The consensus of the commission was that a committee be formed.
City Engineer Reel pointed out that some manufacturing as well as
commercial zoning exists along Main Street. He said that districts
should be set up in the process.
City Attorney Bamburg voiced that efforts through the Chamber of
Commerce did not get off the ground due to lack of funding among
other things.
Chairman Elliott asked for volunteers for the Main Street
Revitalization Committee. Commissioners Foster and Brannen
volunteered from the Planning Commission, Mr. Bart Gray Jr.
volunteered to serve as a citizen at large. Mrs. Leslie Belden who
has been placed before the City Council to fill a position on the
Planning Commission was present for the meeting and volunteered her
services on the committee. Chairman Elliott suggested that Mrs.
Rona Scott and Phil Sullivan from the Economic Development
Department be asked to serve as well as Diana Gunlock from the
Chamber of Commerce and Jerry Halsell, Industrial Specialist.
It was suggested that a member of the City Council also be asked to
serve on the "Main Street Revitalization Committee".

City Engineer Duane Reel related that the property is located on
both sides of Foxwood Drive east of Northeastern and is zoned R-5.
He related that Mr. Jim Green purchased the property and desires to
develop the land for single family residential lots. He then
related that the lots are sizable adding Mr. Greens intention to
pursue to final plat stage.
Mr. Green responded to a question posed by Commissioner Belden as
to the size of the lots. He stated that lot 6F or 7F were possibly
going to be the location for a horne he intends to build for
himself.
It was then related by Mr. Green that the whole development is
located inside the flood plain.
City Engineer Reel related that the amount of filling needed would
not be much more than normally required in pier and beam type of
construction in order to bring finished floor elevations one foot
above the hundred-year flood as required by the City.

Chairman Elliott related that an organizational meeting will be

Commissioner Dornblaser stated that while currently we are looking
at Main Street the focus should include all of Jacksonville. He
related that zoning restrictions such as on North First is a
typical example. He related concern over the problem with having
to cut the top off the magnolia trees due to the power lines.

City Engineer Reel related that with the planned widening along
North First the magnolia trees are to be removed, he then added
that the trees were found to be diseased when inspected by the
Highway Department who determined that only one of the magnolia
trees toward the south end could survive being transplanted.
Chairman Elliott related that once the committee is established
expanding the scope may become an option for evaluation.
City Engineer Reel related that Susan Dollar from Metroplan has
expressed desire to attend the meetings.

lots 47 thru 55 which face Cloverdale Road across from Homer Atkins
School. He stated that the lots already have the necessary

legally described property requested for rezoning, the property is
zoned C-1 and on the west and north sides it is zoned R-1.

City Engineer Reel related that the proposed construction is to be
on the south side of Pay less Shoes on North First Street. He
stated that for the show room space proposed they would have
adequate parking adding that four additional parking spaces could
be added in the front of the building to comply with the square
footage requirements.

Chairman Elliott opened the public hearing at approximately 7:03
p.m.
Commissioner Green excused himself as a commissioner and a voting
member of the commission to speak to the item of business.
City Engineer Reel was recognized by Chairman Elliott to address
the request of Mr. Tad Green regarding the rezoning of Lots 7, 8,
9, 10 and 11, Blk. 2, Brown Addition to the City of Jacksonville,
Arkansas.
He pointed out that the location of the lots are on the west side
of James Street bounded by C-1 lots on the south side and Second
Baptist Church property on the north side. He related that the
City does not have a problem with the request.
Mr. Green asked that the Commission rezone Lots 7, 8, 9, 10 and
11 to C-1. He pointed out that the request falls within the area
targeted by Metroplan for commercial zoning. He related that his
intent is a development for quiet, professional office space.
Commissioner Belden moved, seconded by Commissioner Reid that the
rezoning request of Mr. Tad Green regarding Lots 7, 8, 9, 10 and
11 to C-1 classification be recommended to the City Council.

setbacks are met and that the development scheme adheres to what
was submitted several years ago. He said that he does not have
final approval from the Water and Wastewater Utilities but that a
problem is not anticipated. He added that the City has no
problem with the request.

regarding Lot 503, Stonewall Subdivision Phase VI be granted.

REQUEST TO APPROVE PLATS:
a. Final plat Stonewall Subdivision Phase VI
City Engineer Reel related that a plat presented to the
Commissioners before the June meeting had lots in the flood plain
that were not designated with an "f". He pointed out that Mr.
Green has had another plat prepared which does have the lots in
the flood plain designated with an "f~. He said that letters
from the Water and Wastewater Utilities are forthcoming and that
tests have been made regarding streets which should be completed
within the next ten days.
Mr. Green related that all the lots have been filled in efforts
to get them out of the flood plain. He said that he will be
working with FEMA to get the lots removed from the flood plain.
There was discussion regarding the exact lots with the consensus
being that those which are in the flood plain are lots 484, 485,
486, 487, 488, 489, 490, 491 and 492.

There was discussion regarding common areas.
Mr. Green stated that his intent is to leave a portion behind the
lots along the railroad track for natural growth making a visual
and acoustical block.
The 25' building line for lots 506, 495 and 494 was pointed out
by Commissioner Brannen and during the discussion it was noted by
City Engineer Reel that if the house on the lot faces Stonewall
Drive, the setback must be 35' and if not the 25' setback is
applicable.
Commissioner Brannen moved, seconded by Commissioner Piggee that
the FINAL PLAT of STONEWALL PH VI be APPROVED with the following
stipulations: (1) letters of approval are received from the
Water and Wastewater Utilities, (2) that lots 484, 485, 486,
487, 488, 489, 490, 491 and 492 be designated with an "f"
identifying them as being in the flood plain and (3) that the
streets be completed and accepted by the City Engineer. MOTION
CARRIED.
b. Lot-Split/Jenny Lynn Subdivision Lot 12
City Engineer Reel stated that the subdivision is on the east
side of Northeastern Avenue and immediately adjacent to the south
property line of the Episcopal Church which has recently been
built. He noted the location of the lot as being the
southernmost one in the subdivision. On a map before the
Commission, Mr. Reel pointed out the location of the lot and
noted that a house built by Mr. Brian Boroughs occupies the north
portion. He said that Mr. Boroughs has found a house which he
would like to build with square footage that will fit on the
southernmost portion without interfering with the gas easement.
Commissioner Green moved, seconded by Commissioner Patton that
approval be given for the splitting of Lot 12, Jenny Lynn
Subdivision, making it Lot 12A and Lot 12B, at the request of Mr.
Brian Boroughs. Commissioner Brannen abstained from the voting
process. By a voice vote, THE MOTION CARRIED.
REPORT: MAIN STREET COMMITTEE
A brief report of the last meeting was given by Mrs. Leslie
Belden.
She related that efforts are being made to obtain grants, to
participate in the Mums, Music and Muscadine Festival and to get
the participation of the property owners along Main Street.

Chairman Elliott related that aside from the issue of the building
permit, the proposed accessory building reque!;t9d by Mr. Green is
in violation of the maximum 650 square foot outlined by ordinance.
He then related that Mr. Green will need to seek a waiver from the
Board of Adjustment with regard to the violation. He stated that
the building permit could be approved by the Planning Commission
with the stipulation that a waiver be granted from the Board of
Adjustment.
It was related by Mr. Green that the five acre tract of land is
part of a previous preliminary plat known as the Pinewood
Subdivision. He then related that the name has been changed to Oak
Valley Subdivision, which will not include the legally described
meets and bounds five acre tract to be utilized in the building
permit request.
Chairman Elliott noted that the five acre tract consists of two
lots that were previously addressed as part of the Pinewood
Preliminary Plat.
After a short discussion it was concluded that the property meets
the zoning requirements for the proposed construction.

1613 Foxwood Drive be approved as submitted stipulating that the
petitioner seek a waiver from the Board of Adjustment with regard
to maximum square footage for the unattached accessory building.

Chairman Elliott related that the request included a change of
fifteen foot and twenty-five foot building lines, facing the house
toward the twenty-five foot building line.
Discussion ensued as to the Bill of Assurance with regard to
building lines.
It was related by Mr. Tim LE ·mons that lot 92 on the west side has
a fifteen foot building line. He stated that the garage will face
Delta Court and the drive way will come in from the east property
line.
Commissioner Brannen moved, seconded by Commissioner Reid to
approve the Re-plat of lot 93 Tara Mount Subdivision as submitted.

b. Sketch Plat of Jerry Smith property located at the northeast
corner of Main Street and Harris Road.
Chairman Elliott introduced the item of business inviting questions
from the Commissioners.
Discussion ensued as to the ingress and egress points with regard
to the proposed development of streets within the subdivision and
the access of lots lF through 7 which front on Main Street.
Commissioner Brannen pointed out that the development contained a
culdesac of 750 feet which exceeds the Jacksonville Municipal Code
by 250 feet.
Chairman Elliott pointed out that Main Street is an arterial street
and that it may develop into four lanes in the future, engulfing
any entrance lane proposed for ingress and egress with regard to
lots lF through 7.

Commissioner Belden suggested that the longest culdesac could be
re-designed to connect with Main Street and create an access for
the lots now facing Main Street
Discussion ensued as to the plans of the developer with regard to
filling all lots in the flood plain to comply with the 252
elevation.
It was the consensus of the Planning Commission that the 750 foot
culdesac would need to be addressed at the preliminary plat stage.
Oth~r concerns were addressed as to the ingress and egress of the
lots onto an arterial street (Main), with regard to the growth
plans for the future.
Commissioner Brannen moved, seconded by Commissioner Dornblaser to
table the Sketch Plat asking the developer to address the
stipulations 1) a modification of the long culdesac and re-design
of lots lF through 7 with regard to drive ways off Main Street.
MOTION CARRIED.
c. Final Plat/Growing Pines Subdivision
Chairman Elliott asked for comments from the position of the City
of Jacksonville.
Code Enforcement Officer Wayne Cox related that the subdivisic:n has
Sewer and Water approval and is completed with the exception of
streets. He related that the position of the City is that the
streets be completed and approved by the City Engineer bef.ore any
building permits are issued.
Chairman Elliott related that City Engineer Reel stated that he
would like to delay recommendation to the City Council until the
streets were closer to completion.
Discussion ensued as to the approval with stipulations included
from the City and the first opportunity for it to be presented to
the City Council.
Developer Bart Gray, Jr. mentioned prior concerns with regard to
street development within the subdivision, adding that an agreement
with Mr. Penn has solved the ingress and egress situation.

REPORT: MAIN STREET COMMITTEE
A brief report of the last meeting was given by Mrs. Leslie Belden.
She related that Sandra Hansen from Main Street Arkansas spoke to
the ~ommittee relating the pros and cons of this type of program
for the development of Main Street, adding that she informed the
committee of some ideas of getting started. She then related that
the program will not be open to new cities for ~hile, relating
that Mrs. Hansen stressed the involvement of the whole community,
particularly the owners of the Main Street property.
Chairman Elliott related that the next meeting will be held August
16, 1994, inviting participation from the f lanning Commissioners.

City Engineer Reel voiced that Auto Zone has requested a building
permit in the old Bomber Base Addition to the City of Jacksonville
on the west side of North First Street immediately east of
Jacksonville Dodge. He said that all things are in order pointing
out that a variance is requested regarding a change from the ten
(10) ft. rear yard requirement down to five (5) ft. He said that
the City has no problem with the request and that it was passed on
to the Fire Department adding that they had no objection to the
request as long as the builders agreed to install a sprinkler
system in the building to certain fire protection specifications.
He said they did agree to the requirement of the Fire Department.
He said that the original request included two units of access
noting that after municipal code requirements were explained,
the request was cut back to one drive which will be at the north
end of their property. He noted that use of one driveway at
Hardy's would be permissable with the City if agreed upon by the
two businesses. He pointed out that construction completion would
be about the same time that the widening of North First would be
completed.
Commissioner Belden moved, seconded by Commissioner Reid to APPROVE
the building permit request of Auto Zone with a variance to a five
(5) ft. rear yard setback granted. MOTION CARRIED.

The City Engineer related to the Commission that construction on
the widening of North First Street is due to begin in February or
March with completion in approximately eighteen months.
Commissioner Belden noted that she is representing the City of
Jacksonville in meetings held by Metroplan and that efforts are
being made to improve transportation problems within the greater
Pulaski County area going from Lonoke to Benton to Beebe to Conway.
b. Gateway Apartments 403 Trickey Lane I Pathfinders
Colleen Black related that upon completion of the facility located
on Mulberry the units were filled. She related that the proposed
Gateway Apartments will have thirteen units available for
individuals with developmental disabilities and they expect them to
be filled quickly.
City Engineer Reel related that heavy rainfalls created erosion
problems from Bailey Street to First Street and related that he
asked the architects of the Gateway Apartments Project to design an
erosion control plan to address the issue of drainage and erosion
which would prevent this from occurring. He related that with
regard to drainage for the Gateway Apartments there is a major
drainage ditch on the east side and that on the south and north
there are drainage ditches that supply Old Military Road.
Commissioner Piggee moved, seconded by Commissioner Reid to approve
the building permit requested by Pathfinders for Gateway Apartments
at 403 Trickey Lane with the stipulation that an erosion control
plan be implemented to the satisfaction of the City Engineer.
MOTION CARRIED.
REQUEST TO APPROVE PLATS:
Final Plat/Northlake Subdivision Phase V/Petitioner Tommy Dupree
Tim Lemons from Bond Engineering requested that the final plat be
considered as a revised preliminary plat. He related that the
preliminary plat had been approved years ago with construction
progressing slowly. He stated that they would like to bring a
fin.al plat to the Commission next month when the construction is
one hundred percent complete.
Chairman Brannen pointed out that the previously approved
preliminary plat consisted only of Phase V-A adding that Phase V-B
may never have been approved at the preliminary plat stage and is
now incorporated into the current plat of Phase v.

Mr. Lemons confirmed that lots 169 through 173 and 194 through 201
are now being added to the preliminary plat.
Chairman Brannen posed a question concerning the flood zone
designation on lots 164 through 168.
Mr. Lemons related that the lots have been filled, adding that they
are in the process of having FHMA remove the lots from the flood
plain. He related that it is his hope to have this taken care of
at the stage of final plat presentation. He stated that the plat
would be recorded with the flood zone designation if they were not
able to have the lots removed in time for the final plat
presentation.
Discussion ensued as to what phase of the subdivision the plat
before the Commission would be called.
Planning Commission Secretary Lu Leonard clarified past action of
the Planning Commission by reading minutes of May 12, 1986
regarding approval of Phase V-A which indicated the future
development of Phase V-B.
It was then agreed that with the development of Phase VI the
present phase would be referred to as Northlake Subdivision
Preliminary Plat Phase V.
Discussion ensued as to the future development of adjacent property
and the present status of the ingress and egress of Phase V with
the possibility of a culdesac and a variance.
City Engineer Reel related that the entire subdivision contains two
avenues for ingress and egress that being Oneida and Indian Head
leading to Sherwood. He related that Phase V was a part of the
overall plan which has been approved and that future development
might make Timberwolf a through street.
Chairman Brannen requested confirmation that lots 163 through 173,
194 through 206, 226A and 227A are included in the Preliminary Plat
Phase V.

Commissioner Reid moved, seconded by Commissioner Patton to suspend
the rules and place the Sketch Plat of Foxwood Phase X on the
agenda as an item of business. MOTION CARRIED. (Commissioner
Belden abstained from the voting process.)
Mr. Tim Lemons represented the item stating that it is a
continuation of the Foxwood Subdivision noting that lots in this
phase are approximately eighty (80) ft. by one hundred forty-eight
(148) ft. to one hundred sixty-seven (167) ft.
with two culdesac streets. He said that existing utilities will
meet code requirements. He noted that a preliminary plat will be
presented in the month of October upon approval of the sketch plat.
City -Engineer Reel said that all minimum standard requirements as
far as the lot sizes are concerned, streets, storm drains, water
and sewer etc. will be addressed in the preliminary plat.
Commissioner Patton moved, seconded by Commissioner Piggee that the
SKETCH PLAT OF FOXWOOD PHASE X be APPROVED. MOTION CARRIED.

City Engineer Reel informed the Commission that all changes
suggested when the Sketch Plat was submitted have been made as he
pointed out that a check list regarding the plat was prepared by
Mrs. Founds of the Engineering Department and included in the
agenda packet. He added that the subdivision is now ready for the
development of water, sewer and streets and storm drain planning.
It was pointed out by Commissioner Elliott that no lots open on
Main Street.
City Engineer Reel stated that at one time, Christy Lane was the
only access into the subdivision but that a connection, which was
requested by the Planning Commission, has been made off the
culdesac. He related that an "F" should be designated on the lots
which are in the flood plain before acceptance of the Final Plat.

C. Preliminary Plat/Foxwood Subdivision Phase X (Petitioner
Woodhaven Homes)
City Engineer Reel related that the Sketch Plat was submitted and
approved and that the Preliminary Plat meets all requirements of
the City as far as items on the plat. He noted that the developer
can proceed with water, sewer, street and storm drain plans for
final plat submission.
Commissioner Piggee moved, seconded by Commissioner Dornblaser to
APPROVE the Preliminary Plat of Foxwood Subdivision Phase X.
MOTION CARRIED.
d. Final Plat/Northlake Subdivision Phase V (Petitioner Dupree
Company) (Bill of Assurance on file)
It was noted by City Clerk Leonard that in 1986 Mr. Dupree paid a
plat fee of $100.00 for Northlake Subdivision Phase V and that a
$115.00 check has been received leaving a balance of $15.00 due.
She stated that a check for $140.00 from Mr. Dupree for the plat
fee due on Northlake Subdivision Phase VI has also been received
leaving $140.00 to be paid at the time the final plat is submitted.
City Engineer Reel related that final letters of acceptance for the
water and sewer have not been received as yet. He said that the
street is ready to be paved, that compaction tests have been made
and that they should be asphal ted by the end of the week. He
pointed out that some lots lying in the flood plain have been
filled and are actually out of the flood plain, but that a letter
of map amendment has not been received from FEMA as yet. He said
that the lots should have an "F" designation on the plat until
official notification has been received.
Commissioner Dornblaser moved, seconded by Commissioner Reid that
the Final Plat of Northlake Phase V be APPROVED with the following
stipulations: (1) completion of street paving, (2) utility
improvements, and (3) the "F" designation on lots where applicable
(lots 165 thru 172) until a letter of map amendment is received
from FEMA. MOTION CARRIED.
Chairman Elliott noted that the item 1s to be recommended to the
City Council for their approval.

e. Preliminary Plat/Northlake Subdivision Phase VI (Petitioner
Dupree Company)
City Engineer Reel stated that the water and sewer is in and that
street construction is to be continued. He said that all
requirements for a preliminary plat are met and that those lots in
the flood plain on the final plat should be so designated unless a
letter of map amendment is received from FEMA.
The length of the culdesac was questioned by Commissioners Brannen
and Dornblaser.
City Engineer Reel said that it exceeds the Municipal Code
Requirement of five hundred (500) feet by about two hundred (200)
feet.
He voiced that it might be reasonable to request that the flood
zone be designated on this plat and plats in general after
Commissioner Brannen posed a question regarding its designation on
the plat.
There was a short discussion regarding the length of the culdesac
in Northlake Subdivision Phase VI and whether or not there needs to
be a change by ordinance regarding the code requirement. The
general consensus was that the City Engineer and the City Attorney
should review this along with some other possible inequities such
as curb cuts, sidewalks, basketball goal placement making streets
a playground, etc. which may need to be addressed.
Commissioner Dornblaser moved, seconded by Commissioner Reid to
APPROVE the Preliminary Plat of Northlake Subdivision Phase VI
granting a waiver with regard to the length of the culdesac.
MOTION CARRIED.
It was requested that Northlake Subdivision Phase V and VI remain
as named, that they may not revert back to prior status as phases
Va and Vb.
COMMITTEE REPORTS:
Status of Main Street Revitalization
Chairman Elliott explained that the Main Street Revitalization
Committee will be meeting on a quarterly basis, the next meeting
date being November 1, 1994, 7:00 p.m. at City Hall. He related
that the committee may need to be made an official committee of the
Planning Commission.

Chairman Brannen reviewed excerpts from the minutes of the April
11, 1994 Planning Commission meeting explaining that at the
preliminary stage the plat was named the Pinewood Subdivision Phase
I. He related that after Planning Commission approval the
preliminary plat of Pinewood Subdivision was changed to be the Oak
Valley Subdivision, which is being presented in final plat stage
before the Planning Commission.
Developer Jim Green related that the original preliminary plat was
to be named Pinewood Subdivision which was determined to be a
duplicate name for another subdivision. He stated that he changed
the name of the subdivision to Oak Valley Subdivision for
presentation as the final plat. He then related that he did not
care for the name, deciding to change from Oak Valley to Critter
Hollow. He related that the only difference between the
preliminary plat of Pinewood Subdivision and the final plat to be
titled Critter Hollow is the number of lots. He related that he has

City Engineer Reel related that if passed it would need to be
stipulated that the final plat not appear before the City Council
until letters of acceptance have been received from the Water and
Sewer Departments, adding that otherwise it meets with approval
from his office.
Discussion ensued as to the flood plan elevation of the lots with
regard to the development being in the flood plan.
City Engineer Reel related that the developer would not need to
fill the whole lot, but only around the pad and slopping off to the
lot line.
Commissioner Belden moved, seconded by Commissioner Piggee to
approve the Final Plat of Critter Hollow Subdivision with the
stipulation that letters of acceptance from the Water and Sewer
Department are received before the plat be submitted to the City
Council. MOTION CARRIED.
Resume Agenda:
REQUEST TO SET UP PUBLIC HEARINGS:
Rezone 1.75 acres of Pennpointe Subdivision from R-0 to R-5
City Engineer Reel related that the original request of 1.75 acres
is now for 2.77 acres of the subdivision. He related that Mr.
Penn's desire is to develop the land for single family condominium
type structures, individual residences, proposing total security
featuring a brick wall and card access gate. He related that the
condominiums would be in the price range of $150,000.00 to
$185,000.00, containing from 1,500 to 2,400 square feet depending
on single or two story type construction.
Commissioner Dornblaser moved, seconded by Commissioner Green to
set a public hearing for the next regularly scheduled Planning
Commission meeting to be held December 12, 1994 to hear the
rezoning request of Pennpointe Subdivision from R-0 to R-5. MOTION
CARRIED .

Commissioner Green requested that he be allowed to abstain from the
voting process to represent the item of business.
Commissioner Green related that the property has recently been
rezoned to C-1, adding that the item of business is a re-plat of
the same. He related that after development it would be known as
the James Place Commercial Addition. He stated that copies of a
two-part site plan has been made available to the Planning
Commission.
City Engineer Reel related that the purpose of the re-plat is to
change five separate lots into one lot for development. He stated
that the re-plat cleans up the area for development, and that all
utilities are available. He related that the Water Department is
working with Mr. Green to extend a water line to the fire hydrant
closest to the Second Baptist Church. He stated that the
development meets with all the requirements; characterizing the re-
plat as a house cleaning measure.
In response to a question posed by Commissioner Belden, Mr. Green
related that the office space would house such businesses as
Certified Public Accounts, Attorneys, and their own real estate
offices.
Commissioner Piggee moved, seconded by Commissioner Belden to
approve the re-plat of lots 7-11, Block 2, Brown Addition. MOTION
CARRIED by voice vote excusing Commissioner Green from the voting
process.
REQUEST TO APPROVE BUILDING PERMITS:
No requests were submitted.
MAIN STREET REVITALIZATION: Vice Chairman Brannen noted that the
Main Street Revitalization Committee held a meeting on November 1,
1994, pointing out that those minutes are available in the packet
provided. He related that Mr. Phil Sullivan was unable to attend
the meeting. He announced that the next meeting will be held
February 7, 1995 at 7:00 p.m. in the Council Chambers. He
encouraged participation in the next meeting.
Commissioner Dornblaser requested information concerning the type
of development which might occur adjacent to the R-5 development
with regard to the rezoning of Pennpointe Subdivision.

the Planning Commission carries the authority to restrict the kind
of development approved for a R-5 zoning, thus providing for a
continuous standard with regard to existing construction. He
related that the land west of the proposed rezoning is owned by the
Mathews Company who have no plans for development at this time, and
that the land is located outside the city limits of Jacksonville.
Commissioner Belden related that there are other parcels of land
like zoned that are not considered for i.e. mobile home placement
even though that is one of the allowed zoning uses.
At this time City Engineer Reel informed the Commission that
considerations with regard to rezoning may be necessary before
acceptance of the final plat of Foxwood.
In response to a question posed by Vice Chairman Brannen, Mr. Penn
related that a Bill of Assurance will be submitted with regard to
the area rezoned R-5.
Discussion ensued regarding the Bill of Assurance and restrictions
of an R-5 zoning along with zoning standards regarding future
development. Examples of Planning Commission authority were quoted
concerning like circumstances.
City Attorney Bamburg related that in order to maintain a safe
legal position, the Planning Commission would need to articulate a
legitimate reason for approval or denial with regard to zoning
uses. He related that it is difficult to regulate an adjoining
property owner with regard to development, adding that it must be
considered on a case by case basis.-

Lester Piggee, and Jack Patton answered ROLL CALL. Commissioner
Art Brannen and Commissioner Belden were absent. Chairman Kenny
Elliott answered ROLL CALL and declared a quorum. PRESENT seven
(7), ABSENT (2).
Others present for the meeting were Deputy City Clerk Susan Davitt,
City Attorney Robert E. Bamburg, City Engineer Duane Reel, and
petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Reid moved, seconded by Commissioner Green that the
minutes of the November 14, 1994 Regular Planning Commission
Meeting be APPROVED. MOTION CARRIED.

Chairman Elliott related that the petitioner Mr. Jim Green has
requested that the plat name be changed to Green Acres Subdivision.
City Engineer Reel related that he would be giving consideration to
the flood plain encroachments. He related that the geometries fit
the Planning Commission requirements and that the development has
two proposed entrances one from Berkshire Drive and one from Loop
Road. He related that the City Engineer's office is requesting
that a fence be constructed with regard to the lots that back up to
Loop Road. He related that after looking at the contour map he
doesn't believe the basic drainage pattern will be altered that
much, however, the runoff will get to the ditch quicker due to the
asphalt and paving as a consequence of the construction. He
related that with regard to the culdesac construction and the ditch
location there is a certain area reserved that is actual flood way
that cannot be built on.
It was related in discussion that the items not checked on the
sketch plat have been addressed on the preliminary plat.

Mr. Green related that the name change was due to the fact that he
was undecided as to the development scheme being that of Stonewall
Subdivision or that of the neighboring subdivision of the Ferrell
Addition. He related that he is moving ahead with plans at this
time because of a need to excavate dirt for another project. He
stated that for that reason he is going to assume that it will be
named Green Acres and be in conformity with that of the Ferrell
Addition and not considered a part of Stonewall. He then related
that assuming that it is developed as a part of the Ferrell
Addition the homes would average in size of 1,000 to 1,200 square
feet.
City Engineer Reel related with regard to culdesac length one
culdesac in the development has a side street which cuts down on
the total length of the culdesac. He related that with regard to
the number of lots of the proposed development the City will
require that the street extending from the last culdesac be
constructed further east making a connection onto Loop Road. He
related that his primary concern in looking over the development
plans is the construction of homes with regard to ditch location.
Mr. Andy Timmer, a resident of the Stonewall Subdivision and member
of the Stonewall Board of Directors Association, related that he
and other homeowners have concerns over further development of the
Stonewall Subdivision. He stated that it is his understanding from
the old Bill of Assurance that Mr. Green must obtain agreement from
a certain percentage of Stonewall Subdivision homeowners to develop
any additions. He stated that in speaking for a large number of
the homeowners, it is his understanding that they do not want
further additions to the Subdivision in this area. He related that
one concern is over the amount of traffic that will be funneled
through to Berkshire Drive which will add to the already existing
problem there. He then related that the area of Berkshire Drive
is traveled by school children going to Pinewood Elementary School.
He suggested possibly adding a road going out lots 528 and 529 or
lots 532, 533 exiting directly onto Loop Road, which he feels would
allow a better flow of traffic with a side walk in the area that
would allow a little easier crossing. He informed the Planning
Commission that as a resident of Amhurst Drive he has experienced
12 inches of standing water in his yard as a result of poor runoff
within the Subdivision. He related that a future concern would be
the quicker runoff to the ditch if construction is allowed. He
stated that the ditch would fill up, then back up making this a
major flooding concern for the residents in that area.

Chairman Elliott related that drainage will be one of the extensive
concerns of the City.
City Engineer Reel related that the ditch that drains the first two
phases of Stonewall was widened and the flow characteristic were
increased in order to prevent flooding in that area. He stated
that it is a matter of maintaining the ditch section that is
inhibited by the box culvert under the Union Pacific Railroad. He
related that according to computations it is close to reaching the
maximum drainage point that it can handle. He stated that with
regard to the drainage problems experienced by Mr. Timmer, most of
the flooding is caused by water corning off Stonewall Drive down
Amhurst and that he also has experienced some problems in his back
yard with sub-surface drainage. He related that work has been
performed to eliminate much of the drainage problems. He related
that the residents with concerns for drainage would be the ones
with lots that back up to the ditch of phase I and II of Stonewall
Subdivision.
Discussion ensued as to the number of lots in the development that
is located in the flood plain and the issue of flooding with regard
to that development.
City Engineer Reel related that there will be an impact with regard
to the runoff in the area, which will involve maintenance on the
main ditch located on the other side of the railroad crossing on
Loop Road and proceeding east to the County line. He stated that
the normal maintenance procedure is 2 1/2 to 3 years for cleaning
out and maintaining the flow line of the ditch, adding that
maintenance would have to be stepped up to every year with any new
development. He stated that as long as the ditch is cleaned and
maintained it would take an extended rain fall to cause problems.
He related that with future development the main concern is to keep
the vegetation down in the sod ditches and will eventually have to
be paved in order to handle the water flow.
Commissioner Dornblaser asked if Mr. Green would be willing to
entertain some of the traffic solutions offered by Mr. Timmer.
Mr. Green said he felt that traffic would be hindered by exiting
onto Loop Road rather than Berkshire. He stated that he could not
see a difference in the safety factor. He related that traffic may
divert 1/2 mile toward the east end of the development which would
eliminate some of the traffic problems around the high school. He
stated that the main thoroughfare exiting onto Loop Road would have
a sidewalk.

Mr. Timmer voiced concerns regarding the traffic through Stonewall
to Stonewall Square and North First, adding that the traffic needs
to be funneled to Loop which will expand in the future and can
accommodate the traffic flow. He reminded the Commission of the
increased commitment from the City that it will take to maintain
the ditches if the development is permitted. He related that he
felt adding more houses will only compound the existing drainage
problems experienced by Stonewall residents.
Discussion ensued with regard to the drainage flow and direction of
runoff with construction of asphalt in the development.
Commissioner Dornblaser asked if Mr. Green would consider re-
directing the proposed street onto Loop Road instead of Berkshire.
Mr. Green stated that he is not convinced that entering onto Loop
is better alternative than Berkshire.
Commissioner Piggee questioned if the item could be tabled for
further study and bring back a report. He stated that it needs
further consideration and time.
Commissioner Piggee moved, seconded by Commissioner Dornblaser to
table until the next scheduled meeting in January.
Chairman Elliott related that Mr. Green will need input from the
Planning Commission so that he will know how to proceed with his
development plans.
Two other residents from Stonewall were recognized and requested
that a feasibility study be conducted to identify the degree of
flooding problems in this area.

Petitioner Emma Knight related that time is the major consideration
for her client. She related that the request is to annex the 25
acres that is adjacent to the 5 acres and bring it into the City
with a zoning of R-1A and start the rezoning of the 5 acres of R-0
to R-1A. She related that the funding source is a national company
based in Florida who works in 90 day increments. She requested
that the public hearing be set for the next scheduled Planning
Commission meeting in January.
City Engineer Reel related when the final plat is submitted the
plans for water and sewer will also be submitted to the water and
sewer departments.
Chairman Elliott related that the property can be developed with
county approval adding that it is in the interest of the City to
have control over it after annexation.
Mrs. Knight related that while she explained both ways of
development to her client, she strongly recommended annexation into
the City of Jacksonville.
Commissioner Green moved, seconded by Commissioner Dornblaser
to recommend the annexation of 25 acres generally located Hwy 161
and Valentine to the City Council and to set a public hearing with
regard to rezoning of 5 acres of property generally located hwy 161
and Valentine from R-0 to R-1A. MOTION CARRIED.

Discussion ensued as to the maximum length of a culdesac and the
various reasons variances are requested. It was noted that 500 ft.
is the maximum limit.
GENERAL: Economic Development Briefing
Five (5) year Plan for the City of Jacksonville
Mr. Phil Sullivan related that with regard to the five year plan
for the City of Jacksonville, the Planning Commission will be
central to its progress. He then related the planning process with
regard to citizen participation. He stated that with regard to the
Little Rock Air Force Base, the Planning Commission would need to
look at protecting the flight plan of the planes and promoting
growth of new industrial parks. He suggested that annexations
should be considered with regard to their development and location.
He stated the need for development of single family dwelling from
$40,000.00 to $60,000.00 dollars. He related that many of the
manufacturing executives do not live in the City of Jacksonville
adding the need of this type of subdivision that would accommodate
executives. He stated that the plan would be implemented in
stages, adding that annexation will be one of the first things
looked at. He related the community plan portion of the five (5)
year plan as it would concern the Planning Commission.
It was related during conversation that a land use committee might
be helpful with regard to community plans.
Discussion ensued as to the type of subdivisions needed in the
community of Jacksonville as opposed to the building of what is
hoped will be needed and role of the Planning Commission.
Chairman Elliott related that the next meeting of the Mainstreet
Revitalization Committee will be February 7, 1995 and is set for a
briefing from Phil Sullivan at that time.
