JANUARY 9, 1995 Regular Planning Commission Meeting December 12, 1994 Rezone property/300 Graham Rd. from C-4 to R-1 (DROPPED FROM AGENDA AFTER MEETING) Preliminary Plat of Green Acres Subdivision Drainage Computations (DROPPED FROM AGENDA PRIOR TO MEETING) Rezoning of five (5) acres Hwy 161 & Valentine Road from R-0 to R-1 A OPENING REMARKS: CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 9, 1995 7:00 P.M. -7:40 P.M. Mayor Swaim was present for the Planning Commission Meeting and administered the Oath of Office to recently re-elected Commissioners Art Brannen and Jack Patton. At this time Commissioner Kenny Elliott, Chairman for the year 1994, asked for a roll call by Planning Commission Secretary Lula M. Leonard. ROLL CALL: Conunissioners: Rudy Reid, Jim Dornblaser, Art Brannen, Kenny Elliott, Leslie Belden and Jack Patton answered ROLL CALL. Conunissioner Connie Foster was absent. Chairman Elliott declared a quorum. PRESENT six (6), ABSENT two (2). (One appointment to the Planning Commission has not been filled for the year 1995.) Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Computer Tech. Mylissa Founds and petitioner Council Member Emma Knight. Mayor Swaim addressed the Planning Commission at this time. He challenged the members to do the work they have been doing but to address the five year plan which has been set forth by the Economic Development Department. He noted that the City of Sherwood is endeavoring to annex surrounding areas, challenging the Commission to become involved in the same kind of endeavor for the City of Jacksonville. He asked that meetings be arranged for study of the Master Plan of the City with City Engineer Reel and with recommendations to the City Council regarding future expansion. He pointed out that he challenged the Park & Recreation Commission to put their best efforts to work for the City adding that the fruits of that challenge will be enjoyed by the citizens of the community very soon as he mentioned the completion of the Community Center. He pointed out that he did not want the Commission to step aside but to step forward and get involved. He asked that each help to lay the groundwork for the City of Jacksonville in the year 2000. He commended the work of the Commission and challenged them again to take positive action toward the expansion of the City of Jacksonville. 1 70 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 9, 1995 7:00 P.M. -7:40 P.M. Commissioner Elliott thanked Mayor Swaim for the challenge pointing out that the Commissioners, he feels, is ready to work toward planning for the future. ELECTION: CHAIRMAN, VICE CHAIRMAN & CHAIRMAN OF THE BOARD OF ADJUSTMENT, AND MEMBERS OF THE BOARD OF ADJUSTMENT Conunissioner Belden moved, seconded by Conunissioner Dornblaser that Mr. Art Brannen be elected as Chairman of the Planning Conunission. There being no other nominations, Mr. Art Brannen was unanimously elected. MOTION CARRIED. At this time Chairman Art Brannen accepted the position and continued the meeting. Conunissioner Elliott moved, seconded by Conunissioner Reid that Conunissioner Leslie Belden be elected as Vice Chairman of the Planning Conunission and Chairman of the Board of Adjustment. By a unanimous vote the MOTION CARRIED. Conunissioners Rudy Reid and Jack Patton volunteered to serve on the Board of Adjustment. APPROVAL AND/OR CORRECTION OF MINUTES: Conunissioner Belden moved, seconded by Conunissioner Dornblaser that the minutes of the December 12, 1994 Regular Planning Conunission Meeting be APPROVED with the correction regarding the rezoning of Pennpointe from R-0 to R-5. (the minutes were presented as R-1 to R-5.) MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: The request that was submitted was declared void in that the petitioner requested a refund of the advertising fee. REQUEST TO APPROVE BUILDING PERMITS: No requests were submitted. REQUEST TO APPROVE PLATS: Preliminary Plat of Green Acres Subdivision Drainage Computations (Petitioner Jim Green) The item was withdrawn by sponsor. PUBLIC HEARINGS: Rezoning of Five (5) acres Hwy 161 & Valentine Road from R-0 to R-1A Chairman Brannen opened the Public Hearing at 7:20 p.m. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 9, 1995 7:00 P.M. -7:40 P.M. Alderman Emma Knight spoke to the Commission requesting the rezoning stating that "Patio Homes" is planning a subdivision of one, two and three bedroom homes containing from one thousand to fourteen hundred fifty square feet. She noted that they are efficiency packaged homes and that a park area will be donated by the developer adding that the development will enhance the City of Jacksonville. There were no persons present opposed to the rezon1ng. Chairman Brannen closed the meeting at approximately 7:27 p.m. Commissioner Belden moved, seconded by Conunissioner Elliott to RECOMMEND TO THE CITY COUNCIL the rezoning of five (5) acres on Highway 161 & Valentine Road from R-0 to R-1A. MOTION CARRIED. NON-AGENDA: There was a short discussion regarding the request of Mayor Swaim and other matters of concern such as culdesacs, variances, and i terns not being represented by petitioners that appear on the agenda. The consensus of the Planning Commission was to have an informal meeting January 30, 1995 at 7:00 p.m. at City Hall with Mayor Swaim and City Engineer Reel. It was noted that a reminder would be mailed by the secretary to each Commissioner before the meeting. ADJOURNMENT: Chairman Brannen adjourned the meeting at approximately 7:40 p.m. MOTION CARRIED. City Engineer Reel pointed out that the water service is from the City of North Little Rock and sewer by an Improvement District. He said the plat would go to the county for signatures. He pointed out that the plat does not vary from a previously submitted preliminary plat. Mr. Jim Butler voiced that all improvements have been installed with streets to the specifications required by the City of Jacksonville. PUBLIC HEARINGS: MAIN STREET REVITALIZATION COMMITTEE: Commissioner Belden reported that at the last meeting of the committee those in attendance decided that meetings should be held monthly instead of quarterly. She related that the Economic Development Department is involved pointing out that surveys they are in the process of making will aid in the efforts of the Main Street Committee. She pointed out that 11 hands-on 11 work is planned in contacting business owners in the City for their input regarding improving the downtown area. It was noted that Commissioner Belden and City Engineer Reel will be doing work on maps which will be used in the work of the committee. The next meeting is scheduled for March 15, 1995, 7:00p.m. at City Hall. A bus tour of annexation areas set for the March 25, 9:00 a.m. was announced and a meeting to follow up on ideas on March 27, at 7:00 p.m. at City Hall was noted as well. NON AGENDA: A list was submitted by the City Engineer regarding things that have been discussed that may need to be modified in the Jacksonville Municipal Code especially in the area of zoning classifications as it relates to what is permitted therein. There was general discussion regarding the proposed use of the building, a four-plex, located on the property. Mr. Scott Straub related that wrong information was received from Ms. Valencia Hardy in the City Engineer's office when zoning information was sought with regard to the parcel. Chairman Art Brannen expressed that the letter from Mr. Mason was in poor taste regarding information received. Mr. Straub stated that Mr. Reel was contacted and that he suggested that a letter be written to the Conunission explaining what had transpired. Mr. Mason related that the trend of the property located in the area has been one of neglect and stated that he plans to operate a real estate office from the location which would only improve the asthetics of the area. He pointed out the close proximity to other quiet commercial businesses. Commissioner Belden expressed concerns for the lack of parking space to accommodate the square footage requirement for C-1 zones as set forth in the Jacksonville Municipal Code. Chairman Brannen closed the public hearing at approximately 7:05 p.m. and invited comments from the Planning Commissioners. City Engineer Reel related that the adjacent property is zoned R-4 for mobile home use. He related that a C-1 type activity in the area would not be viewed as a problem. Mr. Mason related that he did not feel his business would utilize the required parking spaces for a building of almost four thousand square feet. He reiterated that much of the surrounding area is already zoned commercial. Other concerns were expressed with regard to future plans and future ownership of the property if it were permanently rezoned commercial. Chairman Brannen offered that if the Planning Commission were to deny the request Mr. Mason would still have an opportunity to seek a variance from the Board of Adjustment with regard to conditional use. He stated that the Board of Adjustment fee could be waived. Discussion ensued with regard to future zoning plans for the area. It was mentioned that this type of business would not warrant a need for a large number of parking spaces. It was then pointed out t hat when Mr. Mason purchased the property he believed it to be zoned C-2. Commissioner Dornblaser asked for clarification with regard to recommendation to the Board of Adjustment, adding that in the future if the area is designated for commercial rezoning then Mr. Mason could bring the item of business back to the Planning Commission and receive a permanent rezoning. He stated that this would give the petitioner the opportunity to operate his business as he had planned. Commissioner Gray suggested that if the petitioner would withdrawn his item of business before the Planning Commission then the motion could be made for a recommendation to the Board of Adjustment. The petitioner withdrew his item of business. Commissioner Elliott moved, seconded by Commissioner Dornblaser to recommend that the request be sent to the Board of Adjustment at the earliest convenience for a variance at no cost to the petitioner. City Engineer Reel related that the request to rezone may also be viewed as one of a spot zoning nature and asked if the petitioner might also need to seek a variance from the Board of Adjustment. It was noted that the area adjacent to the request is zoned residential. It was the general consensus of the Planning Commission that the request not be acted upon without the petitioner present. Discussion ensued as to the petitioner being heard as a matter of record. Further discussion ensued regarding the disposition of the body with regard to spot zoning and what options the petitioner may want to seek before or after presentation to the Planning Commission. Chairman Brannen recommended that the item be delayed and the petitioner be informed of his options with regard to the rezoning of the property located at Valentine Road. REQUEST TO APPROVE BUILDING PERMITS: A request was submitted by Boyce W. Penn for a residence to be constructed off Quince Hill Road. ' City Engineer Reel related that the water line is located directly across the street and the sewer is at the back of the lot, adding that both utilities expressed no problem if the building permit is granted. Commissioner Gray related that with regard to a metes and bounds legal description clarification is needed on how the tract of land may have come to be separated from the adjacent land. Mr. Penn related that he recently purchased the property, that it was part of a larger tract of land with two houses addressed as 708 and 805 Quince Hill Road. He related that he has sold the house located at 805 Quince Hill Road with plans to keep 708 Quince Hill which is being offered as a rental property. He stated that his plans are to build a house on the vacant piece of property. Commissioner Gray related that the recent practice of the Planning Commission with regard to smaller tracts of land being subdivided has been that documentation be presented so the property can be properly platted. It was discussed that the petitioner could start construction with the approved metes and bounds building permit, while the subdividing of the property would move through proper channels to the City Council. REQUEST TO APPROVE PLATS: Preliminary Plat Pennpointe Subdivision Phase II Petitioner Dickie Penn City Engineer Reel related that the one change from the original plat was a requested street outlet to the west on to the Mathews property. He related that the development in Phase II will be exclusive, adding that the developer seeks protection from the Planning Commission with regard to uncertain development of the Mathews property. He stated that if they are required to develop a side entrance it may hurt the integrity of the proposed development of Phase II with regard to proposed security access. He related that he is following the original preliminary plat with exception to the exit to the west. Petitioner Dickie Penn related that because of the expanse of the lake, there is no proposed entrance from Phase I to Phase II. He then related that none of the lots in Phase II are in the flood plain. Discussion ensued as to the proposed development and a need for a waiver with regard to the length of the culdesac in Phase II. MAINSTREET REVITALIZATION: Commissioner Belden gave an update on activity of the Mainstreet Revitalization Committee, making mention of the scientific survey being conducted with regard to shoppers of the area and participation from businesses as well as property owners. Mr. Oldridge stated his desire to request a public hearing with regard to the rezoning of the property to a C-1 zoning. He related that he is planning to purchase the property and build a heating and air conditioning service shop contingent upon the rezoning. Acting Chairman Gray informed Mr. Oldridge that the present owner of the property would need to request the rezoning either alone or jointly. He requested a letter of record from the owner of the property. He related that the public hearing could be scheduled stipulating that the letter be presented in a timely manner so that the property can be properly advertised. REQUEST TO APPROVE BUILDING PERMITS: REQUEST TO APPROVE PLATS: DISCUSSION: Annexation of various areas and the Jacksonville Municipal Code Chapter 17.20.060 regarding Culdesac length. City Engineer Reel related that because of the numerous requests for variances for culdesac length, it has previously been discussed changing the ordinance setting the requirements. He related that in discussions with the Fire Chief it was pointed out that with regard to a 1,000 foot culdesac, adequate fire protection would need to be provided to the end lots. He stated that the developer would be responsible for placing adequate border lines to acomodate for installation of a fire hydrant 500 feet from the end of the 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MAY 8, 1995 7:00 P.M. -8:13 P.M. culdesac. He further related other items that need addressing in ordinance changes: 1) making it unlawful to pour concrete in gutters for the purpose of smoothing driveway entrances; 2) making it unlawful to install athletic equipment at the back of curbs which encourages children to play in the street and impedes traffic. Discussion ensued as to standards and conditions with regard to setting culdesac length. It was related that geometries would largely determine a variance request for more than 1,000 feet. It was noted that the addition of 500 feet in culdesac length would not increase evacuation problems. Chief Hibbs related that the last evacuation did not cause a problem with regard to culdesac areas. He stated that the problems mentioned in association with culdesacs were caused from cars being parked along the curb, making it difficult for fire and sanitation trucks to turn adequately. City Engineer Reel related that the Planning Commission might want to consider increasing the width of culdesacs between 30 to 33 feet which would solve the problem. He related that the present radius of culdesacs does not facilitate the Fire Department ladder truck, adding that Fire Chief Ezell has requested that the Planning Commission investigate the possibility of increasing the paved area in a culdesac to a 100 foot radius. He then related that this would also solve damage problems to the culdesacs made when heavy trucks have to turn sharp to get around the culdesac. Discussion ensued involving subdivision regulations and proposed changes. City Engineer Reel volunteered to gather further data for consideration before it is presented in ordinance to the City Council inviting input from the Commissioners. Acting Chairman Gray related that reports regarding annexation of four areas surrounding the City has been submitted to the Planning Commission and are described as Valentine and Wooten Road area, Graham Road, Military Road, Loop Road to the County line, north of the Air Base which includes Peters Road, Roderweis Road over to Centennial, and an area by the back gate of the Air Force Base. Chief Hibbs referred to his written report with regard to the proposed annexations. He stated that he would also like to discuss an area located along Vandenburg which has caused some confusion over jurisdiction. City Attorney Bamburg related that this not only creates difficulty for the security police and city police but also for the courts with prosecution. Other situations which cause jurisdiction difficulty were cited by Chief Hibbs. Discussion ensued over a joint effort with the Air Force and City regarding annexing the entire Air Force base. It was related by Chief Hibbs that the annexation of the base property would not require any additional force or expense and that military law would continue to supersede the city law with regard to military personnel requiring assistance only when civilians are on base. He then related that with regard to the proposed annexation of the south, east, and west areas the Police Department would be able to use zones already in place without additional budgeting. He stated that the annexation of these areas is seen by the Police Department as a matter of cleaning up and simplifying city limit lines. It was noted that the fire coverage would have to be addressed by Fire Chief Ezell. Public Works Director Skip Spears presented his report, stating that with regard to development in the City it has already reached the point with current subdivisions that another sanitation truck will need to be added in a year or two. He discussed the revenues for sanitation operation and the possibility of an increase in Sanitation cost next year. He related that the west area will have no impact on current collection until it is further developed, adding that the Valentine area in the south is on Tuesday's route and would not be significant with regard to time. He stated that two-thirds of the City is currently being offered recycling service however adding another truck will need to be considered should the EPA require mandatory recycling. He related that with regard to the Street Department the proposed north annexation will have a large impact on mowing, ditch work, and mosquito spraying, while the roads are in fairly good shape. He related that the Wooten Road and Valentine Road will require significant drainage attention because it lies in a low, flat area which is in the flood plain. He noted the problems with beaver control and required mosquito spraying in the area. He related that the west and south area could be incorporated into the Street Department system with little impact but that Wooten Road and the northern area would create significant increases. He related that the Animal Control Department would experience difficulty with regard to regulations that have not previously applied to citizens in the northern area. 4 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MAY 8, 1995 7:00 P.M. -8:13 P.M. City Engineer Reel related that an increase in manpower would be needed in the Code Enforcement Department. Breakdowns on cost and services were discussed with regard to annexation. Public Works Director Spears related that the revenues collected from annexation would not be as significant as the cost to incorporate these areas. He then related that fee increases with regard to Sanitation are projected with future growth in mind in order to prevent raising fees annually. Commissioner Foster requested clarification with regard to the budgeting for a recommendation of annexation to the City Council. Acting Chairman Gray related that the Planning Commission is the first phase for annexation. He stated that it is a matter of cost/benefits; cost to the current citizens and benefits to all citizens in the future. He pointed out that it is the responsibility of the Planning Commission to analyze annexations and make recommendations to the City Council. Discussion ensued as to the operation and preparation of the annual budget as well as the decision making process with regard to expenditures for proposed annexation. Acting Chairman Gray related that he feels personally that a great deal of consideration needs to be given to the question of equal service for all citizens. He related that the issue of water and sewer has not been dealt with yet, giving the Planning Commission other considerations and need for additional information. . City Engineer Reel related that areas with no present population should be considered for annexation for cost reasons. He mentioned the Metropolitan Trust property between General Samuels and Bayou Meto going toward Harris Road. He pointed out that the taxes would drop under annexation for that piece of property because of the difference between City and County taxes. In response to a question posed by Commissioner Foster, Chief Hibbs related the nature of team work between County and City Police with regard to areas located in the Jacksonville City limits and Lonoke County. Reguest to rezone property located at Valentine Road Chairman Brannen opened the public hearing at approximately 7:03 p.m. Mr. Jerry Oldridge spoke on behalf of the request informing the Commission that the owner of the property Mr. Dub Mitchell who was present for the meeting has offered to sell the property for the purpose of operating a heating and air conditioning shop. Mr. Dub Mitchell owner of the property related that there is a title problem with the property that will be taken care of before the sale is completed. Chairman Brannen closed the public hearing at approximately 7:05 p.m. and invited comment from the Planning Commissioners. Commissioner Dornblaser clarified that the adjacent area is zoned residential and inquired as to how the request is related to the comprehensive plan. Commissioner Gray related that the revisions to the land use plan established a commercial zone along Hwy 161, 300 feet wide on each side adjacent to the right-of-way lines. He then related that the property is surrounded by ditches on all sides, which he stated he would fill in at considerable cost. In response to a question posed by Chairman Brannen, Mr. Spicer related that drainage concerns would be addressed by the City Engineer who has already surveyed the property with regard to drainage. Commissioner Elliott asked what the intended use of the property would be if it were rezoned to C-2. It was related by Mr. Spicer that he has not decided at this time adding that it would be in coordination with the Mr. Gray's real estate office. Chairman Brannen closed the public hearing at approximately 7:16 p.m. Commissioner Dornblaser stated he was not in favor of rezoning which would not be in keeping with the comprehensive land use plan without knowing what the intended use would be. Further discussion ensued as to the different uses permitted within a C-2 zoning and concerns for the residential area which it backs up to. It was noted that the property would be better suited for commercial use than residential, adding that a lower commercial zoning would protect the surrounding residential area. Commissioner Dornblaser pointed out what Metroplan had related with regard to blind rezoning and establishing land use policies. He stated that while it may be suited for commercial development, not all C-2 uses are suitable to be backed up to a residential area. Discussion ensued as to the permitted and conditional uses of a C-2 zoning classification which may be objectionable to the surrounding residential area. It was noted that the area consisted of almost 1/2 acre. Commissioner Belden asked if the petitioner would be agreeable to a rezoning of the area to a C-1 zoning classification instead of the requested C-2. Discussion ensued as to the permitted uses in a C-1 zoning classification and concerns with regard to future development if sold while zoned C-2. Mr. Spicer related that at a later time he may develop the area for a real estate office. After reviewing the list of C-1 permitted uses, Mr. Spicer stated that a C-1 zoning would be acceptable. Commissioner Piggee moved, seconded by Commissioner Belden to approve a rezoning of the property to a C-1 zoning classification. REQUEST TO SET UP PUBLIC HEARINGS: REQUEST TO APPROVE BUILDING PERMITS: Remodel and Expand Existing Structure/corner of Bailey & Main Streets (previously Baskin Robbins) Mr. Scott Farrell represented the item of business requested by Mr. Harry Daugherty. He presented a layout of the proposed construction at the corner of Bailey and Main Streets. He said that the existing space will be remodeled and additional space, as indicated on the drawing presented to the Commission, would be added to the west side of the existing structure. He pointed out that there would be ten spaces for parking in the rear of the building, a sidewalk on the west side and a garden area, with a low retaining wall approximately two (2) feet to thirty (30) inches high, in the front of the building. He pointed out that the metal encasement of the existing building and the proposed metal addition would be covered in brick veneer. He noted that the use of the structure is designed to accommodate quite office activity. He said that parking as proposed will solve problems with cars backing into Bailey Street. City Engineer Reel explained that the low wall encas1ng the garden area will not obstruct visibility. Words of commendation were expressed from the Commission regarding the proposal to upgrade Main Street with the construction_as proposed. After a question by Commissioner Gray regarding the widening of Bailey Street, City Engineer Reel explained that at this time the existing building would have to be acquired as right of way if such a situation existed. Commissioner Dornblaser moved, seconded by Commissioner Foster that the building permit requested by Mr. Harry Daugherty to remodel and expand the existing building at the corner of Main and Bailey Streets with variance of the side yard granted also. MOTION CARRIED UNANIMOUSLY. REQUEST TO APPROVE PLATS: PENNPOINTE PHASE II (Condominium Complex) City Engineer Reel pointed out that there are variations from the Jacksonville Municipal Code with regard to R-5 zoning in the Preliminary Plat as presented. He noted the following in the Code: 25 foot wide lots, 25 foot front yard, 25 foot rear yard plus the building is not to take up more than fifty (50) percent of the lot. He pointed out that looking at this type of development in the Memphis, Dallas and Little Rock areas, that lots are more square allowing less yard which is desirable for persons desiring the kind of housing afforded in the condominium concept. He said that 2, 000 minimum to 3,500 foot homes are being proposed with an island for excess parking and a common park area for persons in the subdivision. He said that basically the concept is what zero lot line calls for adding that the lots are wider and not as deep as required by ordinance. He said that a fifteen foot walk is designed to go around the entire lake which will accommodate those who desire to use it. 2 1 2:5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 1995 7:00 P.M. -8:40P.M. There was general discussion regarding the width of the street, the width of the culdesac as proposed, accessibility for fire and police protection, busses, and garbage service as well as utility easements. Mr. Penn noted that the culdesac is to have a forty-five (45) foot radius and a twenty (20) foot street. Commissioner Bart Gray questioned whether or not there would be joint ownership in the development of lots which are zoned R-5. He questioned the sale of lots and the responsibility of the City with regard to streets and the extra parking. Mr. Penn voiced that whatever the City feels is fair would be acceptable in the development. There was a general discussion regarding the liability of the City in the event a gate is constructed across the street as a private ingress and egress. Accessibility for police, fire, garbage pick- up, and bus service was also discussed. It was pointed out that the Fire Department would need a sixty foot radius to turn the ladder truck around as culdesac length and radius was discussed. Mr. Reel said that he did not feel there would be a problem with the development as proposed. Commissioner Dornblaser voiced that he felt there needs to be clarification regarding a twenty (20) foot street one way, versus a twenty-seven (27) foot street, adding that a Bill of Assurance should be submitted as well. He said that accessibility of bus service for school children was also a concern. Discussion ensued again as to the accessibility of a card gate entrance with regard to the fire, police and garbage. It was suggested that the property owners may want to maintain a common general ownership of the property and the streets since public streets are dedicated to public use. Consensus was that neighboring cities may offer insight into handling this type of development with regard to public use and safety concerns for the residents. City Engineer Reel responded to a question posed by Commissioner Dornblaser by relating the main street in the development is 28 ft. wide narrowing to 20 ft. as it goes around the park area. He stated that it would need to be designated with a sign requiring traffic to turn right upon entering the development. After discussing problems with delay of the project Commissioner Gray offered consideration of acceptance for the lot layout, adding that other concerns could be addressed as development unfolded. City Engineer Reel clarified development concerns with regard to culdesac radius in phase I. MOTION CARRIED. Commissioner Gray suggested that Mr. Penn consider privatizing the entire area which would grant leeway to present concerns held by the Commission. He stated that if it is built and maintained privately there would not be the concerns presently over public access and use. Discussion ensued as to the repercussions of privatizing the streets. It was suggested that before he make his final decision regarding the streets and common areas he seek legal advise. PUBLIC HEARINGS: DISCUSSION: Zoning Changes/Culdesac and Conditional Uses. ZONING/CULDESAC Chairman Brannen introduced discussion regarding culdesac length. City Engineer Reel related that most property developed would support a culdesac of 1200 feet. He suggested that the maximum not be over 1200 feet reminding the Commission that no matter what length is set, a variance will still be requested. Commissioner Dornblaser related that he felt that the number of houses to be developed and lot size needs to be part of the equation given consideration to traffic flow. 4 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 1995 7:00P.M. -8:40P.M. City Attorney Bamburg related that he and the City Engineer had discussed using 1000 feet unless the topography indicated or provided for otherwise. He then related that this would give the Planning Commission discretion where the topography of the land would support a culdesac of 2000 feet in length without stimulating concerns adding that in such a case the radius at the end of the culdesac might be 80 feet. Factoring that in smaller areas given safety and traffic flow concerns the Planning Commission may warrant a shorter culdesac providing a basis for determining proper culdesac length. He offered that from a legal standpoint it would need to be done on a consistent basis. He stated that a list of factors would need to be included in the statement of culdesac length so that developers could be prepared to address those issues as plats are prepared. Commissioner Elliott reminded the Commissioners that whatever is decided with regard to the length of a culdesac, decisions by the Commission would have to be consistent. There was general discussion regarding a number of dead end streets which have been allowed in subdivision development in the City. Conunissioner Dornblaser moved, seconded by Conunissioner Foster that culdesac length be designated 1,200 feet with considerations given to the topography of the land, size of the lots, ingress and egress and public safety. PRELIMINARY PLAT/Fair Oaks Subdivision City Engineer Reel said that a Preliminary Plat was presented by Mr. Jerry Smith in November of 1994 adding that changes have been made and appear on the plat before the Commission. He noted that Christy Lane was shown as going all the way through to the east property line on the original plat pointing out that it has been changed to a semi-culdesac on the east side. He said that his contention is that Christy Lane should be connected to Christy Lane as shown in the Bushwood Subdivision Plat. He mentioned a sketch made available to the Commission showing the relation of Bushwood and Fair Oaks Subdivisions which shows that the two streets are misaligned by approximately 380 feet. He related a like connection on General Samuels that goes through Woodland Hills. He said that future development of Fair Oaks should have Christy Lane should go straight through and tie into the north side of lots on Harris Road. There was further discussion regarding the street connection with Commissioner Gray stating that he felt the Preliminary Plat before 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 1995 7:00 P.M. -8:40 P.M. the Commission could stand alone without further consideration with the exception of renaming the street. City Engineer Reel said he did not feel that it is equitable to tie the two subdivisions together mentioning a parcel between Bushwood and Fair Oaks which is undeveloped at this point. He said that Mr. Smith has agreed to changing the name of Christy Lane on the Preliminary Plat. Mr. Smith stated that lots, or portions thereof, designated "F" are in the flood plain and will be filled removing them from the flood plain on the Final Plat of Fair Oaks. A discussion ensued with regard to lots in the flood plain as shown in the plat before the Commission as well as lots in other areas of the City. It was pointed out that the pad where the house is built may be elevated above the flood plain or that the lot as a whole may be filled and brought out of the flood plain. City Engineer Reel said that the flood elevation in the particular Fair Oaks area is 252. It was pointed out by City Engineer Reel that storm drains will eliminate flooding when the lots are filled to bring them out of the flood plain. Commissioner Gray pointed out that the lots are certainly buildable even in the flood plain and that filling them above the flood plain will eliminate flood insurance. He expressed concern that the "F" designation be retained on those lots remaining in the flood plain. Commissioner aesthetics of if the entire be raised. Dornblaser stated that his main concern was the raising the lots out of the flood plain and inquired area including where the streets would be laid would Other concerns were discussed with regard to completing the street to Harris Road and submittal of a Bill of Assurance with the final plat which would include requirement of all construction to face the 35 foot setbacks. Further discussion ensued as to the minimum square footage, lot size and side yard setbacks. Consensus gathered around stipulations for preliminary plat approval. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 1995 7:00 P.M. -8:40 P.M. It was related by Mr. Smith and Mr. Bond that while the development contained 48 lots of which over 30 are in the flood plain, that many of the lots would not require much elevation to bring them completely out of the flood zone. Insurance requirement with regard to a portion of the lot being in the flood zone was discussed. Commissioner Piggee moved, seconded by Commissioner Gray to APPROVE the Preliminary Plat of Fair Oaks Subdivision stipulating FEMA approval before final plat, requesting that lots 12F, 34F, 35F will face the 35 foot building line, that the Bill of Assurance will be submitted with the final plat and the radius of the culdesac will be increased to 60 foot. Discussion ensued as to the request of an increased radius in the culdesac originating from the fire department because of emergency equipment requirements. MOTION CARRIED at this time. c. PRELIMINARY PLAT/Stonewall Subdivision Phase VII City Engineer Reel related that the preliminary plat has been slightly revised from the sketch plat submitted last fall. He related that the developer proposed 30 lots in phase I of Phase VII. He stated that he has asked the developer to change the location of the proposed entrance on Berkshire Drive further south along Loop Road, cutting down on congestion which might occur as traffic leaves the subdivision. He also requested that another entrance into the subdivision be moved to the east border of the phase, giving traffic the opportunity to achieve access to Loop Road without going down Berkshire Drive. He related that with regard to some of the lots that are located in the flood plain he has asked that the developer and engineer design a: drainage retention basin to cut down on the impact of drainage during heavy rain falls as it approaches the major drainage ditch. Concluding he stated that the developer has agreed to address these requests. In response to a question posed by Commissioner Elliott, Mr. Green related that tract A is located in the flood way and is proposed as a land gift to the buyer of lot 508. City Engineer Reel related that Mr. Gre~ dedicating what is needed for the 100 ft. right-of-way requested for Loop Road. In response to a question from Commissioner Dornblaser he stated that he did not feel there would be a problem with the streets being 4 (:5.:5 /3t/- CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 1995 7:00 P.M. -8:40 P.M. constructed in the flood way as long as the excavating and street surface is below the existing elevations, which will not constrict water flow. It was noted that the stipulations requested by the City Engineer would need to be addressed before the plat could receive final plat approval. He then described the nature of a retention basin and its purpose of maintaining the present flow into the main ditch. Discussion ensued as to the water flow with regard to retention and City maintenance to the main ditch. City Engineer Reel related that the retention basin will slow the flow of water and will not cause extra maintenance to the ditch, adding that this will help prevent a backup to Pinion Lane by regulating the flow. Commissioner Elliott posed the question of on-going maintenance of the retention basin. City Engineer Reel related that it may become part of the common areas suggesting that maintenance responsibility will be that of the property owners association. Commissioner Elliott expressed concerns with regard to the street located in the flood way and the build-up of lots for house construction being elevated so much higher than the street. Commissioner Dornblaser related that the method of lot construction occurring in Critter Hollow Subdivision is undesirable, adding that it seems that one lot is at least five feet above the street grade. He related that from past conversations he felt the consensus of the Planning Commission was not favorable for this type of development adding that he feels the plat before the Commission is undesirable for the area mentioning a park across the street from the development. Mr. Green explained two methods of construction in elevating a house above the flood plain for insurance purposes with regard to FEMA guidelines; one, elevating the lot where the house is to be constructed before construction begins and two, elevating the house with blocks then landscaping around the house. He stated that either method exempts the building for insurance purposes. He went on to say that FEMA guidelines allow exemption of the entire lot or exemption of the building. 5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 1995 7:00 P.M. -8:40 P.M. He said that the area of Stonewall Phase VII would be developed similar to Critter Hollow on the north side of Foxwood Drive. He said that the area on which houses would be constructed and an area fifteen, twenty, or thirty feet beyond would be elevated in order not to remove all the trees. He explained that FEMA letters would note that the house and not the lot would be out of the flood zone. There was discussion regarding the effects of a 100 year flood, heavy rains, ditches and water run-off. City Engineer Reel said that the Stonewall ditch as it is will carry a lot of water. City Engineer Reel said that he had not received calls regarding flooding along Loop Road. Commissioner Dornblaser voiced concerns regarding the aesthetics of the subdivision and a stairstepping effect with regard to construction of homes on the lots. Commissioner Elliott voiced that he felt there are several things which need to be worked out with the City Engineer including ingress and egress on Loop Road and lot numbering before the plat could be given approval. Commissioner Elliott moved, seconded by Commissioner Piggee that the plat of Stonewall Phase VII be tabled at this time. MOTION CARRIED. Commissioner Gray voted NAY. NON-AGEND ITEM: FINAL PLAT/Foxwood Subdivision Phase X Commissioner Piggee moved, seconded by Commissioner Elliott to suspend the rules and place the Final Plat of Foxwood Phase X on the agenda. MOTION CARRIED. City Engineer Reel stated that letters of acceptance have not been received from the Water and Sewer Departments. He added that there is about a twenty foot portion of a curb in one of the culdesacs that will have to be fixed due to a failure in a water line which eroded the area. White behind Kentucky Fried Chicken Commissioner Gray questioned whether or not there was a legal description for the tract of land proposed for construction and if the immediate area had previously been platted. Commissioner Gray then stated that he has no objection to the proposed construction but would like to have a legal description available so that the Planning Commission could review the setbacks, side yards, and other code requirements of a metes and bounds building permit request. He voiced concerns regarding the piece meal development of the commercial area. Mr. Buster Smith addressed the Planning Commission regarding the request for a building permit. It was pointed out that the site plan provided to the Planning Commission did not provide information found on a survey drawing. Discussion ensued with regard to setbacks with the entrance being off T.P. White Drive. Mr. Smith agreed to change the side yard setbacks to the required 15 feet for this type of development. The point was made by Commissioner Gray that there has been an act of subdividing that has not been brought before the Planning Commission. He stated that there should have been no recordation of deeds without approval from the Planning Commission of tracts on a metes and bounds subdivision unless it is 5 acres or more. He stated that necessary information regarding a northern access is not available because the land has not been properly subdivided. Discussion ensued with some confusion over the proposed northern access and easement adjacent to Kentucky Fried Chicken. Commissioner Gray pointed out that the Planning Commission did not have the right to allow a development which would bring traffic through Kentucky Fried Chicken's property without their permission. It was decided that the item of business would be delayed until later in the meeting when Mr. Smith could return with a survey of the same. REQUEST TO APPROVE PLATS: PRELIMINARY PLAT / JAXON TERRACE SUBDIVISION PHASE VII Mr. Tommy Bond from Bond Engineering represented the item of business. He related that the petitioner Mr. Dick Jones would like to change the name of the subdivision to JAMESTOWN SUBDIVISION. Discussion ensued as to various changes requested by the Office of the City Engineer with regard to a street name change from Jones Street to Puritan Drive as well as lot depth changes on lots 23 thru 32 from 143.92 to 150.00. He stated that it will provide information regarding adequate sewer ability for proposed subdivisions noting approximate acreage of some available areas which could be developme in the City of Jacksonville with regard to future growth for a five year sewer plan. PUBLIC HEARINGS: MAIN STREET REVITALIZATION: City Attorney Bamburg announced that Economic Development would host a meeting Tuesday at 12:00 p.m. 12 September 1995 at the Ramada Inn. He related that the architectural class from the University of Fayetteville will be present to gather ideas and formulate a street scape that will be prepared for the Main Street Revitalization Program. GENERAL BUSINESS: ORDINANCE 1048 (#11-95) City Engineer Reel requested that the following changes be made: Municipal Code chapter 12.24.110, making the minimum requirement for sidewalks 2 feet from the back of the street curb. Municipal Code chapter 18.44.030, adding to conditional uses the term mini warehouses. Commissioner Gray questioned Municipal Code chapter 15.12.050 and the intent of the term permanent foundation. He questioned the fairness with regard to the requirement of a permanent foundation in an R-4 zone which permits a mobile home subdivision as well as a commercial mobile home park. City Attorney Bamburg offered that the code could be changed to distinguish between regulations for a subdivision of mobile homes and a commercial mobile home park with regard to the term "permanent foundation" or the term itself could be designated under definitions for better clarification. City Engineer Reel cautioned that FEMA's definition of permanent foundation should match that of the City because of ramifications in the event a mobile home that is blocked and tied-down floods. City Attorney Bamburg advised that could be taken into consideration with regard to term clarification while providing protection from anyone being caught in that type of circumstance. Commissioner Gray stated that would address his concerns as long as it did not require an FHA, VA full permanent foundation in a mobile home park. It was the consensus of the Commission that a ruling from FEMA would be sought and that if the ruling is not received in a timely fashion the ordinance would be submitted without that section. City Attorney Bamburg requested clarification from the Commission regarding Section 17.20.060(A)(B) dealing with cul-de-sac length. Discussion ensued regarding Conway's ordinance which stated that a cul-de-sac would serve no more than 44 lots with a maximum length of 1120 feet. Commissioner Dornblaser pointed out that the main concern would be traffic adding that his cul-de-sac is lengthy but serves only a few houses because of the size of the lots. Mr. Tommy Bond commented that the overriding concern lS access for emergency vehicles and cul-de-sac radius. He stated that they are addressing the maximum number of living units located on a cul-de-sac. Chairman Brannen suggested leaving the code as is calling for the special circumstances to warrant an extension of cul-de-sac length. Discussion ensued regarding Section 17.20.060(B) as to the geometric design problems which occur with a property line radius of no less than sixty feet. Mr. Tommy Bond suggested leaving the dedicated right-of-way for the street at a 50 foot radius and build the cul-de-sac at 47.5 feet leaving a 10 to 15 foot easement around the property for utilities. He stated that a bigger paved cul-de- sac can still be accomplished without increasing the right-of-way width. It was disclosed that this would still provide the needed paved area requested by Fire Chief Ezell. City Engineer Reel pointed out that with a dedicated easement the 11.5 feet used to install utilities will work out the same. Design changes were also discussed as an additional avenue for widening the cul-de-sac. Municipal Code Chapter 17, Section 17.20.060(B) will change to 47.5 foot paved, recommended as a street change under Section 17.24.040. Discussion ensued as to the definition of a manufactured home, Commissioner Gray quoted from page 200 Section 15.08.149 of the Municipal Code Book. He then suggested that the definitions for manufactured homes on page 275 be used to define, while Section 15.08.149 could be used to address flood management. Commissioner Piggee moved, seconded by Commissioner Reed to recommend to the City Council for passage consideration Ordinance 1048 (#11-95) deleting Section 15.12.050. MOTION CARRIED. RESUME REQUEST FOR BUILDING PERMIT: General location 1803 T.P. White behind Kentucky Fried Chicken Discussion ensued regarding the private drive on the north side of the property and the entrances proposed on the site plan. Commissioner Gray stated that if it were an actual lot, meeting with regulations for C-3 development, he felt the petitioner would need to seek an access agreement with Kentucky Fried Chicken, failing that, he stated that a new site plan would need to be submitted with the access only on T.P. White Drive and all vehicular traffic would need to be depicted as occurring inside the l ot. 5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPTEMBER 11, 1995 7:00 P.M. -8:30 P.M. Mr. Smith related that boundry lines were re-surveyed when it was determined that the proposed construction would not adequately fit within a boundry line that would include half of the private drive. He then stated that he has no agreement for use of the private drive. Commissioner Gray related that the Planning Commission should not approve a site plan that would put traffic onto a neighboring piece of property without them knowingly accepting that arrangement. It was noted by Vice Chairman Gray and City Engineer Reel that the plat being provided for review correctly represents changes requested by the Engineering Department. It was pointed out by Commissioner Elliott that there has never been an approved Sketch Plat for the subdivision. Acting Chairman Gray gave the following overview of the history of the plat; (1) presentation in December 1994, tabled at that time for presentation in January but withdrawn by sponsor before the meeting ( 2) presentation of a preliminary plat of Stonewall Subdivision Phase VII in August 1995 at which time the plat was tabled for several reasons as set forth in the minutes of said meeting. He said that Mr. Dick Olson, President of the Stonewall Property Owners Association stated that legal council had informed them that eighty percent of the property owners in the existing phases of Stonewall would be required to approve the acceptance into the association with regard to the subdivision proposed by Mr. Green. He said that the Association has issued a statement in June that they are not in agreement with any addition to Stonewall at this time adding that the letter was an opinion with no binding legal affect. He pointed out that the plat has no legal standing, namewise, with the rest of Stonewall at this point. Acting Chairman Gray related that at present there is a mandatory fee structure and benefits to those property owners in the existing Stonewall Subdivision. Mr. Tommy Bond informed the Commission that Mr. Green recently did a mail out and that he has received 140 written approvals so far. He said that he will pursue the issue and try to get the 400 signatures required for acceptance of the addition. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 1995 7:00 P.M. -8:55 P.M. Commissioner Foster questioned the responsibility for maintenance with regard to the retention pond. Mr. Bond related that drainage improvements within subdivisions become the responsibility of the City. City Engineer Reel related that drainage retention will have to be a consideration with any future development within the City because of problems in the past. He said that the concept has been to get all the water off leaving existing subdivisions down from that development to suffer the extra drainage. He related that the retention basin concept is being considered by other cities, adding that due to growth in the City developments will have to retain and contain all the drainage. He pointed out that the retention basis will be mowed and maintained in the same fashion as the rest of the drainage improvements in the City. He stated that it would be a city requirement and for city maintenance. He related that a retention basin will hold drainage during rains and then release them downstream at no greater rate than experienced before the development occurred. He explained the different methods for construction of a retention basin and how they work, adding that the basin would be designed to hold a 1 in 50 year rain with pipes designed to hold a 1 in 10 year rain which is basically what drop inlets, curbs and cutters are designed to do today. He estimated that there are two to three acres involved in the retention area which would have to be mowed. He stated that the retention basin will have to be constructed in the flood plain, not the flood way explaining that the flood way cannot be disturbed unless you excavate or lower present elevation. · Commissioner Dornblaser and Foster raised concerns regarding the two exits from the proposed development. It was estimated that the exits ontp Berkshire and Loop Road would create excess traffic. \ Discussion ensued as to the location of the access onto Loop Road with regard to the location of the access onto Loop Road from Ferrell Drive. It was determined by City Engineer Reel that the best location for the proposed access onto Loop Road from the development would be directly across from the Ferrell Drive access. He said that the ideal intersection is ninety (0) degrees. He related that the proposed four-lane process will extend from Linda Lane to North First Street along Loop Road with two lanes tapered to Berkshire Drive. He said that possibly two more phases will extend to Graham Road at which time he suggested that a traffic light at Berkshire Dr., Linda Lane, Northeastern and Graham Road will probably be installed. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 1995 7:00 P.M. -8:55 P.M. City Engineer Reel related that there is a piece of private property located between Stonewall Park and Loop Road. He stated that there were no waivers requested when the plat of Stonewall Phase VII was presented in August. He pointed out that he requested that the access be changed as presented, getting it further south away from Berkshire Drive. He said that there were concerns regarding the retention basins with regard to drainage. He related that lot sizes are larger than required and that there are no design flaws in the plat before the Commission. Concerns regarding traffic were voiced by Commissioner Patton, Foster and Elliott. There was discussion regarding ingress and egress off Loop Rd and Berkshire and it was noted that there are thirty lots in this phase of the subdivision. There were concerns also regarding length and radius of culdesacs. Mr. Tommy Bond voiced that the developer is willing to commit to developing a street opening on Loop Road if the Commission so desires in the development of Phase 1. It was suggested that the street accommodate Ferrell Drive which opens onto Loop Rd. on the North side. City Engineer Reel said that the Commission needs to be sure that a second outlet on Loop Rd. does not offset or become close to Green Acres Rd., that it should be placed further to the east. Acting Chairman Gray pointed out that there are approximately four hundred houses in Stonewall at present with four outlets comparing said ingress and egress with the plat under discussion. It was the general consensus of the Commission that there is no need to improve Berkshire Drive with curb and gutter at this time. Commissioner Reid in voicing his opinion with regard to Ferrell Drive said that he did not feel there was enough room for a second ingress, egress on to Loop Road from the proposed subdivision. Mr. Bond related that he did not feel that criteria used to justify a traffic signal relating to the development is met at this point. He pointed out that the major traffic generator is the school on Linda Lane, which is to be improved to a four-lane street, adding that he felt traffic on Loop Road would drop considerably upon completion of the project. 4 r -- CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 1995 7:00 P.M. -8:55 P.M. He suggested that the legal description of the basin be included in the development of Phase I with property ownership reserved by a Property Owners Association. Commissioner Elliott raised a question regarding open drainage ditches in future subdivision developments. City Engineer Reel voiced that open ditches will not be allowed any more. He said that catch basins and pipes will have to be put in any time private property is involved because conduits will be closed. He related that when residents move in and fences are put up the city is not able to get equipment into the area for maintenance. He said that this concept will be complied with before final approval will be given from the engineering department regarding the development of a subdivision. It was noted by Mr. Bond that, due to the expense involved in the planning for water and sewer, plans were not submitted by the developer before approval of the Preliminary Plat. He pointed out that in the past several years the Planning Commission has approved preliminary plats without approval from the Water and Sewer Commissions. Commissioner Elliott pointed out that the Planning Commission has the option to deal with the water and sewer at the time of Preliminary Plat submission or at a later date. 5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 1995 7:00 P.M. -8:55 P.M. Mr. Tonuny Bond related that water and sewer plans are already drawn, that there will be no open ditches and that the details of street and drainage plans will be put together in the inunediate future. City Engineer Reel explained how a decision is arrived at regarding traffic signal installation. He said that it takes a lot of traffic over an extended length of time to warrant installation of a traffic light. He said that care must be taken to follow state and federal guidelines of those who will be contributing money to such projects. He pointed out the number of homes in the Stonewall Subdivision with four outlets and one of those signalized, in comparison to the ingress and egress for the subdivision under consideration. Commissioner Piggee moved, seconded by Commissioner Foster to approve the Preliminary Plat of Stonewall Phase VII subject to compliance with the requirements of the office of the City Engineer with the following stipulations: an additional street with an exit on Loop Rd. across from Ferrell Drive, the culdesac design to show improvement radius of 48 ft. of pavement, final approval by the Planning Commission on the plans for streets and drainage including the retention pond which is to be presented at the next regular meeting of the Planning Commission. Smith, Jerry Leggitt, Peggy Leggitt, Louise Bostic) Chairman Brannen voiced the request, opened the public hearing, and asked that there be one spokesman for each side of the issue. Representative Mike Wilson carne forward to speak for the petitioners of the rezoning request. He explained that the property at issue is already zoned C-1 and that the request before the commission is for the rezoning of four of the five lots at the location to C-3, highway commercial. He explained that the property is owned by the children of Mr. Rob Latta. He said that the easternmost lot, number 5, owned by Mrs. Bostic, is not included in the rezoning request. He said that the property has been zoned commercial for approximately thirty (30) years. He mentioned that before that time, Mr. Latta built some apartments and operated a mobile home park on the parcel belonging to him noting that his water bill is paid in the name of Latta Trailer Park. He said that there is thought that the use could be resumed if so desired. He said that the request is to rezone the property to its best and reasonable use which will not interfere with the enjoyment of his neighbors any more that it is now. He said that there is a potential sale for a quiet business, glass shop and framing business, which exists at present for the westernmost lot belonging to Mr. Latta. He asked the Commission to consider that an owner of property which adjoins commercial property is entitled, as a matter of law, to utilize that property in a commercial fashion. 1 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING OCTOBER 30, 1995 7:00 P.M. -8:15 P.M. Mr. Mackie Pierce spoke as a representative for area residents in Woodland Heights, Dennis Martindale and Randy Vincent who oppose the rezoning. He pointed out the C-1 regulations as set forth in the Jacksonville Municipal Code noting that said zoning acts as a buffer between residential and concentrated commercial areas. He said that all sides are bordered by residential properties and contended that C-1 is the highest and best use of the property. He pointed out that single family residences surround the property requested to be rezoned and that new development of homes to the east of the property is for single family residences as well. Mr. Richard Steven Tomboli, 812 Madden Rd., spoke for area residents on Linda Lane and Madden Road. He voiced agreement with the statements of Mr. Pierce. He presented a petition signed by persons who opposed the rezoning as well as pictures of existing problems due to commercial business operations along T.P. White Drive which back up to the rear yard of some residences along Linda Lane and Linda Cove. He expressed that the residents are not opposed to growth in the city, pointing out that they are concerned with property values. He said that he felt that nothing listed in C-3 zoning could do anything good for the neighborhood. He related that a like request was made in 1981 for rezoning the property requesting that the same decision to deny the request be made by the Commission at this time. Chairman Brannen closed the public hearing at this time, 7:18 p.m. Commissioner Bart Gray Jr. asked for clarification of the parcels requested for rezoning pointing out that the easternmost lot is not to be rezoned with a tract of ground between that lot and those up for rezoning. He pointed out that acreage of the four parcels is approximately eleven (11) acres owned by related parties. He expressed concerns regarding the development plan for the proposed rezoning mentioning that there is a pending sale of Mr. Latta's property. He pointed out that development plans for parcels under five acres are required to come before the Planning Commission to ensure proper subdivision development. Commissioner Elliott clarified that there is no intended use of the parcels other than Mr. Latta's property. He noted that 300 ft. off Madden Rd. accommodates residences and is not a buffer. 2 /JJ CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING OCTOBER 30, 1995 7:00P.M. -8:15P.M. After a question by Commissioner Foster, Attorney Wilson read the decision handed down in state law previously mentioned in these minutes and pointed out that it does not distinguish between different classifications of commercial zoning. He related that the intended use of the property up for rezoning is a joint effort of a husband and wife in a glass door and windshield repair business plus custom picture framing. Mr. Bob Steven, 26 Woodland Drive voiced that he and other property owners do not wish to take the loss with regard to their property values in comparison to the gain to the owners of the property up for rezoning. He pointed out that he felt that C-3 development would change the whole character of the area requesting that residential development be given utmost consideration. There was a general discussion during which Commissioner Gray pointed out that once a parcel is rezoned, the Commission does not have the right to question what goes in if it fits the zoning classification. He noted concern for residents pointing out that privacy fences and noise control should be given consideration. It was related by Commissioner Gray and City Attorney Bamburg that C-2 zoning would not accommodate the intended use of the parcel, that a Board of Adjustment hearing would be required to approve the auto glass shop. Commissioner Gray voiced that he felt the request should be downgraded to C-2 if it could be, pointing out that the Board of Adjustment could grant approval for an auto repair shop in a Conditional Use. He said that he would not be in favor of addressing the rezoning of three of the parcels without a development plan. He explained that controls are still maintained on the parcel by the Planning Commission through the process of obtaining a building permit in that it is a metes and bounds legally described parcel. He pointed out that fencing and screening could be addressed at that time. The petitioners were given opportunity to change the rezoning request. After discussion, all petitioners except Mr. Buford Latta withdrew their requests. Mr. Latta chose to request a C-2 classification for his parcel of land. Commissioner Gray requested that the chair recognize the withdrawal of the three easternmost parcels and recommended that the Commission address only Mr. Buford Latta's parcel. Chairman Brannen acknowledged the request. Commissioner Dornblaser pointed out that the request is unusual, noting the residential needs as well as the highway commercial development access relating that he sees the need for a buffer. Mr. Tommy Bond voiced that it would not, that it is a swale and at the maximum point it is 3.3 ft. deep and will be easy to mow. He added that it will hold water only when it rains. He stated that it will accomplish the request from the Planning Commission that the development not impact the current drainage in the area. Discussion began regarding the request by the Planning Commission to install a privacy fence along Loop Road. Mr. Bond related that a privacy fence will add additional cost to the sale of lots in the development. Chairman Brannen requested that the item involving the approval of the drainage concerns be resolved before moving on to other requests from the Planning Commission. City Engineer Reel requested that drop inlets and an 18' pipe be installed at the curve in the western most street at the south side of lot 508F in order to divert the flow of water from Berkshire Drive and direct it toward the drainage retention basin and then into the ditch. He discussed the desired performance of the retention basin citing the effects of a retention basin near the Air Force Base. Mr. Bond related that with regard to the drainage request, he did not see a problem. Mr. Andy Timer expressed concerns regarding the retention basin as an earthen ditch and inquired as to the responsibility of its future maintenance. City Engineer Reel related that other earthen structures located in Northwood Acres and Pennpointe Subdivisions have not presented any major problems. He stated that if properly constructed he did not feel there would be any erosion type problems, adding that this is amoung one of the first times such a structure has been addressed by the Planning Commission. In response to a question posed by Chairman Brannen, City Engineer Reel related that maintenance responsibility can be dealt with in the bill of assurance by the property owners or dedicated to and maintained by the City, adding that nothing definite has been decided. He said that he felt this would offer control of back access to lots and act as a screen along Loop Road. He then requested that the Bill of Assurance state that no access to Berkshire Drive be allowed on an individual basis. Discussion ensued as to location of the privacy fence with regard to projected future widening of Loop Road. Commissioner Gray noted different developments in the City which have used privacy fences as a method of screening. Further discussion ensued regarding types of material that can be used to construct a fence and consideration arose for constructing a fence along Berkshire Drive also. Information regarding other areas using privacy fences for separation or screening was then discussed. Mr. Andy Timer stated that he would like to register his support in favor of a privacy fence along Loop Road and Berkshire Drive because he felt it would be estheticlly beneficial. He then expressed concerns regarding traffic from the proposed development entering onto Berkshire Drive, which he felt is already very congested at times. Mr. Bond expressed his concerns regarding the additional cost of constructing a privacy fence, which would be incurred in the lot sale price. Commissioner Dornblaser stated that he felt lot costs to be secondary to the justification for the fence. Discussion ensued regarding voting on the separate issues and reasons for consideration regarding a privacy fence for Berkshire Drive. A resident from the area suggested that a hedge row be used as a noise barrier. Further consideration for maintenance of the hedges was discussed as well as the uniformity of privacy fencing. Discussion regarding each request ensued the following motions were made. Commissioner Foster moved that Phase VII of Stonewall be accepted with a privacy fence going down Berkshire as related to the phase. City Engineer Reel cited an example regarding specifications requested in building a bridge in Johnson Park six months ago. He stated that penetrated lumber with a forty (40) year ground contact guarantee was used and that repairs are now being sought to correct a variety of problems with the lumber. He stated that it would be hard to cover the variables with regard to using lumber. Discussion ensued as to the maintenance responsibility, Bill of Assurance capabilities and material request. Commissioner Foster moved, seconded by Commissioner Reid that a privacy fence be required on Berkshire and Loop Road with regard to Stonewall Phase VII, asking that the Bill of Assurance state that the property owner will be responsible for the maintenance of said fence. MOTION CARRIED. Developer Jim Green suggested that the Commission deal with the issue of fencing at a later date pointing out that the drainage issue was what he brought before the Commission. The motion stood as passed. White Drive. He related that the request was modified by the petitioner after Planning Commission action in November and that the request presented to the City Council has not been properly advertised or posted according to legal process as determined by the City Attorney . He pointed out the need to follow proper procedure. Attorney Mike Wilson expressed that he and the petitioners understand the desire of the City to properly post the property and voiced that they will respect the delay. He pointed out that the request before the Planning Commission is to rezone to C-2 only the north 200 feet of one lot which is owned by Mr. Buford Latta. He noted that Mr. Andy West will request a public hearing before the Board of Adjustment regarding the operation of the business planned for the parcel. At this time, Commissioner Dornblaser moved, seconded by Commissioner Piggee that a public hearing be set for January 8, 1995 at 7:00 p.m. during the regular meeting of the Planning Commission to hear the request to rezone from C-1 to C-2 the north 200 feet of a parcel located from T.P. Mr. Tommy Bond voiced that there are three lots being dealt with. City Engineer Reel explained that Lot 3 is not tied to any public thoroughfare noting that there are other pipe stem lots in subdivisions around town where access to property is allowed. He explained that an access easement consisting of a 25 ' stem from Toneyville Rd. back to a connection with Lot 3 actually becoming a part of that lot. He said that part of the easement would be a part of Lots 3 and 1 making access for Mr. Pearl and a service area with regard to utilities. Commissioner Kenny Elliott moved, seconded by Commissioner Piggee to approve the PRELIMINARY AND FINAL PLAT of the Carmen-Jewell Subdivision with the stipulation that the north 25' of Lot one (1) become a part of Lot 3 and that a Bill of Assurance be filed with the City Engineer. MOTION CARRIED. It was pointed out by Commissioner Elliott that building lines should be noted on the plat which was agreed to by Mr. Bond representing the petitioner. MAIN STREET REVITALIZATION: City Engineer Reel related, after a question by Commissioner Dornblaser that the Main Street Revitalization Committee has been combined with the Chamber of Commerce with formation of a different committee. City Attorney Bamburg stated that a non-profit organization group of property owners has been set up in relation to Economic Development and Chamber of Commerce efforts. A meeting scheduled by the Economic Development Department for Tuesday, 12:00 noon at Ramada Inn, 12 December 1995 was announced. Commissioner Dornblaser mentioned that annexation efforts have not been pursued and requested that efforts be resumed to which Commissioner Elliott agreed. Commissioner Dornblaser related that he favored further work on modifying Municipal Codes and requested that it become an item of business for the Planning Commission.
