1815ORDINANCE NO. 1815 (#10-2026)
AN ORDINANCE TO AMEND THE METHOD OF SELECTION FOR THE OFFICE OF
CITY ATTORNEY FOR THE CITY OF JACKSONVILLE, ARKANSAS; TO PROVIDE
THAT THE OFFICE OF CITY ATTORNEY SHALL BE APPOINTED RATHER THAN
ELECTED; AND FOR OTHER PURPOSES.
WHEREAS, Arkansas law authorizes municipalities to provide for the appointment of a
municipal attorney pursuant to Arkansas Code Annotated§§ 14-42-112 and 14-43-313; and
WHEREAS, the City Council of the City of Jacksonville has determined that the efficient
administration of municipal legal affairs is best served through the appointment of a qualified City
Attorney by the Mayor, subject to confirmation by the City Council; and
WHEREAS, the City Council finds that an appointed City Attorney will provide greater
continuity of legal services , accountability to the governing body , and administrative efficiency in
the representation of the City and its departments ; and
WHEREAS, the City Council desires to establish by ordinance that the office of City
Attorney shall henceforth be an appointed office rather than an elected office , as authorized by
Arkansas law.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Pursuant to the authority granted under Arkansas Code Annotated
§§ 14-42-112 and 14-43-313 , the office of City Attorney for the City of Jacksonville, Arkansas ,
shall be an appointed office rather than an elected office.
SECTION TWO: The City Attorney shall be appointed by the Mayor, subject to
confirmation by a majority vote of the duly elected and qualified members ofthe City Council.
SECTION THREE: The City Attorney shall be a licensed attorney in good standing with
the State of Arkansas and shall perform all duties required by Arkansas law, municipal ordinance ,
and such additional duties as may be assigned by the Mayor or City Council consistent with law.
SECTION FOUR: The City Attorney shall serve at the pleasure of the Mayor unless
otherwise provided by contract or ordinance.
SECTION FIVE: Any ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict.
