A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AGRICULTURAL
LAND LEASE WITH WESTBROOK FARMS, LLC FOR CERTAIN CITY-OWNED
PROPERTY LOCATED NEAR WOOTEN ROAD; FINDING THAT THE LEASE SERVES
A PUBLIC PURPOSE; AND FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville owns certain real property located near Wooten Road
in Pulaski County, Arkansas; and
WHEREAS, portions of the property are presently suitable for agricultural cultivation but
are not presently needed for immediate municipal development; and
WHEREAS, allowing the temporary cultivation of the property will reduce the City's
maintenance costs by eliminating or reducing the need to mow and maintain the farmable acreage
while keeping the property productive; and
WHEREAS, the City desires to retain complete authority over the property and preserve its
ability to use the property for future municipal, public infrastructure, utility, drainage, park,
industrial, economic development, or other governmental purposes; and
WHEREAS, the proposed Agricultural Land Lease provides for a one-year term, does not
automatically renew, reserves the City's right to terminate the lease when necessary for a public
purpose, and otherwise protects the City's interests; and
WHEREAS, the City Council finds that entering into the proposed lease is in the best
interests of the citizens of Jacksonville and serves a valid public purpose.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,
ARKANSAS, THAT:
SECTION ONE: The City Council hereby approves the Agricultural Land Lease between the City
of Jacksonville and Westbrook Farms, LLC, substantially in the form presented to the Council.
SECTION TWO: The Mayor is hereby authorized and directed to execute the Agricultural Land
Lease and any ancillary documents necessary to carry out the intent of this Resolution, provided that
any non-substantive modifications approved by the City Attorney may be incorporated before
execution.
SECTION THREE: The City Council finds that the Lease serves a legitimate public purpose by:
reducing municipal maintenance costs; allowing productive agricultural use of otherwise idle
property; preserving the property until needed for future municipal use; and protecting the City's
ownership interests through appropriate lease provisions.
SECTION FOUR: Nothing contained in this Resolution or the Lease shall limit or impair the City's
authority to terminate the Lease as provided therein or otherwise exercise any authority granted under
Arkansas law regarding the management, development, sale, exchange, or other disposition of
municipal property.

SECTION FIVE: If any provision of this Resolution is held invalid, such invalidity shall not affect
the remaining provisions.
