AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
LIFEPAK 35 CARDIAC MONITORS, ACCESSORIES, AND WARRANTIES FOR THE
JACKSONVILLE FIRE DEPARTMENT EMS DIVISION; FOR APPROPRIATE
IMPLEMENTATION AND ACCESS FOR THE JACKSONVILLE FIRE DEPARTMENT
AND CITY OF JACKSONVILLE REPRESENTATIVES; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, the City has determined that acquiring LIF E PAK 35 Cardiac Monitors ,
accessories, batteries , and extended service warranties for the Jacksonville Fire Department EMS
Division is necessary for the continued efficient delivery of emergency medical services and the
protection of public health , safety , and welfare ; and
WHEREAS, Jacksonville Fire Department EMS personnel conducted an extensive in-
house review, field testing , and performance evaluation of advanced cardiac monitor systems ,
including products manufactured by Stryker, Zoll , and Phillips , and determined that the LIFEPAK
35 system offered superior usability , reliability , CPR optimization , EMS integration, and
operational performance ; and
WHEREAS, the review and justification prepared by the Jacksonville Fire Department
E MS Division found that Stryker LIFEP AK devices ranked highest in multiple critical categories,
including shock delivery speed, CPR quality , durability , intuitive operation , and integration with
E MS workflows , making the product the preferred choice for prehospital emergency medical
response ; and
WHEREAS , the Jacksonville Fire Department EMS Division has recommended the
purchase of four (4) LIFEPAK 35 Cardiac Monitors with accessories , batteries , freight, taxes, and
extended service coverage through Stryker Sales, LLC, at a cost of approximately Three Hundred
Ten Thousand Nine Hundred Twenty-One Dollars and Sixty-Five Cents ($310 ,921.65), payable
in five (5) annual payments of approximately Sixty-Two Thousand One Hundred Eighty-Four
Dollars and Thirty-Three Cents ($62,184 .33); and
WHEREAS , the City has determined that traditional competitive bidding is impractical
due to the specialized and proprietary nature of advanced cardiac monitoring systems , the
operational compatibility required for EMS deployment, the department's field testing and
evaluation process, and the necessity of maintaining consistency in emergency medical equipment
and training; and
WHEREAS , obtaining the equipment in a timely manner is essential to maintaining
emergency medical operations and avoiding delays associated with the formal bidding process;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:

SECTION ONE: Competitive bidding for the purchase of LIFEPAK 35 Cardiac
Monitors, accessories, batteries, and extended warranties for the Jacksonville Fire Department
EMS Division is hereby found and declared to be unfeasible, impractical, and not in the best
interest of the City.
SECTION TWO: Competitive bidding is hereby waived pursuant to ACA § 14-47-
138 to authorize the purchase ofLIFEPAK 35 Cardiac Monitors, accessories, batteries, and related
service coverage from Stryker Sales, LLC, at a cost of approximately Three Hundred Ten
Thousand Nine Hundred Twenty-One Dollars and Sixty-Five Cents ($31 0,921.65), plus applicable
taxes and fees, payable in five (5) annual payments of approximately Sixty-Two Thousand One
Hundred Eighty-Four Dollars and Thirty-Three Cents ($62,184.33). The Mayor and/or his
authorized representative(s) are hereby authorized to execute all necessary documents to complete
the purchase.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions taken by
said Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance , necessary for the continued efficient delivery of
public services and for the benefit, health, safety, and welfare of the citizens of Jacksonville, should
be implemented immediately. Therefore, an emergency is hereby declared, and this Ordinance
shall be in force and effect from and after its date of passage.
