0856RESOLUTION NO. 856 (#03-2026) A RESOLUTION TO AUTHORIZE THE MAYOR, OR HIS DESIGNATED REPRESENTATIVE, TO ACCEPT, FOR MUNICIPAL PURPOSES, PERMANENT CONSTRUCTION EASEMENTS, RIGHT OF WAY DEDICATIONS, AND FEE SIMPLE ACQUISITIONS; AND TO AUTHORIZE THE MAYOR, OR HIS DESIGNATED REPRESENTATIVE, TO ACQUIRE TEMPORARY CONSTRUCTION EASEMENTS AS NEEDED TO COMPLETE THE CONSTRUCTION OF THE WEST MAIN STREET REALIGNMENT, AND FOR OTHER PURPOSES. WHEREAS, on October 16, 2024, the City of Jacksonville was notified by Metroplan that it had been selected to receive supplemental funding from the CARTS 2025 Surface Transportation Program Block Grant Funds for the construction of the West Main Street Realignment which increased the new project federal maximum funding to $3,508,000.00 (80%), leaving as estimated balance to be matched locally of $877,000.00 (20%) for completion of final design, environmental clearance, acquisition of necessary rights of way, construction, & construction engineering.; and WHEREAS, on October 1, 2020, the City Council adopted Jacksonville, Ark. Resolution No. 801 expressing the willingness of the City of Jacksonville to utilize Federal Aid Surface Transportation Block Grant Program Attributable Funds from Metroplan for the West Main Street Realignment project; and WHEREAS, the acquisition of Easements, Rights of Way, and Fee Simple Acquisitions is needed to accomplish the construction, maintenance and continued public access to the improvements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: Section 1. The Mayor, or his designated representative, is authorized to pursue the acquisition of Permanent Construction Easements, Drainage Easements, Right of Way Dedications, Fee Simple Acquisitions and Temporary Construction Easements as needed to complete the West Main Street Realignment project. Section 2. The Mayor, or his designated representative, is authorized to accept Permanent Construction Easements, Right of Way Dedications and Fee Simple Acquisitions for municipal purposes and the Mayor, or his designated representative, is authorized to accept Temporary Easements needed for construction. Section 3. Funding for the project is budgeted. RESOLUTION NO. 856 (#03-2026) Page Two Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
