Ch~irman Brannen opened the meeting at approximately 7:00 p.m.
expressing appreciation for those in attendance
PRESENTATION OF SERVICE AWARD:
Chairman Brannen presented Commissioner John Hardwick with a plaque
honoring his six years service term to the Planning Commission.
Commissioner Hardwick expressed his appreciation, saying that he had
enjoyed his service on the Planning Commission.
Chairman Brannen requested roll call.
ROLL CALL: Commissioners: Susan Dollar, Chad Young, Bobby Lester,
Glen Keaton, Lester Piggee, Tammy Green, Mark Perry, and William
Montgomery answered ROLL CALL. Chairman Brannen also answered ROLL
CALL. PRESENT nine (9) , ABSENT (0) .
Others present for the meeting were City Engineer Whisker, Aldermen
Howard, Stroud, Fletcher, Mr. Preston Robinson, Mr. Alderman Ray
Gilmore, Mr. Sam Langdon, members of the press, interested citizens,
and petitioners.
ELECTION OF 2002 PLANNING COMMISSION AND BOARD OF ADJUSTMENT
Commissioner Perry moved, seconded by Commissioner Lester to
nominate Art Brannen as Planning Commission Chairman for the 2002
term. MOTION CARRIED .
Commissioner Green moved, seconded by Commissioner Piggee to
nominate Mark Perry as Planning Commission Vice-Chairman and
Board of Adjustment Chairman for the 2002 term. MOTION CARRIED.
Chairman Brannen accepted Commissioner Montgomery and
Commissioner Green as volunteers serving from the Planning
Commission for 2002 Board of Adjustment appointments.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Piggee moved, seconded by Commissioner Perry that the
minutes of the 19 November 2001 Regular Planning Commission meeting be
APPROVED. MOTION CARRIED. The December regularly scheduled Planning
Commission meeting was cancelled.
PUBLIC HEARING (S) : REZONING property South of Graham Road off Loop
Road from R-1 to R-6
Chairman Brannen opened the public hearing at approximately 7:04 p.m.
Mr. Sam Langdon related that he would like to rezone a lot off Loop
Road for placement of a doublewide mobile home with a shingle roof.

With no one to speak in opposition, Chairman Brannen closed the public
hearing at approximately 7:05p.m.
In response to a question from Commissioner Perry, Mr. Langdon related
that the modular horne would be on a slab foundation.
City Engineer Whisker related that the area of Kelley Drive in the
near vicinity is zoned for mobile homes. He added that the petitioner
would need a building permit because the property is not platted.
Commissioner Dollar commented that in viewing the property it did not
appear to be spot zoning.
Commissioner Piggee moved, seconded by Commissioner Perry to approve
the rezoning with the stipulation that a building permit be granted.
MOTION CARRIED.
BUILDING PERMIT(S): SITE PLAN for Triangle Subdivision Lot 1
Mr. Robinson related that the property is the northwest corner of the
Subdivision adjacent to Redmond Road, the south property line and the
LRAFB.
Discussion ensued and Mr. Robinson stated that the sewer has been
approved by the City, adding that water is not active in the area as
yet. He stated that the structure for the fire pump room was approved
at the previous meeting, but has not been tied in at this time until
the building is completed.
Commissioner Dollar moved, seconded by Commissioner Keaton to approve
the plan.
City Engineer Whisker clarified that the development is a commercial
subdivision on the corner of Redmond Road and General Samuels. He
related that it will be developed lot by lot, adding that Mr. Robinson
plans to construct the street.
At this time, MOTION CARRIED.
REQUEST TO APPROVE PLAT(S): a. REPLAT BOO North First Street, Lots
1-6, Block 7, Landmark Mission Baptist Church
Mr. Ray Gilmore stated that the request is to reduce a 15-foot
easement to 5-foot. He related that in 1972 the church received
permission to build over the easement. He stated that the church
wants to add to the current fellowship hall.
City Engineer Whisker stated that he has been in contact with Entergy,
adding that with their approval he does not foresee a problem. He
related that Entergy is the major user of the easement.

Discussion ensued as to the direction of the proposed addition, and
including Entergy's approval as a stipulation to the approval.
Commissioner Lester moved, seconded by Commissioner Dollar to approve
the replat contingent on written encroachment approval from Entergy.

GENERAL: Discussion regarding Landscape/Green Ordinance
Chairman Brannen recognized Alderman Bob Stroud.
Alderman Stroud stated that he is very gratified that the Planning
Commission is considering a Green Ordinance. He related that he feels
Jacksonville has needed a Green Ordinance for a long time. He related
that Jacksonville has some areas including parking lots that need
attention regarding landscaping. He acknowledged that the Wal-Mart
development was well planned and encouraged that type of planning for
other commercial developments. He offered the assistance of the City
Council.
Commissioner Dollar related that she had submitted material from a
four-state planning conference in Kansas. She related that the
ordinance presented is working well for the Kansas area.
r.nmmissioner Young related that he had also submitted a green
ordinance adopted by the City of Conway. He related that the Green
Ordinance provides for minimal landscaping and offers useful
definitions.
Alderman Fletcher questioned the formation of a committee made up of
both City Council and Planning Commission members to discuss provision
for a Green Ordinance. He stated the he had previously submitted the
Little Rock Ordinance for Planning Commission review. He echoed
Alderman Stroud's sentiments regarding the need for a landscaping
ordinance. He stated that with the rising concern over the Ozone, now
would be a perfect time to consider a Green Ordinance.

ANNEXATION OF MURRELL TAYLOR ELEMENTARY SCHOOL UPDATE
City Engineer Whisker related that the annexation of Murrell Taylor
along with First Electric was voted down by a five to two vote. He
stated that his understanding of the reason was that they felt that if
Jacksonville annexed Murrell Taylor it would help them to take Murrell
Taylor in a school district move where Jacksonville pulled away from
Pulaski County Special School District.

about being annexed in the southeast annexation. He stated that he
would be proceeding once he has received the names of all participants
requesting annexation.

a. FINAL PLAT Bridge Creek Farms, Block
Mr. David Jones of Marlar Engineering Company presented revised copies
of the final plat, saying the request will allow the owner to
subdivide 14 acres into four lots for development.
In response to a question from Commissioner Keaton, Mr. Jones related
that the easement was an un-labeled easement on the former plan that
will not affect the property or the development.
In response to a question posed by Commissioner Montgomery, Mr. Jones
related that drainage for the property would go toward the rear at
lots 3 and 4 to Leopard Creek coming from a ditch beginning at Bridge
Creek Road.
It was noted that the subdivision is located off Batesville Pike.
Discussion ensued and City Engineer Whisker stated that the plat meets
subdivision regulations with the exception of building lines, which is
25' instead of the 35' standard, adding that it is common in culdesac
areas to be reduced to 25 foot. He then pointed out that the
development would have to meet with Pulaski County road standards,
which is 6", a 20' section with 4' gravel shoulders. He related that
the only exception would be if the County considered the development
to be urban, which would then require curb and gutter.
Mr. Jones stated that the County is requiring the same standard road
currently in the area which is 20' payment and 4' shoulders. He
stated that the County is not asking for curb and gutter.

In response to a question posed by Commissioner Dollar, City Engineer
Whisker related that developments with less than 20 lots are exempt
from sidewalk requirements.
Discussion ensued regarding zones A and C for lot 1 and City Engineer
Whisker related that the developer plans to build 2' above for BFE
structures.
Mr. Jones related that new information from FEMA is that they are
going to start requiring 2' above the 100-year flood plain. He then
pointed out that lots 2, 3 and 4 are under the 100-year flood plain
elevation, but the floor elevations of the houses will still be built
2' above.
Commissioner Lester moved, seconded by Commissioner Dollar to approve
the FINAL PLAT contingent on Pulaski County's approval. MOTION
CARRIED.
b. REPLAT Bomber Base Addition Lots 16, 17, & 18, Block 6
City Engineer Whisker related that he had approved
explaining that the petitioner had replatted three lots

GENERAL: City Engineer Whisker presented aerial photos of the
annexation for First Electric and noted that in order to provide
Police, Fire and Ambulance services the remainder of Loop Road was
included in the annexation, which he added is the reason the parcel
north of Graham and Loop Road is also being annexed. He noted the
exception in the annexation is Murrell Taylor Elementary School. He
related that he has gotten all necessary signatures except the owner
of the property at Graham and Loop Road who has the petition and has
every intention of signing but is currently out of town. He asked
that the Planning Commission recommend the annexation to the City
Council at its first availability after all signatures are obtained.
He related that the zonings are listed on the map, saying that he had
spoke with the property owners regarding the zonings. He related that
annexations zonings is a study and a hearing held by the Planning
Commission and then approved through City Council. He related that
the R-7 property owner related he would like the option to reestablish
a trailer park on his property.
He then noted that the corner of Loop and Military Road is C-1 and
that the owner wanted to leave it open as C-1. He stated that owner
had indicated that he could possibly sell for apartments and would
want it switched if in the interim he had it sold. He pointed out
that First Electric is currently zoned C-1 on North First Street.

PUBLIC HEARING (S) : a. CONDITIONAL USE R-3 in a C-2 Zone/200 S.
Hospital Blvd.
Chairman Brannen opened the public hearing at approximately 7:01p.m.
Representative Mr. Ben Rice for Jacksonville Towers stated that at the
proposed conditional use is for a site adjacent to the existing nine-
story site of the Jacksonville Towers. He related that each year HUD
has housing available for placement in Arkansas and that for the
previous couple of years the Board has tried to find an acceptable
site to meet HUD requirements. He went on to say that the best site
is the present location regarding some excess land. He stated that
the proposed plan is to split a portion of the property on the south
side into a separate tract B. He related that the Board would like to
be in a position to apply for some of the housing units as they become
available. He related that the property is presently zoned C-2, and
pointed out that apartments are present in the general area and on the
overall tract. He related that with the Planning Commission's
approval for a conditional use, the Board would return with an
application for a building permit and showing the required parking and
drainage. He stated that he is unsure of how many units would be
available, pointing out that HUD offered twenty-four units during the
previous opportunity for housing. He stated that the Board is
assuming HUD will again offer as many as twenty-four or twenty-five
units, saying that their plan is to build up to twenty-five units on
tract B within the next two years. He stated that the area is
conducive to apartment development and is desirable for apartments
because it is close to downtown shopping.
Chairman Brannen closed the public hearing at approximately 7:05 p.m.
City Engineer Whisker agreed that the area is conducive to apartment
construction, adding that additional plans regarding drainage or other
improvements would be brought back to the Planning Commission.

In response to a question posed by Chairman Brannen, Mr. Rice related
that he did not feel the twenty-five unit development would adversely
affect traffic in the area, pointing out that the existing one-hundred
units have not caused a traffic concern.
In response to a question posed by Commissioner Young, Mr. Rice stated
that the existing building was constructed to accommodate handicapped
as well as the elderly, adding that the proposed construction would
feature some handicapped units. He pointed out that the Towers has
five handicapped units.
In response to a questions posed by Commissioner Dollar and
Commissioner Montgomery, Mr. Rice related that the development is
being proposed as a single-floor design with apartments that back up
to one another and parking between the proposed development and the
existing building with a common drive from Hospital Drive.
It was noted that the item of business was approved by the Board of
Adjustment for a density variance.
Commissioner Lester moved, seconded by Commissioner Green to grant the
conditional use of R-3 in the C-2 zone located at 200 South Hospital
also known as Tract B of the existing Jacksonville Towers property.
Discussion ensued regarding the time factor and it was determined that
a time stipulation would not be part of the conditional use as
approved.
Commissioner Young expressed some concern regarding the limited side
yard setback, adding that it could be addressed during the building
permit application.
At this time, MOTION CARRIED.
b. CONDITIONAL USE R-6 in a C-2 Zone/115 West Hickory
Chairman Brannen opened the public hearing at approximately 7:10 p.m.
Mr. Arnold Koester stated he is the owner of two lots on West Hickory
Street. He related that lot 12 has a beauty shop and lot 11 is
vacant, adding that he would like to place a doublewide mobile home on
the vacant lot for personal use.
There was no opposition to speak.
Chairman Brannen closed the public hearing at approximately 7:11 p.m.
In response to a question posed by Commissioner Young, Mr. Koester
related that by personal use he meant as a residence, adding
consideration for a small storage building. He stated that the mobile
home would be a new mobile home.

He then answered that the mobile home would be on a permanent
foundation with the wheels removed. He related that the beauty shop
parking could be used for personal parking. He stated that when his
other home sells he intends to make the doublewide his residence.
Discussion ensued as to a time factor involved with the conditional
use. Mr. Koester answered that adjacent to lot 11 is a residence.
City Engineer Whisker explained that the request was tabled a few
years ago. It was noted that the item of business was re-advertised.
City Engineer Whisker pointed out that to grant the request would be
to allow for a mobile home residence downtown. He stated that some of
the new mobile homes can very much look like a site built house,
adding that typically downtown is reserved for business, pointing out
that the Planning Commission has discussed mixed use of the area.
City Attorney Bamburg answered that the overlay district did not cover
this type of request.
Chairman Brannen questioned the affect this may have regarding the new
Overpass.
City Engineer Whisker related that from reading past minutes, the
Planning Commission expressed concerned regarding the required right-
of-way for the Overpass and decided to wait until bridge construction
to make sure that rights-of-way were secured.
In response to a question posed by Commissioner Green, City Engineer
Whisker related that the surrounding property would be the Salvation
Army store, a 14' X 32' portable building beauty shop owned by Mr.
Koester and an older white wood frame house adjacent to lot 11, then
another empty lot adjacent to the freeway.
Commissioner Dollar recalled a revitalization plan in 1996 or 1997
that was adopted for the downtown area.
Alderman Stroud offered that a revitalization plan may have been
offered when Downtown Inc. was meeting. He stated that the group
consisted of citizens, some City Council members and business owners
in the area who were looking at the possibility of apartments in the
downtown area to create a multi-use purpose. He related that nothing
official was ever brought forth, pointing out a study conducted by the
University of Arkansas regarding the best use of the downtown area.
He related that eventually Downtown Inc. disbanded, but currently they
are trying to get started back with a new group.
In response to a question posed by Commissioner Montgomery, Mr.
Koester related that eventually they plan to live in the mobile home,
saying that they want to move everything to one piece of property and
cut expenses.

City Engineer Whisker related that when he spoke to Mr. Koester, he
informed him that from a planning standpoint the mixed use was
intended to have a business on the bottom with an apartment above the
business. He stated that it would of course be a lot more costly than
a mobile home, but that from a planning standpoint it would be the
ideal situation.
Commissioner Green questioned the planned access and parking, Mr.
Koester stated that if the commission required separate parking from
the business he could provide that, adding that the present parking
lot is big enough for the beauty shop and personal parking. He related
that he has more parking spaces than is required by City Code. He
related that he owns a small trailer for hauling lawn equipment and
would want it located at the property. He stated that the City
requires four parking spaces for his business, adding that he has
enough room to provide for twelve parking spaces.
Commissioner Dollar expressed that she supports the vision of mixed
use in the downtown area, but also expressed concern regarding
placement of a doublewide mobile horne in the downtown area that is
being considered for revitalization.

City Attorney Bamburg related that if the conditional use is granted

granted business purposes. He then clarified that the request is to
use the mobile home only as a residence not for a business. He stated
that if its use were to change, Mr. Koester would have to return to
the Planning Commission because it would be outside the scope of the
conditional use.

lot 11 if the conditional use is granted.
City Attorney Bamburg stated that it would depend on the scope of the
conditional use as granted by the Planning Commission.
Discussion ensued regarding restrictions for conditional uses .
Commissioner Dollar moved, seconded by Commissioner Green to table

BUILDING PERMIT(S):
REQUEST TO APPROVE PLAT (S): REVISED PRELIMINARY PLAT Jacksonville
Plaza Addition Lots 1, 2 and 3.
Mr. Barry Williams of Richburg-Rickett Engineers related the need to
extend the file time of the original preliminary plat filed in April
of 2001. He stated that there was one modification to the plat since
last plat approval, pointing out that the major drainage structure
that traversed the site has been moved. He related that previously it
had been approved to be located between the two buildings and made a
loop through the site. He stated that the drainage structure has been
revised and coordinated with the City Engineer. He stated that the
drainage calculations to support the new location have been submitted.
He stated that there is a structure already in place and paths being
constructed.
In response to a question posed by Chairman Brannen, Mr. Williams
stated that issues involving the ingress and egress have not changed.
He pointed out on the plat that arrows at the south main entry
indicate proposed traffic flow and that the northern entry is a right-
hand in and right-hand out turn only with an island for traffic
direction. He stated that traffic patterns have not changed from the
previous plat.
City Engineer Whisker explained that the previous plat would expire in
April, and the developer wanted to ensure that with the major drainage
change that the Planning Commission gave its approval. He stated that
the first location for the drainage was not workable. He related that
the newly proposed location would remove the floodway waters, adding
that the changes have the approval of the Fire Marshall. He related
that the developer would be seeking a building permit for lot 1.
Discussion ensued as to traffic concerns onto John Harden Drive, and
City Engineer Whisker related that the Highway Department is
conducting traffic counts for the area. He added that he has
submitted a plan to the Highway Department regarding concerns for the
traffic signal at T. P. White, which might help to eliminate many of
the traffic concerns.

Commissioner Dollar expressed concerns for the internal circulation of
the area including the bank and Wal-Mart regarding sidewalks.
City Engineer Whisker related that the development does have plans for
sidewalks.
It was noted that a back access into the Wal-Mart parking lot is still
planned.
Mr. Williams offered that there has been much discussion supporting
the theory that many people would arrive at the main intersection and
realize that a left-hand turn is not the best situation, adding that
there are times of the day that a left hand turn will be possible, but
at busier times a lot of vehicles would revert to the back access of
the development and then to the light from Wal-Mart.
In response to a question posed by Commissioner Young, it was
clarified that land could not be sold until the final plat has been
approved. Mr. Williams then added that internal circulation would
serve lot 2, but added that not knowing who the vendor would be, he is
not fully aware of the parking and circulation needs. He related that
at some point in time the curbs would be pulled out and aprons placed,
allowing access to the central drive through the development. He
stated that those considerations would hold the same for lot 3.
Discussion ensued and City Engineer Whisker stated that an answer from
the Highway Department could take as long as six to eight weeks
regarding the traffic signals at Vandenburg and T.P White. He related
efforts to combine the lights to act as one to help with traffic
storage under the bridge.
Commissioner Green related concerns for the access to the Freeway
directly in front of the development.
City Engineer Whisker stated that the next plan following the
synchronization of the traffic signals, is a radio system that could
be used to relay traffic information to the traffic signals in front
of Wal-Mart, North First Street and the Fire Station. He stated that
the system would run off one controller. He related that
signalization plan is a long range goal and that he has not worked
estimates for the project as yet.
In response to a question from Commissioner Green, City Engineer
Whisker related that there would be more cars generated in the area
due to the new business.
Commissioner Green asked if having access available at the rear of the
development leading to the Wal-Mart parking lot would help the traffic
situation.

Mr. Williams offered that he believes the rear access would provide
cars an opportunity to exit onto John Harden through the Wal-Mart
light. He then stated that the southern access on the property would
have a no left-hand turn sign to help direct traffic.
Discussion ensued regarding other traffic considerations and possible
long-term plans for the on-ramp to the Freeway.
City Engineer Whisker stated that there have been several different
discussions regarding traffic flow of the area when Wal-Mart
developed, including various scenarios for the on-ramp.
Chairman Brannen questioned the possibility of making the entrance
into the development a one-way entrance and then having traffic exit
the property through the rear Wal-Mart access to avoid traffic
attempting to exit onto John Harden from the development.
Mr. Williams stated that Wal-Mart has agreed to an outlet to their
property, but added that he did not believe the agreement to be for
all traffic to exit onto the Wal-Mart parking lot to circulate through
their drive system.
In response to a question from Commissioner Montgomery, City Engineer
Whisker related that a back access to Vandenburg would have to go
through Air Base property. He stated that currently they do not wish
to grant an access. He stated that when Wal-Mart was developed it was
agreed that Bailey Street would not be a through street to Vandenburg.
Mr. Williams reiterated that the preliminary plat is. unchanged from
the one previously approved except for the drainage easement.
Commissioner Lester stated that the plat has essentially been approved
earlier with the same traffic concerns.

Representative Mr. Bond related that the street has not been
completed, but added that Mr. Green has posted a bond for the streets
and sidewalks.
City Engineer Whisker related that Mr. Green would need to post for
streets and sidewalks before the Plat is sent to the Ci ty Council for
Final Approval. He stated that any motion from the Planning
Commission to approve. would need to stipulate that the streets be
completed or have approval from the City Engineer before being
forwarded to the City Council . He stated that oth er aspects have been
worked out, adding that street completion has been delayed because of
the recent bad weather. He then answered that the water and sewer
have been approved.
Commissioner Lester moved, seconded by Commissioner Piggee to approve
the Final Plat of Collenwood PH III contingent upon street completion
and/or the City Engineer approval before being forwarded t o City
Council. MOTION CARRIED.
Mr. Green apologized for the necessity of requesting a special
meeting.

PUBLIC HEARING(S): CONDITIONAL USE R-6 in a C-2 Zone/115 West Hickory
Chairman Brannen opened the public hearing as continued from the
regularly scheduled March meeting at approximately 7:03 p.m.
Mr. Arnold Koester restated his request to place a mobile home for
personal use on lot 11 at 115 Hickory Street, adjacent to a beauty
shop he currently owns. He stated that if in the future the property
is sold, the mobile home would be removed and use of the property
would revert to C-2.
With no one to speak in opposition, Chairman Brannen closed the public
hearing at approximately 7 :04 p.m.
In review, City Engineer Whisker related that the item was tabled to
offer the Commission time to consider if a mobile home in the downtown
area would be conducive to planning issues involving mixed uses.

BUILDING PERMIT (S): Preliminary Plot Plan/Light of the World Church
of the Living God International
Representative Mr. Tommy Bond related that the church is presently
located on Main Street, but is relocating because o f the new overpass.
He acknowledged issu e s raised b y City Engineer Whisker regarding a
drive onto Valenti ne Road, explaini n g that t h e proposed drive is
approximately 50 feet f rom the corner int e r section . He added that

there is no way to fit a drive on Valentine that would comply with the
regulation stipulating that any access should be 300-feet from an
intersection. He reviewed the plan showing an existing culvert drive
and asked the Commission to consider allowing a drive onto Valentine
Road as far away from the intersection as physically possible. He
then related sidewalk issues for Valentine and South Hwy 161, saying
that the property owner would dedicate right-of-way to the middle of
Valentine Road for sidewalk needs in that area.
In response to a question posed by Commissioner Lester, Mr. Bond
related that the existing drive on Valentine Road would be eliminated
and a new one established. He related efforts to save many of the
large trees on the lot by rearranging the parking to provide
additional parking behind or to the side of the Church. He stated
that he did not believe there are any issues regarding fire
protection, pointing out that there is a fire hydrant across the
street on South Hwy 161 and one at the corner of Valentine and Wooten
Road.
City Engineer Whisker related that the City is requesting a 30-feet
right-of-way from the center-line on Valentine Road, sidewalks on
Valentine Road and South Hwy 161, and that the drive be pushed away
from the intersection to the existing gravel drive. He stated that
event1Jall y .=~rlrli t .i onal right-of-way for the wideninq of South Hwy 161
may be requested by the State.
In response to a question posed by Commissioner Keaton regarding
right-of-way needs, City Engineer Whisker related that currently South
Hwy 161 does not have a curb and Mr. Bond related that the parking lot
curb is approximately 20-feet behind the right-of-way. He went to say
that presumably there would be room regarding additional right-of-way.
In response to a question from Chairman Brannen, City Engineer Whisker
related that depending on considerations from the Highway Department,
generally a four-lane road would require 40-feet of right-of-way.
Mr. Bond related that an additional 10-feet of right-of-way for South
Hwy 161 would not be a problem.
City Engineer Whisker then clarified that there would be enough right-
of-way for sidewalks on South Hwy 161.
Mr. Bond explained that the property line is located at the top of the
bank of the ditch, which might affect sidewalk placement. He
explained that with the road and a small shoulder that is being
widening approximately 4-feet, it drops off into the ditch and comes
back up. He related that the ditch is steep and the property line is
right on top of the bank.
Discussion ensued regarding space needed for sidewalks ~nd widening of
Hwy 161.

City Engineer Whisker related that without an additional 10-feet of
right-of-way it would not leave enough room to construct sidewalks.
In response to a question posed by Commissioner Green, City Engineer
Whisker related that adequate space would depend on the Highway
Department 's plans for widening the Hwy. He stated that if the
Highway Department put in four lanes t hey could abut it to the
sidewalk with drainage underneath. He stated that there could be
various sidewalk configurations, adding that if an additional right-
of-way were acquired the sidewalks be on the outside 10 feet .
In response to a question posed by Commissioner Young, City Engineer
Whisker related that the financial responsibility would belong to the
Highway Department if they widened the road and decided to abut the
sidewalk and place the drainage underneath. He related that i£ the
City were to widen the road they would probably apply for Federal
funds regarding an 80/20 match. He then answered that the Fire
Marshal had approved the plans.
Mr. Bond then related the practice of filing a dedication of easement
drawing regarding all easements for drainage , water, and sewer after
the completion of the project.
City Engineer Whisker related that the dedication easement is tied
into the building permit certificate of occupancy.
Commissioner Young moved, seconded by Commissioner Lester to approve
the Preliminary Plot Plan for Light of the World Church contingent on
a 30-foot right-of-way on Valentine Road, allowing for a 10-foot
easement on Hwy. 161, sidewalks on Valentine and Hwy 161 and pushing
the drive to the west as far as possible from Hwy. 161, reusing the
existing gravel drive and contingent upon City Engineer Whisker's
approval. MOTION CARRIED.
b. SITE PLAN Chapel Ridge Phase II
Representative Mr. Tommy Bond related that Phase II of Chapel Ridge is
an adjoining piece of property that abuts Phase I, wh ich would have
access through the existing complex off Military Road through to
Stanphill. He stated that the d eveloper would provide a dedicated
right-of-way and sidewalk for Stanphill, adding that ther e would also
be a sidewalk through the property t hat would connect to the existing
sidewalks in Phase I.
In response to a question posed by Chairman Brannen, City Engineer
Whisker related that the sidewalks on Stanphill (a major road) would
be 5' and 4' for a local roads such as inside the apartment complex.
He stated that he had asked that the developer line up the driveway
with Lemac, adding that he had concerns regarding Nathan Hale.

In response to a question posed by Chairman Brannen, Mr. Bond stated
that he was not aware if single-family development on Nathan Hale
would be part of Phase II. He related that it had been mentioned as a
consideration when City Engineer Whisker had inquired as to future
plans for the street.
In response to a question from Commissioner Keaton regarding the
detention pond, Mr. Bond related that it would be located just north
of the connection road. He went on to say that current plans call for
a dry detention pond, but that it could change in the landscaping
plan. He related that the detention pond will have a levy
approximately 3~ feet and will hold approximately 1~ foot of water
with a 12" drain. He stated that the maximum water level would be 3
feet.
In response to a question posed by Commissioner Lester, City Engineer
Whisker related that the Fire Department does not feel that access to
Phase II through Phase I is a concern. He added that the Fire Marshal
may request an additional fire hydrant at the opposite end of the
complex.
Discussion ensued regarding normal setbacks for C-3 zoned property and
Commissioner Young addressed concerns regarding the close proximity of
7.78 feet to the rear property line.
City Engineer Whisker pointed out that regulation setbacks are 35'
front yard, 25' f or the rear and 5' on the side. He then stated that
typically C-3 setbacks are designed for lots developing a four-plex,
adding that when there is a development of this size each case is
considered individually, saying that if you go strictly by the Code it
would be a 5-foot setback for the side yard.
In response to a question from Commissioner Montgomery, Mr. Bond
related that the 7.78 feet is considered to be a side yard setback.
Commissioner Montgomery related that he felt that 7. 78 feet it is
still too close to the adjoining property.
Commissioner Young stated that the felt the setback at the corner of
the building should be 25-foot parallel from the property line.
Further discussion ensued regarding the side and rear yard setbacks
for planned units.

In response to a question posed by Chairman Brannen, Mr. Bond stated
that typically the width of the complex streets are the same as a
standard City streets, adding that parking areas are typically built
60-feet wide.
Chairman Brannen question provisions for a fence between the apartment
property and the single-family residential area, Mr. Bond stated that
fences were constructed in the last phase and that fences could easily
be incorporated in the plans.
Further concerns were mentioned regarding the 7.78 rear or side
setback to the residential area.
City Engineer Whisker stated that the 7. 78 setback is measured from
the corner of the building, saying that it is the side and rear at the
same time.
In response to a questioned posed by Commissioner Young regardi ng
exchange of location for two of the units with the present pool
location, Mr. Bond stated that he did not feel that would be a
problem, but pointed out that the residential lots on Stanphill are at
least 275-feet deep and the houses are estimated to be 150-feet from
the rear property line.
Discussion regarding the landscaping plan ensued, and Mr. Bond related
that they have an erosion control plan and would be building
barricades around the trees to protect t hem during construction. He
related intentions to landscape the pond area and referenced the
landscaping in Phase I as evidence of the developers intentions for
Phase II, pointing out that the developer laid sod in Phase I.
Discussion then centered around fence construction for the rear of the
property, and Mr. Bond related that they could build a fence around
the area where units come within 50-feet of the property line.
Commissioner Green suggested an 8-foot privacy fence the length of the
back property, pointing out that there would not be any access to the
adjoining property.
Mr. Bond stated that the did not foresee a problem with a fence, but
added that most fences are a standard 6-feet.
Discussion ensued regarding tabling the i tern of business and waiting
until the site plan is returned and reflects the replacement of the
apartment units with the pool location.
Mr. Bond related that the developer is hoping to apply for a building
permit and only have to submit any remaining plans to the City
Engineer who would have the authority to grant a building permit.

In response to a question posed by Chairman Brannen, Mr. Bond stated
that he would like to upgrade his plans to a preliminary plot plan.
City Engineer Whisker related that all stipulations would have to be
met prior to his office issuing a building permit.
Mr. Bond related that he does not have any of the architectural plans
as yet, acknowledging that City Engineer Whisker has to review all
plans before he can issue a building permit.
Commissioner Green stated that she would like to add the stipulation
of a 6-foot privacy fence along the back 700-feet of the property.
Mr. Bond agreed to construct the fence anywhere a unit was within 50
feet of the property line.
Commissioner Young moved, seconded by Commissioner Keaton to approve
the Preliminary Plot Plan of Chapel Ridge Phase II contingent on the
access drive lining-up with Lemac Street across from Stanphill Road,
sidewalk right-of-way and interior sidewalks, relocating the units
that abut property lines to comply with the setback Code of 25-feet
rear, and 5-foot side, with a 6-foot wood privacy fence where units
are within SO-feet of the property line, a 30-foot right-of-way for
Stanphill Ro~d -AmAndmAnt to the motion to construct the wooden
privacy fence to tie into the existing fence in Phase I and with City
Engineer Whisker's approval. MOTION CARRIED.

Others present for the meeting were City Engineer Whisker, Mr. Tommy
Bond, Mr. Jim Green, Mr. Jim Peacock, Alderman Stroud, members of the
press, interested citizens, and petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Young moved, seconded by Commissioner Lester that the
minutes of the 8 April 2002 Regular Planning Commission meeting be
APPROVED. MOTION CARRIED.
PUBLIC HEARING{S):
BUILDING PERMIT (S): Site Plan & Preliminary Plat/Evans Road
Apartments
RP.prP..sP.ntati ve Mr. Tommy Bond related that one obi ection from City
Engineer Whisker was that the parking would back out onto the street,
adding that the parking design has been changed to a one-way drive
into the apartments with parking available in front of the units. He
related that this would create four driveways to Evans Road as opposed
to being open to the street and would decrease vehicular movement
conflict. He stated that he would return with a revised plan
including sidewalk provisions.
Chairman Brannen mentioned that previously there had been a request
for a trailer park in the Taneyville area, questioning if the sewer
pumping station was adequate for the development.
Mr. Bond related that since that time there have been significant
improvements to the pumping station at Northeastern, saying that with
the addition of the Oak Ridge Ranch Subdivision the capacity has been
increase approximately 50%. He related that improvements included
lowering the pump and propeller changes to increase the capacity. He
stated that any sewer issues have been corrected.
Discussion ensued and it was noted that approval from the Sewer
Department would be forthcoming.

In response to a question posed by Commissioner Montgomery, Mr. Bond
related that there would be four buildings consisting o£ thirty-eight
units. He then answered that the property is located adjacent to the
RV Park and Church on John Harden Frontage Road, adding that it backs
up to the mobile home park and would abut the Max Howell Place and the
McArthur Assembly of God Church.

Phase IV
1\epresentati ve Mr. Bond related that Phase IV is the final phase for
Collenwood Subdivision. He referred to a list of comments submi tted
by City Engineer Whisker and stated that all issues have been
answered. He related that more details regarding the drainage from
Lots 58F, 65 and the roadway would be presented. He added that Salem
Cove would be changed to Salem Court and a streetlight would be added
at the end of that street. He related that the subdivision meets the
criteria regarding fire hydrant, saying that one will also be
installed in phase IV. He stated that one of the questions raised by
City Engineer Whisker regarding the maintenance of the park and lake
area would have to be addressed through the bill of assurance,
pointing out the property owners association would handle the
maintenance.
Mr. Green stated that once the phase is completed the common area
property would be deeded to the property owners association.
Discussion ensued, and Mr. Green answered that the lake bottom has
been maintained to drain out, saying that it has been kept
artificially high. He concluded that the lake does drain and that it
is not yet to its final depth. It was noted that the lake is being
maintained by the original plans approved three years earlier.

City Engineer Whisker related that he would need a grade plan for the
lake and then it was determined that Mr. Green would address issues
regarding stones located at the property edge. He assured the
Commission that the City would not have any responsibility regarding
the lake or park area. He stated that at the time of completion the
property would be deeded to the property owners association. It was
noted that the park area would be restored and covered with grass.
City Engineer Whisker requested profiles for the streets.
In answer to a question regarding a request for additional
streetlights, City Engineer Whisker pointed out the addition of a
streetlight in the culdesac and depending on the 300-foot mark an
additional streetlight may be required from Plymouth Lane to Jamestown
Circle.
Mr. Green related that there is one on the corner of Plymouth and
Jamestown on the south and that he is fairly certain that there is one
on the other end.

In response to a question from Commissioner Montgomery, City Attorney
Bamburg stated that a lake within the City limits is permissible
without the City being responsible for maintenance. He cited the
example of Stonewall property owners association owning all of the
common area within the subdivision for use by the owners and their
guest. He stated that his understanding is that Mr. Green is
developing Collenwood in that same manner. He stated that the
property owners association will be the owners of the property after
the subdivision has been developed and will be responsible for
maintenance and upkeep of the common ground lake area and the portion
of the property that is in the floodway that can not be built on. He
related that the property owners association will define its use.
It was noted that the common property consists of approximately ten
acres for the park and lake area combined, and that the lake is
approximately five or six acres.

Mr. Bond stated that there would not be a fence in the park area or
along the rear of the houses next to the lake.
Chairman Brannen questioned sidewalks, City Engineer Whisker related
that there is a plan for sidewalks to run along Jamestown Circle and
make a connection to the existing sidewalks. He answered that the
sidewalk will go on the inside of the Jamestown Circle loop and to one
side of Plymouth.
In response to a question posed by Commissioner Young, City Engineer
Whisker related that the lake and park area is located in the
floodway, adding that the house lines stop at the floodway.
Commissioner Lester moved, seconded by Commissioner Green to approve
the Preliminary Plat of Collenwood Phase IV subject to approval by
City Engineer Whisker. MOTION CARRIED.
b. REPLAT Northlake Subdivision Phase III-A (Lot 159FR) and Phase IV
(Lot 168FR)
Representative Mr. Bond related that the requ est comes from Mr. Wilson
the owner of l ot 159F, saying t4at he has acquired prop erty from lot
168FR. He explained that the pu rchase of property came the back of a
vacant lot that Mr. Wilson is adding onto his property. He related
that Mr. Wilson has is in the process of building a fence to encompass
the area. He stated that 159FR is gaining property while 168FR is
becoming smaller.
City Engineer Whisker r elated t hat this is the second replat of Mr.
Wilson's prop erty, e xplaining the addition of property t o the original
lot. He stated that it wi l l be all one lot and t hat t here will be no
additional access.

Chairman Brannen suggested that the item be tabled and then raised a
question regarding emergency equipment access on Cypress Court.
Mr. Bond related that the Fire Marshall did not have a problem
regarding access to Cypress Court, but did have some other concerns
dealing with the fire hydrant locations, which have been solved. He
then noted that the annexation of the property is nearly completed.
Commissioner Young moved, seconded by Commissioner Green to table the
Final Plat of the Oak Ridge Ranch Subdivision with written request to
City Clerk Susan Davitt. MOTION CARRIED.
d. FINAL PLAT Western Hills Subdivision Phase I Lots 1 thru 37
Mr. Bond stated that initially the entire subdivision was planned for
Final Plat submittal but added that due to the wet conditions that was
changed it into phases. He stated that Phase I is the area located at
the top of the ridge, explaining that the lower street subgrade was so
wet that the street work could not be completed in time to be
submitted as a part of the Final Plat. He related that the asphalt
work in Phase I has been completed with only a little cleanup work
left. He then noted that some waterline, and meter boxes still have
to be adjusted to grade, and some lids replaced. He stated that he
hPliPvPrl r.hat the dilemma is whether to extend the lot line across the
private drive.
City Engineer Whisker related that he had spoke with City Attorney
Bamburg, saying that the main concern is to make ensure that the
street remains private. He related that if the developer does not
extend the lot line then the property would belong to the developer,
because it would not be City accepted. He suggested that it might be
easiest for the property owners of lot 1 through 10 to be responsible
for that small area of grass and have it noted as a private drive.
Mr. Bond stated that if the property lines are extended across the
private drive, he would have concerns that a future property owner may
want to claim the property and obstruct traffic movement. He stated
that it is understood that the drive is private and will be maintained
by those adjacent property owners. He stated that he believes the
issue can be addressed by noting that on the plat and with a statement
in the bill of assurance.
City Attorney Bamburg stated that while the issue belongs to the
developer because the drive is private, he noted that if the lot lines
do not extend across the private drive, then the property will not be
deeded as part of the acceptance of property that the City receives
for streets and utility rights-of-way.
Discussion ensued regarding various options and consequence for
ownership and responsibility of maintenance.

Mr. Bond stated that he was seeking a solution other than extending
the lot lines. He restated concerns regarding future owners claim to
the private drive.
City Attorney Bamburg explained that limitations can be put into place
either through the plat or through the bill of assurance to address
any concerns. He offered that the approval of the plat could be made
specific, allowing that the only access onto Main Street are the two
lots shown on the plat and designate the limitations of ownership and
grant the property owners of lots 1 through 10 a common easement.
Discussion ensued as to ownership by the City, and City Attorney
Bamburg explained that if the City owned the property then the City
would have to be responsible for maintenance, adding that it would
have to meet Code before it could be accepted by the City.
Discussion ensued and it was noted that the drive did not meet City
code for acceptance.
In response to a question posed by Chairman Brannen, Mr. Bond related
that lot 14 and 13 would share a common driveway. He stated that a
common drive was approved earlier when the preliminary plat was
presented.
City Engineer Whisker confirmed that lots 13 and 14 would share an
access, pointing out that they are the only lots that will have access
off Main Street.
In response to a question from Commissioner Lester, Mr. Bond related
that the private drive lacks Code because it does not have curb and
gutter. He stated that he has personal reservations regarding
extending the lot lines across the private drive.
City Attorney Bamburg noted that the final plat designation that lot
12 would have no ingress or egress from West Main, adding that that
lots 11 and 12 would have to gain access from Western Hills Drive.
Mr. Bond stated that the bill of assurance would speak to that issue.
It was noted that the house can face either way as long as the garage
loads off of Western Hills Drive. Mr. Bond related that the sidewalk
would be constructed along Main Street, adding that it will be on the
other side of the private drive. He pointed out that only one other
sidewalk would be constructed for Western Hills Drive.
It was clarified that Phase I consists of Lots 1 through 37.
Mr. Bond related that one of the other issues was that addresses would

In response to a question from Commissioner Piggee, City Engineer
Whisker related that the Wastewater Department has a representative at
the meeting to answer questions regarding sewer, adding that his only
concerns are setbacks regarding the development. He stated that he
has spoken with ~r . Bond regarding the setback requirements being 35-
foot front, 25-foot rear, and 5-foot side yard setbacks. He related
that he has also recommended that the sidewalks be constructed at the
property line, closer to the street.
Discussion ensued as to the type of housing for the complex and Mr.
Robinson stated that it would be multi-family but not HOD housi ng.
City Engineer Whisker related that he would also recommend that the
lot one parking lot line up with Evans Drive.
Mr. Robinson related that he did not think that would be a problem.
In response to a question from Commissioner Young, Mr. Robinson
related that he was not sure regarding access plans onto the site.
City Engineer Whisker related that the access is proposed to come in
off Evans Drive from John Harden. He clarified that Evans Drive is
the first left turn, north of the Pine Meadows Trailer Park. He
related that the access would be an extension of Evans Drive at the
90-degree turn before entering into the Max Howell complex.
Vice Chairman Perry invited comment from the audience.
Mr. Emerson Smith related that he is the owner of the Tall Pines RV
Park located on the corner of Evans Drive and John Harden Drive. He
stated that the project is being referred to as Evans Road, adding
that City record refers to the street as Drive not Road. He related
that concerns were mentioned at the previous meeting regarding the
pump station capacity and that Mr. Bond had made a presentation saying
that the water situation and the sewer system was up to speed and that
there are no problems. He referred to the letter from the Wastewater
Utility and said that the letter indicates that the same problems that
existed two years ago still exist. He explained that the storm water
run-off causes the sewer line to overflow. He stated that he can
speak very emphatically about the situation at the Tall Pines RV Park,
saying that there are situations where the manhole covers have floated
up and raw sewage has spread over the RV Park grounds. He related
that he had one customer so upset when this happened that she moved
from the Park. He stated that he and the Wastewater Department still
recognize it as being a problem. He went on to say that the overflow
of manholes is important because an overflow must be reported to the
EPA, adding that hopefully it is a situation that the City will make
investments to correct . He related that he stood before the
Commission two years ago regarding a rezoning change for the same
property and that at that time the proposal was to rezone the property
from R-0 to R-4. He then related that it is now his understanding

that the property is actually zoned R-3, requesting that the record be
changed to reflect the correct zoning. He stated that the approval of
this project would have significant environmental impact, noting that
all vegetation would have to be removed. He related that the property
is low land, and that when Evans Road was built dirt had to be brought
in to construct the street. He stated that the water flows from Max
Howell and Pine Meadows down Evans Drive into the proposed area and
that the area resembles a wetlands especially during the spring rains.
He related that he assumes it would take significant truckloads of
dirt to bring the low-lying ground up to road surface level regarding
construction. He added that this would not only affect the trees, but
have a negative impact on the community life by creating a concrete
jungle. He stated his deep concern for raising the property elevation
because it would cause his property to have additional water run-off.
He added that he would not want any action by the Planning Commission
to have a negative impact regarding the value of his property. He
asked that the Commission consider what would happen to the water once
the dirt is brought in and the apartments are constructed.
City Engineer Whisker related that manholes are usually built to flood
elevation and Mr. Smith added that there are no manholes in that area.
Mr. Smith asked that the Commission have someone look into the
~~Anrling water situation. He stated that questions were raised at the
last meeting regarding the parking, mentioning a letter written by
City Engineer Whisker saying that the parking is not to City Code.
City Engineer Whisker stated that the Code requirement is 1.5 parking
spaces per unit.
Mr. Smith stated that it is ironic that the City Code is 1.5 spaces
per unit because Ma x Howell has three spaces per unit, and newer
complexes on an average have two spaces per unit. He suggested that
the City consider adjusting the parking space requirement. He then
stated that parking would be very important for this project because
of the inadequate road surface regarding overflow parking. He then
explained safety issues regardi ng parking on Evans Drive with the 90-
degree turn in the road. He a dditionally related concerns regarding
the parking design being up to the easement line, which would allow
the front of cars to be over the easement when parked. He stated that
the project as presented is "humanity on top of humanity" and that the
density of the project compared to Max Howell is 24 units to 8 units,
making for a 200% increase in population density for this project. He
then stated that the project could be a classic case of a civil rights
discrimination, saying it appears that it may be appealing to the low
income. He explained that it is a situation where low-income housing
already exist and that cities today are being subject to their
Planning Commissions being reviewed for signs or patterns of
discrimination against the poor and low class. He then related that
because of the location of the project it is also a situation that
makes it isolated from the general public. He stated that "in other

words it is going to be behind some woods, between a mobile home park
and a housing project." He asked that the Commission consider a less
dense project, with more adequate parking and investigate any negative
impact.
Mr. Tommy Bond pointed out that this proposal is t he third project to
be brought before the Commission regarding this property. He stated
that a mobile home park, and a single-family residence were rejected
previously. He related that this is the second time this proposal for
the apartment complex has been presented, adding that it generally
complies with all of the City's regulations, and is already zoned R-3.
Commissioner Dollar asked Mr. Smith if she understo.od his five major
concerns to be water run-off, sewer capacity, safety, parking, and
ghettoizing.
Mr. Smith stated that it might be a classic case of discrimination
against the City because of the already low income housing in the
area. He added t hat it has the potential of being discrimination
against the poor regarding congregating of low-income people in one
area and also because of the design being i solating from the general
public. He stated that it would be subjecting people to a lower
standard, which is against the law.
Vice Chairman Perry invited a representative from the Jacksonville
Wastewater Utility to address the Commission.
Wastewater Engineering and Construction Manager Bob Williams referred
to the letter provided to the Commiss ion, saying tnat on assessment
conditions of the area pump station have not changed and are not
likely to change in the near future. He stated that there are
overflows in that area under wet weather conditions and have been for
some while. He related that currently the Wastewater Utility is in
the process of rehabilitating the sewer lines of the entire City,
pointing out that a major rehabilitation was just completed between
Quince Hill and Commons Drive. He added that efforts will continue
until the inflow and infiltration is reduced to an acceptable level.
In response to a question from Commissioner Keaton, Mr. Williams
stated that there is adequate capacity in dry weather conditions
regarding the Northeast pump station, but not under wet weather
conditions, which is evident by the overf low of manholes. He stated
that he did not t hink t he project would adversely affect the system in
dry weather, adding that it is not going to help in wet weather.
In response to a question from Commissioner Piggee, Mr. Williams
related that the problem is not with drainage, but the inflow and
infiltration. He pointed out that most of the problems in the area is
with infiltration, saying that manholes are at or above flood
elevation. He then stated that there could be some inflow problems
not identified at this time.

City Attorney Bamburg addressed concerns regarding discrimination,
saying that the proposed development meets Code requirements, adding
that in the discrimination cases he has observed there has to be
factors regarding specific placement of low income housing or code
variations that are of record. He stated that in this circumstance,
if he understands Mr. Robinson's presentation, the proposed project is
not proposed to be HUD housing. He related that low income does not
necessarily have to be HUD housing, but is usually a very common
factor for a discrimination action.
It was noted that the average costs of an apartment has not yet been
determined.
Ms. Stacy Gangluff, manager of Pine Meadow Mobile Home Park addressed
the Commission mentioning previous concerns when Mr. Dick Jones
developed a subdivision in the immediate area. She related that she
and other residents of the Pine Meadows Park are concerned about the
drainage, adding that some lots toward the proposed development area
are prone to be wet areas. She stated that another concern is fencing
and safety traffic issues since the construction of the Wal-Mart
Supercenter. She related that there is a tremendous amount of traffic
in the area.
Mrs. Diana Smith addressed the Commission stating her concerns
regarding the children of the apartment complex, saying that they
might venture into the woods with no planned play area. She went on
to say that this would create additional liability for the surrounding
property owners. She requested that the engineers go to the site and
investigate the continuous standing water in wet weather. She stated
that there is no storm drainage system in the area, and no curbing so
the water runs down the road and settles onto their property. She
related that during heavy rains their property fills with overflow
from the manholes, adding that it is very important that these issues
be addressed.
In response to a question from Commissioner Young, Mr. Bond stated
that a dumpster location has not been discussed. He pointed out that
typically in smaller developments there is not a dumpster, only in
larger developments with 100 plus units.
In response to a question posed by Commissioner Keaton, Mr. Bond
responded that a storm retention plan would be required. He explained
that the retention pond would probably be north of the site. He
explained that Evans Drive turns and goes back west, mentioning the
intersection, saying that the main drain is 600 feet north of the
intersection and runs through the church property to Hwy 67. He
stated that any retention plans would have to be placed in that area
and then related that the parcel is approximately 18 to 21 acres
extending to Quince Hill Road. He explained that a previous
development request had proposed access from Quince Hill Road. He
then responded that construction for a fence would not be a problem.

Commissioner Young commented that he does not believe the layout meets
Code requirements regarding setbacks. He related that he is concerned
about the drive and the parking location, saying that he does not feel
the design works very well regarding safety of pedestrian traffic. He
suggested that the drive be placed on the outside of the lot and
questioned plans regarding green spaces. He stated that he feels that
the design is a tight layout for a maximum number of units.
Commissioner Dollar expressed concerns that there are no provisions
for a recreational area, which she stated originally made her wonder
if the development was being proposed as senior citizen housing. She
also voiced concerns for a "tightly packedu development.
Commissioner Piggee stated that he does not feel enough evidence has
been offer to combat drainage concerns, so that he could feel
comfortable voting to pass a development in this particular area.
There were no additional comments and a motion was not forthcoming.
Vice Chairman Perry stated that the item of business fails for lack of
a motion.
REQUEST TO APPROVE PLAT (S): a. REPLAT Keathley Commercial
Subdivision/ Lots 6 & 7
Representative Tommy Bond related that petitioner Mr. Mike Kirkpatrick
owns the Sands Motel, which fronts the old South Hwy, ~aying that he
has acquired two additional lots to the rear and wants to tear down
the existing Sands Motel and build a new facility to the rear of lots
6 & 7. He stated that there are recorded easements on lots 6 & 7 so
Mr. Kirkpatrick wants to replat the lots and include the front parcel
that is not presently in the Keathley Subdivision, making it one large
lot that will allow him to build a new motel. He pointed out that if
the replat is approved, a site plan for the new facility on the
combined lot would be forthcoming.
Commissioner Lester moved, seconded by Commissioner Dollar to approve
the Replat of Lots 6 & 7 of the Keathley Subdivision.
Discussion ensued and City Engineer Whisker related that the front
portion of the motel facing Hwy 161 would be torn down completely.
At this time MOTION CARRIED.
b. SKETCH PLAT Holland Homes Manufactured Housing Park
Representative Tommy Bond related that the area was rezoned six months
ago, adding that the sketch plat is being presented for comment. He
stated that there will be no public streets in the development and
that it would be privately owned and maintained with the exception of
water and sewer. He related that all of the lots would be rental, and
that it would be as nice as the one at the Bryant County line, an
upscale manufactured mobile horne park that will be maintained, policed
and kept in good order.

He noted that the park would be phased in over a period of five to ten
years, staring with 100 to 120 units for the first phase and then as
it becomes successful additional phases would be presented. He
related that the development would attract retired people, adding that
it seems to be a life style that some people like.
Commissioner Dollar stated that she has viewed developments of this
nature in Birmingham Alabama, saying that it is very nice. She
related that it had a wooded area with a pond and playground area.
She asked Mr. Bond if a playground area was planned.
Mr. Bond stated that there are two areas planned for playgrounds,
saying that one area would be located by the manager's office, which
would be constructed first. He stated that plans are to have a mix of
older residents who might want to live in an area that has children
and areas for residents without children.
Commissioner Keaton questioned what standards would be adopted by the
Park, and Mr. Bond responded that no home over five years old would be
allowed to move into the Park. He related that Mr. Kirkpatrick would
manage the Park, relating that all homes will be strictly maintained.
He stated that since the lots are rental, any resident that does not
maintain standards will be asked to move. He stated that the manager
would handle all maintenance other than the physical buildings. He
related that lot upkeep would be held to strict standards, regarding
grass mowing, and plantings. He pointed out that the mini warehouse
offers storage so there will not be any wrecked cars or junk in the
yards.
Discussion ensued regarding modular and manufactured homes and Mr.
Bond related that this would be manufactured, saying that manufactured
homes of today have pitched roofs with vinyl siding as opposed to the
older style metal roof and siding. It was noted that all units would
be under pinned and possibly the tongues would be removed.
Commissioner Keaton related that one item of concern would be the area
east and northeast of the property that may be used for hunting,
questioning if there are any provisions to keep residents from
mistakenly wandering off the property and onto the other.
Mr. Bond stated that there would be a fence, adding that there is a
buffer strip between that area and the park. He then answered that
they anticipate the walking trail to be asphalt paved with some
lighting, similar to the one in Dupree Park.

Discussion ensued regarding consideration for a green space between
the development and the railroad tracks, Mr. Bond related that a fence
is proposed to p revent children from being able to get to the tracks,
adding that the area also has a tree line between the tracks and the
development. He then stated that on the side of the tracks there is
an additional barrier of 80 to 100 feet owned by the Railroad that is
grown up, but had been used to load timber and grain. He stated that
it is approximately 100 feet between the normal right-of-way and the
additional parcel of ground to where the development starts.
Discuss ion then ensued r e garding t he recent train derailment and a
safe di s tance f or t he development. Mr. Bond related that the railway
car actually fe ll over be cause the track failed, explai ning that it
just leaned over and dumped its load. It was also noted that the
development meets all density codes.
Commissioner Keaton moved, seconded by Commissioner Lester to approve
the Sketch Plat of Holland Homes Manufactured Housing Park as
presented.
Discussion ensued regarding sidewalk recommendations and Mr. Bond
explained that there would be sidewalks inside the development and
possible out to Loop Road.
Mr. Kirkpatrick added that it would be rather diffi cult to place
sidewalks t hat woul d tie into the City Master Sidewalk Plan because
the development will be gated to provide security for the children.
Mr. Bond stated that he believes there is sufficient room for a
sidewalk along the entrance road into the deve lopment ~ He explained
that there is a large open space of approximately 60 0 f~et in front of
the development that will serve as a landscaped entrance into the
development.
Discussion ensued regarding green space between the development and
the railroad tracks and Mr. Bond related that there is currently a lot
of green space that belongs both to the development and the Railroad,
and an earthen ridge to help address factors regarding sound.

Chairman Brannen opened the meeting at approximately 7:00 p.m.
expressing appreciation for those in attendance.
ROLL CALL: Commissioners: Susan Dollar, Chad Young, Bobby Lester,
Glen Keaton, Tammy Green, and William Montgomery, answered ROLL CALL.
Chairman Brannen also answered ROLL CALL. PRESENT seven (7), ABSENT

Others present for the meeting were City Engineer Whisker, Mr. Aaron
Robinson, Alderman Stroud, Commissioner Mark Stroud, Mr. Tommy Dupree,
Mr. Duane Reel, Mr. Harold Crook, members of the press, interested
citizens, and petitioners.
APPROVAL AND /OR CORRECTION OF MINUTES:
Commissioner Young moved, seconded by Commissioner Lester that the
minutes of the 10 June 2002 Regular Planning Commission meeting be
APPROVED. MOTION CARRIED.
PUBLIC HEARING(S):
BUILDING PERMIT(S): Oak Ridge Ranch Subdivision Lot 5
Representative from Bond Engineering, Mr. Aaron Robinson related that
the builder Mr. Dave Kinman understands that there is no water or
sewer service available to the subdivision as yet.
City Engineer Whisker explained that the streets, drainage, and
utilities are mostly complete with minor adjustments to be completed
this week. He explained that there are two different electric
companies and the electrical lines have not been put in to service the
pump station.
Discussion ensued regarding the location of fireplugs relative to lot
5, and City Engineer Whisker related that fireplug locations have been
designated by the City Fire Marshall.
City Attorney Bamburg clarified that the time factor involved with
providing service of electrical power for the sewer station would be
the defining issue.
Developer Jerry Smith addressed the Planning Commission saying that he
expected the electric company to have the lines run to the sewer pump
station in the next few weeks. He stated that all utilities should be
on line in 30 to 60 days.
Commissioner Keaton moved, seconded by Commissioner Green to approve
the building permit for lot 5 of the Oak Ridge Ranch Subdivision
pending completion of all utilities.
Discussion ensued if Mr. Kinman would need to wait until the sewer
pump station has been serviced for electricity and is operational.

Commissioner Keaton amended his motion, seconded by Commissioner Green

Subdivision stipulating that a certificate of occupancy would not be
issued until all utilities have been approved. MOTION CARRIED.
REQUEST TO APPROVE PLAT (S) : PRELIMINARY PLAT of H & H Mobile Home
Development.
Mr. Harold Crook related that the property is located at the northeast
corner of Stanphil and LeMac Drive.
City Engineer Whisker related that he has some questions regarding
sidewalks for the development.
Discussion ensued regarding ownership of the gas line and it was noted
that the property is west of the stubbed road and that the property to
the east belongs to Mr. Boyce Penn.
Commissioner Young questioned if the standard subdivision rules would
apply for this type of development.
City Engineer Whisker responded that the streets already exist and
that sidewalks would be required per City Code, adding that the only
exception would be for a culdesac area of less than twenty lots. He
related that utilities are provided from Stanphil Road. He then
requested utility drawings and noted the gas line, questioning if the
gas line was on an easement belonging to Mr. Crook or in a right-of-
way and asking who would maintain the property.
Mr. Crook stated that he was fairly sure that the gas line was in an
easement.
Discussion ensued as to the responsible party regarding mowing of the
easement, and Mr. Crook related that the gas company has been mowing
the easement area since the gas line was established.
It was noted that proposed access to the property would be from
Stanphil and LeMac Drive. City Engineer Whisker requested that
utility drawings be submitted before construction begins.
Chairman Brannen questioned the need to table the item of business
pending submittal of utility drawings to the City Engineer.
Commissioner Green moved, seconded by Commissioner Dollar to table the
item of business pending submittal of utility drawings for the next
regularly scheduled Planning Commission meeting in August. MOTION
CARRIED.

b. FINAL PLAT Oak Ridge Ranch Subdivision
City Engineer Whisker related that as mentioned earlier in discussion
regarding the request for a building permit for lot 5, the subdivision
is nearly complete with the exception of electrical service to the
sewer pump station. He stated that it could be approximately one
month before service is s upplied by the electric company to the pump
station. He then added tha t t here are some minor issues regarding the
sewer and water, which would be addressed before being forwarded to
the City Council for Final Plat approval. He related that the
sidewalk begins 400 feet down Maddox Road and runs north into the
subdivision, adding that there are sidewalks inside the development on
Oak Ridge Road, and Cypress Court. He pointed out that there is a
small amount of clean up work and grates for the inlets that are
needed to complete the subdivision.
Chairman Brannen requested that Final Plats have all issues addressed
and completed prior to be submitted to the Planning Commission as a
Final Plat. He stated that there should be no exceptions submitted at
the Final Plat stage.
Commissioner Young moved, seconded by Commissioner Lester to approve
the Final Plat of Oak Ridge Ranch Subdivision subject to the developer
having utili ties approved before being presented to the City Council
for Final Plat approval. MOTION CARRIED.
c. DEVELOPMENT PLAN for Northlake Subdivision -Lake Lorene
City Engineer Whiske r related that t he devel oper is proposing to
change t he floodwa y . He stated that a n engineer ing study was
conducted and submi t ted to his o ffice proposing to move t he f l oodway
southerl y , condensin g it f rom t he existing Fears Lake to the levy a rea
and creating Lake Lorene.
Chairman Brannen questioned if this would cause any concerns regarding
the construction of the north belt freeway.
City Engineer Whisker related that this would not interfere with the
existing north belt freeway as it is completed. He pointed out that
the new alignment from US 67 to I-430 has not been chosen as yet. He
then questioned if the entire development would be located inside the
City limits of Jacksonville and wanted to know if water and sewer
utilities would be supplied by the City.
Mr. Dupree related that water and sewer would be supplied by the City
and that if it were necessary he would annex any property into the
City.
In response to a question posed by City Engineer Whisker, Mr. Dupree
related that the southwest corner of the subdivision would be utilized
as a turn around area. He then related that the property consists of

approximately 50 to 59 acres. It was noted that part of the property
is located within the County, but as part of the floodway it cannot be

Discussion ensued regarding the question to annex, and it was the
general consensus that any portion of the development located in the
County that would be serviced by Jacksonville utili ties should be
annexed into the City of Jacksonville.
City Engineer Whisker related that the area not located within the
City limits is the flood plain area, and cannot be developed. He
stated that the lake and the development area are both within the City
limits.
Discussion ensued and Mr. Dupree related that the proposed square
footage for the homes in the development would be approximately 2,000
square feet or above.
Commissioner Young moved, seconded by Commissioner Keaton to approve
the Development Plan for Northlake Subdivision -Lake Lorene area as
presented. MOTION CARRIED.
d. SKETCH PLAT for Foxwood Gardens
Mr. Robinson related that Foxwood Gardens is the proposed development
for the remainder of property north of Loop Road in the Foxwood area.
He stated that the property is located between Phase IX and Phase X,
adding that it is being proposed as a gated community development for
garden homes. He related that the property is currently zoned R-0 and
that the houses are proposed to be between 1,400 to 2,000 square feet.
He explained that the developer would create a borrow pit for dirt
thus forming ponds.
Chairman Brannen questioned if the lots would need to carry the "F"
floodplain designation. It was noted that the Sketch Plat is not
required to carry the floodplain designation and that the Preliminary
Plat would provide that information.
Mr. Robinson then related that the lots would be built up with dirt
from the borrow pit to raised pads above the floodplain to provide for
home construction.
City Engineer Whisker noted that the home construction pads would need
to be raised 1 foot above the existing floodplain.
Discussion ensued regarding access to the property and Mr. Robinson
related that the proposed access would be from Foxwood Drive.
Chairman Brannen questioned if the development would accommodate Fire
Department equipment and if the only access from Foxwood Drive would
be adequate for the Fire Department.

Discussion ensued regarding the development being proposed with only
one access from Foxwood Drive. It was the general consensus of the
Commission that the developer should consider a second access from
Steeple Chase Drive by lot 84 in order to provide the development with
two points of access.
Mr. Robinson stated that two accesses could be a consideration and
then answered that the borrow areas created as ponds would have water.
City Engineer Whisker related that the development is proposed as a
planned retirement area. He related that the development would have
smaller lots with larger homes than what is normally seen on smaller
lots. He stated that there is no current zoning for this type of
development, questioning a lack of direction regarding subdivision
rules for larger detached homes on small lots.
Discussed ensued regarding the R-lA zoning and the maximum house size
for an R-lA development. It was noted that the setback dimensions for
an R-lA development is 25 foot front yard, 25-foot rear yard with
maximum lot coverage of 30%.
City Attorney Bamburg explained that depending on the development R-lA
might fit the scope of the development, adding that issues regarding
utilities would be addressed during the preliminary plat presentation.
He stated that any considerations for rezoning the property should be
addressed prior to the submittal of the preliminary plat.
Discussion ensued and it was the consensus of the Commission that
issues regarding the proper rezoning of the property,c a redesign of
the western end of the development to provide a second access from
Steeple Chase Drive and that the plat show floodplain ~ot designation
until property is brought out of the floodplain be addressed with the
preliminary plat presentation.
Commissioner Young moved, seconded by Commissioner Keaton to approve
the Sketch Plat of Foxwood Gardens with stipulations regarding the
rezoning, access from Steeple Chase, and proper floodplain
designation. MOTION CARRIED.
e. PRELIMINARY & FINAL PLAT/Arthur's Subdivision
Mr. Robinson stated that Arthur's Beauty College is proposing to build
a new daycare center behind Arthur's Beauty College.
Chairman Brannen mentioned concerns regarding sewer and drainage,
saying that a development proposed in the area had been denied because
of sewer capabilities.
City Engineer Whisker related that the drainage flows through a ditch
between Quick Silver Plaza and Chambers Trucking. He was unsure as to
which manhole the sewer flows into.

as a preliminary plat.
City Engineer Whisker then related that he is unsure if the sewer line
runs south along North First Street, or north toward the failed
proposed subdivision previously mentioned.
Commissioner dollar questioned if the plat should be resubmitted with
the revised suggestions.
City Attorney Bamburg clarified that the plat could be approved as a
sketch plat with conditions for preliminary plat submittal, or
disapproved with provided recommendations, or tabled for revision with
recommendations.
Commissioner Green questioned fencing of the playground area as a
safety measure for the children because of its proximity to the
freeway, and landscaping for the playground area.
Discussion ensued regarding the developer cutting down on the number
of proposed parking spaces and providing green areas in the parking
lot.
In response to a question proposed by Commissioner Green, City
Attorney Bamburg related that the owner of the daycare would have to
satisfy State daycare codes before being licensed to operate, adding
that some type of fencing would be required for the area where the
children would play outside.
Discussion ensued as to whether recommendations could be stipulated as
part of the approval of the subdivision.
City Attorney Bamburg clarified that the recommendations regarding
green spaces could be strongly recommended but not stipulated until
the landscaping ordinance is in place.

Chairman Brannen opened the ~!eting at approximately 7:00 p.m.
expressing appreciation for those in attendance.
ROLL CALL: Commissioners: Chad Young, Bobby Lester, Glen Keaton,
Lester Piggee, and Mark Perry, answered ROLL CALL. Chairman Brannen
also answered ROLL CALL. PRESENT five (5), ABSENT (3).
Others present for the meeting were City Engineer Whisker, Mr. and
Mrs. Tommy Bond, Mr. Harold Crook, Alderman Marshall Smith, Mrs. Chris
Strawn, Mr. Don Taylor, members of the press, interested citizens, and
petitioners.
PUBLIC HEARING(S): Conditional Use/First Free Will Baptist Church
Chairman Brannen opened the public hearing at approximately 7:04 p.m.
and related that the property is located off West Main Street across
from Fair Oaks Subdivision and is zoned R-1.
Representative Mr. Tommy Bond demonstrated an aerial photo of the
proposed location, and related that the First Free Will Baptist Church
is presently located on Green Acres Road, south of Madden Road. He
related that the property purchase is contingent on the Church being
granted a condi tiona! use of the property for the construction of a
new church.
Mr. Marshall Smith a member of the First Free Will Baptist Church
addressed the Planning Commission, saying that the Church is proposing
to purchase four acres off West Main Street to relocate and construct
a new First Free Will Baptist Church. He relate d that the proposed
location is directly across from the Fair Oaks Subdivision, adding
that feedback regard i ng the constructi on o£ a church in t hat area has
been positive.
With no one to speak in opposition, Chairman Brannen closed the public
hearing at approximately 7:06p.m.
Commissioner Lester, as a member of the First Free Will Baptist
Church, recused himself from the voting process.
Commissioner Piggee moved, seconded by Commissioner Young to approve
the request as presented. MOTION CARRIED.
BUILDING PERMIT (S): REVISED SITE PLAN Arthur's Beauty College Day
Care Facility
Representative Mr. Bond related that the revised plan addresses
previous concerns voiced from the Commission, but acknowledged that
the biggest dilemma would be the Planning Commission's request
regarding access to North First Street. He stated that petitioners
are present to address issues regarding the access to North First
Street. He pointed out that the daycare facility would be restricted
for the use and benefit of the students attending Arthur's Beauty

College and for that reason Mrs. Strawn the owner, is asking that
access to North First Street be reconsidered. He stated that the
daycare facility would be owned and operated by the same management of
Arthur's Beauty College.
Mr. Bond noted that the site has a three to four foot difference in
elevation between North First Street and the proposed site area.
Chairman Brannen questioned if the daycare facility would use the
sewer lift station located behind the site.
Mr. Bond related that the lift station was built in the past 45 days,
adding that there are still some sewer issues to be worked out with
the Wastewater Utility concerning the lift station, but stated that he
felt any concerns could be worked out if the ownership is maintained
for both facilities. He related that the only other concern would be
that Mr. Knollmeyer's office building is connected to that lift
station. He pointed out that Mr. Knollmeyer has shared a common
sewer, tied into the private sewer system of the mobile home park for
approximately twenty years. He said that these sewer issues have not
been questioned for twenty years, but has since become a concern. He
expressed that he is confident that all issues regarding sewer can be
worked out.
Chairman Brannen questioned concerns for the Taneyville area regarding
the pump station capacity and flooding.
Mr. Bond related that Taneyville is not the only area in the City that
has sewer manhole overflows, adding that if the Planning Commission
were to deny development in all areas where a manhole has overflowed,
then there would be no development at all in the City.
Discussion ensued regarding the City's commitment and achievements to
contain flooding and address drainage concerns.
City Engineer Whisker expressed concerns that the rear lot would not
have access to a street.
Mrs. Chris Strawn explained that the property was split to accommodate
mortgage requirements, adding that the property is not intended for
sale. She stated the desire to build a child care facility on the
property strictly for students attending Arthur's Beauty College. She
stated that they have experienced problems with parties on the rear
lot without a double access. She went on to say that while she would
desire a double access, she has fears for the children. She stated
that a double access would mean more traffic flow through the property
and reiterated that the daycare facility is an on campus daycare
strictly for the students.

City Engineer Whisker stated that he offered Mrs . Strawn several
suggestions, pointing out that the parking lots do not have to be
joined. He related that the parking lots could have a median
separation, which would prevent traffic from flowing through. He went
on to suggest that the buildings could be located next to one another
with two separate parking areas from North First and John Harden. He
related that in order to construct the second building the property
did require a lot-split.

City Engineer Whisker pointed out that the lot fronts North First
Street.
Commissioner Green stated that she was under the impression that the
second entrance was a safety issue regarding access for emergency
vehicles.
City Engineer Whisker related that he was not certain that it was as
much a safety issue as a lot requirement, adding that the only
entrance would be from Arthur's Beauty College. He pointed out that
typically each lot and building has its own entrance, unless there is
a shared area such as a shopping center, which is still typically one
large building.
Commissioner Green questioned the fence requirement, saying that there
should be a 6' privacy fence around the playground area.
Mr. Bond stated that the fence would not be a problem, adding that the
owners would be agreeable to build a fence around the playground. He
related that the only issue of concern is the North First Street
access, pointing out that the only traffic to the daycare would be the
students while the patrons wou l d be the only traffic to Arthur's
Beauty College.
Mrs. Strawn related that graduating students would remove their
children from the daycare. She stated that Arthur's Beauty College
has been an established business in Jacksonville for approximately
thirty years and has grown into a large school o ffering day and night
classes. She added that the daycare is an issue for students attending
classes, and that Arthur's Beauty College is trying to offer a
solution to difficult daycare issues. She pointed out that new
mothers could have their children close while attending class and
visit them during lunch.
She stated that her only concern is that she is not sure the children
should be behind a privacy fence. She added that she is uncertain if
State regulations will allow for a privacy fence, but stated that she
would be willing to construct a huge fence to protect the children.

Commissioner Green stated that she was sure the regulations would
allow for a privacy fence, adding that she feels it is important
regarding safety factors for the children. She pointed out that the
location is highly visible from the Freeway, John Harden Drive and
North First Street with a high traffic count and easy accessibility to
the location.
Mrs. Strawn stated that she would not have a problem with a privacy
fence.
Discussion ensued regarding the location of the Freeway e x it and the
proposed location of the daycare.
Commissioner Green expressed concern for any undesirable attention
from the high visibility situation of the children to a heavy volume
of traffic from both sides of the development. She complimented the
design regarding the proposed landscaping of the project.
Discussion resumed regarding egress to North First Street and its
proximity to the s ignal light. Mr. Don Taylor noted various existing
egresses to North First , mentioning the Knollmeyer Law Firm and the
exit from the Freeway. He related that he felt traffic would cut
through the parking lot to avoid moving through the signal at North
First to proceed to the old Taneyville Highway or traffic avoiding the
signal t o get to John Harden Drive. He stated that cut-through
traffic might raise the safety factor issue.
City Engineer Whisker related that he had suggested to avoid those
traffic concerns the two parking lots be separated.
Mr. Taylor stated that if the parking lots were separated it would
decrease the amount of parking available to the College.
City Engineer Whisker suggested that since only the students would be
using the daycare they could park on the back parking lot and the
front parking lot could be used for patron parking.
Mr. Taylor stated that without the proposed additional parking the
existing parking lot is full.
Commissioner Keaton questioned if the property could be platted with
an ingress/egress easement on the final plat, making it a permanent
part of the platted property.
City Engineer Whisker agreed that a permanent easement could be one
possibility. He then answered that the Fire Marshall has reviewed the
site plan.
Commissioner Young related that he is unsure if the Planning
Commission can enforce a privacy fence around the playground and
pointed out that a chain link fence would allow monitoring of the

children from the College . He s uggested that the fence be 6' to
address safety issues , saying tba t it is more important to see the
children than not . He complimented t he developer regarding the
landscape plan and the wo oden enclosure of the dumpst ers, and agreeing
that the Planning Commi ssion should pursue a permanent ingress/egress
easement . He a l so agreed t hat an entrance to No rth First Street would
be an ideal cut-through opportunity for traffic.
Discussion resumed regarding issues for a privacy fence to raise the
safety factor for the children attending the daycare . Mrs. Strawn
stated that she does not have a problem with a privacy fence, but
would p refer being able to monitor the children through a chain link
fence. She stated that she would comply with any type fence request
from the Planning Commission.
Commissioner Green pointed out that the children could still be
monitored from the daycare facility with a three-sided privacy fence,
with the only entrance being from the daycare.
Commissioner Green moved to approve the revised site plan contingent
upon approval of City Engineer Whisker regarding a second entrance to
North First Street and sewer acceptance, a 6' fence of either chain
link with slats or a wooden privacy fence. MOTION DIES FOR LACK OF A
SECOND.
Commissioner Keaton moved, seconded by Commissioner Piggee to approve
the revised site plan with a 6' fence as discussed, provisions for an
ingress/egress easement through the Arthur's Beauty College property.
MOTION CARRIED with Commissioner Green voting NAY.

Discussion ensued regarding clarification of the right-of-way
ownership and it was noted that the right-o f -way is dedicated as an
easement for the Gas Company.
Mr. Harold Crook questioned the requirement for sidewalks, and it was
explained that the Ordinance does not require sidewalks for a culdesac
with less than twenty lots.
City Engineer Whisker explained that the requirement of sidewalks
along the ten-lot area comes as a result of the area being adjacent to
a thorough street.

the revised Preliminary Plat of H & H Mobile Home Development as

b. PRELIMINARY PLAT Northlake Subdivision Phase X Lake Lorene
Representative Mr. Tommy Bond related that the Vicksburg District
Corp. of Engineers is reviewing the plans for the Lake Lorene area for
approval to proceed. He related that the culdesac would extend toward
the lake as submitted on the plat reviewed by the Planning Commission
one-month prior. He stated that the preliminary plat is a
continuation of a plan that was previously approved in the early 70's.
He noted the name change of Crappie Court to Mallard Court due to
mispronunciation.
In response to a question posed by Chairman Brannen, Mr . Bond related
that the area is presently in the flood plain, but is scheduled to be
removed from the flood p l ain. It was noted that flood plain plans
were submitte d one month a go as requeste d by the Corp of Engineers,
the developer has also submi t t ed data r e gar ding impact to flood levels
on Kellogg Creek. He stated that a 400' floodway was left between the
existing lake to the south in Sherwood and the proposed new lake,
adding that with the 400' floodway there would be hardly any impact to
the water levels in the area. He went on to explain that there would
be certain ~rP~s during construction that the developer would be
required to medicate regarding wetlands.
In response to a question from Chairman Brannen, Mr. Bond stated that
approval from the Corp. of Engineers is expected prior to approval of
the Final Plat by the Planning Commission .
City Engineer Whisker requested that in the submittal of the final
plat for phase X, that the developer include the completed r oad from
phase IX to phase X, and that sidewal ks currentl y l ocated on t he south
side be continued on the south side of Northlake Drive. He related
that the Fire Marshall has reviewed and approved the fire hydrant
placement.
Commissioner Young moved, seconded by Commissioner Keaton to approve
the Preliminary Plat of Northlake Subdivision PH X Lake Lorene as
presented with final approval from City Engineer Whisker. MOTION
CARRIED.
DEVIATION IN AGENDA:
Commissioner Lester moved, seconded by Commissioner Piggee to suspend
the rules and place the revised Sketch Plat of Foxwood Gardens on the
agenda. MOTION CARRIED.

Representative Mr. Tommy Bond related that rev1s1ons include requested
changes from the Planning Commission, City Engineer Whisker and
developer. He related that since the development will feature garden

homes the developer is requesting that the Planning Comm ission
consider allowing a smaller front and s ide yard set back in ord er to
develop nice homes with smaller yards . He requested a 20 ' front y ard
setback and 5' side yard, adding t hat the new dimensions woul d add to
the buffer space b etween t he Railroad and expand some of the broader
areas in the development. He pointed out that as requested the second
entrance is designat e d across from the existing Foxwood Drive, which
will be a gated security entrance allowing for provisions for
emergency vehicles. He stated that he felt this type of development
would meet certain needs for homebuyers and that the area is conduc ive
to this type of development.
Discussion en s ued rega r ding consider ation for smaller setbacks in the
culdesac, and Mr. Bond not e d t hat the all owa n ce £or smaller setbacks
in culdes ac s eems to have b een droppe d from t he code ordinances. He
o ffered that deve l opme nt code s n e ed flexibility t o address various
types of dev e l opme n ts such as retirement communi ties where residents
want smaller yards.
In response to a question from Chairman Brannen, Mr. Bond related that
many apartment developments have a 2 0-foot setback from the street,
saying that as a gated retirement community could be viewed as a
similar concept r egardi ng development . Be stat e d t hat the c oncept is
to maximize the home size while reducing t he yard area requiring
mainte nance . He pointed out that s e v e r a l of t he same type of
developments in Cabot has been very successful, encouraging the
Planning Commissioners to view the retirement communities in Cabot.

In response to a question from Chairman Brannen, Mr. Bond related that
the enti r e area would be r ais ed out of the flood plain. He pointed
out t hat part of the reason for establishing the pond area is to
create borrow pits, estimating that the lots would be raised between
two and three feet above the flood plain. He related that the
developer is requesting approval of the concept of the plan and would
return with greater detail.

the Sketch Plat of Foxwood Gardens as presented. MOTION CARRIED.

Chairman Brannen announced that the draft Green Ordinance would be
delivered to committee members for consideration at a meeting to
follow the regularly scheduled Planning Commission meeting in
September.
Mr. Bond addressed the Commission stating that in speaking with local
developers he has learned that Jacksonville is probably the only City
that has a 35' front yard setback. He related that most cities have a
25' or 30', pointing out the additional costs encumbered by the
builder regardi ng an extra five feet. He pointed out the competitive
nature of the construction industry and asked the Commission to
consider allowin g small er front yard setbacks for residential
development.

City Engineer Whis ker relat ed that the owner wants to sell his
property on Ma r s hall Road adj acent to the car wash on the n orth side
of the existing flood way ditch . He related that in the process of
selling the property it was discovered through an engineering study
that existing conditions of the floodway is shown to be of a smaller
width. He stated that it was necessary to contact the p r op erty owners
and hold a pnhl i r. hP.aring as a matter of record. He explained that
the floodway width was reduced, adding that the floodplain remains the
same or was reduced, but did not encompass any more of the property.
Mr. Tommy Bond related that the owner Mr. Haskill, initiated the study
conducted by Mr. Bernie Al t, wbich has been forwarded to FEMA. He
added that public notice is one of the FEMA requirements. He stated
that the area was previously documented incorrectly, saying that the
study r educe s the floodwa y and lowers the flood level regarding the
area between Marshall Road to Hwy 67.
In response to a question from Mr. Gene Breck, owner of the car wash
at 209 Marshall Road, City Engineer Whisker related that his property
would be taken out of the floodway and the floodplain.

Vice Chairman Perry opened the public hearing at approximately 7:12
p .m.
Petitioner Mr. John Davis of 270 Oliver Lane in Cabot, related that he
owns Whit Davis Lumber Company at 723 School Drive. He explained that
he also owns a t riangular shaped p iece of property that is adj acent to
the Rail road directly behind 701 School Dr i ve . He said that he
purchased property addressed off Hwy 161, which is located behind the
property he is reques ting to be rezoned. He added t h at the t riangular
property is 1000ft . deep, and that approximat e ly 25 yea rs ago the
property had mobile home s. He went on to s ay that he has been the
owner of the property for the past 15 years. He related that there is
a storage facility located on the property that he proposes to
demolish, and construct a 100 X 100ft b uilding to be used as a new
storage facility.

Commissioner Young moved, seconded by Commissioner Montgomery to
approve the rezoning from R-7 to C-4 as requested. MOTION CARRIED.
City Attorney Bamburg noted that the rezoning ordinance would be
addressed by the City Council on September 19th.

Vice Chairman Perry noted that approval of the building permit would
be contingent upon City Council approval of the rezoning ordinance on
the 19th of September.
Commissioner Lester moved, seconded by Commissioner Young to approve
the building permit, contingent on City Council approval regarding the
ordinance to rezone the property from R-7 to C-4. MOTION CARRIED.

Vice Chairman Perry noted that the petitioner is Mr. Joe Collins,
represented by R & K Services.
Representative Mr. Phillip Keaton r e l ated that the plat is a one-lot
subdivision regarding a request to bui l d a new eye clinic, north of
Jacksonville Fitness Center and south of the existing eye clinic on
North First Street.
City Engineer Whisker related that his only concern regarding the
final plat is the sewer line that has not yet been constructed. He
explained that the proposed owner does not want to complete purchase
until the property has been final platted. He clarified that the
proposed buyer does not want to incur the costs to run sewer if he is
not going to purchase the property. He then related that sidewalks
would be placed along North First Street.
It was noted that the sewer plans drawn by Bond Engineering were
approved by the Wastewater Commission.
Mr. Keaton stated that if the plat is approved, Mr.·Collins will file
the plat but intends to have the sewer line completed before the
building construction is finished.
City Engineer Whisker related approval prior to utili ties being in
place would go along the same line as when the City Council approved
the final plat of the Oak Ridge Ranch Subdivision, pointing out that a
certificate of occupancy would not be issued until the sewer is
completed and that the building permit would be stamped "not all
utilities available".
In response to a question from Commissioner Dollar, Mr. Keaton related
that the lot would be 220ft. in depth. He then noted that further
development of the property in the general vicinity would need to be
addressed by First Place Commercial, owned by Mr. Jim Green.
In response to a question from Commissioner Montgomery, City Engineer
Whisker related that the drainage ditch separates the property from

b. SKETCH PLAT Underwood Subdivision
Vice Chairman Perry related that the petitioner is Mr. Glen Underwood,
represented by Bond Engineering.
Representative Mr. Tommy Bond stated that the 61-acre property was
recently purchased from the Met ropol i tan Trust. He stated that Mr.
Underwood is reques ting consideration from the Plann i n g Commi ssion
regarding the geometry of the proposed Subdivision . He r ela t ed that
the lots would be 70' X 125' and consist s of 164 l ots total. He then
related that there is an additional request to rezone a small area of
the property at the regularly s cheduled Planning Commis s ion meeting in
October . Re added that t he area to be c onsidered f or rezoning is a
small parcel at t he c o rner of General Samuels and Harris Road . He
pointed out tha t t he p roperty does not lend itself to single-family
development , because t he p roperty is too long and narrow to be
subdivided into indiv i dual l ots . He related that multi-family
development of the property would need to have access onto General
Samuels, so the parking could be centralized to reduce the ingress and
egress onto General Samuels or Harris Road to one or two driveways.
In response to a question from Contmissioner Keaton, Mr. Bond related
that the property has a major drai n , which goes i nto the Air Base. He
then stated that the design of t he p roperty is t o avoid crossing that
major drain. He t hen s t ated tha t s ome of the drainage area is planned
for retention, regardi n g the use of weirs to h ave some pools that can
be used as landscape features.
City Engineer Whisker stated his desire for a right-hand turn lane at
the corner because of westbound traffic being generated on General
Samuel to turn northbound on Harris Road. He then related the
requirement to have sidewalks along General Samuel and Harris Road
where the inroads are not culdesacs and are greater than 20 lots deep.
He stated that if the developer is not pla nning to connect the two
deve l opment areas across the drain, his thought would be to have a
footbridge for the children crossing to go to school. He related that
his other concern would be that with 122 lots, there would need to be
a second entrance or a larger e nt rance that would accommodate more
than one car in and out. He noted that the waterline in the area
would have to be looped in from Woodland Hills to Harris Road and
added that the other concern is for sewer. He pointed out that the
sewer would have to be pumped back into Woodland Hills, adding that he
believes the p ump station to be sufficient.
Mr. Bond related that the first two tiers of 40 -50 lots will gravity
back to the existing Woodland Hills pump station, and that the
Woodland Hills pump station is under its capacity rate and is probably

at 30% capacity. He then related that once t he first two tiers are
gravitated back to the Wood land Hills pump stati on; decisions will be
made regarding sewer for the rest of the Subdivision. He pointed out
that there is a pump station at Tolleson Elementary School that is
under utilized, being only 30 to 40 % of its capacity. He related that
they would develop ideas regarding the sewer.
In r esp onse to a question posed by Commissioner Lester, Mr. Bond
answered that the f i rst entrance is very near the top of the hill,
allowing traffic to see both ways. He then related that there has
been some discussion regarding a second entrance to be placed by lot
62, adding that the west side of the development does not lend itself
to other than has been designed.
Mr. Bond then pointed out that this is the third conceptual plan
regarding the property, adding that t hi s p lan leaves more open space
along the ditch. He then addressed t he issue of s i de wa lks, saying
that the area along the side o f t he roa d (north side of General
Samuels) is very rough and has a ditch for some distance adjacent to
the road. He related that they would like to approach the Commission
and request that rather than building a sidewa l k along General Samuel,
they would like build one up the drain a r ea so that the residents
would have a way to get to the Tolleson School, and that it would
provide residents with a p lace t o walk. He related that with the
construction of weir::> l n the dra in area for retention it v:ould make
the area nice t o walk t h rough r egarding a s cenic vie w. He then
pointed out that the rest of the development could connect to that
area . He s tated that the concep t of buil d ing a sidewalk along General
Samuels, while it is a good idea, to build a sidewalk there and have
it match future improvements to make General Samuels into four lanes
would be difficult. He stated that the odds are "slim to none" that
the ::;ldewdlk would survive any future cxpu.nsion of the Street. He
stated that it seems like a terrible waste, and pointed out that there
is no development that fronts on General Samuels, except the proposed
multi-family area at the corner. He stated that he did not think the
Planning Commission would have to decide tonight, but felt it should
be mentioned for consideration.
In response to a question from Commissioner Dollar, Mr. Bond related
that the sidewalk going up the drain would be five to six feet in
width, adding that his thought would be to build the same type of
sidewalk that the City constructed in Dupree Park.
City Engineer Whisker related that the sidewalk in Dupree Park is a
ten-foot asphalt trail.
In response to a question from Commissioner Montgomery, Mr. Bond
related that the development is inside the City limits. He added that
his feeling is that the lots would be really beautiful and that the
City needs this type of development in proximity to the school and the
Air Base.

Vice Chairman Perry questioned if a Bill of Assurance had been
formulated to gain an idea regarding the size of the homes.
Mr. Bond stated that he was sure Mr. Underwood has thoughts regarding
that.
Discussion ensued and Mr. Underwood stated the homes would be between
1200 to 1400 square foot, saying that it would probably be a little
bigger than Parkview Subdivision homes. It was also noted that homes
in the Fair Oaks subdivision are between 1400 to 1600 square feet.
Mr. Bond stated that the size of homes would fit well with the
Woodland Hills area, guessing that those houses there between the 1200
to 1400 range.
City Engineer Whisker stated that regarding the sketch plat, he
believes the only considerations would be a possible third entrance,
and direction regarding the sidewalk and/or trail. He then clarified
that the sidewalk as required by ordinance would be for General
Samuels and Harris Road. He then answered that while the issue did
not completely have to be decided tonight, he felt it prudent to offer
the developer directions.
Mr. Bond stated that he felt plans were pretty well set to have a
third entrance by lot 62. He then related that the subdivision would
be offered in phases through the Planning Commission, saying that the
first phase will probably be the tiers of lots that can gravity sewer
to Woodland Hills. He stated that he and the developer are going to
meet with the Water Commission regarding the waterline. He then
explained that a 12" waterline is planned for the area, however,
hopefully arrangements can be worked out for an 8" waterline. He
stated that an 8" waterline would be sufficient for the subdivision.
He related that there is another large tract of land across the street
that has just changed hands, and hopefully everybody working together
the right size waterlines and sewer lines can be put in place. He
stated that those issues will develop themselves out and there will be
more discussion about the right turn lane at Harris Road.
City Engineer Whisker stated that the other issue is the forty-foot of
right-of-way for General Samuels.
Mr. Bond responded that General Samuels has an 80ft. right-of-way.
City Engineer Whisker related that issue regarding 50 ft. for an extra
turn lane.
Mr. Bond stated that he believes some of the issues would better
decided after the decision regarding the rezoning of the property.

expressing appreciation for those in attendance.

Commissioner Young moved, seconded by Commissioner Perry that the
minutes of the 9 September 2002 Regular Planning Commission meeting be

PUBLIC HEARING(S): a. REZONING 1117C & 1117D North First Street from
R-3 to R-2
Chairman Brannen opened the public hearing at approximately 7:02 p.m.
Mr. E. Ray Smith stated that he would like to rezone the property to
R-2 in order to build a duplex.
With no one to speak in opposition, Chairman Brannen closed the public
hearing at approximately 7:03p.m.
City Engineer Whisker presented a vicinity map, pointing out that the
property is located on the corner of North First near Stonewall and
Revere Court. He stated that the property consists of four lots and
that the southeast corner is being proposed for rezoning. He related
that the other three lots have duplexes that were built in the 1980's
by Mr. Smith. He then requested that Mr. Smith establish a recorded
20-foot easement from the southwest lot onto the southeast lot.
Mr. Smith agreed to establish and record the easement.
It was noted that Mr. Smith would also be requesting a building permit
on a metes and bounds legal description.
Commissioner Green moved, seconded by Commissioner Young to approve
the rezoning of 1117C and 1117D North First Street from R-3 to R-2 as
requested. MOTION CARRIED.
It was noted that the City Council would address the rezoning October
17, 2002.
b. REZONING Northeast Corner of Harris Road and General Samuels
(Crooked Creek Subdivision)
Chairman Brannen opened the public hearing at approximately 7:08 p.m.

Mr. Tommy Bond stated that he would be representing the developer Mr.
Glen Underwood. He related that the Planning Commission had reviewed
the Sketch Plat one month earlier, which proposed single-family
development excluding a small tract of land measuring 150' by
approximately 600' in length between General Samuels, Tolleson
Elementary School and Harris Road. He explained that the property
does not lend itself to single-family development because access would
have to be from General Samuels. He pointed out that a multi-family
development would limit the need for access to possibly three
accesses.
With no one to speak in opposition, Chairman Brannen closed the public
hearing at approximately 7:10 p.m.
In response to a question posed by Commissioner Keaton, Mr. Bond
related that there had been little planning regarding the number of
units proposed for the development. He added that in the conceptual
sketch he began with three-plexus and four-plexus to share common
parking, pointing out that it would not be a high-density development
because of the geometry of the land. He stated that he did not
believe there would be any multi-story buildings, adding that
construction would fit the adjacent residential neighborhood.
In response to a question posed by Commissioner Montgomery, Mr. Bond
explained that Tolleson Elementary School is setback approximately 300
to 500 feet from the front property line.
Chairman Brannen noted that there is utility work being conducted in
the area and questioned if the waterline would be adequate.
Mr. Bond stated that the Water Department has a contracted to build a
new 12" waterline in the .J.re.J., .J.dding th.J.t H.J.rrio Road ha3 a 24"
waterline. He stated that plans have been before the Water Commission
and they have agreed to work with the developer regarding waterline
needs. He stated that the Water Commission will decide on either a 10
or 12" waterline between Harris Road and Woodland Hills.
Commissioner Montgomery moved, seconded by Commissioner Dollar to
approve the rezoning of the northeast corner of Harris Road and
General Samuels from R-1 to R-3 as requested. MOTION CARRIED.

City Engineer Whisker related that the sewer has been approved and the
Water Department has requested that approximately three meter boxes be
reset otherwise plans have passed the water test. He related that
there is a 15-foot easement leading from lots 47F and 48F for a storm
swell.
Commissioner Green moved, seconded by Commissioner Keaton to approve
Final Plat of the Western Hill Subdivision Phase II. MOTION CARRIED.
b. PRELIMINARY PLAT Crooked Creek Subdivision (formally submitted as
Underwood Subdivision)
Representative Mr. Bond related that this would be Phase I of the
Subdivision. He stated that Phase I consists of the lots that will
gravity sewer into the pump station for Woodland Hills. He stated
that he believes all issues regarding sidewalks and storm drainage
have been worked out. He related that they have met with the Water
Commission and there is an understanding that they are going to
participate, there is no waterline between Woodland Hills and Harris
Road now and they are doing some studies regarding the appropriate
size waterline. He related that the Water Department is going to
participate to the extent of the line size that would serve the
development. He related that the developer is going to pay for an 8"
waterline and the Water Department will pay for the difference between
that and a 10 or 12" waterline.
City Engineer Whisker reintroduced discussion regarding the required
minimum 35' building setback being changed to allow a 25' building
setback, pointing out that the lots on the plat are plotted for 25
foot.
Mr. Bond stated that it would require and ordinance -change, adding
that he discussed the option at the last Planning Commission meeting.
He stated that the reality is that it makes a large difference in the
costs of a house, because of shorter driveways, shorter sidewalks to
the house, shorter water and sewer services and generally shorter
electrical service. He stated that these costs can add up to several
thousands of dollars that can be saved by bringing the house ten-foot
closer. He related that he is aware that there were strong feelings
regarding the 35' setback, but added that he does not believe most
people could detect a 25' setback subdivision from a 35' setback
subdivision. He related that he was aware of a 25' waiver granted by
the Cabot Planning Commission approximately one month ago. He went on
to say that he feels the positive outweighs the negative and that only
in a more upscale subdivision regarding houses in the $200,000 to
$300,000 dollar range where houses are larger and look more
overpowering is there a need for a 35' setback. He noted that most
houses in California are generally 15' from the front property line.
He stated that a 25' setback would increase density and save the
homebuyer several thousand dollars in the purchase of homes. He asked
the Planning Commission to consider amending the ordinance.

several months before the developer returns with a final plat and
amending the lots to a 35' setback can be changed if necessary. He
added that he feels that in the long term a 25' setback will serve the
City.
Commissioner Green moved, seconded by Commissioner Dollar to approve
the Preliminary Plat of Crooked Creek Subdivision pending the street
names change, possibility of extra storm drains as required by City
Engineer Whisker, and a 35' front yard setbacks unless a 25' setback
is approved by ordinance through the City Council or a variance is
granted by the Board of Adjustment. MOTION CARRIED.
c. FINAL PLAT Collenwood Subdivision PH IV
Mr. Bond stated that this is the final phase of the Collenwood
Subdivision. He stated that most of the drainage concerns have been
resolved.
City Engineer Whisker stated that it is a nice plan, but has not been
implemented to be considered for final platting. He stated that the
swells for drainage are not in, the rock for the road is not in, the
asphalt paving is not in, and noted that as discussed the final
platting of phase IV should include the park or common area. He
stated that it should all be released at the same time, so that the
City has control until it is completely finished.
Chairman Brannen stated that the Planning Commission has experienced
problems in the past regarding final plat approval before all work has
been completed, adding that he does not feel it is ready for final
plat consideration.
Mr. Bond stated that the only thing he might could suggest is that Mr.
Green be allowed to post a bond to cover items that are not completed.
Chairman Brannen questioned if a one-month delay would be a problem.

Mr. Green stated that probably the only issue is time and money; he
explained that he was hoping to have this part of the process
completed. He further explained that there are two steps beyond this
process, one being that it has to go before the City Council and two
it has to be signed by the Planning Commission Chairman. He related
that he is not asking for either of those things and is assuming that
before either one of those happened the City Engineer would have to be
satisfied that everything is completed. He stated that he are not
hoping to be in a position to sell lots, but is hoping that he would
not have to wait another five to six weeks for approval. He estimated
that everything would be completed approximately around the middle to
the end of next week.
Chairman Brannen stated that the president is to have the work
completed before final plat approval, adding that the Planning
Commission does not want to get into the habit of approval before the
work is completed.
Commissioner Montgomery moved, seconded by Commissioner Green to table
the Final Plat of the Collenwood Subdivision Phase IV until the next
regularly scheduled Planning Commission meeting. MOTION CARRIED.
Resume Agenda:
BUILDING PERMIT(S): 1117C & 1117D North First Street
City Engineer Whisker related that Mr. Smith is requesting to build a
duplex contingent upon the afore addressed rezoning being approved by
the City Council. He reiterated his request of Mr. Smith to have a
20-foot easement and proper setbacks.
Commissioner Montgomery moved, seconded by Commissioner ~to approve the
building permit for 111 7C & 111 7D North First Street contingent on
City Council's approval for rezoning, proper setbacks and a dedicated
20-foot easement through the Pulaski County Circuit Clerk. MOTION

DISCUSSION Twenty-five year Comprehensive Development
City Engineer Whisker related that there is a survey being mailed by
the City to every resident of Jacksonville. He stated that surveys
can be picked up at various locations and dropped off at those
locations. He stated that it is for planning purposes, saying that
the original plan was done in 1977. He related some of the questions
included issues regarding the school system, fire stations and future
planning issues. He encouraged everyone to participate. He stated
that the Comprehensive Development Plan is a tool for the Planning
Commission and a guide to future planning.
b. Adding Mixed use to the zoning ordinance.
City Engineer Whisker related that mixed use is used in areas so that
changes are not necessary land use plan each time commercial and

Discussion ensued regarding implementing the mixed-use area with an
ordinance recommended to the City Council. It was also questioned if
the Planning Commission would offer a zone for mixed use of a building
such as commercial downstairs and residential upstairs.

need to host a public hearing regarding the rezoning of annexed
property and then make recommendation to the City Council for final

Discussion ensued regarding the C-1 and C-2 proposed zoning for the
area off Graham and Loop Road and the possibility of residential
zoning.
City Engineer Whisker related that the commercial zone is plan for the
corner of Graham and Loop Road and is typical one corner of an
intersection to have commercial zoned property.

Vice Chairman Perry announced that the regularly scheduled Planning
Commission meeting would be rescheduled due to a lack of a quorum. No
meeting was held.
A special Planning Commission meeting was held November 21, 2002.

Chairman Brannen opened the meeting at approximately 5:30 p.m.
expressing appreciation for those in attendance.
ROLL CALL: Commissioners: Susan Dollar, Chad Young, Glen Keaton, and
Tammy Green, answered ROLL CALL. Chairman Brannen also answered ROLL
CALL. PRESENT five (5), ABSENT four (4).
Others present for the meeting were City Engineer Whisker, Mr. Barry
Williams, Mr. Bill Edwards, Mr. Tommy Lassiter, Mr. Jim Green, members
of the press, interested citizens, and petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Keaton moved, seconded by Commissioner Young that the
minutes of the 14 October 2002 Regular Planning Commission meeting be
APPROVED. MOTION CARRIED.
PUBLIC HEARING(S):
BUILDING PERMIT(S): FAMILY DOLLAR STORE/Hwy 161 & Tricky Lane
Mr. Bill Edwards stated the property is located at the southeast
corner of Tricky Lane and Hwy 161. He stated the building will face
Hwy 161. He related the property consists of the vacant lot and the
lot behind it that a house located on it. He stated that the site
plan meets all codes as provided by City Engineer Whisker regarding
parking, grading, and drainage requirements.
City Engineer Whisker stated that the driveway requirements do not
exactly fit, but added that the developer has placed the driveways to
the edge of the property as far as possible. He stated that they are
combining two driveways. He related that the property is directly
across from the City Auto & Paint Body Shop, adding that the developer
t-Jlctm; Lu demolish the structure located behind the corner lot. Ile
stated that the developer proposes curb and gutter with asphalt
paving, and an inlet on the south side of the property to catch and
move water through a pipe to the north existing inlets on Tricky Lane.
He related that there would be a grass strip behind the sidewalk on
Tricky Lane, Hwy 161 and· then by the driveway on south side of the
property entering from Hwy 161.
Commissioner Green moved, seconded by Commissioner Keaton to approve
Building Permit for Family Dollar Store on Hwy 161 & Tricky Lane.
MOTION CARRIED.
REQUEST TO APPROVE PLAT(S): a. FINAL PLAT Jacksonville Plaza Addition
Representative Barry Williams with Thompson Engineering stated that
the construction is finished and the owner is ready to obtain
occupancy, adding that they have met all utility requirements and
other requirements as directed by City Engineer Whisker and are asking
for final plat approval so that the plat can be filed and recorded.

City Engineer Whisker stated that the building is completed and the
two out parcels are ready for construction with the final platting.
Chairman Brannen expressed his ongoing concern regarding the exit
situation making a left hand turn onto John Harden.
Mr. Williams stated that it is imperative to the development to be
able to have access in the manner that the driveway is constructed.
Mr. Tommy Lassiter addressed Chairman Brannen's concern, stating that
he feels traffic will quickly learn that access to the left will be
easier through the traffic signal at Wal-Mart. He related that he has
made many turns from the exit and has noted that there are times when
the traffic is backed up, but noted that at those times people will
more than likely go to the Wal-Mart traffic signal or make a right
hand turn back to the James Street overpass. He stated that the
traffic situation is tough, but doubts that the shopping center has
added much to that. He related that he feels many of the shoppers are
from the Wal-Mart Supercenter, adding that so far it has worked quite
well and there have not been any complaints from the four stores that
have opened.
Commissioner Young moved, seconded by Commissioner Dollar to approve
Final Plat of the Jacksonville Plaza Addition as presented. MOTION
CARRIED.
b. FINAL PLAT: Collenwood Subdivision Phase IV
Chairman Brannen questioned if all work had been completely finished.
Mr. Green stated that it had to the best of his knowledge.
City Engineer Whisker stated that he was under the assumption that Mr.
Green would have the lake area completed at the time of the final plat
of Phase IV. He related that the final grading is being done now,
pointing out that a 5 foot section of flume has been left out in order
to move equipment back and fourth across the lake and that there is
one pipe left to be installed at the south end of the property next to
Colonial Drive. He related that both items are not included in the
final plat; however, the pipe is responsible for draining the property
from Phase IV. He then stated that both utili ties have given him a
letter and Mr. Green has provided a written letter of warranty for the
streets. He stated that he does not feel that the flume part is a
problem, saying that it is just a philosophical difference regarding
if that area should be platted with the rest of the property when he
is finished or should it be a secondary i tern to the final plat. He
stated that his recollection was that all the property would be
submitted as compete with the Final Plat of Phase IV.
Chairman Brannen questioned when the lake area would be completed.

Mr. Green stated that assuming the weather holds, the lake would be
completed in the next ten days. He related that they still lack some
dress up work, mostly regarding seeding. He stated that the only
physical aspect is the pipe. He explained that a 12 or 15" pipe was
installed sometime around Phase I drained across a part of what is
proposed to be a park area, but had originally been proposed as a
grass swell. He stated that when the park was proposed they put a
pipe in, adding that because of the flatness of the area they had to
add another pipe beside it to carry water without backing up. He
related that the pipe was a temporary pipe they had for this phase,
which has just been dug out this week. He stated that the pipe is not
really a part of Phase IV, but that he and City Engineer Whisker have
talked about it during the construction of this phase.
Chairman Brannen questioned if Mr. Green would have another phase
after this one.
Mr. Green stated that Phase IV is the final phase of
Subdivision, adding that when the lake is finished it will
over to the property owners association. He stated
construction end of the project for him will be finished.
Chairman Brannen questioned how long it would take.
Mr. Green stated i t would be approximately a one-day job.

Mr. Green stated that it is more of a problem with the homebuilders
who want to get houses going while the weather is nice. He related
that he has promised them for a month that they would be done and then
they missed that deadline because of the rain and now he has told them
one week ago that it would be completed this last Monday and has not
been able to do that. He stated that it is a matter of construction
needs conflicting with the weather at this point. He added that he
never anticipated that the lake would be dealt with as a part of this
phase, saying that he had just never put the two together.
Commissioner Young stated that the plat could not be forwarded to the
City Council without everything having been completed.
City Engineer Whisker reminded the Commission that this would be the
final phase.
Chairman Brannen asked for a motion to table until December gth in the
hope that everything will be complete as of that date.
Commissioner Dollar moved, seconded by Commissioner Green to table the
Final Plat of Collenwood PH IV until December 9, 2002.

Mr. Green stated that he does not believe that the records will
reflect anything dealing with Phase IV of Collenwood Subdivision that
has any mention or bearing what so ever to do with that lake project.
Chairman Brannen relat e d to Mr. Green t hat he has put the Planning
Commission in a posit ion that once the final plat is approve he could
walk away from the job without completing the construction. He stated
that the Planning Commission does not want to be put in the position
of granting approval prior to the completion of a project.
Mr. Green questioned what the lake area has to do with the
subdivision. He stated that a subdivision does not necessarily have
to have a lake.
Chairman Brannen questioned if the lake area is part of his
subdivision plan.
Mr. Green responded that i t i s p a rt of his concept , not a part of any
plan that has been approved t hrough the Planning Commission. He
reasoned that if he were n ot t o finish the l a ke then the property
owner's recourse would be through the court system.
In response to a question posed by Chairman Brannen, City Engineer
Whisker reiterated that to complete the project Mr. Green still needs
to put in the pipe, finish the flume and dress up of the lake area.
At this time, MOTION CARRIED.
ZONING FOR ANNEXED PROPERTY TO JACKSONVILLE
City Engineer Whisker stated that an enclosure in the packet is a
photograph regarding the area of South Jacksonville that needs to be
recommended for zoning. He questioned if the Southeast Annexation
should also be addressed for zoning.
City Attorney Bamburg clarified that the Planning Commission would
need to make a recommendation to the City Council regarding what
zoning classification should be set for the annexed areas. He noted
that the Planning Commission would host the public hearing and then
make recommendation to the City Council.
Commissioner Green moved, seconded by Commissioner Keaton to set a
public hearing for the regularly scheduled meeting in January 2003
regarding zoning classification of the south and southeast annexed
properties. MOTION CARRIED.
