Acting Chairman Gray opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance and requested roll call. ROLL CALL: Commissioners: Ken Nabors, Bobby Lester, Bart Gray, Jr., Dean Wi1born, and John Hardwick answered ROLL CALL. Acting Chair.man also answered ROLL CALL and declared a quorum. Commissioner Piggee arrived at approximately 7:06p.m. PRESENT six (6), ABSENT (2). Others present for the meeting were City Engineer Reel, Alderman Bill Howard, Mrs. Emma Knight, Mr. Jim Peacock, Mr. Mark Perry, Mr. Tommy Bond, Patriot Reporter Peggy Koury, and petitioners. ELECTION OF OFFICERS: Acting Chairman Gray related the need to elect the Planning Commission Chairman and Vice Chairman/Board of Adjustment Chairman for 2000. Commissioner Hardwick moved, seconded by Commissioner Lester to ncmin&tQ Ccmmie~ioner Art Brannen tQ s~rve a~ Planning Commission Chairman. MOTION CARRIED. Commission Hardwick moved, seconded by Commissioner Nabors to nominate Commissioner Gray to serve as Planning Commission Vice- Chairman and Chairman to the Board of Adjustment. MOTION CARRIED. Commissioners Hardwick and Nabors volunteered to serve as members from the Planning Commission to the Board of Adjustment. Vice Chairman Gray commended the service of past Chairman Perry who will continue serving as Board of Adjustment Commissioner. PUBLIC HEARING(S) a. Rezoning of property located at 1001 Quince Hill Hoad Chairman Gray opened the public hearing at approximately 7:10 p.m. Mr. Jim Peacock representative for petitioner I owner Dave Goins stated that Mr. Goins has an opportunity to sell property located at 1001 Quince Hill Road for development of a mobile home subdivision. 1 ' 000~'08 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Mr. John Herbold 1100 Quince Hill Road presented a 185 signature petition of opposition to the Commission and related that research he has conducted shows sewer and traffic will not support a mobile home park in Toneyville. He stated that landowners have rights to develop their land, however, homeowners also have rights regarding the best development for their area and the City. He stated that the area proposed for rezoning could accommodate a less dense housing development and that the area needs to be developed slowly. He related that in contacting the Wastewater Department he learned that the last sewer system study of the area was done in 1992. He stated that the Northeast Pump Station had been upgraded and even after the upgrade it was still running at capacity. Since 1992, there has been further development by Mr. Dick Jones in the area. He related that the area from North First to the City limits is serviced by one 8" or 10" sewer line system. He stated that the area includes 100 HUD units, 50 Swiss Village apartments, a beauty college, a school, two churches and over 217 homes for a total of over 600 units in the area. He related that there are manholes that overflow during heavy rains and areas that have required pumping by the sewer system behind Swiss Village. He pointed out that there are forty-six lots approved in the Dick Jones development that will be brought on line as construction is completed. He reiterated concerns for density and speed of development regarding a mobile home park. He then cited traffic concerns with the increased traffic from Cabot, mentioning implications of increased traffic regarding the new Supercenter. He stated that in research he found vacancies at almost every mobile home park in the Jacksonville area. He related that security and appearance of the mobile home park depends on the park manager, mentioning concerns for change of conditions and surrounding property values. He pointed out that the Planning Commission had denied an R-2 zoning for the Dale Street area because of density concerns and was developed as R-0, adding that the same should happen to the proposed property for rezoning. He related that as an R-0 area it would develop slowly with less density. He then stated concerns regarding flooding and a mobile home development. In response to a question from Mr. Herbold, City Engineer Reel answered that his primary concern for the development is the effect it would carry for the area sewage collection system, adding that high density development would have a definite impact on the development of the single family areas. 2 oco)..o9 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEET!NG JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Mr. Herbold read a letter of opposition from Mr. Dick Jones of which he furnished a copy to the Commission. The letter further stated concerns regarding density and the current sewer system. In closing Mr. Herbold stated that R-0 is the best development for the area considering all factors that minimizes the negative effects to the City. Mr. Emmerson Srni th an area property owner stated he would have signed the petition if offered and would like to speak against the rezoning of the property. He related that the sewer system desperately needs attention calling it "an unhealthy situation." He related that on New Years Eve the main sewer line overflowed on his property and that the residue is still present. He stated that the sewer system has become a problem even when it is not raining and that another major concern from the development is flooding. He related that he cleans debris from a nearby creek to keep his property from flooding. He also pointed out the newly developed commercial property and concerns for the run-off water from that development to Evans Drive and through his property. He stated that he is fearful of a very serious accident on the access road, adding that the only access to the proposed property is through Evans Drive, which will increase the traffic significantly. He stated that he did not think Evans Drive was constructed with consideration of a high-density development. He also stated concerns regarding discarded trash relating to density on Evans Drive, pointing out that on New Years Day he picked up seven alcohol containers. He asked that the City consider the debris situation on Evans Drive. He concluded by saying that he did not feel the rezoning was in the best interest of the City. Chairman Gray closed the public hearing at approximately 7:33 p.m. for discussion among the Commission. City Enqineer Reel responded that additional improvements would be necessary to add fire protection mentioning increased supply lines into the area to accommodate additional development of the area. Mr. Peacock answered a question from Commissioner Piggee in saying that he was not aware of the number of units proposed, but reminded the Commission that the development is a mobile horne subdivision not a mobile home park. He said that lots would be purchased and conform to all City codes. 3 OOOZ1.0 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Chairman Gray related in response to the earlier question from Commissioner Piggee that an R-4 zoning would allow for eight units per acre, adding that as an R-4 subdivision it would be subject to the same criteria as any other subdivision, mentioning streets, sidewalks and other utility circumstances. He stated that mobile home lots could be 60' by 100' that relates to requirements .in an R-1 zone regarding density. Discussion ensued and City Attorney Bamburg related that the property could be rezoned to R-4 conditioned on use as subdivision based on request by the petitioner. City Engineer Reel related that the Wastewater Utility expressed adequate sewer concerns regarding the last phase of Jackson Terrace. He further related that he has concerns regarding the further development of property in the area above what is already proposed. In further discussion, City Engineer Reel related that Mr. Dick Jones participated in the construction of the sewer line across the freeway to the current housing development because of sewer concerns in the area. He responded to a questf:on from Chairman Gray in saying that there are sewer concerns . for any future development regarding application for sewer extensions. Chairman Gray mentioned multi-million dollar sewer improvements and asked for the status of the area for Commission awareness. Sewer Commissioner Tommy Bond stated that he is a little surprised at the concern raised over the sewer in that area. He stated that the Sewer Commissioner spent two or three hundred thousand dollars replacing the line on the west side of Hwy 67, the pump station at Northeastern and built a new force main around existing bottle necks in the system less than ten years ago. He then related that the Sewer Commission is in the process of spending twelve million on sewer plant and line rehabilitation, adding that part of those repairs are scheduled for the older portion of the Jackson Terrace Subdivision. He related portions of the subdivision that were slip-lined in the late 80's were not done well and is scheduled for additional work. Chairman Gray questioned if Mr. Bond was aware of sewer concerns before comments made during the earlier public hearing. 4 OCOJ.1.1 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Mr. Bond responded that during the previous development he was aware of concerns regarding the old line located north of and parallel to Quince Hill Road because of slip lining that was not performed very well. When asked of the time-frame regarding improvements, Mr. Bond responded that he was unaware of any serious problem prior to concerns just mentioned, but stated he would make inquiry regarding the situation. He related that there are currently five areas throughout the City of Jacksonville to eliminate manhole overflow, adding that he has made note of the manhole that overflowed on Mr. Smith's property. He related that manhole overflows must be reported to EPA along with a plan to eliminate said overflow. He stated that to his knowledge there are some minor problems in the area that have been targeted for repair, adding that flow test will be conducted regarding new interceptor lines and the need for larger lines in certain areas. He stated that he thought after the backup problem at Swiss Village Apartments was identified, there were no other major problems. Mr. Herbold related that in contact with the Wastewater Utility he was told that the last study conducted in 1992 stated that the northeast pump station was operating at capacity then. He pointed out that development has been added since that time and the area is experiencing overflows. Commissioner Hardwick moved, seconded by Commissioner Nabors to deny the request to rezone property located at 1001 Quince Hill. MOTION CARRIED. b. Conditional Use of Residential Property in a C-2 zone located at 120 South Bailey. Chairman Gray opened the public hearing at approximately 7:50 p.m. Ms. Emma Knight representative for petitioner Mike Abdin related that Mr. Abdin is currently out of the country but has asked that the Commission be made aware that his request for a conditional use of the property comes because his nephew attending college in the area is using the property. She then related that he would like to further use the property as a close by residence from his business where he can rest during the day when he suffers leg pains. 5 j 000~'12 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. In opposition Mr. Gene Adams spoke to the Commission saying that his law firm at 501 West Main was purchased in 1987 and that when he purchased the property the surrounding property was already zoned. He stated that he has become aware of people occupying the structure behind his office and he has noticed changes. He related that he has seen beer cans and bottles when he was having his hair cut at the adjoining structure. He stated that he has concern for the consistent use of the property. He then related that a ·phone booth was installed recently on the corner, which he feels could not have been installed in a residential area. He further related concern for the group of clientele that the corner phone booth attracts at 11:00 p.m. He asked that the request be denied because all Main Street businesses have a buffer from the residential. Ms. Roberta Bonham owner of Salon 122 located at 122 South Bailey explained that her business is one side of the duplex building being considered for variance. She stated that it is her understanding that Mr. Abdin intends to use that part of the duplex addressed as 120 South Bailey as a residence under a conditional use. She pointed out that her lease is still in effect and that if the property is allowed to be used as a residence several factors will come into play. She stated that the most important of which to her personally is that a variance will create undue hardship on both the physical aspect of the property she leases for business and her ability to conduct that business in a manner commensurate with normal business activity. She pointed out that Mr. Abdin has used the property as a residence since September 1999, and that in the last ninety days those residents (as many as eleven) have shown that they have no regard for the aesthetics of the outside business areas or for the peace, public safety and morals of the area. She related personal hardship and duress as a direct result of persons occupying the adjoining structure to her business location. She stated that she has been in business for four and one-half years and has paid to have the outside of the property cleaned in a building that she described as "otherwise falling down to begin with" at her own expense. She related the discarding of beer cans and bottles in front of her business as well as dirty boots with dog feces and fast foot litter on the adjoining front porch. She then described the noise level of music played as that which "rattled" the windows. She spoke of the personal appearance of the residents as being that of no shirt with shaved heads, gang tattoos who scream obscene language in front of the business "in broad day- light." 6 ooo;:1.3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. She related that her salon business has clientele of elderly, children, men and women who expect to be safe and experience an atmosphere conducive to the salon business. She stated that she does not feel that the present conduct should be seen in the front of a business, adding that unfortunately the front door of the adjoining duplex is located directly in front of the window to her business. She stated that the residents have taken full advantage of this situation and said that if the Commission passes the variance it would be condemning her business to a "living hell" for the remainder of her lease. She said that she respectfully request that the Commission take all factors into consideration. She pointed out in a diagram provided to the Commission that there is no other residence or multi-family dwelling in the area zoned C-2. She stated that the request would sandwich a residence in the business area, which will spread havoc not only to her business but also to Main Street businesses. Chairman Gray closed the public hearing at approximately 8:02 p.m. Commissioner Nabors moved, seconded by Commissioner Corroum to deny the conditional use request for property addressed as 120 South Bailey. MOTION CARRIED. c. Rezoning 1412 Stanphill Road from R-3 to R-4 Chairman Gray opened the public hearing at approximately 8:04 p.m. Petitioner Stephanie Thomas apologies for her absence in representing the item of business at the previous Planning Commission meeting and then related that she would like to rezone her property to accommodate a mobile home. She related that the home where she currently resides needs to be torn down. Commissioner Piggee thanked Mrs. Thomas for her presence, stating that he had concerns for her previous absence. At the request of Chairman Gray, Mr. Leroy Akridge related that he is in support of the request because of the need for Ms. Thomas to replace the current residence. He related efforts by Ms. Thomas to purchase a mobile home for the property. Chairman Gray closed the public hearing at approximately 8:07 p.m. 7 0092:14 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. In response to a question posed by Chairman Gray, Ms. Thomas related that she was unsure of the length of time it would take to locate a mobile home and have the existing home moved away. City Engineer Reel related that the lot is 85 X 160, adding that the mobile home would need to be moved in before the home could be torn down. He then stated that he would expect the home to be removed in a reasonable amount of time after moving into the mobile home. He suggested a period of sixty to ninety days. Commissioner Piggee moved, seconded by Commissioner Wilborn to approve the rezoning stipulating that the existing home is removed in a reasonable time frame to be deter.mined by the City Engineer. MOTION CARRIED. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Nabors moved, seconded by Commissioner Hardwick that the minutes of the 13 December 1999 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUEST TO APPROVE PLATS: Sketch and Preliminary Plat -Domicile Senior Residence Center Mr. Tommy Bond representing petitioner/owner Randy Pryor related that the Commission had previously requested that access to additional property be provided. Chairman Gray related that the six acres is located at the dead end of Martin Street and is out of a 42-acre tract. He stated that he feels Martin Street was intended to be a major collector street for further development of the remaining acreage. He related that the remaining acreage has limitations because it is in the flood plain with current zoning for multi-family. He related that the acreage could provide for the potential development of 22 units per acre (up to 400 units) and he would prefer that Martin Street carry straight through instead of turning north. He stated that he personally feels it would be a better development of the area if moved directly north of the proposed straight Martin Street or straight south such that the property boundary itself would have an extension of Martin Street as its entrance. He asked Mr. Pryor, owner of the six acres, if he and Mr. Peacock could work a trade of 8 OCOZ1.5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. property and move the six acres to one or the other side of the proposed extension of Martin Street. He stated that in the grand scheme Martin Street was designed to run straight. Mr. Bond related that Martin Street can only go a limited distance further east before running into the railroad about a 1,000 feet out, adding that the property is about 700 feet. Chairman Gray pointed out that there is room for a few smaller culdesacs to be developed. Mr. Bond related that collector status for Martin Street starts in Stonewall but is not a collector street going east because it is not going to cross the railroad track and it is not going to go north because of Pinion Lane and Pathfinders. He then related two restriction factors are Jim Green's development and the major drain running northwest/southeast. He said that the limitations on Martin Street are significant and pointed out that there is another street provided to the area from the south (a culdesac street). He related that this particular piece of property straddles the top ot a small hill and is the nicest parcel of the entire area as far as physical features. He related that there is property to the north and Jim Green owns the south side of the property with a one-acre tract owned by the former owner. Chairman Gray asked if it would be an improbable or impossible task to consider relocating a little more to the north or south of the proposed straight Martin Street. Mr. Pryor said that he was not sure because the land is already financed and purchased. Mr. Bond related that the State Health Department and local departments necessary have reviewed the development, saying that the current plan before the Commission with the exception of providing easements for the water line construction has been approved. He related that in meetings with the City Engineer he believed that a viable plan was achieved which provided access to the properties to the north and south. He related that the street shown is the street requested by the City Engineer. 9 0002:16 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Discussion ensued as to the left turn of the street and Mr. Bond related that the concept of this retirement community is that they do not want through traffic in the development. He said that there would be 80 rental residences for retired people and is planned to be a nice facility for people who no longer want the care of a yard or exterior property. He said he feels it is a welcome addition to the City and is zoned properly for this type development. In response to a question from Commissioner Hardwick, it was noted that the Fire Department has reviewed plans and it meets their requirements for equipment and trucks. Mr. Bond related that there are two fire hydrants planned to serve the area. City Engineer Reel stated that he does not have any concerns regarding the development and said that he has met with Mr. Bond regarding drainage detention. He said that drainage is designed to be an underground detention so as not to impact drainage down stream any more than it is at present. He pointed out a power line that runs the length of the eastern boundary of Stonewall, saying that it would be part of the street right-of-way. He :-said he believes it will fit with proper clearance. City Engineer Reel said that one of the questions of the property owners association was the need to bring in dirt for fill and that in discussion with Mr. Bond it was indicated that the dirt is going to be on site, adding that only a few loads of select material may have to be brought in. Mr. Bond explained that the entire site is out of the flood plain, adding that the north and east side outside the property is the flood plain. He then stated that one of the specific requirements was that none of the property be in the flood plain. Discussion ensued and it was noted that there would not be any extension of gas lines going into the area because the complex is all-electric. Stonewall resident Mr. Olsen questioned how the construction phase will effect Stonewall and related concerns regarding traffic going in and out. He proposed to City Engineer Reel that Stonewall and Martin Street be a four-way stop to slow traffic on Martin Street. 10 OGO:l1.7 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. City Engineer Reel agreed that before occupation of the complex and after construction starts conditions for a four-way stop would be evaluated. Mr. Olsen said that speed problems already exist on Martin Street. Discussion ensued and Mr. Bond related that the water line already extends to the property so there would not be a need to dig across the street. He then related that the sewer comes across the main drain from the northeast so there will be no connections from existing lines in the Stonewall subdivision. Mr. Olsen questioned the amount of buffer at the left turn of the street and suggested that City Engineer Reel propose trying to leave a nine feet buffer of woods. Mr. Bond related that there was discussion to construct that $treet on the east side of the right-of-way so as to leave as much natural barrier behind the existing housing as what exists now. Mr. Olsen stated that he believed there is a 24 thousand-volt power line running through the property, which is the main service line. He asked if it would need to be moved or raised because it is right at the end. Mr. Bond related that he did not believe there would be any changes to the power line. Mr. Olsen stated that his last concern is that someday apartments could be built there and it will create a bottleneck. He stated that in looking at the area, Martin Street is a thirty foot street which is nothing but an access road now and Edinburgh is basically a culdesac road which was never made into a culdesac as access to service the rest of that property. He stated for the record that he did not think that is adequate to develop that area intensively. Commissioner Wilborn questioned how close the property is to Nottingham Cove. Mr. Bond answered that Nottingham Cove is at the corner of the property as shown, adding that Edinburg will provide access in the future. Chairman Gray asked if moved two hundred feet south or put on the projected complete straighten extension of East Martin would the property still be out of the flood plain. 11 000218 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Mr. Bond responded that it would, however, he added that this is the highest part of the property. Chairman Gray related that while item six on the agenda is the building permit, he believes item seven the plat is actually what the Commission is looking at. He said that the sketch plat of the development is actually what the Commission needs to be looking at versus the terminology of building permit. He related that the Commission has actually been considering the sketch and preliminary plat, adding that the building permit can be addressed secondly. It was agreed to discuss the physical attributes before discussing the building permit. Mr. Bond related that the actual plat would only address streets and easements for water and sewer facilities because there would not be lots as you would normally think of. He clarified that it will just be the street that is proposed to the north plus the easements for water and sewer lines. Chairman Gary stated that predominately the Commission is considering the street easement, property access and general questions regarding improvements for utilities. Mr. Bond related that it is the owners intention for it to be a private development area with access control as with any apartment complex. Chairman Gray stated that the Commission interest is related to the improvement plans as proposed for streets and easements for utilities. Discussion ensued and Mr. Bond related that the development meets with Municipal Code requirements regarding setback easements. Other discussion ensued regarding location of development in proximity to Nottingham Cove. In reply to a question posed by Commissioner Wilborn, Mr. Pryor stated that it has not yet been determined if the property manager would live on or off site. 12 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. Chairman Gray pointed out that the Commission interest at this point is if it is a good development plan and if there is proper access and consideration for utilities. Commissioner Hardwick moved, seconded by Commissioner Piggee to approve the sketch and preliminary plat as presented. Mr. Olsen interjected concerns regarding the electrical aspect to which Chairman Gray advised he address through the City Engineer. Mr. Bond related as a matter of note that utilities inside the site will be underground. It was then noted that the extension of Martin Street would be City right-of-way. At this time, MOTION CARRIED. REQUEST TO APPROVE BUILDING PERMITS: 800 East Martin Street -Domicile Senior Residence Center Chairman Gray related that the same plat considered for the sketch and preliminary will represent information regarding the building permit request and internal development scheme. In response to a comment from Commissioner Nabors, Mr. Bond concurred that the number of handicap parking spaces will be increased. It was also noted that Fire Department access to the development has been approved. Mr. Bond related that parking would be designed to provide 1.5 parking spaces per unit. Commissioner Nabors moved, seconded by Commissioner Wilborn to approve the building permit stipulating provision of additional parking to meet the minimum requirement of 1.5 parking spaces per unit. MOTION CARRIED. REQUEST/STREET OR ALLEY CLOSING: 13 000220 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JANUARY 10, 2000 7:00 P.M. -8:45 P.M. GENERAL: Jacksonville Planning Commission Annual Report Chairman Gray noted that copies of the Annual Report have been provided for review and would be considered at the next regularly scheduled Planning Commission meeting. Chairman Brannen opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance and requested roll call. Chairman Brannen introduced Mr. Gary Buzbee who is hired as City Engineer with the retirement of present City Engineer Duane Reel. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Corroum moved, seconded by Commissioner Nabors that the minutes of the 10 January 2000 Regular Planning Commission Meeting be APPROVED . MOTION CARRIED. PUBLIC HEARING(S) a. REZONING: 1200 Lemac Drive from R-3 to R4 At approximately 7:01 p.m., Chairman Brannen opened the public hearing. Mr. Harold Crook related that his intention is to sub-divide the property for mobile home lots as an unsuccessful attempt to sell the property. At approximately 7:03 p.m., Chairman Brannen closed the public hearing. Commissioner Wilborn moved, seconded by Commissioner Nabo·rs to Approve the rezoning of 1200 Lemac Drive from R-3 to R-4. MOTION CARRIED with Commissioners Nabors, Corroum, Piggee, and Wilborn voting AYE. Commissioner Gray abstained and Commissioner Hardwick voted NAY. 1 000223 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. -7:35 P.M. b. REZONING: 1216 Military Road from R-1 to C-3 At approximately 7:05 p.m., Chairman Brannen opened the public hearing. Mr. Sammy Crook related the desire to place a car lot for the requested location. At approximately 7:06 p.m., Chairman Brannen closed the public hearing. Commissioner Gray related that the rezoning request is in conflict with the Land Use Map which shows the property as residential. It was noted that the Land Use Map would need to be amended to consider the rezoning request. Discussion ensued regarding the procedure to rezone from residential to commercial. Commissioner Piggee moved to recommend a change in the Land Use Map regarding the rezoning request. MOTION DIED FOR LACK OF A SECOND. Mr. Sammy Crook questioned the possibility of a variance instead of a rezoning. Further discussion ensued and it was determined that a variance could not be granted against the Land Use Map and that the use of a car lot was not an allowable conditional use for R-1. Commissioner Hardwick moved, seconded by Commissioner Corroum to deny the request to rezone based upon the Land Use Map and the current zoning of R-1. MOTION CARRIED. In response to a question from Commissioner Piggee, City Attorney Bamburg related that the process to change the Land Use Map is multi-faceted task. He stated that the Commission would begin by looking at the nature of the land and then determine if modification is appropriate. He further related that a recommendation from the Planning Commission would be brought before the Council for vote to change the Land Use Map. He stated that if the Land Use Map were amended, then the petitioner would need to submit a rezoning request in compliance with that change. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. -7:35 P.M. Commissioner Hardwick requested that the petitioner of Lemac ·Drive be informed of requirements prior to the sale of lots for mobile homes. REQUEST TO APPROVE PLATS: a . Subdivision Phase IX PRELIMINARY PLAT Northlake Chairman Brannen read notes from City Engineer Reel saying that Northlake Subdivision Phase IX is a continuation of the subdivision and sketch plat and that utility plans have been approved. Mr. Bond related information regarding the location of the lots in Phase IX in relationship to Bucky Beaver, which was approved last spring. He then related that lots 333, 343 and 392 that are currently in the flood plain but would be brought out. Discussion ensued and Mr. Bond related that there are plans to build a lake in that area of the subdivision. Commissioner Piggee moved, seconded by Commissioner Wilborn to approve the Preliminary Plat of Northlake Phase IX with the "F" flood plain designation for lot 333, 343, and 392. MOTION ~IED. b. PRELIMINARY PLAT Deer Creek Subdivision Phase II Chairman Brannen related that the subdivision is located in Gravel Ridge, Pulaski County and the sewer is served by an improvement district for the Gravel Ridge area, water is served by North Pulaski County with street and drainage specification overseen by Pulaski County and will be maintained by Pulaski County. Discussion ensued that the preview of the Planning Commission is approval regarding the geometric design of the subdivision. Commission Wilborn moved, seconded by Commissioner Piggee to approve the Preliminary Plat of Deer Creek subdivision. MOTION CARRIED. Mr. Bond volunteered to serve as Chairman to the Committee in response to a request from Planning Commission Chairman Brannen and schedule a meeting promptly. Chairman Brannen opened the meeting at approximately 7:00 p.m. Commissioners present: Ken Nabors, Bart Gray, Lester Piggee, Dean Wilborn, John Hardwick, and Chairman Brannen. Others present for the meeting were City Attorney Bamburg, City Clerk Susan Davitt, City Engineer Reel, Patriot Reporter Peggy Koury. Discussion ensued as to the entire City of Jacksonville being designated as the "Overlay District" for affordable housing.which included definitions for manufactured or modular housing with the Sunnyside Addition being the target area. Commissioner Hardwick questioned the approval of a one lot AHOD if the entire City is AHOD. He stated that he would like to see Jacksonville eliminate new mobile homes as defined on page 275 in the City of Jacksonville. He clarified the intent for 14' wide mobile homes (single-section manufactured homes). City Engineer Reel concurred and stated an example of the deterioration of mobile home parks and problems with compliance. Commissioner Hardwick questioned if the City is subject to litigation regarding the current definition of modular homes and its zoning us R-4, when modular homes meets by definition City code for R-1. He noted that modular homes are not even allowable in an R-2 zoning. Discussion ensued and it was noted that modular homes are partially site-built homes, adding that other residential zones include by definition the terminology of "site-built". It was noted that modular homes have a site-built foundation and meets all criterion of site-built homes. Commissioner Hardwick stated that he has concerns regarding recent action by the Planning Commission regarding the rezoning of property to R-4, which does not meet the criteria as a mobile home park because it does not have at least three acres and asked for clarification regarding a manufactured mobile home subdivision. He further stated that he believes the City of Jacksonville should eliminate the ability of someone to locate a new single-wide mobile 1 OOOZ28 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. or manufactured home within the City. He suggested that the definition regarding modular homes be reconsidered. He questioned the need for specific zoning and definition regarding modular homes. City Attorney Bamburg offered that different zoning classifications could be created for mobile, manufactured and modular homes that could define and limit their use or placement. City Engineer Reel related that modular homes need to be classified separately from mobile or manufactured. Commissioner Hardwick questioned the criteria for a manufactured subdivision. City Engineer Reel stated that manufactured subdivision would involve double-wide manufactured homes. Commissioner Gray noted that the terminology of subdivision deals with the land and when termed manufactured subdivision it is land for the use of and installation of manufactured homes. City Attorney Bamburg offered that the definitions for manufactured, modular or mobile could designate the guidelines and restrictions regarding the land use map. Discussion ensued as to the recent rezoning and regulations for manufactured subdivisions as being that of a standard subdivision with setbacks, lot size and sidewalks. Other discussion ensued regarding the R-4 zoning and possible future owners and control of the property. City Engineer Reel related that regulations might keep a mobile home subdivision from becoming a mobile home park in the future. He then stated that Lemac Drive was a natural dividing point between the R-4 zoning leading to R-3 and then the residential on the north. He stated that he was surprised that the rezoning passed. He questioned if mobile homes are allowed on the north side of Lemac Drive where is the barrier from that to other residential. 2 000~29 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. Commissioner Gray stated that the land use map does not distinguish the different residential zonings, adding that the purview of the Planning Commission is to decide what forms of residential are best in good planning. He pointed out that the recent request for a commercial area in a residential was denied because it did not fit the land use plan. Discussion ensued concerning the land use plan and the possibility of changing the zoning to accommodate modular, manufactured and mobile. It was then stated that classification for 14' single-wide and 28' double-wide would need to be clearly defined. City Engineer Reel related that the National Planning Association provided information regarding a lawsuit filed by the Mobile Home Association and the Manufactured Home Association because a city had restricted the use of their product within certain residential areas and the Judge ruled that the city could not restrict that. He related that they presented their case under the premise that their vehicles meet all Code requirements of the Federal Housing Administration, the National Mobile Home Association Construction, adding that however it does not mention the Southern Building Code but they do meet all the criteria established by their association. It was then ruled that they could place a mobile home in any area reserved for residential. City Attorney Bamburg explained the background of the case could have affected its outcome, adding that it could depend on the wording of an ordinance. He offered that it is not known exactly why the Judge ruled the way he did, however he felt there could be standing cases that support making the designation within a zoning classification because of differences and distinction of the properties. Commissioner Hardwick stated that he would like to see classification for modular housing comparable with R-2. He said that separation of modular from mobile is necessary so that when zoning requests are addressed by the Planning Commission and R-4 zoning is approved it can only be developed as presented. He stated that currently if it is rezoned R-4, you have lost control beyond that. 3 000230 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. Commissioner Lester noted that "mobile" is the term used to define construction of manufactured housing built prior to 1976. Commissioner Hardwick stated that he does not feel that a single- wide manufactured home is equivalent to a modular home. He then stated that he is not against newer single-wide if properly underpinned and in a designated area. Discussion ensued regarding conditional uses for double-wide manufactured and the terminology of subdivision regarding sale of property and a permanent foundation. Commissioner Gray suggested that the bill of assurance could regulate single-wide or double-wide manufactured homes with a mandate of a permanent foundation. He said that with consideration of deterioration regarding mobile home parks the definition could include those newer than fifteen years, which would be a self- regulating method in a park situation and still allows for mobile home parks in the City. He stated that mobile home parks can be considered a way of saving land or banking land for future higher uses. He stated that the new residential zoning/manufacturing subdivision should carry a permanent foundation zoning requirment. City Attorney Bamburg clarified that a mobile home park would not carry permanent foundation requirements. City Engineer stated that mobile homes in a mobile home park need to be underpinned or skirted. Commissioner Gray stated that a mobile home park under one ownership could be required to fence, protect, and screen the park. He then related that the mobile homes should be required to underpin and properly tie down regarding protection and safety factors. He stated that this could be a natural responsibility of the park owner under City Code. City Engineer Reel offered that manufactured housing (double-wide) would have a solid foundation in a subdivision (classify the land with intention). Commissioner Gray stated all other zoning classifications outside that of a mobile home park would be subdivisions with permanent foundations. 4 OOO:Z.Z1 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. In further discussion, Commissioner Gray mentioned if modular homes, however they are classified, are allowed as a permitted use in R-1 through R-3. Commissioner Hardwick stated that "modular" is a gray area subject to litigation, mentioning that it did not exist when manufactured housing was conceived. Commissioner Gray offered the term multi-sectional or provide a form of minimum description which can eliminate the single-wide unit. Commissioner Hardwick stated that the current definition lends more to the foundation. Commissioner Lester pointed out that a modular home is constructed on a site-built foundation as opposed to the foundation used for mobile homes and even a double-wide on a "permanent" foundation could be moved. Commissioner Gray offered that his experience regarding a permanent Foundation is a solid perimeter wall foundation with VA or FHA requirement of a solid perimeter wall foundation which automatically requires under FHA/VA to remove the tongue and axles. He then related that there is a footing behind the permanent wall all of which makes it a site-built foundation. He clarified that the assumption is that it would be resting on and bolted to a solid wall foundation. Discussion ensued regarding the smaller lot size zoning requirements of R-1A and the zones that would allow a modular home or manufactured home. It was noted that the purpose of R-1A is a higher residential density and it was further noted that R-1 and R- 2 have the same lot size requirements. Discussion ensued that all setbacks be lowered to twenty-five feet in residential areas and it was noted that most cities carry a twenty-five foot setback for most interior street. Developing trends were discussed regarding the once necessary thirty-five foot setback. City Engineer Reel related negative feedback regarding housing on Northeastern that was granted a twenty-five foot setback. 5 000232 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. It was noted that certain streets would need the thirty-five foot setback. City Attorney Bamburg related that the ordinance process would begin with definition changes relating to recommendations as made to separate and classify. Discussion ensued that the designation for mobile home parks would be R-6 and change R-4 to accommodate either modular or manufactured and/or both. Other discussion ensued regarding two~story manufactured housing and a modular home located in the Foxwood Subdivision. It was noted by City Engineer Reel that in many cases a modular home is better constructed than a site-built home. He related that in talking with the manufacturers of modular homes they offered the removal of sheet rock walls to accommodate code inspections. He said that construction of a modular home has 2' by 4' entry walls, 2' by 6' exterior walls, 2' by 10' floor joist and 2' by 8' ceiling joist. He stated that price wise it is comparable to a stick-built home, adding that the only difference is the length of construction time. City Attorney Bamburg offered that he would prepar~ a rough draft of definition and the different zones/classifications for the next regularly scheduled Planning Commission meeting. It was again noted that the recent rezoning property of on Lemac Drive is not three acres and cannot be developed as a mobile home park. Discussion ensued regarding the mobile home subdivision on Pinion Lane. It was related that the land was subdivided and the lots were sold although some of the homes are not on permanent foundations. Commissioner Gray stated that a future requirement would be that they be placed on permanent foundation, noting that it is not a park but a subdivision. Commissioner Hardwick offered that if lots are assessed as real property it is not considered a mobile home park. 6 . I OCOZ33 CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING FEBRUARY 28, 2000 7:00 P.M. -8:15 P.M. Discussion ensued regarding the recent Planning seminar and Commissioner Hardwick offered that the territorial map be filed with the County because of litigation experienced by other cities after not filing. He further noted situations regarding proper subdivision requirements and current lawsuits filed by developers, explaining later requirements on developers regarding fencing as not previously laid out in subdivision requirements. He recommended requirements carry some leeway for the Planning Commission regarding aesthetics in subdivision developments. Commissioner Hardwick related that lot coverage was suggested in the seminar regarding commercial zoning. He questioned a subdivision requirement, adding that he feels it would be helpful to identify adjacent property. He suggested reviewing the land use map and the zoning map as a result of the new freeway. Chairman Gray mentioned the property near Foxwood owned by Jack Wilson, he then noted that while the land use plan depicts residential there is conflict if there were to be a request to develop as manufacturing. He then spoke in need of annexation, mentioning the Wooten Road area. City Engineer spoke of the need to annex the area between Pennpointe Subdivision and Bayou Meto (south of General Samuels). He related the need to present the annexation to the City Council. Discussion followed that the primary need for annexation is the southeast area of Jacksonville regarding the freeway and discussion ensued as to City service for the area and drainage problems. It was the general consensus of the Committee to continue work toward annexation of those areas. PUBLIC HEARING(S) REZONING of 1200 Lemac Drive from R-3 to R-4 Chairman Brannen related that the item of business has been referred back to the Planning Commission for additional information and consideration, noting that City Engineer Reel was absent from the February 14, 2000 public hearing regarding the rezoning. After being recognized by Chairman Brannen, Mr. Harold Crook read excerpts from the minutes of the City Council meeting referring the rezoning of 1200 Lemac Drive back to the Planning Commission. He requested that the item be approved and returned to City Council for Ordinance approval and not be opened as a public hearing. Chairman Brannen recognized Mr. Rick Hollingshead, who pointed out there was a number of area residents in attendance of the meeting who would not like to see the property developed as a mobile home park. He stated that the surrounding area is being developed as single family homes in an $85,000.00 range and that he would not like to see $12,000.00 mobile home moved into the area. City Engineer Reel stated that the property did not lend itself to mobile home park development because of the restriction regarding a minimum of three acres for that type of development. He said that if developed as an R-4 subdivision it would carry setbacks. Discussion ensued regarding the size of the tract of land and plat requirements for a subdivision. Mr. Crook agreed to develop the property as a mobile home subdivision and requested the item be returned to the City Council. Commissioner Hardwick asked Mr. Crook if his understanding of an R- 4 subdivision is that lots are to be sold not rented as in a mobile home park under one ownership. Commissioner Hardwick then questioned a sketch plat of the property and Mr. Crook stated that he had presented a sketch lot layout of the property at the February 14, 2000 pubic hearing. Commissioner Hardwick pointed out that a plat would show the placement for planned utilities with setbacks. Discussion ensued regarding final plat submittal to be present at a regularly scheduled meeting of the City Council. Mr. Crook stated concerns for financial aspects regarding proposed development of the property without approval from the Planning Commission prior to submittal of plats. Commissioner Corroum pointed out that while the underlying request was approved without opposition the Commission is now aware of opposition from residents of the neighborhood. Other Discussion ensued regarding an additional pubic hearing and the factor of opposition. 2 OCOZ.37 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MARCH 13, 2000 7:00 P.M. -7:35 P.M. Commissioner Lester moved, seconded by Commissioner Piggee to have Mr. Crook present the property in subdivision form. In response to a question from Commissioner Hardwick regarding single-wide and double-wide mobile home in a mobile home subdivision and making the structures permanent, City Engineer Reel clarified that a mobile home subdivision has minimum lot requirement of 60' X 100' or six thousand square feet. He stated the requirements of a preliminary plat and letters of acceptance from water and sewer to develop the property as a subdivision. Commissioner Lester moved, seconded by Commissioner Piggee to amend his motion to recommend to the City Council the rezoning of property located 1200 Lemac Drive from R-3 to R-4 with the stipulation that appropriate plats be submitted for development of the property as a mobile home subdivision. REQUEST TO APPROVE PLATS: SKETCH PLAT Goins Subdivision Chairman Brannen reviewed the recent history regarding a previous request to rezone the property for an R-4 mobile home subdivision. Petitioner Representative Tommy Bond related that the current zoning of the property is R-0 and the developer is now requesting an R-0 single family development. He stated the lot size would be 70 X 120 feet minimum. Discussion ensued regarding sewer capacity of the area as a major concern during the previous request as an R-4 development. Mr. Bond related that Ms. Thea Hughes, Wastewater Utility Manager and Mr. Larry Gattis a consulting engineer for the Wastewater Utility are present to address those concerns. Mr. Larry Gattis stated the pump station was replaced in 1993, but could not speak to changes since that time. He related that with the addition of pump stations, service can always be extended. City Engineer Reel stated that he has reviewed the sketch plat that is adjacent to a residential development and feels that preliminary plat approval is contingent on the completed capacity report from Mr. Gattis. He addressed traffic concerns saying that any development will affect traffic, however, he does not have any major impact concerns regarding the development. In response to a question from the Commission, City Engineer Reel related that the Fire Department has not reviewed the sketch plat but will do so by the final plat stage of development. Commissioner Hardwick requested that future sketch plat presentations included identification of surrounding areas. Mr. Bond responded that a sketch plat is a request for Planning Commission approval regarding the geometry of the property, adding that there is a better over view of the property including utilities in a preliminary plat presentation. He stated that the 40 acre development will consist of eight lots with public rights-of- way and easements for utility access and pointed out a separate fire protection system regarding the utility plan. He stated that the development will remain under one owner who will develop the property as demand presents. In response to question posed by Commissioner Gray, Mr. Bond related that the street being constructed between lots 3, 4 and 5 is necessary because the majority of access to the building will be from a street to the north of lot 5. Discussion ensued and it was noted that street ·layout and completion of the lots as presented is designed to generate traffic to Redmond Road instead of General Samuels since it is a· major street and Redmond Road to the north end has less traffic. Mr. Bond then related that the development would begin with lot 1 and continue one lot at a time, as demand requires. Commissioner Gray questioned if the development plan as presented should be considered a sketch plat following with lot 1 and the street as a preliminary plat. He related that under this proposal zero lot line development will be moved to R-4, creating R-5 for Modular Homes, R-6 for Manufactured Homes and R-7 will be Mobile Home Subdivisions and R-8 is Mobile Home Parks. He said that those zoning classification will be added to the zoning table providing for the minimums or the guidelines for each zone. In response to a query from Commissioner Hardwick, City Attorney Bamburg related that mobile homes prior to 1976 were not included for placement in mobile home parks because of non-compliance with HUD guidelines. Commissioner Hardwick suggested that the verbiage pertaining to the footings being "below the frost line" be added because of requirement for financing. Discussion ensued regarding the inclusion of footing requirements in the Southern Building Code, City Engineer Reel agreed that it should be added to the "Permanent Foundation" definition. Mr. Bond said there are State laws regarding specific requirements for the anchoring and tying down of manufactured and modular homes. City Attorney Bamburg suggested that those provision could be mimicked in the ordinance table for zoning requirements along with the requirement to underpin. He stated that there are no residents in the proposed west annexation. He related that Mayor Swaim has encouraged the annexation. City Attorney Bamburg related that to accomplish the annexations legal descriptions will need to be submitted to the City Council for acceptance following the Planning Commission recommendation. He related that it would then need to be filed with the County along with a request of position of adjoining governing agencies. He then related that North Little Rock services water up to the church located on the west side of the new overpass. In response to a question from Chairman Brannen, City Engineer Whisker related that the property is not located in the flood zone. Commissioner Hardwick suggested that the Sewer and Water Departments be contacted regarding utility considerations. Mr. Lowe related that a site survey has been conducted and sewer is available from Valentine Road where there is also a fireplug across the street as well as one located on Cloverdale Road. City Attorney Bamburg clarified that since the property is not zoned commercial and because it will be considered for annexation in some form either through the owner or as a part of proposed annexation considered by the City, the Planning Commission can extend a verbal acknowledgement of like or dislike regarding the sketch plat but suggested that the sketch plat not be given approval at this time even contingent upon rezoning or annexation. Commissioner Gray hypothesized that if the sketch plat were being considered at this time he would predominately be concerned about access off Valentine Road and the approximately 300 foot distance from major turns in the area. He questioned adjoining property belonging to Link Liquor Store and their access, adding that the area seems to consist of major turns off a busy highway. He then stated that for that reason it should be considered for development as commercial, but added concern for preventing too many quick turns. He stated that Phase II consist of five (5) lots in a culdesac, one hundred feet of sewer and three hundred feet of water line. He stated that the pump station is north off Main Street approximately five to six hundred feet before the Subdivision begins. He said that the property is in the flood plain and the actual house sites will be raised above the flood plain. He related that the flood plain is a result of backwater from Bayou Meto. He stated that the lots will be platted with the "?' designation and a LOMA (Letter of Map Amendment) from FHMA will be requested to remove the house site from the flood plain. Discussion ensued regarding a question from Chairman Brannen pertaining to sidewalk requirements in u culdcsuc und the possible requirement regarding Main Street. In response to a question from Commissioner Hardwick, Mr. Bond related a distance of 300 feet between curb cuts. It was noted that a culdesac with less than 20 homes would not carry a requirement for sidewalk construction. Mr. Bond clarified that there would not be a requirement unless there is one for the small area regarding Main Street, adding that if the Master Sidewalk Plan has requirements for Main Street the developer will comply. 1 000~62 CITY OF JACKSONVILLE I ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 2000 7:00 P.M. -8:10 P.M. Discussion ensued regarding the radius of culdesac construction and Mr. Bond related the construction of a paved 47.5 feet radius plus allowing for a ten-foot easement behind a hundred-foot radius. He stated that the paved 47.5 feet complies with the Fire Department's radius requirement regarding their largest truck. City Engineer Whisker related that the plat was presented to the Planning Commission approximately two years previously, adding that the developer complied with the request for a sixty-foot radius and no curb cuts onto Main Street. He stated that the water and sewer have been reviewed. Mr. Bond noted that there is a 24" waterline located on the south side of Main Street, adding that the sewer runs down the east property line of the development. Commissioner Gray said that it was his understanding there would be no driveway access onto Main Street and that he felt it should be included in the bill of assurance, adding that anybody who would approve the building permit should be aware of that stipulation. Mr. Bond assured the Commission that it would be covered in the bill of assurance, but would only concern lot 48F regarding Main Street access. Commissioner Hardwick stated that the street appears to be closer than regulation permits to the intersection, but added that as a five lot plat it probably would not be a problem. Commissioner Gray questioned if the developer would be willing to place a sidewalk to Fair Oaks Drive in addition to the requirement of lot 48F. Chairman Brannen questioned setbacks of 35 feet in the culdesac for R-1. Mr. Bond responded that the plat depicts 30 foot setbacks but he would comply with 35 feet if desired by the Planning Commission. He then stated that typically on some culdesac lots the setback is 25 feet. Commissioner Gray recommended that setbacks be approved as submitted on the preliminary plat, granting a setback waiver. SKETCH PLAT Maddox Road & Pridmore Lane Mr. Tommy Bond related the plat is being resubmitted with a variation of lot size. He related that the lots are approximately ~ acres with the exception of lot 1 belonging to the developer. He stated that the subdivision consists of 48 lots and is located outside the City limits. He related that lots located in the eastern portion of the development are located in the flood plain as best can be determined, explaining that the flood elevation has not yet been established in this area of the County. He then said that North First Street was established at 2 60, which is less than ~ mile east of the development. He then related that he has interpolated the flood plain as being 262 for the proposed development. He related that fire protection concerns had encumbered previous plans, explaining that the City of Cabot has bid a new water system & supply and have notified Jacksonville Water Commission that in six-months they will no longer require water from Jacksonville. He stated that the problem with serving the area is the fifteen hundred gallons supplied to Cabot from the water line along the freeway. He pointed out that when that fifteen hundred gallons is no longer used by Cabot there will be an ample water for the area as well as other areas. He related that fire protection was a major concern in previous discussions regarding annexation into the City of Jacksonville. He related that Mayor Swaim expressed concerns in not wanting the fire rating endangered by an area that would not meet code. He stated that the owner would like to have the subdivision annexed at this time. He reiterated that the Mayor and Fire Chief's concern regarding the water flow being less than a thousand gallons a minute. He stated that North Pulaski Water Users Association is currently serving the area and has a water line on Pridmore Lane, Maddox Road. He pointed out the location of a six-inch water line close to the development which has been tested in the past only getting about close to 700 hundred gallons a minute. He stated that desirable is 1000 gallons a minute in a residential area. In response to a question posed by Chairman Brannen, Mr. Bond related that the area is three to four thousand feet south from the AICUZ zone. He stated that the LRAFB representatives reviewed the property in the past and did not express concerns for a residential development. Mr. Dennis Sobba, Chairman for the Commission of North Pulaski, expressed concerns regarding the septic system. He stated concerns for approval unless the property is annexed. He pointed out that there is a 3-inch water line serving Pridmore Lane that could be collapsed. Commissioner Gray clarified that we need access to additional water supply than the current three-inch water supply serving the area. So we actually need service from Jacksonville versus North Pulaski Water for it to handle this many houses in this area. Mr. Sobba retorted that the only way this could fly is if it were annexed and when I talked to Mayor Swaim before he was not interested in annexation if it would jeopardize the fire rating. City Engineer Whisker stated that he is aware of the concerns being stated, adding that the County does not want this particular subdivision on their water line. In response to a question from Commissioner Hardwick, Mr. Bond related that the development is planned to have Jacksonville Sewer. Commissioner Gray stated that he believes the property needs to be annexed and services provided by the City of Jacksonville. He related that the subdivision was originally planned for Jacksonville utilities and that from the sketch plat it looks to make a beautiful subdivision. He pointed out that the right-of-way to Madden Road should be incorporated into the next part of the planning process. He stated that it is a high priority in the preliminary plans to incorporate that easement into a finished road. 4 cOOZ65 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 2000 7 :00 P.M. -8:10 P.M. Mr. Bond said that preliminary plans would provide more details regarding the utilities, storm drainage, and flood plain. He related that mainly the sketch plat is being presented for geometry approval. He then added that a survey was made and the City Engineer has received what areas would be affected in the flood plain. In response to a question from Commission Hardwick, Mr. Bond related that this area has not been defined in the FHMA study as to the elevation of flood. He then related that he has arbitrarily made an assumption that it would be two foot higher than elevation shown about ~ of a mile to the east in Jacksonville. He explained that the area is effected by backwater from Bayou Meto. Discussion ensued as to positions regarding annexation and City services of the area. Mr. Bond related that discussion regarding annexation occurred prior to the annexation of the Air Base property, which provided for a continuous property situation. He stated that the City limits is now adjacent to the property. He stated that he did not believe the water would be a current concern and will be determined by hydraulic information that would be returned to the Planning Commission for review. He stated that the developer wants to use City water and will provide fire hydrants. Commissioner Hardwick moved, seconded by Commissioner Piggee that the developer receive a verbal approval regarding the layout, but that plat approval be tabled until the property is either annexed and/ or City services can be provided. MOTION CARRIED. d. SITE PLAN Chapel Ridge Mr. Bond introduced Mr. Paul Hill designing archi teet, to address questions regarding general layout. He stated that he is looking for input from the Planning Commission, adding that the project is not yet ready for a building permit. He said that the complete and final plans are not ready yet. He stated that they are looking for geometry and layout approval before final plans are presented. Mr. Hill related t hat ERC Properties is the owner and developer of the property. Discussion ensued regarding plans for the retention pond and consideration for Fire Department equipment. Mr. Hill related that it would be the main entrance and related the possibility of an entrance coming off Woodbriar Drive if that is acceptable to the City and the neighborhood. He related that if a second phase is constructed then the parking would loop through with only one dead end to the northeast boundary. He presented the Commission with floor plan elevations for an idea of the scale of the buildings. In response to a question posed by Chairman Brannen, Mr. Hill related that there is 8 60 feet proposed from the entrance to the culdesac if a phase II is not proposed. Chairman Brannen noted that if phase II is not proposed then the development may require a culdesac length waiver. Mr. Bond related that the drive and all utilities would be a private with the exception of water. He stated that the sewer line runs along the east property line allowing for service lines which will not be maintained by the City. He stated that the water line will require an recorded easement for maintenance access. He stated that the development will have fire hydrants, adding that it is typically best for the City to have ownership so that they are properly maintained. It was noted that the Fire Chief would review those plans later in the stage of development. In response to a question from Commissioner Corroum, Mr. Hill related that every ground floor apartment entry is on the accessible route and the entire complex is fully wheel chair accessible with paths for any unit and handicap parking. REQUEST TO APPROVE BUILDING PERMITS: REQUEST/STREET OR ALLEY CLOSING: 6 0002~1 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 2000 7:00 P.M. -8:10 P.M. GENERAL: a. Manufactured Home Standards Draft Ordinance City Attorney Bamburg stated that he developed the draft ordinance taking all the information from the Manufactured Homes Association and combined it with the existing ordinances. He related that some of the code designations have shifted to remain consistent in zoning classifications. He highlighted the definitions and the re- establishment of zoning classifications. He stated that in sections three through five modular homes are listed as approved conditional uses in the zone classifications of R-lA, R-2, and R-3. He stated that in renaming zones and districts the zero lot-line was included. He stated that section seven creates a modular home district/subdivision and section eight covers a manufactured housing subdivision, adding that it addresses a manufactured housing park, making a distinction between the two. He stated that he did not included the uses of manufactured homes in various zone classifications for conditional uses which may be something that the Commission may want to consider. He suggested that the Commission review for discussion at the next regularly scheduled Planning Commission meeting. City Engineer Whisker stated that the existing zoning map will change with new zoning classifications. City Attorney Bamburg asked that the Commission recognized that passage would change not only the Official Zoning Map but also the Land Use Map to remain in compliance with State law. He stated that chart 18. 68 regarding minimum requirements will be changed and is included in the draft ordinance. It was the general consensus of the Planning Commission to continue discussion at the next regularly scheduled Planning Commission meeting in August. b. Metroplan 2025 Briefing Chairman Brannen related that the briefing is postponed until further notice. DEVIATION IN AGENDA: a. REPLAT of Lots adjacent to the Lake in Northlake Subdivision Mr. Bond related that the developer Mr. Tommy Dupree built the lake in Northlake and has always intended to transfer ownership to the property owners association. He stated that there are little pieces of ground between the lake and each lot without utili ties in the floodplain that were not included as part of the adjacent lot so that the lots would not be encumbered with a flood statement. 7 000268 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 10, 2000 7:00 P.M. -8:10 P.M. Commissioner Gray questioned maintaining a separate piece of property rather than use a LOMA . Mr. Bond stated that when the new FHMA was issued neglected to include all the LOMA's that had previously by FHMA. He related that in essence it did away with which created confusion given efforts over the years. that LOMA's had to be resubmitted by the City Engineer. in 1995 it been issued the LOMA' s, He stated Commissioner Hardwick questioned why the developer had not included this property in the lake. He also noted that Fair Oaks property owners are receiving two tax bills and questioned how the property owners of Northlake would feel about receiving a second tax bill for the small strip of land. Mr. Bond stated he was unaware of that and that theoretically the value of the second parcel is zero. He stated that there should be almost no tax. He noted that Fair Oaks was designed to completely take FHMA out of the picture for the home lots. Chairman Brannen questioned responsibility for the restriction of building in the floodplain. Mr. Bond stated that it would be included in the Bill of Assurance and it would be up to the adjoining property owners. In response to a question related that separate deeds adjacent to the lake. from Commissioner would be issued Corroum, Mr. to property Bond owner Commissioner Corroum concurred with Commission Hardwick in questioning the simplicity of extending the boundaries of the lake. Mr. Bond stated that Mr. Dupree and the property owners have agreed to the proposed arrangement, adding that the property owners wanted to have control down to the water's edge behind their lot. Discussion ensued and it was related that Mr. Dupree's intention is to transfer the lake property to the owners association. Commissioner Hardwick suggested that the City Attorney research the authority of the Planning Commission to decree that the parcel will transfer to the adjacent lot. He cited the reverse of eminent domain. Commissioner Hardwick said that it is understandable why the property owners want to control the property, but added that he is not sure the Planning Commission has the authority. Mr. Bond stated that theoretically they could write deed to transfer. City Attorney Bamburg stated that ownership deed transfers could come from Mr. Dupree as the Grantor, not from the Commission. Mr. Bond explained that the desire to have the revision filed as a plat, adding that the final plat would need to be signed by the Planning Commission Chairman. He stated that it is more of a lot- split rather than a subdivision, adding that under Planning Commission regulations the Chairman and the City Engineer could approve it for signing. He stated that given the complication of the matter he has brought it before the Commission to address any concerns. He stated that all property owners on the lake will receive the property behind their house with a deed and that there will be a Bill of Assurance restricting that transfer with that lot. He stated that the main point is control of the property by the lot owner. Commissioner Gray pointed out that the terminology of lot carries minimum requirements and suggested that the property not be referred to as a lot but as a non-notable truct. He stated that the term lot infers housing ability. He pointed out that it is more of a subdivision of tracts to adjoin a lot and that change in reference might clear future inquiries. He went on to say that the Bill of Assurance will not allow fences or structures built closer than seven ( 7) feet to the adjacent property line. He related that it has been changed from a replat to a Tract Plat. Discussion ensued and it was noted that the tracts are located in the flood plain and carry the "F" designation. City Attorney Bamburg requested that the Bill of Assurance address the property covenants regarding no split of ownership from adjacent Lake Tracts. Mr. Bond said it could be added to the Bill of Assurance and then related that one property owner with approximately ten ( 10) feet of Lake Frontage did not want the additional tract and it was decided that it would to be deeded to a neighbor. He stated that the property has all improvements mentioning water, sewer, street, and street cuts. It was noted that the setback is fifty (50) feet for C-3. In response to a concern voiced by Commissioner Gray, Mr. Bond related that the 30-foot easement leading to the rear of the property is currently used by a mobile home park but is not planned to be a public street. He then stated that the owner of the auto parts store and Mr. Wilson will have an agreement regarding joint use of the easement area providing one driveway for the mobile home park and the auto parts store. He stated that the auto parts store would be located on lot 1. Discussion ensued and it was noted that the development for lot 1 would have a driveway onto North First Street. He then stated that a street cut already exists, mentioning the driveway to the residence. City Engineer Whisker related that the existing st~eet cut at the north end of the property could serve as a shared access between the two commercial properties with access to the mobile home park and the residence. He then mentioned shared access points regarding median considerations. Commissioner Gray questioned if the lot next to the easement will be a dedicated entrance to the highway. Mr. Bond noted that they are showing one on the site plan. Commissioner Gray stated that preliminary plat presentation is the time for it to be addressed, adding consideration for a joint access especially if the easement is allowed as another turning point. He cautioned that there would be three turning points in too short a distance, adding that it might better serve future owners and development to have a joint entrance and another entrance for the auto parts store which is projected off the easement. 3 ; I CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 2000 7:00 P.M. -8:10 P.M. Mr. Bond agreed, saying that at this stage of planning it could be directed by the Commission. He noted that the existing drive is very close to the property line. City Engineer Whisker related that plans would also have to be presented to the Arkansas Highway Department because the entrance is located on a State highway. Commissioner Gray added that even if the Highway Department allowed the access it would be better direction from the Planning Commission to recommend a plat re-draw showing one common entrance for lots one and two shared. Mr. Bond responded that he did not think it would be a problem. Discussion ensued as to the location of entrances for the auto parts store and access for the mobile home park. Mr. Bond related that between Mr. Goodsell's property and the Kroger store there would be three driveways, one being the existing alley, two being the one just discussed and the third being for the mobile home park. He stated that all exist now adding that what is being said is that there would not be any new ones. Commissioner Gray agreed, saying that a C-3 type business operation might generate traffic which will create more turns and as such now is the time to address it in a safe and efficient manner. PRELIMINARY & FINAL PLAT Lots 26, 27, & 28 Jordan Acres Subdivision Representative Duane Reel related that the plat consists of additional property acquired adjacent to property that was submitted as a preliminary plat of lots l through 25 of Jordan Acres Subdivision in November 1998. He stated that the developers acquired lot 28 from Lucille Pate and a piece of ground between their property and Military Road suitable to make two additional lots. He stated that the lots were continuously numbered and the developer is submitting a preliminary and final plat. He related that the lots are 60 x 17 5 foot and are not part of the original rezoning request, adding that the lots are still R-1, whereas the subdivision rezoning request was for R-1A. It was noted that there is a house under construction on lot 28 and that the lots are not located in the flood zone. ADDITION TO AGENDA: SITE PLAN Chapel Ridge Apartments (Military Road) Consensus of the Planning Commission was to hear the i tern of business. Representative Tommy Bond pointed out that the site plan was slightly amended, and now depicts a larger radius at the parking lot end along with the addition of a fire hydrant to the water plan. He related that the water line will be extended to the property line adjacent to the ditch for future extension/connection by the Water Department. He stated that the developer does not own the 3.2 acres adjacent to his property. 5 000:2.77 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 2000 7:00 P.M. -8:10 P.M. He stated that there could be a different plan for the adjacent property to the west. He related that City Engineer Whisker had requested that the 200-foot area from the box culvert location to the end of the existing concrete line ditch be paved. He stated that all issues regarding water, sewer, storm drainage, and Fire Department have been addressed. In response to a question from Chairman Brannen, Mr. Bond related that there was a zoning hearing regarding the property two months previously. Commissioner Gray noted that the property has had no zoning issues, adding that the a conditional use was permitted to build under R-3 requirements. He related that it is to build under R-3 requirements for multi-family housing in a commercial zone. Chairman Brannen questioned if the site plan is to be considered as a sketch plat. Mr. Bond stated that the site plan will be the final approval for a building permit. Chairman Brannen questioned front yard setbacks. Mr. Bond stated that he did not feel building setbacks would come into play, adding that the first building has a 62.87 feet setback from Military Road, which complies with this type of development. He said that a plat will be filed which will be for easement purposes regarding water and sewer, adding that all the sewer lines will be private. He related that the public sewer surrounds it on three sides so the lines that serve the buildings will be service lines that belong to the facility. He then stated that the City will not maintain those lines and that the only other public utility is the water line. He related that a right of access regarding maintenance will be given to the Water Department. He said that there will be a plat which records the street and easement for the waterline, pointing out similar situations regarding Pathfinders and the senior domicile, regarding submittal of a plat that records the easements for public access for the maintenance of water and sewer lines and any other utility that may need an easement recorded. REQUEST/STREET OR ALLEY CLOSING: GENERAL: RECOMMENDATION for Draft Ordinance/Manufactured Home Standards In response to a question from Commissioner Hardwick, City Attorney Bamburg stated, that a singlewide built after 1976 is referred to as a singlewide manufactured home. Discussion ensued regarding two or more sections and City Attorney Bamburg related that a mobile home built __ prior to 1974 is transportable in one section, and that the term manufactured should apply to one or more sections. Commissioner Hardwick asked for clarification regarding minimum square footage concerning length and width. City Attorney Bamburg related that minimum square footage applies to when erected on site. He added that he understood the regulations to mean nothing smaller than 320 square feet. It was then noted that the 320 square foot minimum does not relate to the 12' or 40' requirement. Discussion continued regarding year model and transportable size and City Attorney Bamburg offered that that the wording be spelled out specifically regarding the date. He stated that a reference to the June 15, 197 6 effective date of manufactured housing code in the beginning portion of the definition for a structure constructed transportable to clarify the issue. 7 000279 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 2000 7:00 P.M. -8:10 P.M. City Engineer Whisker stated that it sets better guidelines for what the City allows in those zones. City Attorney Bamburg offered that between the word "structure" and "transportable" the language "constructed after June 15, 1976 and in compliance with the Federal Manufactured Housing construction safety standards act, transportable in one or more sections which in traveling mode are 12 feet or more in width, 40 feet or more in length, or when erected on site has a minimum 320 interior square feet" be interjected. The Commission agreed to the new wording. Commissioner Gray questioned the difference regarding the requirement of a 96" fence and the 60" fence in section six, under location of an accessory building, JMC 18.36.140. City Attorney Bamburg related that he had assumed that there is a distinction based on fencing for animals versus a decorative fence. He added that the section was already a part of the Codebook. Commissioner Hardwick stated that his understanding is that a 60" fence is allowable from the back of the building to the front setback line and a 96" fence from the back of the building to the back setback. City Attorney Bamburg agreed, saying that it is the current requirement regarding the Code. Commissioner Hardwick further explained that a 96" fence is allowable from the back of your house on the side property lines but if you come from the back of the house up to the front setback line it can only be 60" tall. Mr. Bond offered that the 96" fence may be erected on any boundary of the "enside" lot, adding that he felt the Code to be addressing "end side" lot lines as opposed to "inside". He then added that it was a typographical error, and that there is no such thing as an "ens ide" lot line. He said he thought is was mean to address lot lines between lots as opposed to the outside which would be at the end of the subdivision or at a corner lot. Commissioner Gray agreed with Commissioner Hardwick that it means any line parallel to the back of the house, and that fencing constructed from the rear of the house forward had to be shorter. 8 000280 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 14, 2000 7:00 P.M. -8:10 P.M. Mr. Bond added that it was a consideration regarding site distance for vehicles. City Attorney Bamburg reminded that these provisions are part of the zero lot line, one family district requirements and in the Codebook it does say "end" . Discussion ensued regarding clarification regarding zero lot line considerations and it was noted that the fence requirement is correct for a zero lot line zone. Commissioner Gray noted that back yard fences can be eight-foot while any front yard fence would be five-foot with no greater extension than the front building line. Mr. Bond said that it would not be a continuous fence it could only go from the back of the building to the rear and the same for the front of the building. Discussion ensued regarding presentation to the City Council and City Engineer Whisker questioned the location of the new areas created. City Attorney Bamburg stated that part of the provisions in the Ordinance re-labels or corrects the land use map and the zoning maps. City Engineer Whisker questioned the labeling for a mobile home park that is currently not zoned as a mobile home park, but was grandfathered. City Attorney Bamburg said that if it is grandfathered it would be placed in the appropriate classification, adding that if it is not zoned for other reasons it would not be reclassified because no action had been taken. City Engineer Whisker questioned if there is any modular home zones currently in the City, and City Attorney Bamburg stated that he was not aware of any. Commissioner Gray noted that under the draft ordinance a modular home can be placed in an R-lA. City Attorney Bamburg clarified that that the only provision addresses modular in an R-lA zone as a permitted conditional use. Discussion ensued regarding presentation time to the City Council and Commissioner Gray said that it might be in the best interest to review actual zone classifications on a map prior to sending it to the City Council. It was the general consensus that it would be presented to the Planning Commission again before going to the City Council for final approval. Commissioner Hardwick noted the task of redrafting the Plan to include the new zones because the map refers master plan. Master to the Commissioner Gray pointed out that the Master Plan probably needs redrafting anyway, but the Master Plan does not designate between residential areas. He stated that the draft ordinance is further classification of those residential areas; with the exception of the area City Engineer Whisker was referring to changing from a C-2 to the appropriate zone. ANNEXATION UPDATE: Discussion ensued regarding annexation considerations recommended to the City Council regarding the south and west area adjacent to the City Limits of Jacksonville. Conditional use of 1912 McArthur as a Daycare Facility Chairman Brannen opened the public hearing at approximately 7:12 p.m. Ms. Cara Walloch related that she purchased the property and daycare center which is operating under a conditional use granted to the previous owner, she explained that she would like to continue the same operation as a daycare at that location. With no one to speak in opposition, Chairman Brannen closed the public hearing at approximately 7:12 p.m. Chairman Brannen explained that a conditional use is granted to an individual such as the property owner and is not transferable upon sale of the property. Side yard setback Variance/624 Brookhaven Court Chairman Brannen opened the public hearing at approximately 7:15 p.m. and read from notes provided from the City Engineer stating that "the backyard access will continue to be available on the opposite side of the residence. The side fence runs from the front yard to the back of the property on the garage extension side. The proposed eighteen (18) foot garage, as measured on the ground, by the owner is approximately five ( 5) feet from the property line." 2 OOOZ85 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPTEMBER 11, 2000 7:00 P.M. -7:35 P.M. Mr. Kenneth Garnsey, the property owner, related that there was a difference regarding calculation in footage from the drawing and actual ground approximation. He stated that he is proposing a garage 26-feet in length and 19-feet in width, which is by actual measurement 1.3 feet from the property line. He stated that he will still require a four-foot variance. Chairman Brannen questioned the City Engineer's estimate of a five foot setback from the property line and Mr. Garnsey related that the original footage on paper was thought to be less than five feet from the property line but actual measurement revealed that it was greater than five foot from the property line. He related that he hired a surveyor who determined that the footage was not figured by original scale, adding that dimensions for the garage were changed from 20' X 18' to 26' X 19'. He explained that he increased the measurements to accommodate a large truck he owns. In response to a question from Chairman Brannen, Mr. Garnsey stated that foundation work has not yet begun, explaining that he would add 9 feet of concrete to an existing carport drive for the foundation. Discussion ensued regarding overhang of the roofline. REQUEST TO APPROVE BUILDING PERMITS: a. 3505 North First Street Chairman Brannen stated that as per City Engineer Whisker the property was originally zoned to be in the Taneyville Subdivision as lot 22 & 23, but was never developed. He pointed out that the driveway is proposed off Shane Drive, which according to paperwork, is a dedicated street that is an unimproved, gravel street. 3 OOOZ8G CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPTEMBER 11, 2000 7:00 P.M. -7:35 P.M. In response to a question from Commissioner Hardwick, Mr. E. Ray Smith stated that he owns an additional two-acres adjacent to the property proposed for a metes and bounds building permit. He stated that the property measures 556 feet from North First Street. He related that he is seeking a building permit for a portion of the property that fronts North First for his personal residence. Commissioner Hardwick questioned the development plans for the additional acreage. Commissioner Gray then questioned if the intent is to plot as a subdivision regarding consideration for the additional property. He pointed out that in the process of a metes and bounds building permit the property would actually be subdivided. Mr. Smith agreed. Commissioner Gray established that the eleven-foot gravel drive is the proposed entrance, saying that in addressing a metes and bounds building permit it must be determined if there is an effective subdivision. He related that a metes and bounds permit is appropriate when the land is transferred in that manner, such as a tract of land owned by one person for home development. He then stated that on other occasions involving tracts of five- acres or less it must be determined if the property needs to be platted as a subdivision. He pointed out that the property lends itself to a subdivision development requiring the Planning Commission to include fulfillment of a subdivision. He mentioned attributes regarding streets, curbs, and gutters for street improvement. He noted that the proposed development does not include the driveway. Mr. Smith stated that the driveway has been dedicated to the City as a forty to fifty foot street. Commissioner Gray questioned if the dedicated property is an access easement or a drive, noting a difference in the two. Discussion ensued and Mr. Smith stated that the City owns the drive. Commissioner Gray pointed out that the City should not be required to build a street for access to that acreage or the adjoining acreage. In response to a question from Commissioner Hardwick, Mr. Smith replied that he is proposing a small orchard and garden for the property adjacent to his residence. Commissioner Hardwick question if there is any reason not to include all the property in the metes and bounds building permit request to insure that there would not be other homes developed. He stated that there is concern that it would become a subdivision with street considerations to provide access to additional homes. Mr. Smith stated that in ten or fifteen years he could not say what may happen, adding that he would rather not include the additional property to the metes and bounds building permit request. He explained that he gave the property owners directly across the street a fifteen-foot easement for sewer in exchange she dedicated the street. He related that at that time he and the City Engineer discussed what would be required to get a building permit and he was told he could get a building permit. Commissioner Gray pointed out that if his objective is to obtain a building permit then it will not hinder that to include all the property in a one-lot plat. In addition, he stated that if Mr. Smith wanted to subdivide at some point in the future then he could do so. He related that for the time being it would serve the same purpose if the entire acreage is included in the building permit request. Mr. Smith questioned the impact regarding his taxes, saying that it is in acreage right now and that if it is put with the lot then he would have to pay all of it as a lot instead of part acreage. Commissioner Gray stated that tax issues would have to be addressed by the assessor, assuming the assessor is going to address this as one house and one lot, instead of one house on a lot and an extra tract with two tax bills it can be included all on one tax bill. He related that if later Mr. Smith decides to propose something different he can bring it back to the Planning Commission at that time to help work through it. Mr. Smith reiterated that this is not what he understood when he made a deal with the City Engineer and was told he could build. Mr. Smith stated that he has a copy of the dedication paperwork, but did not bring it for the meeting. He related that the former City Engineer signed it and surveyed it out. Commissioner Gray stated that it would be difficult for him to vote for a metes and bounds building permit on land that is being subdivided without a true plat. He added that he is not opposed to the development but the subdivision. Commissioner Lester requested additional information from the City Engineer regarding impact to the City before voting. He stated that he does not feel that he is in a position to vote at this time without the City Engineer being present to explain or answer questions. He stated that the Planning Commission had approved a 3-foot side yard variance, 8-foot rear yard variance, and a parking waiver. City Engineer Whisker related that the property is not located in the flood plain, adding that it is adjacent to Main Street with an access point of 300 feet from the intersection of Redmond Road. He stated that he believed the Fire Marshall has reviewed most of the plans and is requesting that approval be contingent on acceptance from the Fire Marshall and himself. It was noted that the Pire Marshall has reviewed the plans and a letter would be forthcoming. PRELIMINARY PLAT and PROPOSED ANNEXATION/Oak Ridge Ranch Subdivision Mr. Tommy Bond stated that there is no requested action for the plat or proposed annexation, but is being presented as an informational item for discussion before the annexation procedure begins. He related that the lots adjacent to Maddox Road has a church on lot 5, which is adjacent to a residence on lot 4. He then related that lot 3 is vacant and lots 2, 17, ,18, 19, have homes. He stated that he has visited each of the homes and left information regarding the annexation and asking for a response. He related the effort to include everyone that might want to be annexed into the City. He stated that without response from the homeowners they are proposing annexation of the development and the access road leading into it. He reiterated that the developer wanted to offer the Planning Commission an opportunity for input. He then relate that the Taneyville feed store owner does not want to participate in annexation into the City. Commissioner Gray explained that part of the annexation process is a request from the property owner to be annexed followed with an overview and recommendation from the Planning Commission to the City Council regarding the annexation request, adding that the City Council will forward the request to the County Judge and Quorum Court for acceptance regarding withdrawal from the County. He related that in review of the proposed subdivision, the Planning Commission felt the development should be annexed into the City. He mentioned developer cost regarding infrastructure of water and sewer. He then stated that the annexation would be good for the future development of Jacksonville. 4 000006 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. -7:40 P.M. Mr. Bond agreed, saying this is the reason it has been brought before the Planning Commission for review regarding thoughts and suggestions. He related that the mobile home park on Maddox Road had not been contacted regarding annexation efforts, but all other adjoining property owners except owners of the vacant lots were contacted. He stated that the process will take approximately sixty-days regarding public notices and County considerations. Commissioner Gray stated that one question he would have involves adequate infrastructure, saying that as the process for annexation is worked through and development ensues part of the issue would be to make sure infrastructure for the subdivision and any future demands could be met. He pointed out future neighbors preferring to have City utilities. Discussion ensued and Mr. Bond stated that annexation could be requested by property owner or proposed by the City. He related that the driving force would be desired utilities, police and fire protection. He stated in his conversations with some of the property owners of the area there were mixed feelings, adding that the one property owner indicated that he did not want to be annexed into Jacksonville, and another property owner was interested mainly for the significant difference in fire insurance. Commissioner Hardwick noted that while thP. propP.rt.y l s l n the AICUZ zone, it is not in one of the clear zones and does not adversely affect the operations of the Air Force Base regarding density factors. Mr. Bond agreed, stating that the developer has met with Air Base Engineers as previously requested by the Planning Commission. Commissioner Hardwick voiced his support of the annexation, but questioned if the annexation would adversely effect the City's fire rating. Mr. Bond related that water flow issues are being resolved. He stated that he met with the Water Commission regarding a new analysis. He explained one problem has been that Cabot uses approximately 14 hundred gallons a minutes on a 3ixtccn inch line along Hwy 67. He related that Cabot's demand lowers the area rating. He related that the flow is at 600 but needs to be at 1000. He stated that Cabot is going off line in six to nine months which should resolve some water issues, adding that then a new hydraulic model will be run showing that demand removed. 5 r J ODOD07 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. -7:40 P.M. Commissioner Hardwick question responsibility of the developer to incur the cost of a stand pipe if the water pressure was not adequate, to raise the rating for the City. Mr. Bond stated that all issues would be addressed next month with the final/preliminary plat that will indicate the final design regarding water, sewer, streets, and storm drainage. City Engineer Whisker stated that the only adversity he observed is that a portion of the northern property is located in the flood plain. Mr. Bond stated that there are 12 lots that are shown to be in the flood plain. He explained that he may have estimated the flood plain elevation too high, because it is not determined for that area. He said that he took Jacksonville's flood plain elevation from North First Street and raised it one-foot. In response to a question from Chairman Brannen, Mr. Bond stated that the access road will be the connection to Jacksonville City Limits, adding that it is hoped that some of those residence will want to be a part of the annexation. He then stated that Maddox Road would become a part of the City street system, pointing out the similar situation to Loop Road regarding parts of the street which is included in the City street system. Discussion ensued and it was determined that recommendation to the City Council would follow when specifics are worked through. Commissioner Hardwick suggested that the developer meet with the Fire Chief regarding water pressure concerns and any effect the annexation may have on the City's fire rating. Mr. Bond stated that the information would be included on the preliminary plat. b. FINAL PLAT: JORDAN ACRES/Lots 1 through 25 Mr. Duane Reel representative for Jordan Acres development stated that the final plat is identical to the preliminary plat presented August 1998. He related that the developers are requesting approval with the stipulation that it not be presented to the City Council until the streets are completed and accepted by the City Engineer. MOTION CARRIED . PUBLIC HEARING(S) a. CONDITIONAL USE for an auto repair shop/lots 8, 9, 10, & 11, Block 6, Crestview Addition. Chairman Brannen opened the public hearing at approximately 7:06 p.m. Mr. Ben Rice explained that his client would like to operate an dulo repair and tire service shop on the property located directly across the street from the First Presbyterian Church on Main Street. He stated that the auto service shop would be a well-recognized franchise and that the area would be good for this type of operation. With no one to speak in opposition, Chairman Brannen closed the public hearing at approximately 7:10p.m. Commissioner Lester moved, seconded by Commissioner Wilborn to grant a Conditional Use for the operation of an auto repair shop at lots 8, 9, 10 & 11, Block 6, Crestview Addition. Discussion ensued as to the request being granted either to the property owner or for a specified length of time. Mr. Rice related that he has an option to purchase the property on behalf of his client who wishes to be undisclosed, adding for that reason he would prefer it be granted on basis of time. 1 r I 0000:11. Following clarification from City Attorney Bamburg regarding identity disclosure, the following motion was accepted. Commissioner Lester moved, seconded by Commissioner Wilborn to grant a Conditional Use for the operation of an auto repair shop at lots 8, 9, 10 & 11, Block 6, Crestview Addition and to amend the motion to include that the Conditional Use is granted to Mr. Ben Rice's client. REZONING 10001 South Hwy 161 Chairman Brannen opened the public hearing at approximately 7:12 p.m. Representative Mr. David Richardson related that he is planning to purchase the property from Mr. Tommy Dupree, adding that he owns a business (Ingle Fence Co.) adjacent to the property requested for rezoning. He related that the 3.99 acres is proposed for rezoning from R-1 to C-3 for the development of mini warehouses. He pointed out that the adjacent property is outside the City limits. With no one to speak in opposition, Chairman Brannen closed the public hearing at approximately 7:15 p.m. Discussion ensued and it was determined that the land use map depicted the area to be commercial and that the property located behind the liquor store is vacant. In response to a question from Commissioner Hardwick, Mr. Richardson related that a portion of the property is adjacent to homes located on Homer Adkins Drive. City Engineer Whisker stated that the City does not have a problem with the rezoning, adding that the property is designated for commercial on the land use map. Commissioner Wilborn moved, seconded by Commissioner Piggee to approve the REZONING of property addressed 10001 South Highway 161 as requested. MOTION CARRIED. c. CONDITIONAL USE for a Recreational Facility/300 Ray Road Chairman Brannen opened the public hearing at approximately 7:18 p.m. Mr. Joseph Booker, president of the Mighty Vikings Youth Football Association, related that the property is zoned R-1. He stated that the 3. 5 acre property was purchased a few years ago and is located in the "at risk" target area for kids. He said that a 16' X 16' building was built for concessions operation and to film the games, adding that it is only utilized from July through October. He stated that he was unaware of the need for a conditional use regarding a recreational facility when they starting the organization. He related that there are 110 boys and 30 girls in the program, which features approximately six games per season on Saturday morning from 9:00 a.m. to 2:00 p.m. He related that the facility is mainly used for practice on Monday, Tuesday, and Thursday and that it is open to anyone who would like to participate. He stated that the organization provides equipment for all kids in the program. Chairman Brannen closed the public hearing at approximately 7:20 p.m. City Engineer Whisker stated that it was brought to his attention that Mr. Booker would need a conditional use to continue operation as a recreational facility. He then stated that the organization works with the Parks Department and have had "children at play" signs installed in the area. He stated that the change from daylight savings time prevents evening use of the facility because it does not have lighting. In response to a question from Commissioner Piggee regarding written wording of the request involving lighting, City Engineer Whisker related that the City is not responsible for lighting. Mr. Booker then explained that the association is requesting permission to use the lighting at Dupree Park for approximately three weeks to finish the season and that the association does pay for the lighting expense of that use. Discussion ensued as to the fall football schedule and the possibility of a spring softball session. Mr. Booker stated that anyone is welcome, adding that they maintain the field. Commissioner Piggee thanked the audience for its show of support regarding their community. Commissioner Piggee moved, seconded by Commissioner Wilborn to grant a conditional use of a Recreational Facility at 300 Ray Road amended to grant that conditional use to Mr. Joseph Booker. MOTION CARRIED. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. REQUEST· TO APPROVE BUILDING PERMITS: 1807-C South Highway 161 proposed Beauty Shop 000013 Mrs. Annie Tucker related that she would like permission to move a building into the proposed location. She then related that the property is adjacent to the Shell Service Station at the Old Pic- n-Pac building across from the Crooked Hook Restaurant. City Engineer Whisker related that the location is part of the Pic-n-Pac property and that the proposed building meets with all setback requirements. He related that the building will be position so that the side of the business will face the street and the front will face parallel to Pic-n-Pac and is adjacent to the Shell Station. In response to a question posed by Chairman Brannen, Mrs. Tucker related that the proposed building for the location is four years old. Commissioner Gray questioned the site plan for the location, asking if the building is within the 50-ft setback requirement regarding Hwy 161. City Engineer Whisker stated that since the lot is deep the building would not be within 50-foot of Hwy 161 and reiterated that it is his impression that no variances will be needed. In response to a question from Chairman Brannen, Mrs. Tucker related that the foundation would be of peer and beam, adding that the building is 16' X 24' in dimension. She then related that she is the owner of the Pic-n-Pac store located at site. Commissioner Lester moved, seconded by Commissioner Wilborn to approve a building permit at 1807-C South Highway 161 for a proposed beauty shop. MOTION CARRIED. REQUEST TO APPROVE PLATS : REQUEST/STREET OR ALLEY CLOSING: GENERAL: Proposed Annexation of Oak Ridge Ranch Subdivision Attorney Will Bond related that the item has previously been presented to the Planning Commission regarding their input. He then stated that the proposed area to be annexed is owned by one entity. He related that he was aware of some concerned property owners in the area present. He related that the purpose of addressing the Planning Commission is to offer an opportunity to 4 000014 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. see the subdivision and the proposed plan for comment. He stated that it has been the intent to make everyone aware of plans and that he has talked with some of the property owners who are involved. He related that there is no effort to annex anyone who does not want to be included in the annexation, adding that he feels some property owners are more concerned about the development. He then mentioned that he thought the City Engineer may have concerns about street easement being shown in the development. He stated that the next step would be to go before the County Court after three weeks of published notice for the County Court to decide on the annexation. He stated that following a 30-day appeal period to the Circuit Court it would come before the City Council for a request of ordinance accepting the property into the City. He concluded saying that the proposed annexation has been brought before the Planning Commission on a couple of occasions to ensure that the Planning Commission input opportunity and receive tentative approval. He expressed that he was aware of concerns from area residents regarding the pump station location. City Engineer Whisker stated that two years ago the proposed annexation was before the Commission and there were concerns regarding water issues. He then stated that he is aware of concerns regarding street connections to Pridmore from area residents and that one resident had voiced to him that he felt he had not been contacted in a timely manner, adding that she felt that the flyer on the door W.:=l.s nnt P.nnn<Jh. HP. stnted that efforts have been on-going pending Cabot re-structuring their water system. Discussion ensued and it was noted that the Planning Commission has not yet fully approved the subdivision and is now only looking at the general layout of the land. City Engineer Whisker stated that the proposed annexation is very near the base area that has been annexed at the corner of Maddox and Pridmore. Commissioner Hardwick questioned the disposition of property owners in attendance regarding annexation consent. Ms. Linda Tucker of 0 01 Stirrup rlace and property owner on Pridmore Road where she is anticipating to build soon, stated that one of the concerns they have is that the original formatted plan all properties that surround the subdivision are five acre lots. She clarified that when they bought property in the area it was proposed that the subdivision would have five acre lots 5 J 0{)001.5 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. and that the middle section, although they knew there was an easement and did anticipate a road that it would lead into a culdesac of five acre lots. She then related that the in current proposal the possibility of 10 to 12 homes have been increased to 48 homes. She said that this is a substantially different proposal than what people bought into and that the question now is some debate as to whether they want to be annexed. She added that the major issue is not the annexation but the development. She then related other concerns regarding developing an area that is a flood zone that is going to affect all the area properties. She related that based recent information the annexation has been proposed for a couple of months, adding that she found out Saturday while other people were never contacted. She went on to say that there are residents on the other side of Pridmore that will not be annexed but will be affected by the traffic flow and will now be looking at a major road where it was a wooded area. She stated that their concern is the change of the development, the affects of building in a flood zone, and location of the proposed pump station. She related that lot one has not been designated as to wh~t will be developed there, questioning if it is going to be a pump station or something to be developed later. She stated that the area residents have many questions not necessarily dealing with the annexation but the property development. She then related that it was a surprise to see how much information has come before the Commission yet the area property owners have not had any opportunity to hear how it was progressing or what was proposed. She stated that the residents on the easement where the road is going through have some concerns as to how that will affect their property even though they knew the easement was there, the developer has not been specific enough as to how it will develop. She concluded in say that if the Planning Commission starts now by saying yes and allowing the easement along with the annexation, our concerns are what kind of input will we have. In response, Attorney Bond stated to make clear to the Commission, that the drawing as provided is proposing annexation of only the property owned by one person and not an attempt to annex anyone not wanting to be annexed and are in understanding of the concerns regarding the development. He stated that they are unaware of a bill of assurance, problems or restrictions that would hinder this development and are not trying to sneak past anyone. He reiterated that the annexation will have to go before the County Court before going to the City Council for property acceptance. He offered that the annexation matter could be reset before the Planning Commission before being offered to the City Council if preferred. He then stated that most of the concerns 6 0000:16 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. regarding water, sewer, and flood plain issues have been addressed through the development along with any major concerns for traffic. He offered that the land is changing, which is going to happen and efforts are being made to provide information regarding the development. He related that it is unfortunate that the development is a disappointment to some area residents which is part of the rcuson for bring it to the Commission to air out some of these concerns initially. Discussion ensued regarding tentative annexation approval from the Planning Commission as a single landowner, which might have lead to some of the mis-communication. Mr. Bond stated that the City did not have to be involved until after the matter goes before the County Judge, adding that it is being presented, in essence prematurely, in an effort to inform everyone of the plans that will be moving forward. He added that he has offered his card to area residents and is trying to provide the information they want. Commissioner Gray related that it is a courtesy, adding that he believes the City Council would want review by the Planning Commission prior to their takinq any action. He then stated that the Planning Commission will be looking at several aspects, one being the annexation, however, he pointed out that if the property is not annexed the Planning Commission will still be the overseeing body in the subdivision. He then explained that if the property is annexed the Planning Commission rRm~ins the overseeing body regarding the subdivision. He pointed out that the annexation issue before the commission tonight is a matter of recommendation. In response to a question from Commissioner Piggee regarding development requirements, Commissioner Gray rephrased that if the property is not annexed the County has an oversight into the subdivision development and the Planning Commission would have review matter, but would analyze requirements also. He further clarified that as annexed property it falls within the purview of City ordinances regarding subdivision regulations overseen by the Planning Commission. He stated that there are advantages for the subdivision to be in the community and under the oversight and protection of community services, as would it be for the other land owners. However, it may have zero difference or change in the ultimate intent of the land owner and how he subdivides his property. He suggested that the matter be brought back to the Planning Commission. 7 r J OGOG:17 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. City Engineer Whisker reiterated that the subdivision will come back before the Planning Commission regarding the design of roads, sewer, and water, adding that everyone is welcome to be present at those times to study the design of the subdivision. Mr. Ralph Pridmore of Pridmore Road stated that first of all he would like to go on record saying that he was not notified or given any information regarding the annexation. He questioned issues regarding the subdivision and the five mile radius around the base. Commissioner Gray stated that the five mile jurisdiction is in force and does not affect issue before the Commission tonight. He went on to say that the Air Installation Compatibility Use Zone in the overlay district extends beyond this land and will have no effective change in recent developments. In response to further question from Mr. Pridmore, Commissioner Gray stated that the proposed development does not fall in the accident potential zones I or II, or the clear zone and is not affected by those zone requirements. Mr. Pridmore questioned if the land would be limited to the one house per acre. Commissioner Gray stated that to the best of his knowledge the property does not fall in those zones. Mr. Pridmore then stated that his assumption was that the zones were directly behind a portion of his property on the opposite side of Pridmore Road and while it is not direct, it is still within a five-mile radius. Commissioner Gray agreed, saying that the most concentrated concerns are the first three thousand feet off the runway being the clear zone, followed by a five thousand foot Accident Potential Zone I and then seven thousand feet further is Accident Potential Zone II. He clarified that the proposed annexation property does not fall within any of those areas. Commissioner Hardwick commented that the annexation would not change the requirements of whatever zone it is in, adding that it is based on the airstrip and lines off the end of the runway. He stated that in or out of the City the AICUZ requirements would be the same. 8 00001.8 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. Mr. Pridmore stated that he understands it might not prevent the annexation, but it might prevent the number of dwellings permitted. Commissioner Hardwick and Commissioner Gray clarified that it would be the same requirement in or out of the City and that it would depend strictly if the proposed property were located in one of the AICUZ zones. Stating that the property is already governed by that rule. Mr. Pridmore question if the fact that the property is a flood area would be a consideration regarding the number of dwellings or would the Planning Commission look at the type of system to be constructed. Commissioner Gray stated that he would defer to the City Engineer on that issue, but added his information would be that if located in the City limits it would carry stricter concerns regarding drainage. City Engineer Whisker stated that it would have to be built one foot above the flood plain. Commissioner Gray related that the ultimate drainage plan becomes more of a concern as it relates to the City than it would outside the City. City Engineer Whisker stated building up the lots would force drainage more to the north and east where the flood plain is located. Mr. Pridmore stated that when you build up those lots water will turn back to property owners on both sides, because it is a natural flood area where the water comes off Pridmore and goes across that property. He related that there have been past problems with the property perking. Chairman Brannen reminded everyone that annexation is the discussion currently, and that other considerations will be taken up later if the property is accepted by the City. Mr. Pridmore offered that he felt all information would enter into consideration for annexation. In response to a question from Commissioner Wilborn, City Engineer Whisker stated that the proposed annexation area would include an entry into the subdivision from Pridmore Lane. 9 r Onoo·-:n u . ..Ji.......J CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 2000 7:00 P.M. -7:55 P.M. Mr. Ron Lewis, a resident of the area, questioned the contiguous path to the City. He then stated that the only way it is contiguous is considering the Air Force Base property and the road easement that comes through the five acres on Maddox Road unless the property owners on Maddox are involved in the annexation. He stated that otherwise it would be a pocket of 20 acres that is not going to be in the City and there would be a section of property that is in the City Limits. He questioned the intended meaning of "contiguous", saying he thought it to mean beside or adjacent to. City Engineer Whisker clarified that by extending across Maddox Road from the Air Force Base right-of-way it is contiguous, meaning the City limits keeps going without a break. He then said that it continues on one straight path never breaking from itself so it actually would start at the Air Force Base on the south east corner and go up around the land before coming back down and touching Maddox Road again. Mr. Lewis mentioned contiguous to be on a 20 to 30 foot section. City Engineer Whisker pointed out that it would actually cross Maddox Road. Mr. Lewis stated that it would not actually be adjacent to the City limits. City Engineer Whisker stated that the City limit is at the right- of-way at Maddox Road. Chairman Brannen asked that the item for discussion be brought back to the Planning Commission following a ruling by the County Judge. Mr. Bond explained the process and time span involved with County procedure and stated that they would be happy to come back after the County legal process and advertising considerations in asking the City for an Ordinance accepting the property. NEW ZONING MAPS City Engineer Whisker asked that the Commission review the new zoning map regarding the changes in zoning designations of R-4, R-5, R-6, and R-7. He pointed out Stagecoach Subdivision which is Wells Fargo and Stagecoach Park that is zoned R-6 (manufactured housing) has been changed along with Linda Lane which has two mobile homes that needed to be changed and also Carver Lane where there is a mobile home park that carried an R-1 zoning classification. He asked that the Commission be ready in December to designate R-5 (modular housing) zoning classifications. He then mentioned consideration for other areas of annexation previously reviewed by the Planning Commission. Discussion ensued and Commissioner Hardwick stated that he thought the property had already been recommended to the City Council for annexation. It was then noted that firm legal descriptions of the property were only recently obtained and would be brought back for formal recommendation to the City Council. FINAL PLAT Collenwood Subdivision PH II Mr. Jim Green related the plat changed only by the addition of three or four lots from the preliminary plat presentation. Clty Engineer Whisker clnrificd that the preliminary plat included the remaining development area and Phase II is a portion of that remainder. He related that changes included Jamestown Circle which now stops as it connects to Colonial Drive and the Bill of Assurance added the wording that the property owners association had to meet with the flood plain manager regarding construction in the flood way. He pointed out that the flood way is located at the rear of lots 48, 49, 50 and 51. Mr. Green then related that none of the lots actually encroaches on the flood way. Chairman Brannen question the F designation for lots 45, 46, 47 and 94. It was noted that the ditch is directly behind lots 50, 51, and 49. Mr. Green further clarified that it is approximately three or four hundred feet and that the ditch runs southeast/northwest. He noted that the plat did not include a scale and that for reference purposes, Jamestown Circle is within a minute or so of due north and south. Commissioner Hardwick recalled that the original subdivision plans required fences in the rear of lots located on J.P. Wright Loop, which would now be lots 70 through 66 of Phase II. He questioned initial action regarding fences for those lots. Mr. Green stated that he does plan to continue with previous fence stipulations regarding lots 66 through 70. City Attorney Bamburg advised that it should be included as part of the approval as a requirement. City Engineer Whisker asked that approval also be contingent upon his approval regarding readiness to send the item to City Council. Discussion ensued regarding sidewalk requirements and it was the general consensus that the Master Sidewalk Plan was adopted after the approval of the Preliminary Plat for Collenwood Subdivision. Commissioner Hardwick noted that there was always a • sidewalk plan, but was somewhat ignored and agreed that the preliminary plat was approved prior to the revision of those guidelines. He stated that he did not feel it would be wise to place sidewalks that do not lead anywhere at this point. Commissioner Gray stated that the Ordinance requires sidewalks of all developers. Commissioner Hardwick related that it is a requirement of new plats being approved, but he felt it was not intended to be retro for plats that were previously approved regarding second and third phases because the sidewalk would not connect or lead. City Engineer Whisker pointed out that the preliminary plat of Collenwood included the remainder of that subdivision not just phase II, which will be further broken out later with Phase III. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 2000 7:00 P.M. -8:05 P.M. Further discussion ensued and City Engineer Whisker related that preliminary plat approval stands for one year as long as Phase III begins within one year. He stated that he would research if it actually has to be finished or just in construction. Commissioner Gray pointed out that support data indicated that the preliminary plat for Collenwood Phase II was approved November 8, 1999. It was then noted that water, sewer, and fire has given plat approval to the City Engineer. Commissioner Hardwick moved, seconded by Commissioner Wilborn to approve the Final Plat of Collenwood Phase II, stipulating that fences be erected on lots 66 through 70 as with Phase I and further stipulating that if the Master Sidewalk Plan calls for sidewalks it would not require them in phase II, as it does not appear to be practicable for this development to place sidewalks that do not lead or connect and further subject to the City Engineer's final approval. MOTION CARRIED. b. FINAL PLAT Gene Wilson Commercial Development Mr. Wilson related that he is scheduled to close Thursday on one of the two tracts involved in the final plat. City Engineer Whisker related that the property is located south of Kroger on North First Street. He stated that lot 1 currently has a small green house located there and lot 2 has a duplex on the corner with a gravel drive leading back into the mobile home park behind both pieces of property. He further related that an auto parts store is planned for lot 2, and the final plat will create the subdivision and plat the 30-foot easement owned by the Mr. Wilson as access to the mobile home park. Commissioner Gray recalled several discussions in the original review and in Board of Adjustment considerations for the auto parts store and it was recommended that the property be platted as a joint access off Hwy 161 for both lots. City Engineer Whisker agreed and stated that the building permit would be the last action for lot 2 after it becomes a subdivision adding that a building permit in a subdivision docD not huvc to go through the Planning Commission. Commissioner Gray suggested that consideration for one turning in access for both lots as a stipulation needs to be addressed at this time. 3 J OG002S CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 2000 7:00 P.M. -8:05 P.M. City Engineer Whisker suggested that the bill of assurance could provide an avenue for that provision. Mr. Wilson pointed out that the property actually has three entrances. City Engineer Whisker stated that the current discussion suggest that the parking area of both lots should share all three entrances, connecting the parking areas behind the sidewalks so that a vehicle pulling into lot 2 can drive through to lot 1. Commissioner Gray explained that currently there is access on the north side, behind the grocery store and one on the south part of lot 1 to the mobile home park, adding that the recommendation will only be for one additional turning into both lots. He clarified that the two driveways would be consolidated into one driveway for both lots. Discussion ensued and Commissioner Hardwick stated that the objective of the Planning Commission is for two driveways, pointing out that while there is three curb cuts, two of them are single family residents. He then stated that because of the traffic generated from a commercial development this stretch of Hwy 161 does not need three curb cuts to access these properties. He stated there would be an access to lot 1, lot 2 and access to the mobile home park, adding that it could be structured for a shared access between lot 1 and 2, or where the only access to lot 2 is from the easement then we can accomplish two curb cuts as opposed to three. He concluded that he felt -it would be a traffic hazard to have three curb cuts for these two lots. Discussion ensued regarding the location of the third curb cut being at Gregory Place and City Engineer Whisker stated that it was his understanding that there would be three curb cuts and the middle one would be a shared access by the two lots. Commissioner Gray mentioned the alley behind Gregory Place adjoining the property and Commissioner Wilborn asked it a fence was between the properties and Kroger. Mr. Wilson responded that there is an alley behind Kroger and that the north line has a fence, adding that half of the forty foot curb is in the alley and half is on his property as a continuous shared curb cut. 4 onoo~s CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 2000 7:00 P.M. -8:05 P.M. In response to a question from Commissioner Wilborn, Mr. Wilson related that the location of the road that leads to the trailer park is not a center access, adding that the center access point lead behind his house. It was noted that the road on the south side is the road that goes into the mobile home park. Mr. Wilson then responded that the mobile home park easement is going to be turned into a street. City Engineer Whisker questioned and clarified with Mr. Wilson that the new owners of lot 2 are going to asphalt the utility/access easement back to the west property line and that it will be maintained by the property owner. Mr. Wilson stated that easement maintenance will be shared with the owner of lot 2 and is covered in the bill of assurance. City Engineer Whisker quoted the bill of assurance as saying "will be the responsibility of the owner to maintain, and no utility and/ or public agent will be liable for destruction of same in constructing and maintaining its facilities located within the area of said easement." He stated that it speaks specifically to the area of the easement and that as stated it places the responsibility to the owner to maintain. Mr. Wilson responded that the bill of assurance needs to be changed because the easement agreement stated that it would be shared. City Attorney Bamburg reminded that the a bill of assurance covenant is for 30-years and City Engineer Whisker added that it extends itself every ten year after unless changed. City Attorney Bamburg clarified that the mobile home park is not a part of the subdivision and it was related that the owners of lot 1 and 2 could decide that the owner of the mobile home park does not have to maintain the road at the end of 30-years. In response to a question from Commissioner Gray, Mr. Wilson agreed to revise the bill of assurance, adding that he requested the road be developed to City specifications because of truck access and future repairs. Discussion ensued and it was noted that both parties must agree to changes of the bill of assurance regarding shared maintenance for the access. Commissioner Hardwick offered that it would be beneficial to all parties to redraw the bill of assurance and have it state that the access to lot 2 includes an easement to lot 1 from the street to the building setback line. He explained that if lot 1 is granted an easement to the building setback line regarding the present curb cut then there would be no need for lot 1 to request an additional curb cut. Discussion ensued and it was related that lot 1 is currently for sale as commercial property. Commissioner Hardwick moved, seconded by Commissi9ner Lester to table the item of business pending Mr. Wilson' s return with a revised bill of assurance, drawn as he intended on the present easement regarding access to the mobile home park by showing it to be shared maintenance between lot 2 and the mobile home park and to show an easement to lot 1 on the north side of lot 2 to the building setback line regarding the 40-foot drive and that the bill of assurance would also state that after the 30-year period the easement maintenance to the back line of lot 2 would fall upon the owner of lot 2. Discussion ensued and it was suggested that final plat could be approved specifying all stipulations. When asked about his thoughts, Mr. Wilson stated that he was not sure regarding his next action but wanted finality. He then stated that the bill of assurance would be changed quickly but added that he would need to get with the future owners of lot 2 regarding a shared access between lot 1 and 2. He stated that if a shared access could not be worked out, it renders the deal useless. He also mentioned waiting for City Council approval. Discussion ensued and it was noted that as the motion stands the Planning Commission would have to meet again for approval before recommendation to the City Council. It was then discussed if the closing date could be reset regarding time for final plat approval. Commissioner Wilborn clarified that the only real question is if the owners of lot 2 will allow a shared access with lot 1 and the bill of assurance regarding maintenance responsibility for the easement. Discussion ensued as to a special called meeting of the Planning Commission regarding final plat approval. Mr. Wilson did not know if it would be a problem to change the closing date. Commissioner Hardwick moved, seconded by Commissioner Lester to amend the previous motion and approve the final plat of the Gene Wilson Commercial Subdivision with the conditions that the paragraph one of the bill of assurance be changed to show the shared cost of the utility/access easement for the first 30- years, and then the cost to be the responsibility of the owners of lot 2 after that 30-year period; and further that the bill of assurance include an easement to lot 1 from the curb cut on the north side of lot 2 back to the SO-foot building line, with the plat showing the same. Consensus was that the amended paperwork would be delivered to the City Engineer. Discussion ensued and it was determined that based on the wording of the motion a special Planning Commission meeting prior to the City Council meeting would not be necessary if all stipulations are met. He related that the annexation would include St. Luke's Church, a few houses on Hwy 161, part of the cemetery, and one or two businesses along Hwy 161. He related that he is currently contacting property owne rs. He announced that the public hearing annexation meeting will be held J anuary gth at 6:00 p.m. at City Hall. He related that the Water and Sewer Departments will be in attendance to answer questions. He then related that regarding the west distributed. an aerial photo and legal annexation proposal was description previously Discussion ensued and it was related that the public hearing will cover both the west and south annexation proposals. City Engineer Whisker mentioned consideration for the Federal Grant involving the Wooten Road area regarding wastewater. He then mentioned that an area.of property from the cemetery to the liquor stores would remain in the County. He stated that a private club located on Hwy 161 will be included in the south annexation. It was further discussed and consensus was to determine if it was a private club or open bar. City Engineer Whisker related that his understanding is that the south annexation is a result of efforts to annex the northbel t freeway and a portion of the Hwy 161, adding that this is accomplished by following the railroad tracks and the section line. Commissioner Gray suggested that a property owners map be made available for the public hearing. City Engineer Whisker stated that some of the boundary line follows property owner lines as well as section lines as they coincide. He pointed out that the boundary line does not split property owners' land except a property owner on the north section by the church to the railroad tracks and AP&L's property on the south end divided by the section line where the property continues to extend southward. City Attorney Bamburg stated that the annexation process would depend on input from the various property owners involved in the proposed annexed area. Commissioner Corroum stated that with the completion of the northbel t freeway; Hwy 161 is going to become a major thoroughfare with possibility of additional annexation proposals. 8 000030 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 2000 7:00 P.M. -8:05 P.M. Commissioner Hardwick stated that current proposal is less likely to receive objections. In response to a comment from Commissioner Corroum, City Engineer Whisker related that the Police Department currently patrols the landfill area and he will check regarding the area south of there. Discussion ensued regarding the proposed annexation for Maddox Road and Pridmore and it was related that it was not included in the current annexation public hearing.
