25 JUL 14OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on July 14, 2025. Chairman Moore opened the meeting at approximately 6:35 p.m.
expressing appreciation to those in attendance.
ROLL CALL: Commissioners Mike Dietz, William Montgomery, Terry Sansing, Vivian Brittenum, Zeke Brown, and Chairman Jim Moore were present and answered ROLL CALL. Chairman Moore declared
a quorum. PRESENT (6) with chair, ABSENT (3).
CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Montgomery moved, seconded by Commissioner Brittenum to approve the minutes of June 9, 2025 as presented. MOTION CARRIED.
PUBLIC HEARING(S): CONDITIONAL USE 200 North First Street auto sales, repair, and detailing in C-4 zone
Chairman Moore opened the public hearing at approximately 6:38 p.m.
Craig Friedman of Diversified Acquisitions Inc. stated this will allow the property to continue the use it has been, with a new tenant. He explained it will be a car lot with associated
activities, as it was before. He confirmed it is zoned C-4, but the use is C-3 and that requires a conditional use.
Craig Mosley with C & D Mosley Enterprises noted 8-10 cars can fit on the lot.
City Engineer Adam Whitlow related there is an approved layout based on the previous conditional use. He confirmed there have been no calls for or against this request.
Chairman Moore closed the public hearing at approximately 6:54 p.m.
Commissioner Montgomery moved, seconded by Commissioner Sansing to approve the conditional use of auto sales, repair, and detailing in a C-4 zone at 200 North First Street. MOTION CARRIED.
REQUEST TO APPROVE PLAT(S): PRELIMINARY PLAT DG Addition
Representative Aaron Robinson with Bond Engineering stated this property was recently rezoned and will be divided into lots, with Phase 1 being Lots 1-3 and Phase 2 being the street
and remaining lots. He confirmed the first three lots do not require any new infrastructure, other than curb, gutter, and sidewalk along Spring Street. He noted the Water Department
has to set meters, Wastewater has to put the sewer services in, and Phase 2 has things needing worked out with the Public Works Department. He related that all lots will have duplexes
on them.
Chairman Moore mentioned setback variances possibly being required in the future.
City Clerk Davitt brought up her concern approving a preliminary plat that forces a hardship later on during development.
Mr. Robinson replied there should not be any variances, adding that triplexes could be put on the lots and would meet setbacks.
Discussion ensued regarding whether a variance or a waiver would be necessary and it was determined only the preliminary plat of Phase 1, being Lots 1-3, would be addressed tonight.
Commissioner Sansing moved, seconded by Commissioner Montgomery to approve the preliminary plat of DG Addition Phase 1 (Lots 1, 2, and 3 only). MOTION CARRIED.
BUILDING PERMIT(S): a. SITE PLAN Fast Pace Urgent Care 1118 North First Street
Autumn Francis with Hutton stated plans to put a 2700 square foot urgent care building on this vacant lot. She explained they would be open 12 hours a day, except for Sundays, and have
either a physician’s assistant or nurse practitioner on staff at all times, with a regional MD. She described how it would have five exam rooms, an x-ray room, and a lab.
City Engineer Adam Whitlow confirmed it is properly zoned and Staff has no issues.
Commissioner Brittenum moved, seconded by Commissioner Montgomery to approve the site plan for Fast Pace Urgent Care located at 1118 North First Street. MOTION CARRIED.
b. SITE PLAN Hilltop MW Warehouse Lot 3 MW Commercial Subdivision
Representative Aaron Robinson with Bond Engineering stated this is a lot on General Samuels Road proposed for mini warehouses. He explained they received comments from Public Works today
and they have no issues with those. He detailed it is on the corner of Redmond and General Samuels Road where they cleared trees. He brought up a possible issue with fencing, adding
that since it is a mini storage facility, they want a fence with wire on top. He related that they are proposing a chain link fence with plastic slats to make it opaque, since it is
under a powerline easement and they cannot plant trees. He confirmed all other sides are industrial.
City Engineer Whitlow cited the following sections of Jacksonville Municipal Code:
§ 16.20.020-Definitions-Buffer(s) A combination of physical space and vertical elements, such as plants, berms, fences, or walls, the purpose of which is to encourage preservation of
large trees on a site, facilitate effective drainage and erosion control, reduce or eliminate public view of cuts and fills, and/or separate and/or screen incompatible land uses.
§ 16.20.036-Screening Requirements The grading and landscaping of a site shall be accomplished in such a way as to screen dumpster areas, outside storage areas, and certain other such
activities external to buildings on the site from street view and abutting development of dissimilar use (i.e., commercial adjacent to residential, etc.). Existing and planted vegetation,
berms, fences, walls and other landscaping devices may be used to achieve the required screening in accordance with minimum standards as outlined under the terms of this Ordinance.
§ 17.44.010-General (2.) Industrial subdivisions abutting residential subdivisions or areas zoned for residential use shall protect such areas from potential nuisance by providing a
minimum fifty-foot buffer strip and a fence not less than six feet in height. Where possible, existing plant materials within the buffer strip shall be maintained. If not possible,
suitable landscaping including trees, ground cover and other plant material natural to the area shall be provided. No building or outside storage shall be constructed in the buffer
area. No parking areas will be allowed in the first thirty feet of the buffer area. The six-foot fence shall be of wood, masonry, or metal construction and shall extend along the entire
property line abutting the residential areas as specified above.
He questioned if slatted chain link meets the intent of the codes.
Commissioner Sansing brought up this will not be noisy industrial, so the slatted six foot fence with wire will serve the purpose of blocking it from view to the residential area.
City Engineer Whitlow concurred, but since there was some ambiguity, he wanted the Commission’s interpretation.
Commissioner Sansing moved, seconded by Commissioner Montgomery to approve the site plan of Hilltop MW Warehouse Lot 3 MW Commercial Subdivision and allow slatted chain link fencing.
MOTION CARRIED.
