1794ORDINANCE NO. 1794 (423 - 2025)
AN ORDINANCE TO AUTHORIZE THE CITY OF JACKSONVILLE TO
CONDUCT BUSINESS WITH CERTAIN INDIVIDUALS WHO SERVE AS
MEMBERS OF VARIOUS COMMISSIONS AND BOARDS OF THE CITY OF
JACKSONVILLE; DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
WHEREAS, the Jacksonville City Council recognizes the importance of certain
financial services provided to the City by First Arkansas Bank & Trust ("FAB&T"); and
WHEREAS, certain members of City boards and commissions also serve in
executive roles at FAB&T, which provides financial services to the City; and
WHEREAS, Ark. Code Ann. § 14-42-107 requires the governing body of a
municipality to approve by ordinance any contract or business arrangement between the
municipality and an entity in which a board or commission member holds a significant
interest or executive position; and
WHEREAS, the City Council acknowledges the following affiliations and finds it to
be in the City's best interest to continue its financial relationship with FAB&T and approves
the following individuals' roles within the City:

NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Pursuant to Ark. Code Ann. § 14-42-107, the Jacksonville City
_ Council hereby approves and authorizes the City of Jacksonville to conduct business with
First Arkansas Bank & Trust, acknowledging the executive positions held by Roger
Sundermeier and Larry Wilson, who serve on City commissions.
SECTION TWO: The City Council affirms that it is in the best interest of the
City to receive the financial services provided by FAB&T, and that the involvement of these
individuals does not impair their ability to serve or act in the City's best interest.
SECTION THREE: The provisions of this ordinance are severable. If any section,
clause, or provision is found to be invalid, the remainder shall remain in full force and effect.
SECTION FOUR: All ordinances or parts thereof in conflict with this ordinance
are repealed to the extent of such conflict.
SECTION FIVE: Emergency Clause. Due to the need to ensure uninterrupted
financial services and maintain continuity of operations for the benefit of the citizens of
Jacksonville, an emergency is hereby declared. Therefore, this ordinance shall be in full
force and effect from and after its passage and approval.
