25 APR 14OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on April 14, 2025. Vice Chairman Oakley opened the meeting at approximately 6:40 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Mike Dietz, William Montgomery, Terry Sansing, Nick Priest, Vivian Brittenum, Zeke Brown, and Vice Chairman Jim Oakley were present and answered ROLL CALL. Vice Chairman Oakley declared a quorum. PRESENT (7) with chair, ABSENT (2). CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Sansing moved, seconded by Council Member Dietz to approve the minutes of March 10, 2025 as presented. MOTION CARRIED. PUBLIC HEARING(S): a. REZONING 420 West Hickory Street from R-0 to R-2 Vice Chairman Oakley opened the public hearing at approximately 6:43 p.m. Petitioner John Kirby stated this property has always been two units that previously included a beauty shop business on one side and residential on the other. City Engineer Adam Whitlow recalled prior to 2016, it was zoned C-2, the Master Land Use Plan has it as Mixed-Use, and it was rezoned to R-0 in 2016. He confirmed his Staff has no objections has received no calls in support or opposition. Vice Chairman Oakley closed the public at approximately 6:46 p.m. Council Member Dietz moved, seconded by Commissioner Sansing to approve the rezoning of 420 West Hickory Street from R-0 to R-2. MOTION CARRIED. b. REZONING 7430 T.P. White Drive from C-3 to C-4 Vice Chairman Oakley opened the public hearing at approximately 6:47 p.m. Representative Aaron Robinson with Bond Engineering stated this is for the mini storage mentioned in the Board of Adjustment meeting this evening. He explained they will also have some open display and commercial. Engineer Whitlow related the mini storage would be on the backside of the property, with commercial along the frontage. He feels it is consistent with the Land Use Plan of the area. Vice Chairman Oakley closed the public at approximately 6:48 p.m. Commissioner Sansing moved, seconded by Council Member Dietz to approve the rezoning of 7430 T.P. White Drive from C-3 to C-4. MOTION CARRIED. c. REZONING 3121 & 3125 North First Street from C-2 to R-3 Vice Chairman Oakley opened the public hearing at approximately 6:49 p.m. Mr. Robinson related plans to build townhome-style triplexes on this property, which would mirror the ones to the south of it. He explained the north side of Woolfort Road is zoned R-0 and R-3. He recalled the Commission granting a conditional use for R-3 previously, but they decided to rezone to the use it is intended for instead. Engineer Whitlow confirmed there have been no objections and it is consistent with what has been done there. Vice Chairman Oakley closed the public at approximately 6:51 p.m. Council Member Dietz moved, seconded by Commissioner Montgomery to approve the rezoning of 3121 & 3125 North First Street from C-2 to R-3. MOTION CARRIED. d. REZONING vacant parcels at intersection of Dupree Drive & Stone Street from C-2 to Planned Unit Development Vice Chairman Oakley opened the public hearing at approximately 6:51 p.m. Mr. Robinson stated they are proposing a Planned Unit Development (PUD) that will be apartment-style townhomes. He explained on one side there are eleven two-stories; the ones on the west side have garages, and the one on the east side do not. He confirmed they decided to do a PUD because of the setback requirements and to be able to fit everything in. He related there will be 19 units that they planned the size of the buildings, ingress/egress, fencing, signage, setbacks, parking spaces, etc. Engineer Whitlow brought up that when you approve a PUD, you are approving the rezone and site plan. He confirmed he would need to approve all drainage and construction details and they need to provide ½ street improvements, or clearly state intention of non-compliance. He recommended either providing ½ street improvements, or in lieu of, improvements of equal value. Discussion ensued regarding curb and gutter requirements. Vice Chairman Oakley closed the public at approximately 7:11 p.m. Council Member Dietz moved, seconded by Commissioner Brittenum to approve the rezoning and the site plan for vacant parcels at intersection of Dupree Drive & Stone Street from C-2 to a Planned Unit Development contingent on all drainage and construction details be approved by the City Engineer and provide a comparable in lieu of fee, or in lieu of improvements, regarding ½ street improvements. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): FINAL PLAT ODP Addition-Lot 1 Mr. Robinson stated this is platting two tracts of land into one lot, noting it is the property approved for rezoning on this agenda under PUBLIC HEARING(S) item c. Council Member Dietz moved, seconded by Commissioner Sansing to approve the final plat of ODP Addition-Lot 1. MOTION CARRIED. BUILDING PERMIT(S): a. SITE PLAN ODP Addition-Lot 1 Mr. Robinson related this is six buildings that include three townhouse-style units per building. He reiterated it will mirror the property to the south. Engineer Whitlow added that all drainage will need to be approved by him and the only other outstanding comment Staff has is regarding the sidewalks on North First Street. He explained Mr. Robinson proposed a sidewalk on North First Street coming south to the driveway, and then from the driveway, they left sidewalks off. He recommended an in lieu of fee until some of the construction is done and they are able to see how the sidewalk will tie into the adjoining property. Mr. Robinson mentioned putting sidewalks on Woolfort Road and then turn south to go along the first unit and tie into the parking lot. He confirmed that is not a right-of-way and questioned if they want the public walking on private property. Engineer Whitlow recommended an in lieu of fee for the portion of sidewalk coming from the driveway and going south along North First Street. Commissioner Sansing moved, seconded by Commissioner Montgomery to approve the site plan for ODP Addition-Lot 1 contingent on all drainage being approved by the City Engineer and in lieu of fee be provided for the portion of sidewalk running south of the driveway along North First Street. MOTION CARRIED. b. SITE PLAN Dupree-Stone Addition-Lot 1 This item approved under PUBLIC HEARING(S) item d. c. SITE PLAN Bayou Estates-Lot 8 Mr. Robinson stated this is the property previously discussed for the mini storage and commercial toward the front with open display. Engineer Whitlow confirmed they must: have fire hydrants, meet Fire Code, provide a Grading Plan to include drainage calculations and a SWPPP, a driveway permit, notate driveway widths, have all construction details, sidewalks, and handicap ramps or lack thereof to be approved by him, correct parking calculations, provide Exterior Building Elevations, ensure Commercial Design Standards are as outlined in JMC § 16.22, coordinate with Water and Wastewater, and agree to a preconstruction meeting with Public Works. Commissioner Sansing moved, seconded by Commissioner Priest to approve the site plan for Bayou Estates-Lot 8 contingent on fire hydrants being added, access through site and around all structures adhering to Fire Code, provide a Grading Plan to include drainage calculations and a Storm Water Pollution Prevention Plan, an Arkansas Department of Transportation driveway permit, notate driveway widths, all construction details approved by City Engineer, sidewalks and handicap ramps or lack thereof be approved by City Engineer, correct the parking calculations, provide Exterior Building Elevations and ensure Commercial Design Standards are as outlined in Jacksonville Municipal Code § 16.22, coordinate with Jacksonville Water Works and Jacksonville Wastewater, and agree to a preconstruction meeting with the Public Works Department. MOTION CARRIED. d. SITE PLAN New Primer Facility Mark Bailey with Sig Sauer stated this was originally going to be made up of smaller buildings, but is now one facility with concrete walls on a large portion and a pre-engineered metal building on the east side. Engineer Whitlow confirmed the sign must meet location and height requirements per Code and they need to provide drainage calculations and SWPPP as required by ADEQ. Commissioner Sansing moved, seconded by Council Member Dietz to approve the site plan for Sig Sauer New Primer Facility contingent on the sign meeting location and height requirements per Code and drainage calculations and Storm Water Pollution Prevention Plan be provided. MOTION CARRIED. GENERAL: ANNOUNCEMENT(S): Engineer Whitlow gave a brief legislative update that included the removal of territorial jurisdiction and the removal of cities being able to impose regulations restricting accessory dwelling units in standard residential zones. He explained this allows duplexes on single-family lots, if the unit is no more than 75% the size of the primary dwelling and no larger than 1,000 square feet. He mentioned two other changes that will most likely fail, including the removal of residential zoning and cities not being allowed to require more strict standards than FEMA.
