VARIANCE REQUEST(S): Side & Rear Yard Setback Variance 401 South Spring Street Petitioner: Gray Thad Revocable Trust Representative: Bond Engineering 4-5 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 12, 2025 6:00 p.m. – 6:07 p.m. ATTENDANCE: Commissioners: Sansing, Hall, Brittenum, Twitty, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Oakley declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Sansing moved, seconded by Commissioner Brittenum to approve the regular meeting minutes of April 14, 2025. MOTION CARRIED. VARIANCE(S): Side & Rear Yard Setback Variance 401 South Spring Street The public hearing opened at approximately 6:01 p.m. Representative Aaron Robinson with Bond Engineering stated this property is 50’ x 100’ and is part of Station Grounds original part of Jacksonville. He explained the two-story duplex was destroyed by a tornado and the owners want to rebuild. He noted when this was platted, there were no setbacks, and now with the 25’ required on a corner lot, you cannot fit a building. He confirmed they are keeping the front yard setback at 25’, but the side yard will match the building that was there. He mentioned they decided to do a one-story duplex, so it would have to be deeper, making a rear yard setback variance necessary. He told how the road was closed behind this property and the owners were supposed to get 25’ of the right-of-way to make the lot 125’ deep. He was unsure why, but the owner behind this lot somehow has the entire 50’ of right-of-way and built a house around 2006. Discussion ensued regarding the abandonment and division of the rear right-of-way where City Engineer Adam Whitlow confirmed it validates the rear yard setback variance request. The public hearing closed at approximately 6:07 p.m. Commissioner Brittenum moved, seconded by Commissioner Twitty to approve a 5’ side yard setback and a 9.5’ rear yard setback at 401 South Spring Street. MOTION CARRIED. ADJOURNMENT: Without objection, Chairman Oakley adjourned the meeting at approximately 6:07 p.m. MOTION CARRIED.
