Rear Yard Setback Variance 127 Central Avenue Petitioner: Midark Houses LLC 7-8 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 10, 2025 6:00 p.m. – 6:19 p.m. ATTENDANCE: Commissioners: Sansing, Hall, Brittenum, Twitty, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Oakley declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brittenum moved, seconded by Commissioner Twitty to approve the regular meeting minutes of February 20, 2025. MOTION CARRIED. VARIANCE(S): a. Front Yard Setback Variance 108 Revere Court City Engineer Adam Whitlow stated this request is for a variance from a 35’ front setback to 31’, due to the encroachment into the platted building line of a metal carport. He does not think this is a setback issue, but is a platting issue. He explained since the 25’ setback requirement is below the 31’ requested, they technically meet code, but do not meet the subdivision requirements of the plat. He believes they require a replat, which could require an amendment to the Bill of Assurance, which could require 51% of owners’ signatures. He confirmed the City cannot vary from the developer’s rules. He recalled this being platted when the setback requirement was 35’, noting if a developer chooses 50’ setbacks, the City has no right to grant a variance from that. He related that his Staff needs to research in order to guide the applicant to the right process. He recommended this Board not take any action at this time. Engineer Whitlow concurred when City Clerk Davitt requested any such replats come before the Planning Commission. b. Rear Yard Setback Variance 127 Central Avenue The public hearing opened at approximately 6:15 p.m. Arkansas Homes and Rentals Project Manager Colby Ferguson stated this is the same house plan they have been building in Sunnyside, noting they need the rear yard setback to be reduced from 25’ to 14’. Commissioner Sansing recalled that City Council knew when they sold these lots that they would get a lot of variance requests on them. Engineer Whitlow explained these are non-conforming lots with 86’ depth, so the plan they are building is not an overbuild of the area at all. The public hearing closed at approximately 6:18 p.m. Commissioner Twitty moved, seconded by Commissioner Sansing to approve a 14’ rear yard setback at 127 Central Avenue. MOTION CARRIED.
