1789ORDINANCE NO. 1789 (#18 - 2025)
AN ORDINANCE TO AMEND AND MODIFY JACKSONVILLE MUNICIPAL CODE
§2.44.010 (EMPLOYEE POLICY MANUAL); DECLARING AN EMERGENCY; AND, FOR
OTHER PURPOSES.
WHEREAS, because the need for modification of policies, the City Council of the City of
Jacksonville deems it appropriate to update and modify applicable policies contained in the City of
Jacksonville Employee Policy Manual.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville, Arkansas, Employee Policy Manual, as
originally approved by Ordinance No. 1000 and modified thereafter, is hereby amended and
modified to include the additions, deletions, and modifications as included, outlined, and specified in
the attached Document.
SECTION TWO: All Ordinances, parts of Ordinances, or previous actions taken by said
Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION THREE: Because passage of this Ordinance is necessary for public peace and
safety of the citizens of Jacksonville, an emergency is hereby declared. This Ordinance shall take
effect immediately upon passage and publication, as provided by and subject to the requirements of
applicable law.

ADDITIONS, DELETIONS, AND MODIFICATIONS FOR THE CITY OF
JACKSONVILLE EMPLOYEE POLICY MANUAL:
Section 5.1 Progressive Discipline Policy
This progressive discipline policy does not apply to employees in safety -sensitive positions who
test positive for drugs or alcohol. Such employees shall be terminated immediately pursuant to
Section 7.12.
Section 7.7 Drug -Free Workplace
Employees in safety -sensitive positions are subject to immediate termination for any verified
drug or alcohol policy violation as defined in this section.
Section 7.10 Post -Incident Drug Testing
A verified positive test result from post -incident drug testing for employees in safety -sensitive
positions shall result in immediate termination. Department Directors are required to enforce this
policy and are authorized to terminate employees in violation in accordance with the Manual and
applicable law.
Section 7.11 Reasonable Suspicion
If an employee in a safety -sensitive position yields a verified positive test under reasonable
suspicion testing, the employee shall be terminated immediately. Directors must enforce this
provision and have full authority to terminate such employees. This policy supersedes all lesser
disciplinary options under this Manual.
Section 7.12 Random
Any employee in a safety -sensitive position who tests positive for illegal drugs, controlled
substances without a prescription, or misuses prescription medication under any testing protocol
shall be terminated immediately.
For purposes of this section, a "valid prescription" does not include authorization for medical
marijuana use under state law, as marijuana remains a Schedule I controlled substance under
federal law. The City expressly prohibits employees in safety -sensitive positions from using or
being under the influence of marijuana at any time.
Directors are required to enforce this without exception, in accordance with all applicable laws.
This policy overrides discretionary disciplinary procedures previously available.
