1468 ORDINANCE NO. 1468 (#30 - 12) AN ORDINANCE ABANDONING PUBLIC RIGHT OF WAY ON REAL PROPERTY LOCATED IN THE JAMESTOWN SUBDIVISION, JACKSONVILLE, ARKANSAS (GENERAL LOCATION: REAL PROPERTY LOCATED AT 1242 COMMONS DRIVE, JACKSONVILLE,ARKANSAS);AND, FOR OTHER PURPOSES. WHEREAS, an older public Right of Way as more particularly described below, which lies between previously platted lots, is no longer of use to the City. The existing Easement property is no longer needed and serves no beneficial purpose either now or in the future for the City of Jacksonville, for additional, better located Easements have been granted by the affected property owner(s); WHEREAS, the Jacksonville City Council held a Public Hearing regarding said abandonment of Easement on Thursday, December 20, 2012,with notice of said meeting duly published. Because additional Easement(s) have and/or will be granted, no consent was necessary from other parties; and, WHEREAS, under State law, the City has determined that said real property reverts to the real property owners of record, who has consented and approves of the abandonment of the old City Easement and who, in exchange, has granted or will grant a new Easement. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,ARKANSAS: SECTION ONE; The Public Right-of-Way Easement being abandoned is more particularly described as follows: The Westerly Eight Feet(8') of Lot 19,Jamestown Subdivision,Jacksonville, Pulaski County, Arkansas, recorded as Instrument Number 98-045154, in the Pulaski County Court House, Real Estate Records. (GENERAL LOCATION: Real property located at 1242 Commons Drive, Jacksonville, Arkansas) 4 ORDINANCE NO. 1$68(#30—12) PAGE TWO Said Right-of-Way Easement is hereby abandoned under the powers granted to Cities of the First Class in the State of Arkansas. The Mayor and City Clerk are hereby duly authorized and directed to approve the appropriate documents designating the Easement described above closed and abandoned. The real property rights described herein shall revert to the current property owner, identified as the Richard Baily Jones Revocable Trust, of the real property affected in accordance with State law. SECTION TWO: A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County, hereby amending the plat recorded on June 12, 1998, in the Pulaski County Circuit Clerk Records as Instrument Number 98-045154. SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION FOUR: This Ordinance shall take effect immediately upon passage and publication, as provided by and subject to the requirements of applicable law.
