MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: February 10, 2025 6:00 p.m. – 6:27 p.m.
ATTENDANCE: Commissioners: Dietz, Twitty, Hall, and Chairman
Oakley were present.

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Oakley declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Council Member Dietz moved, seconded
by Commissioner Hall to approve the regular meeting minutes of January 13,
2025. MOTION CARRIED.
VARIANCE(S): a. Front Yard Setback Variance 1300 Foxwood Drive
The public hearing opened at approximately 6:00 p.m.
Petitioner Dan Broughton requested a 6’ extension of the front garage, but
noted he could do 5’ or 4.5’, and also wants to redo the brick and reroof
it. He recalled differences in the original blueprints that had the garage
facing east, which was approved by the City. He stated the blueprints had
been flipped, switching the garage to the south side on Foxwood Drive.
City Engineer Adam Whitlow explained the original plot plan intended for
the driveway to come out at the setback that is 35’, but they built the
driveway on the short side of the lot, which is already at a 15’ setback.
Mr. Broughton shared the reason in asking for this extension is because
he bought a full-size truck and there is not much space between it and the
garage door where he can walk around to the other side. He mentioned the
outermost garage is a workshop that had to be shortened due to the property
line. He would have rather had the garage where it was originally planned,
but it would be too much to change now.
Engineer Whitlow confirmed the extension would not affect the sight line,
but noted the only reservation his Staff had was the fact it is already
on a side that is 15’, which is their comfort level with the side setback.
He clarified that the request is from 15’ down to 10’ and they cannot go
more than that since it would go into the utility easement.
The public hearing closed at approximately 6:11 p.m.
Engineer Whitlow related that the property was advertised and posted
properly and Public Works received no phone calls in support or objection
to the request. He was unsure if there would be enough room for a vehicle
to park in front of the garage if these improvements were made, but there
are two spaces in the driveway beyond this.
Commissioner Hall moved, seconded by Council Member Dietz to deny the front
yard setback variance at 1300 Foxwood Drive.
Engineer Whitlow clarified this is a front yard setback since it is a double
frontage lot, but is already at 15’. He explained if platted today, it would
be required to have 25’ on both sides, but this property had 35’ on one
side and 15’ on the other. He confirmed it is already 10’ closer than the
typical 25’ setback and the petitioner is asking for an additional 5’ beyond
that to take it to the easement. He was unsure if the Bill of Assurance
would affect this request.

Mr. Broughton added that if the original plan was done properly and not
flipped, which changed the distance, he would not be put in this
inconvenience where he is stuck. He related that he did not know that when
he bought the house in 1994. He reiterated he would be adding all new brick,
redoing the roof, and putting in a lot of money to do it right. He told
how he was an inspector for 25 years and he just needs a few feet.
When it was questioned if Mr. Broughton could add on to the workshop,
Engineer Whitlow replied that it was an addition to the original footprint
and he built as far west as he could go.
MOTION CARRIED at this time.
When Mr. Broughton inquired about the appeal process, City Attorney
Friedman responded that he has 30 days to file an appeal with Circuit Court
in Little Rock.
b. Front & Rear Yard Setback Variance 118 Jaxon Street
The public hearing opened at approximately 6:24 p.m.
Colby Ferguson, Project Manager for Arkansas Homes & Rentals, stated he
will be the project manager that builds this house if approved.
The public hearing closed at approximately 6:26 p.m.
Council Member Dietz moved, seconded by Commissioner Twitty to approve a
20’ front yard setback and a 16.5’ rear yard setback at 118 Jaxon Street.
MOTION CARRIED.
ADJOURNMENT: Without objection, Chairman Oakley adjourned the meeting at
approximately 6:27 p.m. MOTION CARRIED.
