MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: October 14, 2024 6:00 p.m. – 6:20 p.m.
ATTENDANCE: Commissioners: Dietz, Montgomery, Twitty, and
Chairman Oakley were present.

Assistant City Clerk Emilia Vazquez recorded those listed above in
attendance and Chairman Oakley declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Council Member Dietz moved, seconded
by Commissioner Montgomery to approve the regular meeting minutes of
September 9, 2024. MOTION CARRIED.
VARIANCE(S): a. Front Yard Setback Variance 2308 Memorial Drive
The public hearing opened at approximately 6:02 p.m.
Petitioner Mark Bowen requested to install a 12’ x 20’ carport awning. He
explained he measured it from the street to where the awning would start
and it was 23’ and 6”.
City Engineer Adam Whitlow clarified that the code requires 25’ and Mr.
Bowen is requesting a 12’ front setback for a placement of a metal carport.
He confirmed the property was properly advertised and posted and there have
been no phone calls in support or objection to the request. He shared that
Mr. Bowen desires to utilize the proposed metal carport for parking vehicles
in since the existing driveway and carport is being used as a covered patio
area. He noted there are like properties in the area and staff has no
technical objections to granting the variance, due to similar uses in the
area. He added that it is a movable structure, but by the City’s definition,
since it has a roof on it, it is a structure that counts toward setbacks.
He reiterated that staff does not have any objections and it will not impose
a visibility issue.
Council Member Dietz pointed out there are others like it nearby.
The public hearing closed at approximately 6:05 p.m.
Council Member Dietz moved, seconded by Commissioner Montgomery to approve
a 12’front yard setback for placement of a metal carport at 2308 Memorial
Drive. MOTION CARRIED.
b. Sign Variance 2651 Triangle Street
The public hearing opened at approximately 6:05 p.m.
Chairman Oakley explained that code states they can only have one sign,
unless it is on a corner street, and the petitioner wants an additional
attached sign.
The public hearing closed at approximately 6:06 p.m.
Council Member Dietz moved, seconded by Commissioner Twitty to approve an
additional attached on-site sign at 2651 Triangle Street. MOTION CARRIED.
c. Front Yard Setback Variance 196 Pike Avenue

The public hearing closed at approximately 6:07 p.m.
Council Member Dietz moved, seconded by Commissioner Montgomery to approve
a 22’front yard setback at 196 Pike Avenue. MOTION CARRIED.
d. Front Yard Setback Variance 108 Pulaski Drive
The public hearing opened at approximately 6:07 p.m.
Chairman Oakley noted this is corner lot.
The public hearing closed at approximately 6:08 p.m.
Council Member Dietz moved, seconded by Commissioner Twitty to approve a
10’front yard setback at 108 Pulaski Drive. MOTION CARRIED.
Council Member Dietz told how Arkansas Homes and Rentals came here, bought
lots, and started revitalizing the area. He mentioned they are building
a beautiful office on T.P. White Drive that is landscaped with sprinklers.
He shared his appreciation to them for coming back to their hometown and
doing things to promote it.
e. Maximum Lot Coverage by Buildings Variance 300 Taylor Street
The public hearing opened at approximately 6:10 p.m.
Engineer Whitlow stated the applicant is requesting a maximum lot coverage
variance since current code would only allow 28 units per the density and
they are requesting to go up to 37 units. He confirmed the property was
properly advertised and posted and there have been no phone calls in support
or objection. He explained these owners are improving a prior existing
mobile home park that had 37 units and ceased operations, so it lost any
grandfathered status. He brought up that is one of the reasons the applicant
is pursuing this, because that is what was there originally. He shared that
his staff’s primary concern was if they can meet the applicable geometry
for fire code, because his staff, nor this Board, has the authority to vary
from fire code. He related that Mr. Bond has provided a layout on paper
that would meet the geometry of the fire code. He noted there are some design
elements that might impact the density, but if the Commission feels like
the use and what is presented here tonight is adequate for a variance, then
they can. He pointed out they will still have a site plan and full design
set to review that will come back and confirm those things. He passed out
a revised site plan that is just supporting documentation for the variance
and is not on the agenda for approval. He mentioned these mobile homes are
longer than the ones in the original park that had a maximum length of
approximately 44’, and some of these are in the 60’ range. He confirmed
what they are asking for can physically be done, but they have comments
related to the grading, drainage, and the proximity of the units to the
road that all may impact density. He added that all of that can be rectified
on the design drawings, but all the Commission is considering tonight is
if the request is worthy to increase the density.

Representative Tommy Bond with Bond Engineering told how his clients bought
the park when it had 37 old, dilapidated units. He explained their concept
was to put 37 units back on it, but code only allows 28 units. He acknowledged
it may end up being a challenge if the Commission approves it, but they
have the geometry worked out for the 37 units. He believes storm drainage
is going to be the greatest issue, but thinks they can get it worked out.
He brought up they have to do serious work on the sewer and may even have
to build new water and sewer infrastructure. He recalled over the years
it has been surface drainage and will probably stay that way because there
are no pipes to put it in. He told how they have a couple of small ditches
they may be able to use as retention basins.
Engineer Whitlow confirmed all of the road infrastructure will be new.
The public hearing closed at approximately 6:20 p.m.
Council Member Dietz moved, seconded by Commissioner Twitty to approve a
maximum lot coverage by buildings variance for 37 manufactured home units
at 300 Taylor Street. MOTION CARRIED.
ADJOURNMENT: Without objection, Chairman Oakley adjourned the meeting at
approximately 6:20 p.m. MOTION CARRIED.
