1765ORDINANCE NO. 1765 (#18 - 2024)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR CONSTRUCTION OF
THE FIRE STATION LOCATED ON HIGHWAY 161; FOR APPROPRIATE
IMPLEMENTATION AND ACCESS FOR DEPARTMENT AND CITY OF
JACKSONVILLE REPRESENTATIVES; DECLARING AN EMERGENCY; AND,
FOR OTHER PURPOSES.
WHEREAS, the City has determined that the construction for Jacksonville Fire
Station 4 can be conducted by Dave Kinman Construction Co., Inc. and has presented a
proposal for said construction; and
WHEREAS, Jacksonville Building Maintenance asks City Council to waive
competitive bidding and request authorization to contract with Dave Kinman Construction
Co., Inc. for the project outlined in their proposal, including demolition, framing, roofing,
and other related tasks;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the Jacksonville Fire Station 4
construction would be costly, untimely, and non-productive, making said competitive
bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived pursuant to ACA § 14-
47-183 to authorize contracting with Dave Kin -man Construction Co., Inc. for the
construction of Jacksonville Fire Station 4 at a cost of Eighty -Two Thousand Dollars
($82,000.00) plus any applicable taxes. Authorization is hereby given to the Mayor and/or
his authorized representative(s) to enter into the contract.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance, necessary for the continued efficient delivery
of public services and for the benefit, health, safety, and welfare of the citizens of
Jacksonville, should be implemented immediately. Therefore, an emergency is hereby
declared, and this Ordinance shall be in force and effect from and after its date of passage.
